Clean Water Act. The Mt. Vernon residents and downstream communities are at risk of the negative effects of raw sewage and other illicit pollutants from the storm sewer system discharging into the Hutchinson and Bronx Rivers. The City has been issued a comprehensive federal judicial order and a permanent injunction initiated by the Environmental Protection Agency to bring the storm sewer system into compliance to protect public health and the environment. The City intends to take all reasonable efforts, which include the securing of funding, increase of pollution related fines and penalties, and deviation from standard procurement procedures- if necessary, to comply with the orders listed below to mitigate the irreparable injury caused to the waterways and expedite compliance with Clean Water Act. - Track down and identify all sources of illicit discharge (or impaired storm sewer system outfalls and eliminate all sources ofillicit discharge. a Perform all necessary construction and repairs for impaired outfalls. o Complete inspections to ensure detection of future illicit discharge. a Obtain the necessary equipment, staffing, and funding to comply with its Clean Water Act and permit obligations. a Develop an updated sewer water management plan. - Perform a sewer system evaluation survey of the sanitary sewer system to identify discharges of sewage and develop a sewer system corrective action plan; and a Submit periodic reports to the EPA and New York's Department of Environmental Conservation. - The City further adds any storm sewer repairs discovered during the execution of these orders that would pose a danger to public health and the environment if left untreated. FEB I 0 2021 NOW, THEREFORE, The City Council of the City of Mount Vernon, NY by its members: The Honorable City Council President Marcus A.
