AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO

THE CITY OF NEW YORK AND THE CITY OF MOUNT VERNON
TO RENT EIGHT (8) REAR LOADER 25 YARD COLLECTION
TRUCKS.
WHEREAS, by letter date July 19, 2021 tlie Mayor is requesting legislation
autliorizing her to enter into a Memorandum of Understanding ("MOU") by and
between tlie City of New York Acting through its Department of Sanitation and the City
of Mount Vernon,, and
WHEREAS, on July 15, 2021, effective at 9 a.m., the Mayor declared a city-
wide state of emergency due to a public health and safety crisis that has threatened the
public liealth and safety of the City's residents. Due to tlie City's current inability to
rectify this threat, the Mayor has reached out to New York City for assistance, and they
have agreed to assist the City of Mount Vernon by allowing us to rent eight (8) Rear
Loader 25 Yard Collection trucks from the NYC Department of Sanitation for a period
of 90 days for $1.00 per truck available in Budget Code A8160.203 (DPW Sanitation-
Equipment); NOW, THEREFORE,
Tlie City of Mount Vernon, in City Council convened, does hereby ordain and
enact:
Section 1. The City Council does hereby authorize the Mayor to enter into a
Memorandum of Understanding ("MOU") by and between the City of New York
Acting tl'u'ough its Department of Sanitation and the City of Mount Vernon.
Section 2. The City Council does liereby authorize tlie City of Mount
Vernon to rent eight (8) Rear Loader 25 Yard Collection Ttucks from the NYC
Department of Sanitation for a period of 90 days at a cost not to exceed $1.00 per truck
available in Budget Code A8160.203 (DPW Sanitation-Equipment).
Section 3. The City Council does hereby authorize DSNY to transport the
Tnicks from DSNY's Bronx 12 Garage at 1635 East 233rd Street, Bronx, NY 10475 in
which they are stored and deliver them to Mount Vernon at City of Mount Vernon
Department of Public Works, 33 Canal Street, Mt. Vernon, MY 10550. DSNY shall pick
up the trucks from Mount Vernon at the end of the term in the same condition in which
they were provided to Mount Vernon, reasonable wear and tear excepted. The serial
numbers and Vel'iicle Identification Numbers (VINs) of the Trucks that will be rented
are:

Subject: MOU with NYC for Sanitation Equipment

As per our conversation on Sunday, July 18, 202011 executed the MOU with the
Department of Sanitation for the City of New York. While the normal course of
action is a City Council resolution and Board of Estimate approval; during this
declared State of Emergency we agreed that we needed to expedite this
process. Insurance for the trucks have been secured and we will be receiving the
equipment at 6am Tuesday morning.

The City of Mount Vernon, in City Council convened, does hereby ordain and
enact:
Section 1. The first and second decretal paragrapl'i and Sections 1, 2 and 4
of Ordinance No. 3, adopted July 16, 2021, entitled "AN ORDINACE GRANTING
PERMISSION TO GRACE BAPTIST CHURCH TO HOLD A BLACK AND BLUE
PANEL DISCUSSION AND PERMISSION TO THE DEPARTMENT OF PUBLIC
SAFETY TO CLOSE SOUTH 6"' AVENUE BETWEEN WEST 2""' STREET AND
WEST IST STREET" is hereby amended as follows:
WHEREAS, by letter dated June 25, 2021, Grace Baptist Cliurch has requested
authorization to liold a Black and Blue Panel discussion on Saturday, July 24, 2021
[July 17, 20211 from 8:00 a.m. to 2:00 p.m.; and
WHEREAS, Grace Baptist Church 'further requests the Department of Public
Safety close South 6"1 Avenue to veliicular traffic from West Ist Street to West 2"d Street
duting the stated event on July 24, 2021 jJuly 17, 20211; and
WHEREAS, it is further requested that Grace Baptist Church be allowed to park
in the Municipal Lot across the street from 52 Soutli 6f'l Avenue; NOW, THEREFORE,

