Mount Vernon City Council Regular Meeting Minutes June 12, 2013 The meeting was called to order by Mayor Boudreau at 7:02 p.m. Present: Mayor Boudreau, Councilmembers Fiedler, Lindquist, Hulst, Molenaar, Quam, Ragan and Urban Staff Present: Finance Director Huschka, Community and Economic Development Director Hanson, Senior Planner Lowell, Public Works Director Bell, Assistant Public Works Director Love, Human Resources Director Bartlett, Police Lieutenant Cammock Citizens Present: Sixty-five CONSENT AGENDA A. Approval of May 22, 2013 Regular Council Meeting Minutes. Councilmember Fiedler moved to approve the May 22, 2013 Regular Council Meeting minutes. Motion seconded by Councilmember Hulst. Motion carried 7-0. B. Approval of May 31, 2013 payroll checks numbered 101572 – 101638, direct deposit checks numbered 41539 – 41734, and wire transfers numbered 425 & 426 in the amount of $908,259.55. Councilmember Hulst moved to approve the May 31, 2013 payroll as stated above. Motion seconded by Councilmember Quam. Motion carried 7-0. C. Approval of May 31, 2013 claims numbered 130198 – 130204, 130215, 130216, 130221, 130222, 130223 - 130431 in the amount of $1,371,519.08. Councilmember Urban moved to approve the May 8, 2013 claims as stated above. Motion seconded by Councilmember Lindquist. Motion carried 7-0. REPORTS A. Committees: 1. Public Works – for details see Committee minutes. B. Community Comments: Mount Vernon City Council June 12, 2013 Page 2 of 5 None. C. Councilmember Comments:  Councilmember Fiedler stated that he is thrilled that the bridge will be open by end of next week.  Councilmember Quam said that he has heard many comments about the timing of the opening of the Laventure Anderson extension. It has been a real asset since the bridge collapse. D. Mayor’s Report:  Mayor Boudreau welcomed the Mount Vernon Bombers soccer team. This group began as a youth soccer group in 2006. Their level of talent had them advancing into the PSPL Developmental League as an independent team. This year they finished 1st. They continue to display good sportsmanship and play for the love of the game. This year they won the title of State Cup 2013 making them eligible to compete in the Santa Clara Invitational in California. E. Committee Agenda Requests: None. UNFINISHED BUSINESS None NEW BUSINESS A. Open Record Public Hearing – Proposed Amendments to the Neighborhood Commercial Zone (C-4) Codified in Chapter 17.54 of the Mount Vernon Municipal Code: Ms. Lowell gave an overview of the proposed amendments to the neighborhood commercial zone C-4 in Chapter 17.54. Mayor Boudreau opened the public hearing.  Steve Fallquist, Mount Vernon resident, said that he supports the proposed amendments.  Sheila Mccandlish, Mount Vernon resident, stated that she supports the proposed amendments and likes the requirement of creating a C-4 zone at time of platting.  Charlie Guildner, Mount Vernon resident, representing Peoples Bank, stated that Peoples Bank, Mount Vernon School District and Joe Woodmansee have agreed to a settlement agreement after negotiations between the parties involved. The proposed changes are more restrictive and he spoke at the planning commission against the restrictive measures of the PUD C-4 requirement. He received an email from one of the property owners that stated they were okay with a business center that would only be open from 8 am to 5 pm next to their development at Skagit Highlands. Hearing no further comments Mayor Boudreau closed the public hearing. An extensive discussion occurred regarding the proposed amendments including the mandatory requirement of a trail system. Mount Vernon City Council June 12, 2013 Page 3 of 5 Councilmember Hulst moved to adopt Ordinance 3605 approving the amendments to the Mount Vernon Municipal Code 17.54. Motion seconded by Councilmember Fielder. Motion failed 2-5. Councilmember Urban moved to have further language review on this item and have it on the agenda in two weeks. Motion seconded by Ragan. Motion carried 7-0. B. Open Record Public Hearing – Proposed Amendments to the Land Use Element of the Comprehensive Plan: Ms. Lowell stated that this item is directly related to the first item and would need to be postponed until the code amendment to the Mount Vernon Municipal Code 17.54 is codified. Councilmember Fiedler moved to postpone this item for two weeks. Motion seconded by Councilmember Quam. Motion carried 7-0. C. Bid Award – 2013 Sanitary Sewer Lining Project 13-3: Mr. Love said that bids were opened at the end of May for the 2013 Sanitary Sewer Lining Project. Columbia Pumping and Construction was the responsible lowest bidder in the amount of $279,970.75. Councilmember Lindquist moved to award the bid to Columbia Pumping and Construction for the 2013 Sanitary Sewer Lining Project 13-3. Motion seconded by Councilmember Ragan. Motion carried 7-0. D. Approval of Professional Services Agreement: Ms. Hanson explained that this professional services agreement with Susan Drummond is for assistance with the processing of legislative requests and land use permits necessary for the new Skagit County Jail Facility. Skagit County is funding this agreement in the amount of $18,000. Councilmember Lindquist moved to authorize the Mayor to enter into a professional services agreement with Susan Drummond for assistance with the new Skagit County Jail Facility not to exceed $18,000. Motion seconded by Councilmember Quam. Motion carried 7-0. E. Agreement for Health Insurance Broker/Consultant Services: Ms. Bartlett stated that the Healthcare Affordability Act has several requirements that the City must meet. This agreement with Gallagher Benefit Services will allow them to fully evaluate the necessary steps needed to comply with this act and also review the city’s current healthcare plan for affordability and compare the plan design and cost with other options available on the market. The cost of this agreement is $1500 a month and the term of the agreement is for one year. Councilmember Urban requested the automatic renewal clause be stricken from Mount Vernon City Council June 12, 2013 Page 4 of 5 the agreement. Councilmember Hulst moved to authorize Mayor Boudreau to enter into an agreement with Gallagher Benefit Services as amended, not to exceed $1500 monthly. Motion seconded by Councilmember Lindquist. Motion carried 7-0. F. Tourism Promotion Fund 2013 Budget Amendment: Ms. Huschka said that due to the Interstate 5 bridge collapse the impact on local businesses and hotels has been tremendous. This request to supplement the Tourism Promotion Fund 2013 budget by $25,000 is to financially support marketing efforts to help alleviate the loss of business and draw people back into the county. This amendment will allow for an increase to the Mount Vernon Marketing Campaign that will focus their advertising on drawing tourists from outside of our area. The lodging tax advisory committee was consulted and the full committee is supportive of this request. Councilmember Hulst moved to adopt Ordinance 3605 amending the 2013 Tourism Promotion Fund budget by $25,000. Motion seconded by Councilmember Molenaar. Motion carried 7-0. G. Amendment to the Mount Vernon Community Marketing Campaign Interlocal Agreement: Ms. Hanson gave an overview of the current marketing strategies that are occurring due to the Interstate 5 bridge collapse. The amendment to the Interlocal Agreement with Skagit Public Hospital District No 1, Mount Vernon School District, Port of Skagit, Skagit Valley Community College and Mount Vernon Chamber of Commerce is to allow for the increase in revenue and added scope of work. Councilmember Quam moved to authorize Mayor Boudreau to enter into an amendment to the agreement with Skagit Public Hospital District No 1, Mount Vernon School District, Port of Skagit, Skagit Valley Community College and Mount Vernon Chamber of Commerce to increasing funding in the amount of $25,000. Motion seconded by Councilmember Hulst. Motion carried 7-0. The meeting was adjourned into executive session at 8:26 p.m. and estimated to last 10 minutes. H.
