The meeting was called to order by Mayor ProTem Lindquist at 7:00 p.m.
Present: Councilmembers Lindquist, Molenaar, Quam and Urban
Absent: Mayor Boudreau, Councilmembers Fiedler, Hulst and Ragan (excused)
Staff Present: City Attorney Rogerson, Engineering Services Manager Chesterfield, Senior
Planner Lowell and Building Official Prosser

CONSENT AGENDA
A. Approval of January 23, 2013 Regular Council Meeting minutes and January 30, 2013
Committee of the Whole Minutes
Councilmember Molenaar moved to approve the minutes as
stated above. Motion seconded by Councilmember Quam.
Motion carried 4-0.
A. Approval of January 31, 2013 payroll checks numbered 101097 – 101154,
direct deposit checks numbered 39986 - 40177, and wire transfers numbered
409 & 410 in the amount of $900,635.88.
Councilmember Quam moved to approve the November 30,
2012 payroll checks, direct deposits and wire transfers as
stated above. Motion seconded by Councilmember Urban.
Motion carried 4-0.
B. Approval of January 23, 2013 claims numbered 128601 – 128680 in the amount
of $1,037,455.35.
Councilmember Urban moved to approve the January 23,
2013 claims as stated above. Motion seconded by
Councilmember Quam. Motion carried 4-0.
C. Approval of February 13, 2013 claims numbered 128681 – 128920 in the
amount of $481,685.43.
Councilmember Molenaar moved to approve the February 13,
2013 claims as stated above. Motion seconded by
Councilmember Quam. Motion carried 4-0.

Mayor Pro Tem Lindquist stated that Mayor Boudreau and Councilmembers Hulst and
Ragan are attending the City lobby day in Olympia sponsored by the Association of
Washington Cities.
Mayor Pro Tem Lindquist thanked the Boy Scout troop for attending the meeting.

NEW BUSINESS
A. Interlocal Agreement with Skagit County Senior Services: Mr. Rogerson presented an
agreement in which the City will pay Skagit County $53,856 for 2013 Senior Services
including nutrition services, operation support of the center, support services and
advertising. Kristl Torset from Skagit County Senior Services briefly explained the function
and services provided by for senior citizens in Mount Vernon and at the Mount Vernon
Senior Center.
Councilmember Urban moved to authorize the Mayor to enter
into an interlocal agreement with Skagit County to provide
Senior Services for 2013 in the amount of $53,856. Motion
seconded by Councilmember Quam. Motion carried 4-0.
B. Ordinance Amending Chapter 2.08 and 2.12 of the Mount Vernon Municipal Code: Mr.
Rogerson reviewed the proposed code changes housekeeping items that include removing
an ordinance designating the Mayor as chairman of several committees; removing an
ordinance requiring documentation to be housed in the “new addition” of City Hall ;
amending an ordinance requiring how a person must address the Council; and amending

an ordinance creating standing committees of the City Council.
Councilmember Molenaar moved to approve Ordinance 3594
amending Chapter 2.08 and 2.12 of the Mount Vernon Municipal
Code. Motion seconded by Councilmember Urban. Motion
carried 4-0.
C. Open Record Public Hearing – Proposed Amendments to Chapter 17.06 (Definitions) of the
Mount Vernon Municipal Code: Ms. Lowell presented the proposed amendment to the
definition of “adult cabaret” to remove the existing reference to ”male and female
impersonators”
Mayor Pro Tem Lindquist opened the open record public hearing. Hearing no comments
Mayor Pro Tem Lindquist closed public hearing.
Councilmember Urban moved to approved Ordinance 3595
amending the definition of “adult cabaret” . Motion seconded
by Councilmember Quam. Motion carried 4-0.
D. Open Record Public Hearing – Proposed Amendments to Mount Vernon Municipal Code
Chapter 5.04 (Business Licenses): Ms Lowell stated that the same change as stated in the
previous item is being made to the business license section of the Municipal Code.

Mayor Pro Tem Lindquist closed public hearing.
Councilmember Quam moved to approved Ordinance 3596
amending the definition of “adult cabaret”. Motion seconded
by Councilmember Molenaar. Motion carried 4-0.
E. Open Record Public Hearing – Proposed Amendments to Chapter 17.56 of the Mount
Vernon Municipal Codes: Ms. Lowell explained that this change will allow existing
residential uses to expand without having to obtain a variance of non-conforming permit
consistent with the Resolution of Mutual Understanding that the City historically agreed to
for the area annexed in South Mount Vernon.

Councilmember Urban moved to approve Ordinance 3597
amending Chapter 17.56 of the Municipal Code as stated
above. Motion seconded by Councilmember Molenaar. Motion
carried 4-0.
F. Ordinance Correcting scrivener’s Error within Chapter 17.06 (Definitions) of the Mount
Vernon Municipal Code: Ms. Lowell presented an ordinance to correct a scrivener’s error
that removed the definition of “accessory building” in error.
Councilmember Molenaar moved to approve Ordinance 3598
to correct a scrivener’s error. Motion seconded by
Councilmember Quam. Motion carried 4-0.
G. Open Record Public Hearing – Resolution Docketing 2013 Comprehensive Plan
Amendment, Rezones and Municipal Code: This Resolution will docket five site-specific
Comprehensive Plan amendments to be considered for 2013. Ms. Lowell emphasized
that this allows staff to study the requests and this resolution does not approve the items.
Councilmember Urban inquired whether or not one of the jail sites could be excluded. Mr.
Rogerson explained that Skagit County is required to allow public input before selecting a
site for the jail. Ms. Lowell explained that Skagit County has indicated that two of the three
proposed sites would eventually be withdrawn and only one would end up before the City
Council.
Mayor Pro Tem Lindquist opened the open record public hearing. Hearing no comments
Mayor Pro Tem Lindquist closed the public hearing.
Councilmember Urban moved to approve an amended
Resolution 856 wherein project under PL13-013, the Skagit
County Jail Site, Gunn Road, would be removed from ‘Exhibit
A’ of the Resolution. The remaining items within ‘Exhibit A’
shall be docketed for the 2013 Comprehensive Plan
Amendments, Rezones and Municipal Code Amendments.
Motion seconded by Councilmember Molenaar. Motion
carried 4-0.
H. Completion of Work – Downtown Revitalization Project, Phase II : Mr. Prosser asked for
approval of the work performed by JT Muenscher General Contractor, Inc. The project
consisted of demolition of three buildings and site restoration on Main Street at a total cost
of $248,513.32.

Councilmember Urban moved to approve the completion of
work on Main Street as stated above. Motion seconded by
Councilmember Quam. Motion carried 4-0.
I. Professional Services Agreement with Brown and Caldwell Inc: Mr. Chesterfield requested
approval of an agreement with Brown and Caldwell, Inc for program development and
implementation for the City’s National Pollutant Discharge System (NPDES) Phase II of
Municipal Stormwater Permit.
Councilmember Molenaar moved to authorize the Mayor to
enter into an agreement with Brown and Caldwell, Inc. to
provide program development and implementation for the
City’s NPDES. Motion seconded by Councilmember Urban.
Motion carried 4-0.
