TOWN OF MOUNT PLEASANT, SOUTH CAROLINA PLANNING & DEVELOPMENT COMMITTEE MONDAY, JUNE 4, 2018 MEETING MUNICIPAL COMPLEX, COMMITTEE MEETING ROOM Present: Joe Bustos, Chair, Bob Brimmer, Guang Ming Whitley, Tom O'Rourke. Staff: Eric DeMoura, Christiane Farrell, Jeff Ulma, Julia Copeland, Liz Boyles, Eddie Bernard, Michele Canon Mr. Bustos called the meeting to order at 10:00 am. 1. Approval of Minutes from the April 30, 2018 meeting and the May 9, 2018 special meeting. Mr. O’Rourke moved for approval of the minutes. Ms. Whitley seconded the motion. All in favor. 2. Public Comments Ms. Laurie Bixler, 144 3rd Avenue, expressed concern with proposed changes to short-term rental regulations. She suggested that there should be an advisory committee to work on this issue. She stated that she has had short-term rentals since 2009 before AirBnB was established and has paid the appropriate taxes the entire time. She agreed that there should be reasonable legislation regarding short-term rentals. She suggested that those existing short-term rental properties like hers should be grandfathered in and allowed to remain. Mr. George Bixler, 144 3rd Avenue, stated that short-term rental regulations should be accomplished in a sensible and logical manner. He stated that there can be controlled regulated rentals and asked that short-term rentals be allowed to continue. Mr. Kevin Haim, Walk-a-way Stays, stated that he has several short-term rental properties in the Town. He stated that there are approximately fifty people a day that are moving to the area as well as events such as weddings occurring on a daily basis that need temporary housing. He suggested that the short-term rentals should be allowed but regulated. He stated that he pays all appropriate taxes associated with the short-term rentals. He suggested that regulations such as requiring business licenses, taxes, etc. should be considered and implemented for Planning Committee June 4, 2018 Page 2 of 9 all short-term rentals. He suggested that the regulation should include consideration for those that are legally existing. Ms. Laurie Bauer, 506 Live Oak Dr, stated that she owns a duplex that is rented as a short-term rental and has done well. She suggested that requiring the owner to live on the property is too onerous and should not be a requirement. She stated that she pays all the appropriate sales and accommodation taxes. She expressed concern with the loss of income if she cannot continue with her short-term rental. She suggested that food service should not be a requirement to have short-term rental. She suggested that a different zoning classification could be considered for short-term rentals. Ms. Chavonne Wren, 3607 Colonel Vanderhorst, stated that there is a stigma with having short-term rentals in single family neighborhoods as it would mean more transients and there would be loud parties. She suggested that short-term rentals are ideal for those wanting to stay longer than a few days in a hotel such as grandparents visiting family, stays associated with events such as golf tournaments, etc. She suggested that limiting short-term rentals for stays of a month or more might be more appropriate. 3. Review of Planning Commission recommendations from the May 23, 2018 meeting a. Request to rezone from R-1, Low Density Residential District, to OP, Office Professional District, one parcel of land, located at 1503 Mathis Ferry Road. TMS #559-00-00-072 Mr. Ulma reviewed the request with the Committee. He stated that the Planning Commission unanimously recommended approval. Ms. Whitley recused herself due to a conflict of interest. Mr. O’Rourke moved to recommend to Town Council approval of the request. Mr. Brimmer seconded the motion. All in favor with Ms. Whitley abstaining. 4. Update regarding Affordable Housing Task Force/Housing for All Mount Pleasant Planning Committee June 4, 2018 Page 3 of 9 Mr. Jack Little provided an update to the Committee. He stated that the nonprofit status has been approved and was ratified at their last meeting. He stated that they have Board members and have elected officers. He stated that the Board would consist of fifteen members with 1/3 of those seats for those that qualify for affordable housing. He stated that they are in the process of applying for grants and hiring an executive director. Mr. Bustos asked if the Workforce Housing Committee remains in effect. Mr. DeMoura answered that it remains in effect until dissolved by the Mayor. Mr. Bustos asked if those on Housing for All, Mount Pleasant