An amendment to Ordinance No. 7, adopted February 11, 2025, THE SELECTION OF WOODARD & entitled "AN ORDINANCE AUTI-IORIZING CURRAN FOR THE SOUTH THIRD & SOUTH COLUMBUS AVENUES FLOOD MITIGATION PROJECT UNDER THE HAZARD MITIGATION GRANT PROGRAM (HMGP) PROJECT #461S-0004 CMVNY AND ALSO UTILIZE THEIR SERVICES FOR THE BRONXVILLE FIELD CLUB COST ESTIMATE REVIEW" Whereas,by letter dated February 6, 2025, tlie Commissioner of tlie Department Works has reqriested legislation arithorizing tlie City of Morint Vernon to of Public engage Woodard & Curran to study and plan tl'ie Soritli Tliird & Soritl'i Colru'nbus Avemies Flood Mitigation Project under FEMA's Hazard Mitigation Grant Program and also utilize their services for the Bronxville Field Club cost estimate review; and Whereas, a significant floodevent carised an explosion due to water pressure in leading to ongoing safety and infrastructure concerns in tlie affected area; and a manliole, Whereas, subsequent mitigation effort, including tlie addition of a retention area and new sump structures, liave not sufficiently alleviated tlie risk of road closures during severe storm events; and Whereas, the City lias been awarded Nine hundred Fifty Tliousand Dollars ($950,000) in federal funding rinder the Federal Emergency Management Agency's (FEMA) Hazard Mitigation Grant Program (I-IMGP) to conduct a compreliensive study and develop solutions for t]ie intersection, outfall, structures, substructures, surrounding areas, and waterslieds; and Whereas, the Departn'ient of Public Works lias conducted a tliororigh evaluation of potential firms based on tlieir rmderstanding of scope of work, experience with similar projects, qriality of proposed staff, familiarity witli state and federal requirements, organizational and financial responsibility, and logistical familiarity witli the area; and Whereas, tlie scope of services provided by Woodard & Curran will agree to provide tlie following as per reqriest of the City's contracted Land Use Attorney (LUA), Zarin & Steinmetz, LLP. Woodard & Curran will provide professional engineering services related to the review of the cost estimated developed by the City support Engineer and Bronxville Field Club's (BFC) Engineer for tl'ie proposed drainage improvements currently rinder negotiation for settlement. Tlie proposed scope of services includes tlie following tasks: a) Meeting between Woodard & Curran (two Woodard & Curran representatives, in-person) and City to discuss overall proiect objectives and understand the proposed work items for the drainage improvements on Denman Avenue, Burkewood Road, and tlie Backyards. b) Review of tlie two cost estimates (qriantities, rmit costs, construction duration/labor liorirs) provided by LUA via email JLIIY 10, 2025. Includes conference call witli BFC's engineer to discuss their cost estimate. c) Preparation of Engineer's Opinion of Probable Construction Cost (EOPCC), inclriding internal QA/0C prior to distribution to tlie City. }4"" 4 'T":('!':')l'i,\;y 'a ]Ut 2 B 2025 EOPCC will include an estimate of consttuction duration/labor liours per applicable work items. I d) Meeting between Woodard & Curran (two Woodard & Curran representatives in person) and City to present and discuss EOPCC. Whereas, the City shall pay Consultant in accordance with services rendered; and for Reimbursable Expenses and Miscellaneous Direct Expenses; and as furtlier follows for a Not-to-Exceed Sum of $8,000.00. This fee worild be adjusted. if necessary, via future contract an'iendment(s) or change order(s) to reflect a budget increase to accormt for the final level of effort/horirs iyivested to complete tliis scope of worlc; and Whereas, funding to support tliis amendment are available from Budget Code A8120.405; and Whereas, based on tliis evaluation, tlie Department of lublic Works has determined that Woodward & Curran is the most qualified firm to execute tlie necessary study and mitigation plaruiing; NOW, Therefore, Be It Resolved That The City of Mount Vernon, in City Corincil convened, does liereby ordain and enact: Section 1. Purpose. Tliis ordinance aritliorizes tlie City of Mount Vernon to engage Woodward & Curran to study and plan the Soritli Tliird & Soritli Columbus Avenues Flood Mitigation Project ru'ider FEMA's I-Iazard Mitigation Grant Program. Section 2. Project Scope. Tlie selected firm, Woodward & Curran, shall comprehensively assess tlie flooding issues at Soritli Tliird and South Columbus Averuies, including tut not limited to: a. Evaluating tlie intersection's drainage capacity and structural integrity; b. Analyzing tlie outfall system and the impact of tidal clianges on drainage efficiency; c. Studying stormwater volume and impact under changing climate conditions; d. Assessing potential mitigation strategies, including infrastructure improvements, e. Providing recommendations for long-term flood prevention measures. Section 3. Authorization to Enter into Agreement. Tlie Mayor and tlie Commissioner of tlie Department of Public Works are liereby aritliorized to enter into an agreement witli Wood$ard & Curran to execute tlie study mentioned above, with funding provided by tl'ie Hazard Mitigation Grant Program (I-IMGP) Project #461S-0004 CMVNY and also utilize tlieir services for tlie Bronxville Field Club cost estimate reWeW. Section 4. Implementation. The Department of Public Works sl'iall oversee tlie study's implementation and ensure compliance with all applicable local, state, and federal regulations. Section 5. Effective Date. Tliis Ordinance sliall take effect immediately upon its approval by tlie Board of Estimate & Contract.
