TOWN OF MOUNT PLEASANT, SOUTH CAROLINA PLANNING COMMISSION DECEMBER 20, 2017 MINUTES Present: Joseph Wren, Chair, Roy Neal, John McNeill, Rodly Millet, Alys Campaigne, DeAudre Gregg. Absent: Kathy Smith, Tripp Cuttino, Peter Lehman. Staff: Jeff Ulma, Lee Cave, David Pagliarini, Kent Prause, Liz Boyles, Austin Rutherford, Lynnette Lynes Mr. Wren called the meeting to order at 5:00 pm. 1. Approval of Minutes from November 15, 2017 Meeting Mr. Neal moved for approval of the minutes. Mr. Millet seconded the motion. All in favor. 2. Update on Planning Commission Recommendations Mr. Rutherford reviewed Town Council decisions with the Commission. 3. Correspondence and Public Comments There being no comments, Mr. Wren continued with the agenda. 4. Requests A. Rezone from CC, Community Conservation District, to R-2, Low Density Residential District. Location: 1843 Rifle Range Road Parcel ID (TMS No.): 561-00-00-012 Mr. Rutherford reviewed staff comments with the Commission (attachments 1 & 2). Mr. Millet asked about CC zoning. Mr. Rutherford answered that the Comprehensive Plan does not recommend CC zoning. Mr. Neal asked if both CC and R-2 zonings allow three units to the acre. Mr. Rutherford answered in the affirmative. Mr. Neal asked if the only difference is the lot size requirement. Mr. Rutherford answered in the affirmative. Planning Commission December 20, 2017 Page 2 of 8 Ms. Erin Stevens reviewed the request with the Commission. Mr. Neal asked if there are grand trees on the property. Ms. Stevens answered that the tree survey has not yet been conducted but there are a significant number of trees on the property. Mr. Wren asked if there was access other than Rifle Range Road. Ms. Stevens answered in the negative. Mr. Neal asked about development plans. Ms. Stevens answered that a finalized plan has not been completed to date. Mr. Millet asked the reason for the rezoning. Ms. Stevens answered that the difference between the zonings would allow more flexibility with the lot sizes. She stated that being able to have the smaller lots would allow more green space within the development and more of a buffer between the main roadway and the development. Mr. Millet asked about the nearby roadway and if this could be the main access for the development. Ms. Stevens answered that the adjacent property is located in the County and is not a dedicated right-of-way for the requested property. Ms. Gregg asked if R-1 zoning was considered. Ms. Stevens answered in the negative and stated that R-2 was considered to provide more flexibility with the lot sizes. Ms. Campaigne noted that R-2 would allow smaller lot sizes and potentially more lots could be created as opposed to R-1 zoning. She suggested that the applicant work on providing future interconnectivity to the adjacent lots. There being no comments, Mr. Wren closed the public hearing. Mr. Wren asked about the Foxhorn property and if the adjacent property was located in the Town. Mr. Rutherford answered in the affirmative and pointed out those properties not in the Town for the Commission. Mr. Neal moved for approval of the request including all staff comments. Mr. Wren seconded the motion. Planning Commission December 20, 2017 Page 3 of 8 Mr. Neal stated that the property would be sold in the near future and suggested that the rezoning would allow flexibility and provide the opportunity for a better development. Mr. McNeill agreed and expressed concern with access from Rifle Range Road and the proximity to Magnolia Woods Drive. He suggested that this should be considered going forward. Mr. Neal agreed and stated that the Commission would have the opportunity to review and approve the sketch plan for this development. Ms. Gregg expressed concern with increased traffic on Rifle Range Road and suggested that R-1 might be more appropriate. Mr. Wren agreed and stated that the adjacent properties are zoned R-1 and there is not any R-2 zoned property in proximity to this property. Mr. Millet suggested that the zoning should not be changed as the same number of units are allowed. Mr. Wren called for a vote on the motion. Motion failed on a 3 to 3 vote with Ms. Campaigne, Mr. McNeill, and Mr. Neal in favor; Ms. Gregg, Mr. Wren, and Mr. Millet opposed. Mr. Wren stated that the item would move forward with no recommendation. B. Amend the Dunes West PD, Planned Development District Ordinance, by rezoning from R-1, Low Density Residential District, to DW-C-R-1, Dunes West Covington R-1. Location: Bessemer Road Parcel ID (TMS No.): 583-00- 00-003 and 583-03-00-254 thru -261, -263, -265 thru -281 