I WHEREAS, by letter dated August 24, 2021, Mayor Sliawyn Patterson- Howard is respectfully requesting that the City Council enact legislation to transfer $222,000.00 to ver the cost of EPA fines ordered by the Honorable Cathy Siebel for the City's a aa to comply with the Court's Third Remedial Order concerning tlie DOJ/EPA/D consent decree; and , Mayor Sliawyn Patterson-Howard further requested that the $222,000.00 be transferred from Budget Code Al930.494 (Judgements & Settlements) to tlie escrow account authorized by the Board of Estimate and Contract on August 17, 2021; NOW, THEREFORE, The City of Mount Vert'ion, in City Council convened, does liereby ordain and enact: Section 1. Tlie Comptroller is hereby authorized and directed to transfer tlie sum of $222,000.00 to cover tlie cost of EPA fines ordered by tlie Honorable Catliy Seibel for the City's inability to comply witli the Couit's Third Remedial Order regarding DOJ/EPA/DEC decree. ,i. PC FOR THE ARMORY SENIOR CENTER, DOLES RECREATION CENTER,dTHE OAK STREET FIREHOUSE ST ATION (ST ATION 41 'D'PW Department of Public Works has requested legislation authorizing the Mayor to enter into an engineering services agreement with Environetics Group Architects, PC ENV") for a conditions assessment report at the Aimory Senior Center, Doles Recreation Center. and the Oak Street Fireliouse Station (Station 41 in the amount of $56,950.00: and WHEREAS, tlie aforesaid consultant rendered consultant engineering services in 2012 to provide preliminary assessment reports for several facilities, including the Oak Street Firel'iouse. Due to their previous knowledge, completion of preliminary reports, and understating of the facilities, it would behoove tlie city to retain ENV to complete the necessary engineering documents, oppose to identifying another consultant firi'n which will have to corninence without any prior experience, thus resulting in additional associated cost(s); and WHEREAS, the updated reports will include a review of each building's envelope, infrastructure, structure, electrical, mechanical, plumbing, fire protection systems and potential envirorunental issues. Tlie City f Mount Vernon, in City Council convened does, hereby ordain and enact: The fifth decretal paragraph of Ordinance No. 27, adopted August 11, 2021 entitled "AN ORDINANCE DECLARING AN EMERGENCY ROOF REP AIR OR THE MO{JNT VERNON ARMORY, LOCATED AT 144 NORTH 5"' A " is hereby amended as follows: , by letter dated August 6, 2021, the Coinrnissioner for the Department of lic Works is requesting legislation declaring an emergency roof repair for the Mo Vernon Annors7 located at 144 Noith 51"Avenue; and , in early July 2021, the department of Public Works along with the Building and R aon Departments, agreed to shut down the Ari'nory due to excessive deteri on of the roof fagade of the structure that resulted in an unsafe 6nvironment; WHEREAS, conditions assessment report was completed on October 28, 2011, by Envioronetics up Architects, p.c. (ENV), which included recoinrnendations and budgets aa to the exterior of the building and roof. The Department is in the process of devel an updated conditions assessment report to: Assess a conditions of the site and building fabric and systems to document deterioration and deficiencies in building elements and systems, Building compliance, ADA compliance, presence of hazardous materials, and defici cies in design and systems that affect its efficiency and suitability to continue s use. Make endations for remedial actions and repairs, including categorizing and pri the work and recoiui'nendations for renovations and upgrades required make the building suitable for its continued designated use. Provide estimates for work to be completed; and WHEREAS, e Ari'nory is an important asset to our coinmunity; it serves our City's seniors daily and its kitchen provides over 1500 meals a week. In the extreme heat of the sui'nu'ner months, the property can serve as a cooling center for those in need. All nutrition and aor operations and programs once lioused within the Armory have since moved to Doles Center, wliich is an inconvenient and poorly suited building for these specific eeds; and WHEREAS, e Department of Public Works has obtained three quotes and identifies An'ieri Signature Groups Corp. jHarrow Constniction] as the vendor to complete the roo replacement; and WHEREAS, e cost for these services is $149,000; and funds are available through the American R Plan Act (ARPA) that have been allocated from the US Department of T , NOW, THEREFORE, The City Mount Vernon, in City Council convened, does hereby ordain and enact: Section 1. The Mount Vernon City Council declares an emergency roof repair for the Mo Vernon Aimory located at 144 North 5"1 Avenue. 3 AU6 2 7 2021 Section The aforesaid cost for these services is $149,000; and 'funds are available thro the American Rescue Plan Act (ARPA) that liave been allocated from the US Departm of Treasury. Section 3. This ordinance shall take effect upon its approval by the Board of Estimate and Contract.
