Mount Vernon City Council Regular Meeting Minutes March 13, 2013 The meeting was called to order by Mayor Boudreau at 7:03 p.m. Present: Mayor Boudreau, Councilmembers Fiedler, Lindquist, Hulst, Molenaar, Quam, Ragan and Urban Staff Present: City Attorney Rogerson, Special Projects Administrator Stendal, Community and Economic Development Director Hanson, Public Works Director Bell, Engineering Services Manager Chesterfield, Parks Supervisor Weppler Citizens Present: Seven CONSENT AGENDA A. Approval of February 13, 2013 and February 27, 2013 Regular Council Meeting m inutes. Councilmember Urban asked that Item G on the February 13, 2013 minutes be modified to include: Mayor Pro Tem Lindquist opened the open record public hearing. Hearing no comments, Mayor Pro Tem Lindquist closed the open record public hearing. Councilmember Urban moved to approve the February 13, 2013 and February 27, 2013 Regular Council Meeting minutes with the change stated above. Motion seconded by Councilmember Lindquist. Motion carried 7-0. A. Approval of February 28, 2013 payroll checks numbered 101237 – 101294, direct deposit checks numbered 40369 – 40561 and wire transfers numbered 413 & 413 in the amount of $891,718.24. Councilmember Lindquist moved to approve the February 28, 2013 payroll checks numbered 101237 – 101294, direct deposit checks numbered 40369 – 40561 and wire transfers numbered 413 & 413 in the amount of $891,718.24. Motion seconded by Councilmember Molenaar. Motion carried 7-0. B. Approval of March 13, 2013 claims numbered 129084, 129085, 129087 – 129090 and 129092 – 129273 in the amount of $428,065.27. Mayor’s Report:  Mayor Boudreau reported that she and Kristen Keltz from the Chamber of Commerce recently toured the Sierra Pacific Industries and the newly renovated building at 1220 Memorial Highway which includes offices of the Pirkle Law Firm, Collins Office Supply and Glass Aquarium.  The next Mayor’s Coffee will take place Friday, March 15th from Noon to 1:00 p.m. at City Hall. E. Committee Agenda Requests:  Councilmember Fielder requests a discussion of the Council’s position on the 1/10 of one percent sales tax increase at the next Finance Committee meeting.  Councilmember Ragan requests a discussion of the Lincoln Theatre at the next Finance Committee meeting.  Councilmember Lindquist requests a review of the retreat item regarding employee evaluations. UNFINISHED BUSINESS None NEW BUSINESS A. Presentation by FEMA Region X Administrator Recognizing Mount Vernon’s Efforts to Reduce Flood Impacts: Mr. Prosser stated that Mount Vernon participates in the community rating system and the City’s rating of six has resulted in a twenty percent discount in insurance premiums. He then introduced FEMA Region X administrator Ken Murphy. Mr. Murphy presented Mayor Boudreau with a plaque recognizing the City’s effor ts to undertake activities that reduce the effects of flooding in the City. B. Skagit County Community Action Update: Mr. Stendal noted that this item is not an update; he introduced Bill Henkle of Skagit County Community Action. Mr. Henkle thanked the City for partnering with SCCAA. He acknowledged the contributions through the CBDG grant Mount Vernon City Council March 13, 2013 Page 3 of 6 that will help with a facility purchase. Dave Malsed representing Skagit Home Trust also thanked the City for their contributions that assist low income home projects. C. Mowing Contract: Mr. Weppler reported that five bids for the 2013 turf, right-of-ways and planter bed maintenance areas were received on March 4, 2013. This contract consists of weekly maintenance for nine months; the contract includes a two-year renewal clause. The lowest responsible bid in the amount of $36,332.48 was submitted by Seattle Maintenance Solutions through the Small Works Roster process. Councilmember Ragan recommends outreach to local business when soliciting future bids of this type. Councilmember Lindquist moved to authorize the Mayor to enter into an agreement with Seattle Maintenance Solutions in the amount of $36,332.48 for contract mowing. Motion seconded by Councilmember Quam. Motion carried 7-0. D. Hillcrest Landing Final Plat Approval; File No. LU-06-088: Ms. Lowell presented a request for final plat approval of the Hillcrest Landing subdivision. This subdivision will create 29 new single-family residential lots, and two (2) duplex lots {for a total of 33 residential units} over approximately 7 ½ acres. This site is located on the east side of South 18th Street north of Blackburn Road and south of Section Street and owned by Whidbey Island Bank. Frontage improvements, the plat access road, site detention pond and sanitary and storm infrastructure have been completed and approved by staff. Bond language and corrections to the CC & R’s have been requested and will be made prior to the Mayor signing the final plat map. Councilmember