Mr. Prause reviewed staff comments with the Commission (attachments 1& 2). Mr. Neal asked if this is part of the recent “clean-up” of zonings for the Dunes West properties. Mr. Prause answered that a portion of the property was separately purchased. Mr. Neal asked about restriction for accessory dwelling Planning Commission December 20, 2017 Page 4 of 8 units (ADUs). Mr. Prause answered that this restriction was offered by the applicant. Mr. Wren asked why this property was not be recommended to be zoned R-3. Mr. Prause answered that the community preferred the larger lots as opposed to being allowed the smaller lot size allowed with R-3 zoning. Mr. Millet commended the applicant for including the community. He asked the reason for the request. Mr. Prause answered that they are requesting reduced setbacks. Ms. Campaigne asked about ADUs. Mr. Prause answered that ADUs are allowed in R-1 zoning. He stated that as a planned development, they are requesting that ADUs not be allowed for the development. Mr. McNeill asked if an ADU could not be constructed because of the setbacks. Mr. Prause answered that the current setbacks are for the main structure. He stated that an ADU could be constructed within six feet of the property line. Mr. McNeill asked if the requested setbacks could mean that the main structures could be constructed with only a ten foot separation. Mr. Prause answered in the affirmative, but suggested that the setback could be staggered so that there would be more distance between the main structures if desired by the developer. Mr. Chris Donato, representative for the applicant, reviewed the request with the Commission. Mr. Wren asked if ADUs are allowed in the Dunes West PD. Mr. Donato answered that he does not believe that the Dunes West PD specifically addresses ADUs. He stated that the requested PD would specifically restrict the construction of ADUs. Ms. Campaigne suggested that restricting construction of ADUs would limit the rights of the property owner. Mr. Donato stated that the setbacks are being requested in order to have more flexibility in product and as another contingency, the developer included the restriction of construction of ADUs. Mr. Rutherford stated that there are other PDs that restrict construction of ADUs. Planning Commission December 20, 2017 Page 5 of 8 Mr. McNeill suggested that a new zoning would be created with the restriction of the ADUs. Mr. Neal asked the number of existing lots. Mr. Donato answered that there would be 25. Mr. Neal asked how many different product variations could be utilized if rezoned. Mr. Donato answered that the different product type variations would increase from four to approximately seven. Mr. Millet asked if a special exception would be needed under the R-1 zoning to have the different product types. Mr. Donato answered in the negative and stated that a special exception would require Board of Zoning Appeals (BOZA) approval. Mr. Millet asked if this could be included in the Dunes West PD. Mr. Donato answered in the negative as they would like different setbacks in order to have the flexibility with product types. He suggested that this would allow for a better overall development. Mr. Millet expressed concern with the request as there was recently a large concerted effort with changes to the Dunes West PD. Mr. Donato suggested that the request would further “clean up” the PD. Mr. McNeill asked if the number of lots would change. Mr. Donato answered in the negative. Mr. Kevin Cunnane, 3032 River Vista Way, suggested that the request should be carefully considered before the acreage for Dunes West is increased. He suggested that the amenities within Dunes West are already to capacity. Mr. Danny Cignanovic, 3216 Carmel Bay Drive, asked for clarification on how the existing vacant land would be developed and which PD the property is located in. There being no further comments, Mr. Wren closed the public hearing. Mr. Wren asked about the maximum number of units allowed under the Dunes West PD and if property could be added to the PD and therefore have a new maximum number of units allowed. Mr. Prause answered that there is not a request to change the maximum number of units. Mr. Pagliarini agreed and stated that this would be an amendment to the PD. Mr. Prause concurred and Planning Commission December 20, 2017 Page 6 of 8 stated that a request to change the maximum number of units allowed is not included with this request. Mr. Neal moved for approval including all staff comments. Ms. Campaigne seconded the motion. Mr. Neal suggested that this was