Mount Vernon City Council Regular Meeting Minutes September 11, 2013 The meeting was called to order by Mayor Boudreau at 7:04 p.m. Present: Mayor Boudreau, Councilmembers Fiedler, Lindquist, Hulst, Molenaar, Quam Absent: Councilmembers Ragan and Councilmember Urban, both excused Staff Present: Community and Economic Director Hanson, Senior Planner Lowell, Building Official Prosser, Public Works Director Bell, Solid Waste Supervisor Sutherland, Wastewater Supervisor Duranceau, City Attorney Rogerson, Human Resources Director Bartlett Police Chief Dodd Citizens Present: Nine APPROVAL OF MINUTES None APPROVAL OF CLAIMS AND PAYROLL A. Approval of September 11, 2013 claims numbered 131492 - 131676 in the amount of $293,358.46. Councilmember Hulst moved to approve the September 11, 2013 claims as stated above. Motion seconded by Councilmember Quam. Motion carried 5-0. B. Approval of August 30, 2013 payroll checks numbered 101962 – 102029, direct deposit checks numbered 42727 – 42927, and wire transfers numbered 437 & 438 in the amount of $912,733.85. Councilmember Fiedler moved to approve the August 30, 2013 payroll as stated above. Motion seconded by Councilmember Molenaar. Public Works – for details see Committee minutes. B. Community Comments:  Duana Dotinga-Wilkins, Skagit County resident, talked about national recovery month. She provided material for National Recovery Month. C. Councilmember Comments: None. D. Mayor’s Report:  Mayor Boudreau said that the Wellness Challenge is about healthy minds, healthy bodies, and a healthy spirit. She read a proclamation declaring September as National Recovery Month.  Mayor Boudreau reviewed her official activities for the past two weeks.  Mayor Boudreau announced that the Eat Local campaign goes through the end of the month E. Committee Agenda Requests: UNFINISHED BUSINESS None NEW BUSINESS A. Deferral of Required Infrastructure Improvements, PL13-047: Ms. Lowell stated that this request to defer the construction and installation of short plat infrastructure is from PBWA Properties, LLC (People’s Bank). The infrastructure would be constructed with future development. It is recommended that a note to that effect be placed on the face of the short plat map. Councilmember Hulst moved to approve the deferral of required infrastructure improvements, PL13-047 as requested by PBWA Properties. Motion seconded by Councilmember Molenaar. Closed Record Public Hearing – Site-Specific Comprehensive Plan Map Amendment and Associated Rezone: Ms. Lowell explained that this is the last rezone request for the 2012 docket. The request is to re-designate P27512 from a Comprehensive Plan designation of Medium Density Single Family with a zoning designation of Single-Family Residential to a Comprehensive Plan designation of Schools and associated zoning of Public. Mayor Boudreau opened the closed record public hearing.  Carl Bruner, Mount Vernon resident and Superintendent of Mount Vernon Schools, said that there has been a lengthy negotiation process with the property owner and this is a critical piece of the process. There is need for additional housing for the growing elementary school student population.  Charles Guildner, Mount Vernon resident and representing Peoples Bank, said that he fully supports this request. Hearing no further comments Mayor Boudreau closed the closed record public hearing. Councilmember Fiedler moved to adopt Ordinance 3611 approving the site specific Comprehensive Plan Map Amendment and Associated Rezone. Motion seconded by Councilmember Quam. Motion carried 5-0. C. Open Record Public Hearing – Proposed Amendments to Mount Vernon Municipal Code Chapter 3.40, Impact Fees: Ms. Lowell stated that the State statute has been amended to allow municipalities a 10 year timeframe in which impact fees need to be spent. The proposed amendment will make the Mount Vernon Municipal Code Chapter 3.40 consistent with state law. Mayor Boudreau opened the public hearing. Hearing no comments Mayor Boudreau closed the public hearing. Councilmember Lindquist moved to adopt Ordinance 3612 approving the proposed amendments to Mount Vernon Municipal Code Chapter 3.40, Impact Fees. Motion seconded by Councilmember Hulst. Motion carried 5-0 D. Bid Award – Residential Garbage Carts and Inserts: Mr. Sutherland said that a bid opening occurred on August 27 for residential plastic garbage carts and inserts. The lowest responsible bidder was Rehrig Pacific Company in the amount of $40,326.96. Councilmember Molenaar moved to approve the bid award to Rehrig Pacific Company in the amount of $40,326.96. Open Record Public Hearing – Ordinance to Adopt the 2012 International Building Code and Amendments: Mr. Prosser explained that this request is to adopt the 2012 International Building Code and amendments to the Municipal Code Chapter 15.04 to clarify those changes. Mayor Boudreau opened the public hearing. Hearing no comments Mayor Boudreau closed the public hearing. Councilmember Fiedler moved to adopt Ordinance 3613 approving the adoption of the 2012 International Building Codes and Amendments. Motion seconded by Councilmember Hulst. Motion carried 5-0. F. Agreement for AWC Worker’s Compensation Group Retro Program: Ms. Bartlett explained by joining the AWC Workers’ Compensation Group Retro Program the City will be eligible for a refund on membership fees and create opportunities to improve workplace safety. Councilmember Hulst moved to authorize the Mayor to enter into an agreement with the Association of Washington Cities for the Workers’ Compensation Group Retro Program. Motion seconded by Councilmember Quam. Motion carried 5-0. G. Motion to Approve Right of Way Lease Agreement Amendment: Mr. Rogerson said that PKC Investments is asking to extend the lease agreement until November 1, 2013. Councilmember Lindquist moved to authorizing the Mayor to enter into an amendment to the right of way lease agreement with PKC Investments. Motion seconded by Councilmember Fiedler. Motion carried 5-0. The meeting was adjourned into executive session at 7:53 p.m. and estimated to last 60 minutes. H.
