Staff: Jeff Ulma, Brad Morrison, David Pagliarini, Lee Cave, Kent Prause, Michele Canon, Eddie Bernard, Liz Boyles, Kevin Mitchell, Lynnette Lynes Mr. Wren called the meeting to order at 5:03 pm. 1. Approval of the Agenda Ms. Smith moved for approval of the agenda. Mr. McNeill seconded the motion. All in favor. 2. Approval of Minutes from June 12th Special Meeting and June 19th Regular Meeting Ms. Smith moved for approval of the minutes. Mr. McNeill seconded the motion. All in favor. 3. Update on Planning Commission Recommendations Ms. Canon reviewed Town Council decisions with the Commission. 4. Correspondence Ms. Canon stated that all correspondence received was posted with the agenda. 5. General Public Comment There being no comments, Mr. Wren continued with the agenda. R-17-19 Request to rezone the Mount Pleasant Regional Airport from R-1, Low Density Residential District, to LI, Light Industrial District, located at 700 Faison Road/Mount Pleasant Regional Airport Parcel ID (TMS No.): 540-00-00-021. This item was withdrawn by the applicant. B. R-18-19. Request to 1. Rezone from PD, Planned Development District Ordinance, to WG-C, Cooper River Waterfront Gateway District; 2. Amend the official Building Height Plan Map to allow up to 80 feet in building height; and 3. Approval of an Impact Assessment and Conceptual Plan, located at Patriots Point Road. TMS No.: 517-00-00-001 (portion thereof) Ms. Canon and Mr. Morrison reviewed staff comments with the Commission (attachment 1). Mr. Larry Murray, executive director for Patriots Point Development Authority, James Wilson, attorney, and Gary Collins, Seamon, Whiteside, and Associates, reviewed the request with the Commission. Ms. Pam Ireland, 820 Fiddler’s Lane, suggested that the plan is a good concept, but expressed concern with the request for increased height to 80 feet. She stated that a majority of respondents of a survey during the Comprehensive Plan update process were against additional height along the gateways. There being no further comments, Mr. Wren closed the public hearing. Ms. Smith moved for approval of the rezoning request. Mr. Wren seconded the motion. All in favor. Mr. Gates moved for denial of the increased height request of 80 feet. Mr. McNeill seconded the motion. Motion passed on a 6 to 1 vote with Ms. Gregg, Mr. Gates, Mr. McNeill, Mr. Wren, Ms. Smith and Mr. Bennett in favor; Mr. Campbell opposed. Mr. McNeill moved for approval of the impact assessment including all staff comments. Mr. Wren seconded the motion. All in favor. Planning Commission July 24, 2019 Page 3 of 5 The Commission convened for a short break at 7:14 pm and reconvened at 7:18 pm. C. R-19-19. Request to rezone one parcel from R-1, Low Density Residential District, to OP, Office Professional District. Also request to include subject parcel in the BOD, Boulevard Overlay District, located at 1228 Melvin Bennett Road. TMS No.: 560-02-00-020 Ms. Canon reviewed staff comments with the Commission (attachment 1). Mr. Scott Shellhaas, owner and applicant, reviewed the request with the Commission. He showed pictures of the surrounding property for the Commission. Mr. Paul Taylor, 1336 Bluebird Drive, expressed concern with the rezoning request and that it is located in a residential neighborhood. He suggested that the commercial use is not appropriate adjacent to residential. He asked that the rezoning request be denied. Mr. Christian Ensminger, 1244 Melvin Bennett Road, suggested that the property should remain residential. Mr. Doug Sadler, 1224 Melvin Bennett Road, suggested that the request would have an adverse effect on the surrounding property and would affect residential property values. Ms. Sybil Noll, 1330 Bluebird Drive, suggested that the property should remain residential. She suggested that the rezoning request would adversely affect the neighborhood. She expressed concern with child and pedestrian safety. She expressed concern with traffic in the area and that this request would increase traffic. She asked that the request be denied. Mr. Wesley Davis, 423 Springfield Road, suggested that the request could be beneficial for the neighborhood. He suggested that the office use would not adversely affect the neighborhood. Planning Commission July 24, 2019 Page 4 of 5 Ms. Alex Coleman, 1495 Green Shade Way, expressed concern with the request. She suggested that the request would be a “tragedy”. She asked that the request be denied. Ms. Denise May, 1324 Bluebird Drive, suggested that the request would adversely affect the neighborhood. She suggested that the requested zoning is not appropriate for a residential neighborhood and asked that the request be denied. There being no further comments, Mr. Wren closed the public hearing. Ms. Smith moved for denial of the rezoning request and the request to be included in overlay district. Mr. McNeill seconded the motion. All in favor. D. R-20-19. Request to rezone one parcel from NC, Neighborhood Commercial District, to R-1, Low Density Residential District. Subject parcel is proposed to remain in the BOD, Boulevard Overlay District, located at 1218-1220 Schirmer Avenue. TMS No.: 532-07-00-142 Mr. Gates brought a point of order that the address on the application does not exist. Ms. Canon answered that the TMS was correct and the property was appropriately posted. Ms. Canon reviewed staff comments with the Commission (attachment 1). Mr. Tim Askins, owner, reviewed the request with the Commission. There being no comments, Mr. Wren closed the public hearing. Ms. Smith moved for denial of the rezoning request. Mr. McNeill seconded the motion. Motion passed on a 5 to 2 vote with Ms. Gregg, Mr. Campbell, Mr. Gates, Mr. McNeill, and Ms. Smith in favor; Mr. Wren and Mr. Bennett opposed. E. SP-03-19. Request approval of Sketch Plan for 6 single family residential lots. Also request Waivers from Land Development Regulations for access from a private ROW and for radial lot lines, located at 1494 Stratton Place/Sheepshead Lane. TMS No.: 614-00-00-333 Planning Commission July 24, 2019 Page 5 of 5 Mr. Bernard reviewed staff comments with the Commission (attachment 1). Mr. Brian Kizer, applicant, reviewed the request with the Commission. Ms. Smith moved for approval of the sketch plan and land development regulation waivers. Mr. McNeill seconded the motion. Motion passed on a 6 to 1 vote with Mr. Bennett, Mr. Campbell, Mr. Gates, Mr. McNeill, Mr. Wren, and Ms. Smith in favor; Mr. Gregg opposed. F. Discuss proposed ordinance amendment to Zoning Code Section 156.102(A)(3). G. Discuss proposed ordinance amendment to Zoning Code Section 156.107(A)(1). Mr. Prause reviewed the proposed amendments with the Commission. The Commission agreed to move forward with the amendments as presented. H. Discuss proposed ordinance amendments to various provisions of Zoning Code Section 156.201(I)(2). Mr. Prause reviewed the proposed amendment with the Commission. The Commission agreed to move forward with an amendment to allow for a vision corridor through a critical line buffer for individual residential property maintaining the buffer as much as possible and that it should be uniformly applied. This consideration was promulgated by a request to install a generator next to an outdoor HVAC unit on a single family home. The current provisions allows a four foot encroachment without a variance for a heating or cooling unit, but not a generator. Staff has recently received inquiries regarding the application of the vision corridor provision of section 156.201 (I)(2)(c) being applied to adjacent property outside Type of Request: of the boundaries of the property to be benefited and in an incremental manner (for example in five -foot increments, rather than as a unified whole). Alternatively, proposed is the utilization of the entire length of an adjoining property’s buffer for calculation of the vision corridor area cleared to benefit an adjoining property.