continuation of the “clean up” of the Dunes West area. He suggested that while expanding the footprint of the Dunes West subdivision, it would be developed within the Town and the Town would have some control on how it is developed. Mr. Millet commended the applicant for their work on this plan and for including the surrounding community. Ms. Campaigne stated that she is in favor of the request and that it is sensitive to the surrounding communities. She took exception to restricting construction of ADUs. Mr. Millet agreed with Ms. Campaigne’s comment regarding restriction of ADUs and suggested that this could be omitted. Mr. Neal suggested that this should be the decision of the applicant. Mr. Pagliarini stated that if desired, the recommendation could be made to not restrict the ADUs. Mr. Wren suggested that this would be setting up another PD and could set a precedent. Mr. Wren called for a vote on the motion. Motion passed on a 4 to 2 vote with Ms. Campaigne, Ms. Gregg, Mr. McNeill, and Mr. Neal in favor; Mr. Wren and Mr. Millet opposed. C. Amend the text in the I’On PD, Planned Development District Ordinance (Ord. No. 97010) pertaining to “Neighborhood Standards,” which includes Yard, Porches, Outbuildings and Building Types. Location: I’On Development Parcel ID (TMS No.): Approximately 243 acre area comprising the I’On development Mr. Neal recused himself due to a conflict of interest. Planning Commission December 20, 2017 Page 7 of 8 Mr. Prause stated that correspondence was received from Nelson Mullins and from Mr. Julie O’Connor. He reviewed staff comments with the Commission (attachments 1 & 2). Mr. John Bigler, 15 LeeAnn Lane, stated that the regulations were established to provide for a better community. He suggested that the request would eliminate all requirements for porches, allows more lot coverage, and all lots to be built with no setbacks. He suggested that the proposed amendments would be a detriment to the community. He suggested that this was not a clarification of the I’On Code, and several versions of the I’On Code have been implemented over the years. He suggested that the request would protect the violators of the I’On Code and asked that the request be denied. There being no further comments, Mr. Wren closed the public hearing. Ms. Julie O’Connor, representative for the I’On Design Committee, stated that the request would formalize the standards that have been in place since 1999. She stated that the request is to formalize the standards that have been in place based on a letter between the Planning Director and Developer, dated 1999. She stated that the I’On Code would be upheld by the Design Committee. Mr. Millet asked if the Design Committee meetings are open to the residents. Ms. O’Connor answered in the affirmative and stated that they can also comment on requests. Mr. Millet moved for approval including all staff comments. Ms. Campaigne seconded the motion. All in favor with Mr. Neal abstaining. 5. Staff Update on the 2018 Comprehensive Plan Process Ms. Boyles provided an update for the Commission. Mr. Wren asked where the open house would be held. Ms. Boyles answered that it would be held at Town Hall. Mr. McNeill asked how many members are in each subcommittee. Ms. Boyles answered that there are approximately ten members. Phase 1 is currently comprised of two (2) zoning districts, Dunes West PD, Planned Development District, and R-1, Low Density Residential District. Those nine (9) lots currently zoned DWPD at the front of Phase 1 are designated as DW-R-3 within the PD (see current map below). Current Map 3. STAFF COMMENTS 1. For planned development zoning, the text of the planned development ordinance sets forth the permitted uses and development standards and the plan map becomes the zoning map for the property. 2. This request pertains to proposed text amendments to the I’On Planned Development District Ordinance, which was adopted in 1997 (Ord. No. 97010) and subsequently amended on multiple occasions. 3. The request is a matter of clarification. Over the years residential lots in the development were not developed in a fashion that was fully consistent with the ordinance, as evidenced in the letter that was enclosed in the packet and, more specifically, the three (3) Building Types illustrated in the Neighborhood Standards. With the intent to rectify this situation and at the direction of the Zoning Administrator, the I’On Company proposes the following text amendments to match what has been constructed over the years and, ultimately to bring much of the development into compliance. 4.
