Mount Vernon City Council Regular Meeting Minutes October 14, 2015 The meeting was called to order by Mayor Boudreau at 7:00 p.m. Present: Mayor Boudreau, Councilmembers Fiedler, Hulst, Lindquist, Molenaar, Quam Ragan and Urban. Staff Present: Public Works Director Bell, Parks Recreation Supervisor Brookings, Police Chief Dodd, Wastewater Utility Manger Duranceau, Finance Director Huschka, Senior Planner Lowell, City Attorney Rogerson, Library Director Soneda, Special Projects Administrator Stendal, Parks Operations Supervisor Weppler, Community Works Program Supervisor Wenzl. Citizens Present: 22 Approval of Minutes A. Approval of September 16, 2015 Study Session Minutes. Councilmember Lindquist moved to approve the September 16, 2015 Study Session meeting minutes. Motion seconded by Councilmember Fiedler. Motion carried 7-0. B. Approval of September 23, 2015 Regular Council Meeting Minutes. Councilmember Quam moved to approve the September 23, 2015 Regular Council meeting minutes. Motion seconded by Councilmember Ragan. Motion carried 7-0. C. Approval of September 30, 2015 Committee of the Whole Meeting Minutes. Councilmember Hulst moved to approve the September 23, 2015 Committee of the Whole meeting minutes. Motion seconded by Councilmember Molenaar. Motion carried 7-0. Approval of Claims and Payroll A. Approval of October 14, 2015 claims numbered 141689 - 141690 and 141703 – 141940 in the amount of $1,306,585.52. Councilmember Molenaar moved to approve the October 14, 2015 claims numbered 141689 - 141690 and 141703 – 141940 in the amount of $1,306,585.52. Motion seconded by Councilmember Quam. Motion carried 7-0. B. Approval of September 30, 2015 payroll checks numbered 104702 - 104762, direct deposit checks numbered 527 - 52966, and wire transfers numbered 537 & 538 in the amount of $1,035,926.28. Community Comments: None C. Councilmember Comments: th • Councilmember Hulst informed the public about the Ward 2 meeting on Oct 27 at 6:00pm at Hillcrest Lodge. D. Mayor’s Report th • There will be Fall Clean-up days on October 17 & 24 . • Annual winter coat drive held by Police Department going on for the month of October and November. • USDA Secretary Tom Vilsack visited Mount Vernon and spoke about investing in small and medium agricultural communities. • Times and locations of upcoming Mayor’s coffee were noted. • Rebecca Lowell updated Council on the Hidden Lakes issue. DNR will be at the th November 4 Council meeting. E. Committee Agenda request: • Councilmember Fiedler would like a parks foundation update. • Councilmember Lindquist would like salary survey information for the budget put on the Council drive. • Councilmember Urban had two requests. The first, he would like a public safety update on downtown issues and a discussion on the use of speed bumps. The second request is a discussion on the fate of the City’s portable flood structure. NEW BUSINESS A. Closed Record Public Hearing- 2015 Comprehensive Plan Amendments: Ms. Lowell presented a request to Council to authorize the Mayor to sign the accompanying Ordinance approving all of the Comprehensive Plan amendments and associated rezone applications processed in 2015. There are four applications for consideration. Ms. Lowell presented each application individually, and separate public hearings were held for each application. Mayor Boudreau opened the closed record public hearing for Food Services, Inc, PL14-008. There being no comment Mayor Boudreau closed the closed record public hearing for Food Services, Inc, PL14-008. Councilmember Lindquist moved to approve the rezone application for Food Services Inc. Motion seconded by Councilmember Urban. Motion carried 7-0. Mayor Boudreau opened the closed record public hearing for Skagit Valley College, PL15- 006. There being no comment Mayor Boudreau closed the closed record public hearing for Skagit Valley College, PL15-006. Councilmember Fiedler moved to approve rezone application for Skagit Valley College. Motion seconded by Councilmember Ragan. Jay Stewart, a resident of Mount Vernon, spoke in favor of the rezone application. Barbara Jarobe, a resident of Mount Vernon, spoke in favor of the rezone application. Mike Forbe, a resident of Mount Vernon, spoke in favor of the rezone application. Bruce Lisser, representing the applicant, will strive to maintain compatibility with the neighborhood. There being no further comment Mayor Boudreau closed the closed record public hearing. Councilmember Ragan moved to approve rezone application for PBWA. Motion seconded by Councilmember Lindquist. Motion carried 7-0. Councilmember Ragan moved to approve the land use element language. Motion seconded by Councilmember Lindquist. Motion carried 7-0. Mayor Boudreau opened the closed record public hearing for LaVenture Rd LLC, PL15-010. Pat Fontana, a resident of Mount Vernon, spoke against the rezone application. Jessica Baldwin, a resident of Mount Vernon, spoke against the rezone application. Jim Axthelm, a resident of Mount Vernon and the owner of the property under consideration, explained the rezone application and possible plans for the property. He also noted that right now there is no planned development set for this site.. Travis Baldwin, a resident of Mount Vernon, spoke against the rezone application. There being no further comment Mayor Boudreau closed the closed record public hearing for Laventure Rd LLC, PL15-010. Councilmember Hulst moved to deny the rezone request for Laventure Rd LLC. Motion seconded by Councilmember Ragan. Motion carried 7-0. Councilmember Hulst moved to approve Ordinance 3662 with the Laventure Rd LLC, PL15-010 application being removed from the ordinance. Motion seconded by Councilmember Quam. Motion carried 7-0. Council was recessed at 8:14 pm for five minutes. Council was reconvened at 8:19 pm. B. Presentation by Community Action Agency: Mr. Hyde introduced Bill Henkel, executive director for Community Action Agency (CAA) who briefed the Council and Mayor on efforts by CAA in the area of affordable housing. Joan Penney, with CAA, also addressed the Council regarding homelessness and affordable housing in our region. C. Library Update Presentation to Council: Mr. Soneda presented Council with an update on recent and upcoming activities at the Library. He presented statistics for September 2015 and noted that the book sale brought in $1,514.05 in sales and donations. D. Interagency Agreement with Washington State Department of Natural Resources: Mr. Weppler presented Council with a request to authorize the Mayor to enter into an agreement with Washington State Department of Natural Resources to perform urban forestry maintenance and restoration tasks outlined in the agreement as part of a non-monetary grant awarded to the City. The agreement will be the first steps in developing and implementing an urban forestry program. Mount Vernon City Council October 14, 2015 Page 4 of 4 Councilmember Ragan moved to authorize the Mayor to enter into an agreement with Washington State Department of Natural Resources. Motion seconded by Councilmember Hulst. Motion carried 7-0. E. Interlocal Agreement for Provision of Emergency Medical Services with Skagit County: Chief Hari presented Council with a request to authorize the Mayor to enter into an interlocal agreement with Skagit County EMS to enable the City to seek reimbursement as well as to establish a working plan for the delivery of emergency medical services within Mount Vernon. Councilmember Lindquist moved to authorize the Mayor to enter into an interlocal agreement with Skagit County EMS. Motion seconded by Councilmember Urban. Motion carried 7-0. F. Condemnation Ordinance: Mr. Rogerson proposed an ordinance for the condemnation of certain property rights needed for the City’s Downtown Flood Project. Councilmember Hulst moved to approve Ordinance 3663. Motion seconded by Councilmember Molenaar. Motion carried 7-0. The meeting was convened into executive session at 9:06 p.m. and was estimated to last 30 minutes. G. Executive Session: Real Estate, Potential Litigation and Collective Bargaining The meeting was reconvened at 9:36 pm.