would continue to serve on the Workforce Housing Committee. Mr. DeMoura answered in the negative. Mr. O’Rourke suggested a motion should be made to dissolve the Committee. Mr. Bustos stated that this would be an action of the Mayor. Mr. Bustos asked who would be eligible for housing. Mr. Little answered that those meeting the income threshold could be eligible for affordable housing. Ms. Whitley asked about the funding being provided next fiscal year and how it would be utilized. Mr. Little answered that the Board is working on a job description for an executive director position. Ms. Whitley asked when it is anticipated the executive director would be hired. Mr. Little answered that they anticipate hiring an executive director by September. 5. Annexation: 2174 Gulf Drive. Request to annex an approximately 0.29 acre tract of land located at 2174 Gulf Drive, identified by TMS No. 577-05-00-006 and depicted on a plat recorded by Charleston County ROD Office in Plat Book L, Page 73. Mr. Ulma reviewed the request with the Committee. Ms. Whitley moved to recommend to Town Council approval of the request. Mr. Brimmer seconded the motion. Mr. Brimmer asked the reason for the zoning designation recommendation. Mr. Ulma answered that this would be the default zoning for this property as recommended in the Comprehensive Plan. Planning Committee June 4, 2018 Page 4 of 9 Mr. Bustos called for a vote on the motion. All in favor. 6. Annexation: 1152 Graddick Road. Request to annex an approximately 0.25 acre tract of land located at 1152 Graddick Road, identified by TMS No. 559- 00-00-007 and depicted on a plat recorded by Charleston County ROD Office in Plat Book AP, Page 121. Mr. Ulma reviewed the request with the Committee. Ms. Whitley moved to recommend to Town Council approval of the request. Mr. O’Rourke seconded the motion. Motion passed on a 3 to 1 vote with Ms. Whitley, Mr. Bustos, and Mr. O’Rourke in favor; Mr. Brimmer opposed. 7. SE Spine Institute - Tree Removal adjacent to Mathis Ferry Road (State scenic highway) [Per State Law, SECTION 57-23-520, Article 11: Removal of certain trees prohibited. No trees in excess of a six-inch caliper located within the highway right-of-way of this scenic highway may be removed without the permission of the Department of Transportation upon the recommendation of the governing council of the Town of Mount Pleasant.] Mr. Bernard reviewed the request with the Committee. Mr. Bustos asked the consequence if not approved. Mr. Bernard answered that Mathis Ferry Road would have to be realigned and the water line being relocated. Mr. Bustos expressed concern that approval could set a precedent for additional tree removals on Mathis Ferry Road. Ms. Whitley asked if these improvements are required. Mr. Bernard answered that it is required for traffic improvements. Mr. DeMoura suggested that this could be an opportunity to restore a portion of the scenic highway. He stated that there are invasive vines and plantings that are threatening the trees and suggested that this could be an opportunity for restoration of the buffer in that area. Mr. Bustos asked how the restoration would be funded. Mr. DeMoura answered that there are Tree Bank Funds that could be utilized. Mr. Bustos asked what Planning Committee June 4, 2018 Page 5 of 9 portion SE Spine would be responsible for. Mr. DeMoura answered that he was unsure, but suggested that this could be discussed. Mr. Ulma stated that this would be a recommendation to SCDOT. He stated that while mitigation could not be planted in the same area, there is an opportunity to provide some restoration to the area. Mr. Bustos stated that he would be interested in seeing what the project would entail. Mr. Brimmer asked the reason for the request and if a different use on the property would trigger the same result. Mr. Bernard answered that the transportation improvements were required due to the development of this site as outlined in the planned development (PD) document. Mr. DeMoura added that any development of the site would require the improvements. Mr. Bustos asked if this could be deferred to next month. Mr. Ron Crump and Mr. Jerry Trainor, reviewed the request. Mr. Crump stated that any improvements to the hospital site would trigger these transportation improvements. He stated that the utilities for the area must be relocated as well. Mr. Bustos asked if the utility improvements would help correct the drainage issues in the area. Mr. Crump answered in the affirmative. Mr. Brimmer asked if different