TOWN OF MOUNT PLEASANT, SOUTH CAROLINA PLANNING & DEVELOPMENT COMMITTEE OCTOBER 1, 2019 MINUTES Municipal Complex, Committee Meeting Room PowerPoint Presentation Present: Joe Bustos, Chair, Guang Ming Whitley, Tom O'Rourke. Absent: Bob Brimmer. Staff: Eric DeMoura, Jeff Ulma, Michele Canon, Austin Rutherford Mr. Bustos called the meeting to order at 10:38 am. 1. Approval of Minutes from the August 5, 2019 meeting Mr. O’Rourke moved for approval of the minutes. Ms. Whitley seconded the motion. All in favor. 2. Public Comments Ms. Laura Fox, 1507 Plover Avenue, spoke regarding item 5c, the rezoning of property for use by the school. She stated that they are in favor of the school using the additional property for extending the drop off lanes, but expressed concern with additional traffic. She stated that there should not be any additional vehicular traffic on Hale Road or an additional curb cut on Hale Road. She asked that if approved, it be stipulated that there would not be additional traffic on Hale Road and that there be a buffer maintained along Hale Road as well. Mr. Eddie Twilly, HOA representative for Back Bay Village, spoke regarding item 5c, the rezoning of property on Hale Road. He expressed concern with the potential for additional traffic. He asked that there be no new accesses to Hale Road as this could be a hazard for pedestrians, bike riders, and children. He also would like it stipulated that the property would revert back to its previous residential zoning if not utilized by the school. Mr. Lee Gastley, Seamon, Whiteside, and Associates, stated that they met with residents from surrounding community regarding the school rezoning request. He stated that they have included a golf cart access that would keep the golf carts off the road. Additionally, they would include additional pedestrian access from Rifle Planning Committee September 30, 2019 Page 2 of 6 Range Road. He stated that they do not intend to have additional vehicular access to Hale Road. He stated that there would be a buffer along Hale road as well. Ms. Linda Balzac, president of Hobcaw HOA, spoke regarding undergrounding power lines in the neighborhood. She stated that power outages affect over 380 homes in the neighborhood. She stated that undergrounding power lines in the area would benefit I’On, Molasses Creek, and Hobcaw neighborhoods. She distributed documentation for the Committee to review. She stated that they have over 200 signatures on a petition regarding this request as well. Mr. Robert Irvine, 1190 Shadow Drive, spoke regarding the rezoning of his property where his business is located. He stated that he would like to rezone the property so that is consistent with the current use. 3. Annexations a. A-12-19: 4586 Cape Island Drive. Request to annex an approximately 0.68 acre tract of land located at 4586 Cape Island Drive, identified by TMS No. 617-14-00-021 and depicted on a plat as Lot 46, Block C, Phase I recorded by Charleston County ROD Office in Plat Book EA, Page 699. Mr. Ulma reviewed the request with the Committee. The Committee discussed the impact of annexing one property and if there should be discussion with the entire neighborhood on annexing into the Town. Mr. O’Rourke moved to recommend to Town Council denial of the request. Motion failed due to the lack of a second. The Committee agreed that there should be further discussion on the Town’s annexation policy at their next meeting. Mr. O’Rourke moved to recommend to Town Council deferral of the request for up to 60 days. Ms. Whitley seconded the motion. All in favor. 4. Review of Planning Commission recommendations from the August 21, 2019 meeting a. Proposal to amend Zoning Code Section 156.007, Definitions, by adding “Story, Half (1/2)” as a definition; Amend Zoning Code Section 156.313, Old Planning Committee September 30, 2019 Page 3 of 6 Village Historic District, by modifying the boundaries of the district to do the following: i) adding a map to graphically depict the boundaries of the district; ii) prohibiting roofed structures on docks; iii) redefining the calculation for impervious lot coverage and building area ratio to only include high ground; iv) providing clarification on the location of accessory structures; and v) permitting required off-street parking to park in tandem and encroach within required yard setbacks. Also amend Zoning Code Sections 156.430, 156.431, 156.432, and 156.433, which provide for the Organization, Definitions, Power and Duties, and Procedures of the Old Village Historic District Commission, and elsewhere within Chapter 156, to do the following: i) rename the Old Village Historic District Commission as the Historic District Preservation Commission; ii) clarify the requirements of membership for the Commission; iii) clarify the duties of Town staff; iv) add Freedom of Information Act requirements; v) change the date for the consideration of historic properties and structures from 1936 to a rolling fifty (50) years; vi) clarify their certificate of appropriateness oversight; vii) clarify requirements for requests for demolition; viii) clarify the Vested Rights for previous approvals; ix) change and clarify the requirements for applications to the Commission; and x) clarify the requirements of municipal and public utilities. Mr. Ulma and Mr. Rutherford reviewed the request with the Committee. Ms. Whitley moved to recommend to Town Council approval of the amendments as presented. Mr. O’Rourke seconded the motion. All in favor. 