1. Call to order
Ms. Whitley called the meeting to order at 11:00 am.
2. Approval of Minutes from the July 3, 2024 meeting
Mr. Chapman moved for approval of the minutes. Ms. Hyatt seconded the
motion. All in favor.
3. Public Comments
Mr. David Donato, Realtor for Towne Centre, spoke regarding the Wilson Tract
PD amendment. He stated that all the feedback from last month’s meeting was
taken into consideration and changes were made to the proposed PD amendment.
He stated this project has positive input from the public and various agencies.
With no further public comment, Ms. Whitley closed public comment.
4. R-06-24. Request to amend the Wilson Tract Planned Development District
ordinance (Ord. No. 95041) as it pertains to an approximately 41.74-acre
portion of an approximately 45.83-acre tract of land known as Towne Centre,
located between Hungryneck Boulevard and U.S Highway 17 North and
identified by TMS Nos. 558-00-00-096, 558-00-00-098, 558-00-00-100, 558-
00-00-102, 558-00-00-340, 558-00-00-387, and 558-00-00-399. Furthermore,
the development proposes to rezone and aggregate an approximately 0.75-
acre property from its current designation of AB, Areawide Business District
into the Towne Centre portion of the Wilson Tract PD, Planned
Development, property is located at 1903 North Highway 17. Proposed
Amendments specifically pertain to expansion of master plan onto 558-00-

00-102, and governing development standards, including an increase in
height, density, and signage allowances. Review of Impact Assessment and
Conceptual Plan to be conducted as well.
Ms. Reed reviewed the request with the Committee.
Ms. Hyatt asked about the proposed height. Ms. Reed responded it is proposed
to be 75 feet for 37 percent of the development site.
Mr. Chapman asked what was recommended in the Comprehensive Plan
pertaining to a “step-back” design. He shared his opinion and suggested keeping
what is included in the Comprehensive Plan. Additionally, he is concerned with
determining the height through a percentage of acreage. He recommended that
the motion should include height at 35 feet around the outer boundary.
Mr. Chapman moved to recommend to Town Council approval of the
amendment with the height starting at 35 feet around the edges, working in a step-
back fashion to a maximum height of 55 feet for the internal development.
Ms. Reed responded that the plan is already set up for the step-back design as
the garage on the perimeter is at 30 feet and the hotel on the interior is constructed
at 65 feet.
Ms. Whitley stated the motion is very vague and prefers it to be a discussion
for further exploration. She stated she is not sure what the further step-back will
be. Mr. Chapman stated he would like to get away from the percentages. Ms.
Whitley asked to see the display showing the setbacks.
Ms. Hyatt spoke to clarify the motion from Mr. Chapman and define the acreage
and increase the center of the property to 55 feet in height.
Mr. Chapman stated he was not comfortable with the percentage
recommendation from the Planning Commission. He stated that the step-back
should be determined by staff in working with the applicant.
Mr. Chapman’s motion failed due to the lack of a second.

Mr. Rambo asked what the definition of “open space” is. Ms. Reed responded
they wanted to see more open space, trees, and benches. He asked about the
current open space at Town Center, and about what is required in our current
ordinance.
Ms. Abigail Richardson, Seaman Whiteside, Ms. Richardson responded they are
close to 10 percent open space already and are increasing the open space by the
park and new buildings and parking space would have additional open space.
Mr. David Donato shared that placement is very important for a shopping
center like this and they are focused on more green space and pocket parks where
people can enjoy the center.
Ms. Whitley asked about the economic model of this center and stated that Mr.
Donato would contract with a developer who would develop one of the chunks, he
would retain ownership of the retail and the developer would retain the office
space and residential. Mr. Donato answered in the affirmative. He continued to
explain how that would work, and that it is critical that the ground floor remains
retail. Ms. Whitley asked about the incentive to keep the retail open when
apartments are above. He answered the incentive was to keep the ground floor
open with retail. Mr. Donato shared there are incentives to keep the retail filled.
Mr. Chapman asked about the graduated height, whether this is something Mr.
Donato and staff could work out. Mr. Donato shared the plan already exceeds
staff’s recommendations. Additionally, Mr. Chapman stated the updated
residential unit count request of eight market rate units and four attainable units
is acceptable and already exists in other locations throughout the Town.
Ms. Whitley shared her concerns regarding a long-term redevelopment plan,
especially if Regal Cinemas and Belk were to close. She would also like to see more
detail on the height and density issue and if this is necessary for this and future
projects to be economically sound. She suggested a separate consultant look at
this project and give feedback if height at 75 feet and density are necessary for the
proposal to be economically viable.
Mr. Rambo stated he is not comfortable with the height of 75 feet and the
number of buildings at this height. He stated he is comfortable with the uses and
55 foot height.

Ms. Hyatt asked if East Cooper hospital and Ferry Wharf are 80 feet in height.
Peter Stone answered that both East Cooper Hospital and Ferry Wharf are both 80
feet in height. Ms. Hyatt stated she is comfortable at 55 foot height.
Mr. Chapman stated he could go higher than 55 feet, but thinks 75 feet is too
high. He suggested that a height between 65 feet and 55 feet would be appropriate.
Mr. Donato and staff explained the 45 foot step-back and 65 foot height and
the difference between step-back and setback.
Ms. Whitley suggested this be taken to the full Council for discussion and then
sent back to the Committee.
Mr. Chapman moved to recommend to Town Council approval of the
recommendation for the parking as proposed using ULI standards. Mr. Rambo
seconded the motion. Motion passes 3 to 1.

No: Laura Hyatt.
Mr. Rambo moved to recommend to Town Council approval of the proposal
regarding the 10 percent open space. Ms. Whitley seconded the motion. All in favor.
Ms. Hyatt moved to recommend to Town Council approval of the Planning
Commission’s recommendation to allow the density of four market rate residential
units plus an additional four units if they are attainable housing. Mr. Rambo
seconded the motion. Motion failed 2 to 2.
Yes: Ms. Hyatt and Mr. Rambo.
No: Ms. Whitley and Mr. Chapman.
Mr. Chapman suggested no recommendation be made at this time on the
height and request Town Council send the issue back to the Planning Commission
for further discussion and negotiation.
The Committee agreed to make no recommendation to Town Council on the height
or approval of the planned development and impact assessment and conceptual
plan and request that Town Council refer these items back to the Planning
Committee for further discussion and recommendation.

5. Discuss possible amendment to Home-Based Business ordinance to allow
certain outdoor activities.
Ms. Reed shared the proposed amendment change on home-based business
regarding swimming lessons with the Committee.
Mr. Rambo shared his opinion about swimming lessons at homes as a business
and their commonality.
Mr. Rambo moved to send this issue to the Planning Commission for a public
hearing to change the ordinance to allow swimming lessons as a home-based
business with a limit of two students at a time. Ms. Hyatt seconded the motion. All
in favor.
The Committee agreed that other home-based business activities such as dance
lessons, fishing lessons, etc. could be considered as well.