Black and Blue Panel discussion on Saturday, July 24, 2021 jJuly 17, 2021] from 8:00
a.m. to 2:00 p.m.
Section 2. The Department of Public Safety is hereby authorized and
directed to close Soutli 6t'l Avenue to vehicular traffic from West Ist Street to West 2"d
Street during the stated event on July 24, 2021 JJuly 17, 2021], from 8:00 a.m. to 2:00
p.m.
Section 3. Permission is hereby granted to the Department of Public Works
to drop off barricades at tlie intersection of West 2nd Street and South 6I'l.
Section 4. Permission is granted to the Parking Bureau to post "No Parking"
signs to reflect no parking on July 24, 2021 jJuly 17, 2021] from 7:00 a.m. to 3:00 a.m.
Signs should be on botli sides of the street on South 6I'1Avenue between West 2nd Street
and West ISt Street at least 72 hours piior to the aforesaid event.
Section 5. The City of Mount Vernon Fire Department has no objection to
the aforesaid event. In case of a food vendor being on site an inspection and pennit is
necessary for any open flames or warning units before the event, and in case of
gasoline, kerosene or diesel generator(s), an inspection and pennit is necessary before
the event.
Section 6. The Department of Recreation has no objection to the aforesaid
event.
Section 7. The pen'nission hereby granted is conditioned upon the aforesaid
location being maintained, cleaned and kept in good condition by Grace Baptist Church
at its sole cost and expense during said event. The peri'nission hereby granted is further
conditioned upon the maintenance by Grace Baptist Church, its members and guests, of
access to such street at all times for emergency services in the event of necessity

City of Mount Vernon lian'nless of and from any and all damages that occur to persons
or property by reason of the liolding of said panel discussion, and that Grace Baptist
Churcli before acting upon this ordinance, sliall file witli the City Clerk and to be
approved by the Corporation Counsel, a public liability policy covering the City'of
Mount Vernon as an additional insured witl'i limits of at least $1,000,000.00 per
occurrence.
Section 9. This ordinance sliall take effect only upon the filing of tlie above-
described documents in tlie office of the City Clerk of tlie City of Mount Vernon.

WHEREAS, Congress of the United States enacted Public Law 93-383 Title I of
3 the Housing and Coinmunity Development Act of 1974 (which established the
Community Development Block Grant (CDBG) Program; Public Law 101-625, tlie
Cranston-Gonzalez National Affordable Housing Act (which establislied tlie HOME
Investment Partnersliips Program (HOME); and Public Law 100-77, the McKinney-
Vento Homeless Assistance Act as amended by the Homeless Emergency Assistance
and Rapid Transition to Housing (HEARTH) Act of 2009 (Public Law 112-141), which
re-autliorized the Emergency Solutions Grant (ESG) Program; and
WHEREAS, tlie City of Mount Vernon is an Entitlement Coi'nu'nunity forpurposes
of the Coini'nunity Development Block Grant Program (CDBG), and HOME Investment
Paitnersliips Program (HOME); and Emergency Solutions Grant Program (ESG); and
WHEREAS, as a recipient of Federal entitlement grant funds, the City of Mount
Vennon (City) is required to submit an annual action plan to the U.S. Department of
Housing and Urban Development (HUD); and
WHEREAS, HUD infon'ned the City tliat it is receiving FY 2021 entitlement
funding in the following amounts:
Community Development Block Grant $1,710,229
HOME Investment Partnerships Grant $478,089
Emergency Solutions Grants $145,882
Total 2020 Entitlement Funding: $2,334,200
WHEREAS, The Department of Planning and Coi'nununity Development/Urban
Renewal Agency recommends approval of tlie 2021-2022 j'u'tnual Action Plan by the
Mount Veriion City Council; NOW, THEREFORE,
Tlie City of Mount Vernon, in City Council convened, does hereby ordain and
enact:
