Call to Order: At 04:08 P.M. by Chairwoman Mayor Shawyn Patterson-Howard

RESOLUTIONS APPROVING ORDINANCES
Item No. 1 Authorizing the Department of Buildings to offer a Professional Pilot Certification
Program
On the Question: Comptroller Morton – Is this being offered as a fee or is it just an option
we are allowing them to do, 2nd…..how does impact the resident?
Response: Chairwoman Patterson-Howard- Self certification is not free it’s just an
expedited process.

Item No. 2 Settling the Claim of Bank of America, NA as assignee of Altec Capital Services, LLC
vs. The City of Mount Vernon, NY in the Amount of $85,000.00
On the Question – Comptroller Morton asked corporation counsel to provide some
background of this item.
Response: Corporation counsel advised the body that this is a case where the City is in
possession of a truck, the City did not pay for said truck, the truck was in the process of
being repossessed, the company sued the City and is in the process of getting a court order
to repossessed the truck. The is not the same as the issue this morning.

Item No. 3 Adopting the 2022 Annual Estimate Budget
On the Question: Chairwoman Patterson-Howard advised that this item will be held
and a special meeting will be called later in the week to discuss.
Motion to hold the item and seconded.

DEC 8 202! AN ORDINANCE AUTHORIZING THE DEPARTMENT
OF BUILLDINGS TO OFFER A PROFESSIONAL
CERTIFICATION PILOT PROGRAM.
WHEREAS, by Ietter dated November 18, 202I, the Commissioner of the
Deparh'nent of Buildings l'ias requested legislation auihorizing said departtnent to
implement a Professional Certification Pilot Program (Policy & Procedure Notice-
PilotProgram:) attached; and
WHEREAS, tl'ie aforesaid policy and procedure will enable Professional
Engineers and Registered Architects to certify that the plans they file with the
Department of Buildings are in compliance with all applicable laws thus eliminating
the process of plan examination ai'id approval generaIly conducted by said
depariment; and
WHEREAS, the aforesaid policy and procedure will apply several layers of
recourse should the P.rofessional certifying the work be found to have made false
statements in ceitificates, foims, written statements, applications, reports, or
certificates of cot-rection; and
WHEREAS, it is fuither requested that the aforesaid be introduced initially
as a Pilot Program for a period of six (6) months to a short Iist of designated
Professionals. At tl':ie end of the trial, a revaluation wi?I be detenuined whether to
make it a permanent policy moving forward; NOW, THEREFORE.,
The City of Mount Venion, in City Council convened, does hereby ordain
and enact:
Section l. The Deparh'nent of Buildings is hereby authorized to
implement a Professional Certification Pilot Program (Po[iq & Procedure Notice-
Pilot Program) attached
Section 2. There is no cost to the City
Section 3. This ordinance shall take effect upon its approval by the

Pilot Program
Professional Certification(Pro-Cert) Pilot Program: TheDepartmentof Buildingswill offer asofJanuaryr 1st,i
2022 a ProfessionalCertification(Pro-Cert)Programwhich enables Professional Engineers (PE) and Registered ',
Architects(RA) to certify the plansthey file with the building depmtment are in compliance with all applicaMe la;ws.
This will reducethe mnountof time an applicantwill take for aDOB permit by elimiffiating the process ofplan
examination for approvaI.
Applicants who use the Pro-Cert Program need to be aware that:
* Professional Certification must be selected on the ffliug applications at the titne of ffling.
* An application that is Professionally Certified goes through the same pre-ffling, paynnent, and data enty
process. However, if all required documents are present, the application will be approved at the end of data
entry. Professional Certification Applications are subject to audit bythe Department of Buildings.
A Professionally Certified application does not go through the Departmentplan examination. The applicant
can check the application status by contacting the Departtnent Clerks initiaIIy and e;ventually by using the
OpenGov System (slated to be introduced to the public later in 2022. Exact launch date T.B.A.)
Post ApprovaI Amendments to Professionally Certified applications must also be professionally Certified.
Department examination and approval are not available.
Twenty percent of all Post Approval Amendments are also subject to audit once,the application's first ':
pennit has been issued.
Effective: January 1, 2022
PURPOSE: enables Profe,ssional Engineers (PE) andRegisteredArchitects(RA) to cerf,fy;tha,the plane.they fil
with the Depmtment are in compliancewith all applicablelaws. ' : "
SPECIFICS: The following procedure shaIl be implemented:
1. The applicant, a Professional Engineer or Registered ArchitectI (P.E./R.A.), shoulds'eleptProfess7onal
Certificatiqn on the fling application at the time of fiIing. '
The follo'iving documents shall be submitted:

1. Seal & signature of the P.E. /R-A. on all submitted documents-
2. Construction Documents as noted on the back of the standard Building Pamit Application.
C Any of the existing filing protocols may be used. i.e. online; or in-person filing.
D ProfessionallyCertifiedA2filingsvirillnotbesubjecttoreviewbythedepartment'splaiiroom.
E All standard fees applicable to a Professionally Certified A2 filing will apply.
F Plan content mid format shall be in accordance with all applicable sections 6f Chapter I of
the Building Code ofNY State, andwiththerelaiedmes andregulations oftheDepmtment.
The Department of Buildings Shall:
A Conduct random audits of professionatly Certified A2 applications that will review content.
B Respond to questions related to the content of the Professionally Certified process or about
this notice that are directed to the Commissioner of Buildings

WHEREAS, by letter dated January 31, 2022, Corporation Counsel
requested the approval of this Honorable Board to settle the matter "Settlement
of BANK OF AMERICA, N.A., as assignee of ALTEC CAPITAL
SERVICES, LLC v. City of Mount Vernon, Settlement Amount: $85,000.00;"
and
WHEREAS, by letter dated January 24, 2022 (a copy of which is
annexed hereto), the Wagstaff Firm, p.c. explained why it would be in the best
interests of the City of Mount Vernon to settle said claim in the amount of
$85,000.00; and
WHEREAS, the City has successfully negotiated a settlement in this
matter for Eighty-Five Thousand Dollars ($85,000.00) through the services of
the Wagstaff Firm, P.C.; and
WHEREAS, the Corporation Counsel hereby recornrnends that the
Board of Estimate and Contract approve the settlement of the aforesaid
grievance in the amoiu'it of $85,000.00; NOW, THEREFORE, be it
RESOLVED, that the aforesaid claim of BANK OF AMERICA, N.A.,
be settled for the sum of $85,000.00 and that said settlement be and the same
hereby is approved; and be it further
RESOLVED, that said sum be paid out of Budget Code A1930.494
(Judgments & Settlements (Increase for DEC Settlements)), 2022 Budget.

WHEREAS, a public hearing having been held by this Board on the 24'h
day of January, 2022 in reference to the Annual Estimate of the City of Mount
Vernon, New York for the year 2022, pursuant to the provisions of Section 81 of
the Charter of the City of Mount Vernon, NOW, THEREFORE, be it
RESOLVED, that pursuant to the provisions of said Section 81 of said
City Charter, as amended, tlie following itemized statement of the estimated
revenues and expenditures of the City of Mount Vernon for the fiscal year
commencing the first day of January, 2022 be and tlie same hereby is adopted by
this Board of Estimate and Contract and submitted in final form to the City
Council.