5. Review of Planning Commission recommendations from the September 18, 2019 meeting a. R-21-19: 1190 Shadow Drive. Request to rezone one parcel from OP, Office Professional District, to AB-2, Areawide Business-2 District. TMS No. 535- 16-00-254 Ms. Canon reviewed the request with the Committee. She stated that the Planning Commission recommended unanimous approval. Ms. Whitley moved to recommend to Town Council approval of the request. Mr. O’Rourke seconded the motion. All in favor. Planning Committee September 30, 2019 Page 4 of 6 b. R-22-19: North Highway 17 and South Morgans Point Road / Lowes Home Improvement Center. Request to amend the Oakland Plantation PD, Planned Development District Ordinance (Ordinance No. 04014, as amended) pertaining to the treatment of signs on five certain development parcels identified on the Sign Exhibit by proposing an additional 150 square foot monument sign on Highway 17, and classifying two existing legal nonconforming signs to be conforming. Ms. Canon reviewed the request with the Committee. Ms. Whitley moved to recommend to Town Council approval to amend the PD to only include the existing signage (signs #9 and #10 on exhibit). Mr. O’Rourke seconded the motion. All in favor. c. R-23-19: 1432 Hale Road / Rifle Range Road / Hale Road. Request to amend the Central Mount Pleasant PD-MU-SU, Planned Development-Mixed Use Suburban-Urban District Ordinance (Ordinance No. 07030, as amended), by rezoning an approximately 1.99 acre parcel from R-1, Low Density Residential District, and incorporating it into the PD as part of the School Tract. TMS No. 560-12-00-054 Ms. Canon reviewed the request with the Committee. She stated that the Planning Commission recommended denial and recommended that the applicant meet with the surrounding neighborhoods. Ms. Whitley moved to recommend to Town Council approval of the request with the allowance for golf cart access, with the condition that there is no additional vehicular access on Hale Road. Mr. O’Rourke seconded the motion. All in favor. d. Zoning Code Text Amendment: Proposal to amend Paragraph (3) of section 156.102(A), of Chapter 156, Zoning Code, of the Mount Pleasant Code of Ordinances pertaining to the height of certain structures. Proposed changes include making the list of exclusions suggestive as to like-kind items, rather than definitive and mutually exclusive. e. Zoning Code Text Amendment: Proposal to amend the Building Permit Allocation Ordinance (Ordinance No. 18097), to increase the number of Accessory Dwelling Unit (ADU) permits from 10 to 25 permits annually, with these additional 15 permits coming out of a reduction to the single family residential dwelling allocation. Mr. Ulma reviewed the request with the Committee. He stated that the Planning Commission recommended approval. Ms. Whitley moved to recommend to Town Council approval of the request. Mr. O’Rourke seconded the motion. All in favor. 6. R-20-19: 1218-1220 Schirmer Avenue. Request to rezone one parcel from NC, Neighborhood Commercial District, to R-1, Low Density Residential District. Subject parcel is proposed to remain in the BOD, Boulevard Overlay District. TMS No. 532-07-00-142 Ms. Canon reviewed the request with the Committee. Mr. O’Rourke moved to recommend to Town Council approval of the request. Ms. Whitley seconded the motion. All in favor. 7. Continued discussion of building heights in the Johnnie Dodds and Chuck Dawley portions of the Boulevard Overlay District Mr. Ulma reviewed the request with the Committee. Planning Committee September 30, 2019 Page 6 of 6 The Committee discussed having a maximum number of stories rather than maximum height. The Committee agreed to continue discussed and have staff bring back options on maximum stories. 8. Update from Dominion Energy a. Hurricane Dorian recovery efforts b. Potential undergrounding service lines Ms. Jennifer Hightower, Mr. Bill Turner, and Mr. Danny Kassis updated the Committee on their recovery efforts and undergrounding of service lines. The Committee discussed franchise fees and how the non-service agreement works. The Committee agreed that there should be further discussion on identifying areas where undergrounding could be accomplished. There being no further business, the meeting adjourned at 12:20 pm.