improvements were considered. Mr. Crump answered in the affirmative and stated that other alignments would further impact trees in the buffer. Ms. Whitley asked if there would be mitigation required. Mr. Crump answered that no mitigation is currently required. Mr. DeMoura answered that some mitigation would be required; however, removal of the vines would be necessary to protect the area. Mr. Trainor stated that they are willing to work with staff. He asked that the approval be given with working with staff on mitigation and restoration. Mr. O’Rourke agreed that the restoration should be done in conjunction with the tree removal. Mr. DeMoura suggested that a mitigation plan could possibly be drafted before Town Council. Planning Committee June 4, 2018 Page 6 of 9 Mr. Bustos suggested that this should be deferred to next month’s meeting. Mr. O’Rourke moved for deferral to the next meeting for the applicant to work with staff on a mitigation and restoration plan. Ms. Whitley seconded the motion. All in favor. 8. Old Business: Pending Rezonings a. I’On rezoning (Action Required) Mr. Ulma reviewed the request with the Committee. Mr. O’Rourke moved to recommend to Town Council denial of the request. Ms. Whitley seconded the motion. All in favor. b. National Medal of Honor Museum rezoning (Withdrawal by Applicant) Mr. Ulma stated that the applicant has withdrawn the request. Mr. Joe Daniels, Executive Director, stated that in reviewing the previous request and noting that significant changes would be needed, they would like to withdraw the previous request. He stated that they would request a waiver from Town Council on the one-year waiting period. He stated that they have scheduled three open forums, with the first being held on June 27th at 6 pm on the Yorktown. He stated that this would be open to the public to provide information on the new design as well as receive input from the public. Mr. Bustos asked when the request would come back for approval. Mr. Daniels answered that they would work with staff on the new design in addition to having the public meetings. Mr. O’Rourke moved to recommend to Town Council approval of the withdrawal request and approval of request for a waiver. Mr. Brimmer seconded the motion. All in favor. 9. Staff Updates a. 2018 Comprehensive Plan Process Planning Committee June 4, 2018 Page 7 of 9 Ms. Boyles updated the Committee on the Comprehensive Plan update. She stated that the open house tomorrow (June 5th) from 5 pm-7 pm would focus on land use and transportation recommendations. She stated that a survey will be available online as well. b. Accessory Dwelling Units (ADU’s) and Short-Term Rental properties regulations Ms. Canon provided an update to the Committee. She stated that draft amendments would be presented at the July Committee meeting. Mr. Bustos expressed concern with advertising the public hearing prior to being reviewed by the Committee. He asked if a pending ordinance doctrine could be put in place. Mr. DeMoura answered in the affirmative. Mr. O’Rourke suggested that this is a very controversial issue and suggested that the issue should not be “rushed”. He suggested that the public hearing should be done in August. Ms. Whitley suggested that other municipalities have limited the number of permits available for short-term rentals and have a bid process for those permits. She suggested that a similar system might be appropriate for the Town and should be considered. Mr. Brimmer agreed that time should be taken to sufficiently review the amendments. Mr. Bustos agreed. The Committee agreed that the public hearing should be held in August. c. Proposal to amend the Vegetation and Tree Protection divisions of Chapter 156 of the Mount Pleasant Code of Ordinances, pertaining to various sections regarding bufferyard requirements, special bufferyards including the Critical Line Buffer, and tree protection, removal and replacement requirements Ms. Canon provided an update to the Committee. She stated that draft amendments would be presented at the July Committee meeting. Planning Committee June 4, 2018 Page 8 of 9 Mr. Brimmer suggested that moving forward with the public hearing in July should be accomplished. Mr. Bustos agreed. The Committee agreed that the public hearing should be held in July. d. Urban Corridor Overlay District (UCOD) and various ordinance changes Ms. Canon provided an update to the Committee. Mr. Bustos suggested that rezoning would be the best option for removing single family from the UC-OD, but does not want to have a