(1/28/21)  RESOLUTION CITY OF MOUNT VERNON JAN i 9 2Ua WHEREAS, on July 15, 2019, August Spencer filed a Notice of Claim seeking the Sum Of $11, 163.57 against the City Of MOunt Vernon far property damage to claimant's vehicle, which was allegedly damaged by a City owned DPW vehicle; and WHEREAS, by interview"ing the appropriate City personnel it was determined that the City DPW vehicle indeed made contact with and caused the damage to claimant's vehicle; and WHEREAS, the claimant's insurance company sued the City and the matter was set for trial, the cost of trail would increase the cost significantly higher than the amount settled for hereunder; and WHEREAS, the Corporation Counsel hereby recommends that the Board of Estimate and Contract approve the Settlement of the aforesaid claim in the amount of $5,58i.7g; NOW, THEREFORE, be it RESOLVED, that funds are available in Budget Code A1910.469 (Insurance Claims), Law Department 2020 Budget.
