PUBLIC HEARING REGARDING THE 2023
PROPOSED ANNUAL ESTIMATE FOR THE
CITY OF MOUNT VERNON, NEW YORK
The City of Mount Vernon, in City Council convened, does hereby ordain and
enact:
Section 1. The City Clerk is hereby directed to give public notice, pursuant
to Section 81 of the City Charter of the City of Mount Vernon, New York, as
amended, that a public hearing will be held in reference to the proposed annual
estimate for the year 2023 at a meeting of the City Council of the City of Mount
Vernon, to be held at the City Council Chambers, Municipal Building, Mount
Vernon, New York, on the 28' day of December, 2022, at 6:00 p.m. (Eastern
Standard Time). The cost of said notice is to be paid from Budget Code A10IO.401
(Office Expense) City Council, 2022 Budget.
Section 2. This ordinance shall take effect immediately.

LOCAL LAW N0. 7 0F 2022
A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT EST ABLISHED IN
GENERAL MUNICIPAL LAW SECTION 3-C.
Be it enacted by the City Council of the City of Mount Vernon in the County
of Westchester in the State of New York, as follows:
Section 1. Legislative Intent.
The New York State Comptroller recently released the "2 Percent Tax Cap"
figures for the budget year 2023 and advised the City of Mount Vernon that the tax cap,
in actuality, will be 2.0%. The City of Mount Vernon acknowledges that it is vitally
important to use the taxes of the City in a fiscally responsible manner and it is necessary
to keep the tax levy on the property taxpayers to a minimum amount, especially in
economically hard times. However, the financial position of the City determines that
the Fiscal Year 2023 Budget may require a tax levy increase that is greater than that
allowed by General Municipal Law §3-c.
It is the intent of this Local Law to override the limit on the amount of real
property taxes that may be levied by the City of Mount Vernon, County of Westchester,
State of New York, pursuant to General Municipal Law §3-c, and to allow the City of
Mount Vernon to adopt a budget for (a) City punposes and (b) any other special or
improvement governed by the City Council for the fiscal year 2023 that requires a real
property tax levy in excess of the "tax levy limit" as defined by General Municipal Law
§3-c.
Section 2. Authority.
The local law is adopted pursuant to subdivision 5 of General Municipal Law
§3-c, which expressly authorizes the City Council to override the tax levy limit by the
adoption of a local law approved by vote of sixty percent (60%) of the City Council.
Section 3. Tax Levy Limit Override.
The City Council of the City of Mount Vernon is hereby authorized to adopt a
budget for the fiscal year 2023 that requires a real property tax levy in excess of the
limit specified in General Municipal Law, §3-c.
Section 4. Severability.
If any clause, sentence, paragraph, subdivision, or part of this Local Law or the
application thereof to any person, firm or corporation, or circumstance, shall be
adjusted by any coiut of competent jurisdiction to be invalid or unconstitutional, such
order of judgment shall not affect, impair, or invalidate the remainder thereof, but shall
be confined in its operation to the clause, sentence, paragraph, subdivision, or part of
this Local Law or in its application to the person, individual, firm or corporation or
circumstance, directly involved in the controversy in which such judgment or order
shall be rendered.
Section 5. Effective Date.
This Local Law shall be operative upon its approval by the City Council and
shall take effect immediately upon filing in the office of the New York State Secretary
of State.

NOTICE THAT THIS LOCAL LAW MAY
CONFLICT WITH APPLICABLE PORTIONS OF THE GENERAL CITY LAW OF
THE ST ATE OF NEW YORK, IT IS THE ST ATED INTENTION OF THE CITY TO
EXERCISE ITS AUTHORITY TO SUPERSEDE AND AMEND, AS GRANTED
UNDER THE MUNICIPAL HOME RULE LAW OF THE STATE OF NEW YORK,
SECTION 10. THE CITY HEREBY PROVIDES NOTICE THAT IT IS
EXERCISING ITS AUTHORITY TO SUPERSEDE AND AMEND PURSUANT TO
MUNICIPAL HOME RULE LAW OF THE ST ATE OF NEW YORK SECTION 22.

WHEREAS, by letter dated December 15, 2022, the City Clerk has
requested the City Council approve legislation authorizing the Comptroller to
transfer funds between City Council Expense Accounts in the amount of
$35,000.00 from expense account A1010.401 "Office Expense" to A1010.405
"Contracted Outside Services" to allow payment to Granicus Corporation, in full,
for legislation management software; NOW, THEREFORE,

and enact:

WHEREAS, by letter dated December 15, 2022, the City Clerk has requested
that the City Council approve legislation authorizing and directing the Comptroller to
make payment to Granicus Corporation in the amount of $105,189.00 which
represents payment in full for legislation management software. Legislation dated
October 4, 2022, stated that payment would be made in installments as set forth below:

AT NEW ROCHELLE FOR DOG SHELTER SERVICES"
The City of Mount Vernon, in City Council convened, does hereby ordain
and enact:
Section 1. The first decretal paragraph, and Sections 1 and 2 of Ordinance
No. 29, adopted on December 14, 2022, entitled "AN ORDINANCE AUTHORIZING
THE MAYOR TO ENTER INTO A SERVICE CONTRACT WITH THE HUMANE
SOCIETY OF WESTCHESTER AT NEW ROCHELLE FOR DOG SHELTER
SERVICES" is hereby amended as follows:
WHEREAS, by letter dated December 15, 2022 jDecember 7, 2022], the Chief
of Staff for the Honorable Mayor has requested legislation authorizing the Mayorto enter
into a [one (1) year service] contract for the term of December 15, 2022 through
December 31, 2023. The costs for the contract will be apportioned in two amounts:
* $6,287.67 - the prorated amount for 12/15/22-12/31/2022 (17 days),
payable from FY22 A3510.445; and
* $135,000 - the initial annual amount for 1/1/2023-12/31/2023, payable
from FY23 A3510.445 (in an annual payment or equally quarterly,
whichever frequency the City shall elect.)

of Westchester at New Rochelle for dog (and cat) shelter services [for an initial annual
amount of $135,000.00. The siun is payable in an annual payment or equally quarterly,
whichever frequency the City shall electl; and
WHEREAS, the contract will replace the current shelter services at the Mount
Vernon Animal Shelter ("MVAS") located at 600 Garden Avenue. The City is required
to license dogs and as a result must either maintain a shelter for dogs or contract for
pound or shelter services within any other municipality or humane society. Since 1974
the City has run its own animal shelter, which in recent years has fallen into various
stages of disrepair as documented in NYS Agriculture reports and staffing challenges.
Additionally, the shelter has struggled with adoption rates, housing the animals much
longer than what is best for the animals, and drastic negative revenue variances; and
WHEREAS, as a solution in the best interests of the animals and the financial
condition of City, the Office of the Mayor is proposing the contracting of these services
to the nearest Humane Society (New Rochelle) that just underwent a $5 Million
renovation to provide the care and services needed for the animals. This solution will be
a cost savings to the city of Mount Vernon of approximately 55% over the current
b udgeted and unbudgeted staffing and shelter expenses; and
WHEREAS, the City is still responsible for animal control services, dog catching,
transport of animals to the shelter inNew Rochelle, and the emergency seizure of animals
and will retain the position of Animal Warden during the tansition to contracted services
and will modify the position accordingly to accurately reflect the duties that complement
the contract; NOW, THEREFORE,