more intensive residential use. Ms. Whitley asked what is existing. Ms. Canon answered that there is a mixture of uses. Mr. DeMoura suggested that the intention was not to allow residential on property that had underlying commercial zoning. Mr. Bustos agreed and stated that the intention was not to have additional apartments on a commercial property. Ms. Whitley suggested that this would be an onerous effort. Mr. DeMoura suggested that removing the ability to have residential uses on a commercial property would be a simple effort. Ms. Canon agreed. Mr. Bustos agreed that removing the ability to have residential on a property that has an underlying commercial zoning should be accomplished. Mr. Ulma stated that there may be some properties that having underlying residential zoning. He suggested that this could be reviewed after the initial amendments are completed to determine how they should be handled. The Committee agreed to the amendments as discussed. e. Future Zoning Code Text Amendments (Wireless communications facilities, signs, etc.) Ms. Canon stated that staff has several text amendments that will go to the Planning Commission in June and then forwarded to the Committee in July. Planning Committee June 4, 2018 Page 9 of 9 She stated that these amendments would include changes to the sign ordinance regarding political signs and the addition of allowing small cell wireless facilities. Mr. Brimmer asked about changes to the annexation procedures. Mr. Ulma answered that staff needs direction on whether to move forward with this and how the annexation and initial zoning would occur. Mr. Brimmer suggested that this should be further discussed at next month’s meeting to provide staff with additional guidance. Mr. Bustos suggested that some type of growth management plan should be determined so that it can be put quickly in place if needed. BACKGROUND/STATUS • Request to Amend the “Neighborhood Standards” for the I’On PD, primarily to reduce the three (3) different “Building Types” to one (1) based on prior administrative determinations • Planning Commission unanimously recommended approval • Planning Committee recommendation at March meeting: A. The three building types in the PD continue to apply (effectively, denying the applicants’ request) B. Additional, new language be included to address existing situations which would then become nonconforming C. Referred to Legal staff for further review BACKGROUND/STATUS • Town legal counsel has reviewed this desired two-part recommendation & has had discussions with applicant’s counsel • Some consideration of withdrawing the request was given, but will not be pursued • Counsel’s opinion is that changes to the PD amendment (rezoning) request as filed cannot be imposed by the Town & offers the following: BACKGROUND/STATUS • Recommendation: A. Refer to Town Council for action on the original application at the next meeting (Note: the 6-month period for expiration of the case will occur on June 20 if no action is taken by Council) B. If the original request is denied, address the other concern about existing nonconforming situations either by: 1) Directing staff to pursue a separate, Town-initiated PD amendment which would add appropriate language, or 2) Making no further changes and handling all existing situations where lot coverage or other development standards do not conform to the PD via individual variance requests to the Board of Zoning Appeals on a case-by- case basis (this could generate dozens of such cases over time) NEIGHBORHOOD STANDARDS Yard 1. Buildings shall be set on the lot relative to the build to zones and setbacks specified for each building type. 2. Stoops, chimneys, balconies and bay windows may encroach within the setback or build-to zone. 3. Street walls shall be built on frontage lines as shown. Porches 1. Shopfront buildings shall have an arcade that extends along 100% of the street façade. 2. Side-yard and All-yard buildings shall have a covered porch a minimum of 8 feet in depth. 3. The porch shall extend a minimum of 50% of the length of the home in the case of Side-yard buildings and a minimum of 40% of the street façade in the case of All-yard buildings. 4. The street façade of All-yard buildings shall extend along the front yard a minimum of 40% of the lot width. Outbuildings 1. Outbuildings shall have a maximum footprint of 625 square feet and building height of 18 feet. 2. The walls of the outbuildings at interior property lines shall be left windowless and shall be two-hour fire rated. 