Fiedler moved to authorize the Mayor to sign the final plat map accepting the final plat of Hillcrest Landing as stated above. Motion seconded by Councilmember Hulst. Motion carried 7-0. E. Open Record Hearing to Amend Chapters 12.08, 12.12, 12.16, 12.20, 12.22, 12.24 and 12.28 of the Mount Vernon Municipal Code: Ms. Lowell stated that this is an open record public hearing to add alleys as an area where a right-of-way permit can be granted, Chapter 12.22 {Right-of-Way Use}. In addition, to amend Chapters 12.08, 12.12, 12.16, 12.20, 12.22, 12.24 and 12.28 so that enforcement of these Chapters is through Title 19 of the Mount Vernon Municipal Code. 12.22: this will provide right of way permits to allow alley cafés and amend enforcement provisions. Councilmember Ragan pointed out a typo on page 6, line 11. Mayor Boudreau opened the open record public hearing. Motion seconded by Councilmember Molenaar. Motion carried 7-0. F. Open Record Public Hearing for Proposed Amendments That Will Add Land Clearing Permits and the Associated Submittal Items to Chapter 14.05 (Procedures) of the Mount Vernon Municipal Code : This is an open record public hearing for proposed amendments to Mount Vernon Municipal Code Chapter 14.05 (Procedures) to add Land Clearing Permits and the associated submittal requirements to the City’s code. This action is necessary following the adoption of Ordinance 3599 on February 27, 2013 wherein a new Land Clearing Chapter of the Municipal Code was adopted. Ms. Lowell clarified that this is for large land clearing projects. She also explained that the fees for type 3 permits are higher because those permits must go to the hearings examiner and therefore require additional staff time to prepare. Councilmember Fiedler moved to approve Ordinance 3601 amending the Mount Vernon Municipal Code as stated above. Motion seconded by Councilmember Ragan. Motion carried 7-0. G. Open Record Public Hearing to Amend Chapter 19.05 (General Provisions) within Title 19. (Code Enforcement) of the Mount Vernon Municipal Code : This is an open record public hearing to amend Chapter 19.05 (General Provisions) within Title 19 (Code Enforcement) of the Mount Vernon Municipal Code to include Title 12 to the list of titles that are enforced through Title 19. This item is requested in conjunction with Item F. Mayor Boudreau opened the open record public hearing. Hearing no comments Mayor Boudreau closed the open record public hearing. Councilmember Fielder moved to approve Ordinance 3602 amending the Mount Vernon Municipal Code as stated above. Motion seconded by Councilmember Lindquist. Motion carried 7-0. H. Open Record Public Hearing to Add Submittal Fees for New Land Clearing Permits to Chapter 14.15 (Fees) of the Mount Vernon Municipal Code: This is an open record public hearing for proposed amendments to the Mount Vernon Municipal Code Chapter 14.15 (Fees), to add submittal fees for Land Clearing Permits. This action is necessary following Mount Vernon City Council March 13, 2013 Page 5 of 6 the adoption of Ordinance 3599 on February 27, 2013 wherein a new Land Clearing Chapter of the Municipal Code was adopted. Ms. Lowell noted that the fees are lower than other jurisdictions and SICBA is supportive of the fee schedule. Ms Lowell explained the reason for consultant fee reimbursements and the $1,000 fee for moratorium removal. Mayor Boudreau opened the open record public hearing. Hearing no comments Mayor Boudreau closed the open record public hearing. Councilmember Hulst moved to approve Ordinance 3603 amending the Mount Vernon Municipal Code as stated above. Motion seconded by Councilmember Quam. Motion carried 7-0. I. Land Lease Agreement for Use of Two Tax Lot Parcels (P52188 and P 52189): Mr. Bell said this is a request for approval of a land lease agreement with Anthony Pickering for the use of approximately one and one-fifth acres of land north of the Division Street Bridge for construction staging and parking purposes in conjunction with the construction of Phase II of the Downtown Flood Protection Project. Councilmember Lindquist moved to authorize the Mayor to enter into an agreement with Anthony Pickering for the land lease as stated above Motion seconded by Councilmember Ragan. Motion carried 7-0. J. Amendment #1 to the Original Interlocal Cooperative Agreement with Skagit County for the Disposal of Vactor and Sweeper Waste: Mr. Chesterfield requested approval of Amendment #1 to an Interlocal Agreement with Skagit County for the disposal of vactor and sweeper waste, which extends the contract date and updates the reimbursement amount from $17,118 to $25,118. Councilmember Lindquist moved to authorize the Mayor to enter into Amendment #1 of the Interlocal Cooperative Agreement with Skagit County for disposal of vactor and sweeper waste. Motion seconded by CouncilmemberQuam . Motion carried 7-0.
