Mount Vernon City Council Regular Meeting Minutes November 9, 2016 The meeting was called to order by Mayor Boudreau at 7:00 p.m. Present: Councilmembers Fiedler, Hudson, Hulst, Lindquist, Molenaar, Quam, and Ragan Absent: None Staff Present: Public Works Director Bell, Public Works Assistant Director Love, Parks and Enrichment Services Director King, Police Chief Dodd, Project Development Manager Donovan, Finance Director Huschka, Library Director Soneda, City Attorney Rogerson, Community Economic Development Director Hyde Citizens Present: 22 Approval of Minutes A. Approval of October 26, 2016 Regular Council Meeting Minutes. Councilmember Lindquist moved to approve the October 26, 2016 Regular Council Meeting Minutes. Motion seconded by Councilmember Hudson. Motion carried 7-0. Approval of Claims and Payroll A. Approval of November 9, 2016 claims numbered 146990-1469925, 146999-147000 and 147002-147249 in the amount of $958,968.87. Councilmember Ragan moved to approve the November 9, 2016 claims numbered 146990-1469925, 146999-147000 and 147002-147249 in the amount of $958,968.87. Motion seconded by Councilmember Molenaar. Motion carried 7-0. B. Approval of October 31, 2016 payroll checks numbered 106188-106244, direct deposit checks numbered 58073-58275 and wire transfers numbered 589 & 590 in the amount of $939,816.28. Extension of Contract for Indigent Defense Services: Mr. Stendal presented Council with a request to authorize the Mayor to enter into a month-to-month extension of contract for indigent defense services, along with the City of Burlington, with Mountain Law, PLLC. Councilmember Hudson moved to authorize the Mayor to enter into a month-to-month extension of contract for indigent defense services, along with the City of Burlington, with Mountain Law, PLLC. Motion seconded by Councilmember Lindquist. Motion carried 7-0. B. Public Hearing- Adoption of New Stormwater Regulations and Associated Code Amendments: Ms. Lowell presented Council with information regarding proposed amendments to Mount Vernon Municipal Code Chapters: 13.33 (Storm Water Drainage Utility), 13.35 (Surface Water Utility – System and Structure of Rates), and 15.40 (Critical Areas). These amendments result in the adoption of the Department of Ecology’s 2012 Stormwater Management Manual, will require low impact development where feasible, and will adopt four new best available science documents into the City’s critical areas ordinance. Mayor Boudreau opened the closed record public hearing. There being no comment Mayor Boudreau closed the public hearing. Councilmember Hulst moved to approve Ordinance 3700 approving proposed amendments to Mount Vernon Municipal Code Chapters 13.33 (Storm Water Drainage Utility), 13.35 (Surface Water Utility – System and Structure of Rates), and 15.40 (Critical Areas). Motion seconded by Councilmember Quam. Motion carried 7-0. C. Open Record Public Hearing- Review Revenue Sources for the 2017 Budget and Discuss Setting 2017 Property Taxes: Ms. Huschka reviewed with Council the revenue estimates for 2016 and 2017, and discussed setting the 2017 property taxes for the City for the year 2017. Mayor Boudreau opened the public hearing. There being no comment Mayor Boudreau closed the public hearing. No action was taken. D. Proposed Ordinance to Amend Mount Vernon Municipal Code Chapter 2.97, Broadening Residential Restrictions for Commission Members: Mr. Donovan presented Council with a request to approve Ordinance 3701 to amend MVMC Chapter 2.97, to broaden restrictions upon where a student commissioner may reside. Approval of Two New Members to the Mount Vernon Arts Commission: Mr. Donovan presented Council with a request to allow the Mayor to approve the appointment of Andrew Schuh to the Mount Vernon Arts Commission (term to expire 12/31/2019), and Hannah Schuh to the position of Student Representative of the Mount Vernon Arts Commission (term to expire 8/31/2017). Councilmember Lindquist moved to allow the Mayor to approve the appointment of Andrew Schuh to the Mount Vernon Arts Commission (term to expire 12/31/2019), and Hannah Schuh to the position of Student Representative of the Mount Vernon Arts Commission (term to expire 8/31/2017. Motion seconded by Councilmember Quam. Motion carried 7-0. F. Library Update Presentation: Mr. Soneda presented Council and the Mayor with an update on recent and upcoming events at the Library. G. Approval of Interlocal GIS Services Agreement with Skagit County: Mr. Hyde presented Council with a request to authorize the Mayor to enter into an interlocal agreement with Skagit County to assist the City with Geographical Information Services (GIS) operations on a work order basis. Executive Session: Potential litigation The meeting was convened into executive session at 8:21 p.m. and was estimated to last 15 minutes.
