Mount Vernon City Council Regular Meeting Minutes September 26, 2018 The meeting was called to order by Mayor Boudreau at 7:00 p.m. Present: Councilmembers Beaton, Brocksmith, Carías, Hudson, Hulst, Lindquist and Molenaar Staff Present: Fire Chief Brice, Police Chief Dodd, Project Development Manager Donovan, Wastewater Treatment Plant Supervisor Duranceau, Library Services Director Huffman, Senior Planner Lowell, Development Service Director Phillips, City Attorney Rogerson, Finance Director Volesky, Parks Manager Weppler and CWP Supervisor Wenzel. Citizens Present: 2 CONSENT AGENDA A. Approval of September 12, 2018 Regular Council Meeting Minutes. B. Approval of September 20, 2018 payroll checks numbered 108638 - 108681, direct deposit checks numbered 67556 – 67774, and wire transfers numbered 687 – 688 in the amount of $1,079,076.11. C. Approval of September 26, 2018 Claims numbered 156676, 156679 – 156935 in the amount of $1,602,591.40. Councilmember Hudson moved to approve the consent agenda items A-C. Motion seconded by Councilmember Hulst. Motion carried 7-0. REPORTS A. Committee Reports: • Finance Committee and Parks & Enrichment Services – details see Committee minutes. • Development Services – for details see Committee minutes. B. Mayor’s Report • Mayor Boudreau reported on her recent trip to visit the USS Stennis while it was underway. She and was transported by plane and made a landing on the carrier. The Mayor then spent 24 hours aboard the super carrier and toured the extensive facilities that are required for a structure of this size. • Mayor’s Coffee Hours times and locations were reviewed. NEW BUSINESS A. Public Hearing – 2019-2024 Capital Improvements Plan: Mr. Donovan presented Council with information and background on a proposed ordinance adopting the 2019-2024 Capital Improvements Plan. This ordinance will amend the Comprehensive Plan for the city by updating the capital improvements section. The Planning Commission has held a public hearing on this and recommends approval of this plan. Councilmember Hulst moved to approve Ordinance 3761 adopting the 2019-2024 Capital Improvements Plan. Motion seconded by Councilmember Molenaar. Motion carried 7-0. B. Public Hearing – Capital Facilities Plan and Amendments to Mount Vernon Municipal Code (MVMC) 3.36 for the Mount Vernon School District: Ms. Lowell presented Council with a request to consider adoption by ordinance of the Mount Vernon School District’s Capital Facilities Plan and amendments to MVMC 3.36. The School District has created this plan and the Capital Facilities Element of the City’s Comprehensive plan requires an inventory of public facilities, not just the City’s facilities. The School District utilizes impact fees for their capital programs, but cannot collect those fees themselves. The District has requested an increase in those impact fees. The Planning Commission has recommended the approval of the CFP but not the impact fee structure. This ordinance does not include any setting of the impact fees; those will be addressed at a different time. Mayor Boudreau opened the public hearing. There being no comment Mayor Boudreau closed the public hearing. Councilmember Lindquist moved to approve Ordinance 3762 adopting the capital facilities plan and amendments to Mount Vernon Municipal Code 3.36 for the Mount Vernon School District. Motion seconded by Councilmember Hudson. Motion carried 7-0. C. Wastewater Treatment Plant 2017 Outstanding Performance Award: Mr. Bell presented the Wastewater Treatment Plant staff their fifth consecutive. Outstanding Performance Award from the Department of Ecology. The department has successfully maintained a perfect National Pollutant Discharge Elimination System permit compliance. D. Professional Service Agreement – HDR Engineering, Inc.: Mr. Bell presented Council with a request to authorize the Mayor to enter into an agreement with HDR Engineering, Inc. for a sewer utility rate study. The last rate study was completed in 2008. The study will provide a thorough evaluation of current and projected operating cost, future capital improvement need, review current permit regulations, perform analysis of rate structure methodology and submit a final report with recommendations. Councilmember Hulst moved to authorize the Mayor to enter into an agreement with HDR Engineering, Inc. for a sewer utility rate study. Motion seconded by Councilmember Lindquist. Motion carried 7-0. E. Ordinance Updating Mount Vernon Municipal Code 5.04 – General Business License: Mr. Volesky introduced a proposed ordinance that updates the Mount Vernon Municipal Code 5.04- General Business License to bring it into compliance with state business license requirements. Councilmember Molenaar moved to approve Ordinance 3763 repealing and reenacting Mount Vernon Municipal Code 5.04 – General Business License. Motion seconded by Councilmember Hudson. Motion carried 7-0. F. Banking Services Agreement with Opus Bank: Mr. Volesky presented a request for Council to authorize the Mayor to enter into an agreement with Opus Bank for provision of banking services. Motion carried 7-0. G. Ordinance Repealing Chapter 12.32 in Title 12 MVMVC and Enacting a New Chapter: Mr. Rogerson presented Council with a proposed Ordinance that will repeal and enact a new City’s Park Code in the Mount Vernon Municipal Code. The ordinance would establish policies for the use of the City’s Parks and Trails by the general public so that these recreational facilities can be used and enjoyed by all persons in a manner that maintains the high quality of the City’s Parks System. It also establishes a Park Ranger position to enforce violations of the City ordinances that occur in or near the City’s park system. It further codifies rules in which persons may be trespassed from the City parks system in the event they violate the parks code. Councilmember Hulst moved to approve Ordinance 3764 establishing a City’s Park Code in the Mount Vernon Municipal Code 12.32 Motion seconded by Councilmember Lindquist. Motion carried 7-0. The meeting was convened into executive session at 7:45 p.m. and was estimated to last 10 minutes. H. Executive Session: Potential litigation.