3. Outbuildings may have less than 3’ setbacks from adjoining property line. STAFF UPDATES 9.A. 2018 COMPREHENSIVE PLAN PROCESS • The Plan Forum held their most recent group meeting on May 1, 2018, and reviewed and affirmed the work by the four subcommittees on the various “big issues” identified through this process: • Urban Corridor Overlay District • Settlement Communities • Cultural Core • “Mount Pleasant Way” • Housing Diversity • Financial Resiliency • Open Space Network • Open House to give the public an opportunity to comment on draft future Land Uses and draft Transportation Recommendations TOMORROW June 5, 2018 from 5-7:00 pm • Open House information, documents & survey are available online through TOMP website 9.B. ACCESSORY DWELLING UNITS (ADU’S) AND SHORT TERM RENTAL PROPERTY REGULATIONS -Staff presented background, current regulations and options for moving forward at the April 30th Planning Committee meeting -Planning Committee provided the following guidance as staff proceeds with researching and drafting ordinances and requirements:  Require impact fees for all ADU’s  Explore regulating the number of bed & breakfasts allowed within a neighborhood / area so as not to diminish the character of the neighborhood  Explore prohibiting short term rentals in ADU’s (with a grandfathering clause for those already approved through the B&B process) and regulating the number of days a year a “whole house” short-term rental may occur  Consider permits and business licenses for all short-term rentals and bed & breakfasts to cover administrative costs for a regulatory program (permitting, regulation, enforcement, emergency and town services) STATUS: Staff is working on draft ordinances with the goal of meeting the following schedule: -Present draft ordinances to Planning Committee at the July 2nd meeting -Present to Planning Commission for Public Hearing at the July 18th meeting -Present to Planning Committee and full Council at their August meeting for first reading, with the final reading in September 9.C. VEGETATION AND TREE PROTECTION - As requested, staff presented additional information to Planning Committee at the meeting on April 30th -Planning Committee provided directive for staff to move forward with researching and drafting ordinance language to address the following:  Adjust the Development Review Process to focus on Open Space  Preserve more open space/tree cover/green area within developments, and introduce Natural Open Space Preservation requirements  “Soften” views of development from the street with additional/improved streetside buffers  Ensure that new developments are planned around greenspace rather than the other way around  Take advantage of the ability to integrate drainage & open space  Provide connectivity within and among surrounding developments both with greenspace and trails STATUS: Staff is working on draft ordinances with the goal of meeting the following schedule: -Present draft ordinances to Planning Committee at their July 2nd meeting -Present to Planning Commission for Public Hearing at their July 18th meeting -Present to Planning Committee and full Council at their August meeting for first reading, with final reading in September 9.D. URBAN CORRIDOR OVERLAY DISTRICT (UCOD) -As discussed at the special Planning Committee meeting on May 9th ✓ Remove the “Urban Corridor” designation ✓ Remove the section of Ben Sawyer overlay from Rifle Range Road to the sound STATUS: Staff has completed draft ordinances pertaining to the removal of the Ben Sawyer portion, and changing the nomenclature for the “Urban” Corridor. 9.D. URBAN CORRIDOR OVERLAY DISTRICT (UCOD) -As discussed at the special Planning Committee meeting on May 9th ? Remove the option of SFR from the entire overlay STATUS: Staff is evaluating the best method for dealing with removal of single-family residential now. The goal is to meet the following schedule: -Present draft ordinances to Planning Commission for Public Hearing at their July 18th meeting -Present to Planning Committee and Town Council in August & September REMOVAL OF SFR FROM THE ENTIRE URBAN CORRIDOR OVERLAY Staff has looked at a couple of options for accomplishing this and they are as follows: 1. Map amendments that would remove all parcels currently in the corridor overlay that have an underlying residential zoning district  Approximately 40+ properties affected, including the Town Library, Town Hall, James B. Edwards School, etc.  Each property owner would need to be notified and each property posted with a PH sign 2.
