DRIVERS WANTING TO TURN SOUTH, TOWARD THE PARK, WILL BE DIRECTED TO SOUTH BAKER STREET FINDINGS/CONCLUSIONS: Closing South Ball Street will increase traffic flow on W. Division Street, while continuing to allow event attendees to access Edgewater Park by proceeding one block further to the west, at S. Baker Street. RECOMMENDATION: Staff recommends Council approval of this S. Ball Street closure request, between the hours of 9 a.m. July 21st, and 1 a.m. July 22nd; for the Festival Familiar event at Edgewater Park. ATTACHED: Special Event Permit Application  AGENDA ITEM: B DATE: July 10, 2019 TO: Mayor Boudreau and City Council FROM: Esco Bell, Public Works Director SUBJECT: ORDINANCE TO CHANGE SOLID WASTE SERVICES RATES – FIRST READING RECOMMENDED ACTION: First Reading – Public Hearing, No action at this time. INTRODUCTION/BACKGROUND: The City of Mount Vernon has an agreement with Skagit County for solid waste disposal services. Effective June 3, 2019 the Skagit County increased their disposal fee from $88 per ton to $96 per ton. The cost impact to the Solid Waste Division is approximately $10,000 per month. FINDINGS/CONCLUSIONS: The City of Mount Vernon engaged Bell & Associates, Inc. to perform a comprehensive solid waste rate study, which began in February 2019. During the interim between the County’s rate increase and the City Council’s approval of the cost of solid waste service rate study, Bell & Associates is recommending that the City increase the current collection rates and pass through the disposal fee increase. The table on the following page summarizes the increase for the various cart and container sizes provided by the City. ATTACHED: Ordinance AGENDA ITEM: C AGENDA ITEM: D  AGENDA ITEM: E DATE: July 10, 2019 TO: Mayor Boudreau and City Council FROM: Rebecca Lowell, Development Services SUBJECT: REQUEST TO CONTINUE A PUBLIC HEARING FOR PROPOSED STREET VACATIONS RECOMMENDED ACTION: Staff recommends that Council make a motion to continue the previously scheduled street vacation public hearing to July 17, 2019. INTRODUCTION/BACKGROUND: Staff previously set a public hearing date of June 26, 2019 for Council to consider the vacation of an undeveloped portion of South 6th Street and a portion of a nearby alley that are identified on the accompanying maps. On June 26, 2019 Council opened the public hearing and continued this hearing to July 10, 2019. Staff is requesting this hearing be continued again to July 17, 2019. FINDINGS/CONCLUSIONS: On May 22, 2019 City Council approved Resolution 963 setting a public hearing date for the subject street vacations on June 26, 2019. The subject street vacation cannot be approved until such time that a Public Benefit Agreement has been completed. Although staff has made much progress with completing the Public Benefit Agreement it is not quite complete. As such, staff is requesting that Council continue the previously scheduled public hearing to July 17, 2019. RECOMMENDATION: Council make a motion to continue the scheduled public hearing to July 17, 2019. ATTACHED: • Map showing the proposed street vacation area(s)  AGENDA ITEM: F DATE: July 10, 2019 TO: Mayor Boudreau and City Council FROM: Chris Phillips, Development Services Director SUBJECT: TONY COOK & MOUNT VERNON REVOCABLE RIGHT OF WAY/LICENSE FENCE AGREEMENT RECOMMENDED ACTION: Staff recommends City Council enter into a revocable Right of Way/License Fence Agreement with Mr. Tony Cook. INTRODUCTION/BACKGROUND: City Staff at the request of Council invested the greater part of a year conducting extensive research on this one-of-a-kind Right of Way/License Agreement to allow a resident (Mr. Cook) build a fence over a City Easement and Utility Easement. Mr. Cook has competed all requested tasks which include: 1. Obtain written consent/support from adjacent property owners of his intention to build a fence and move the public trail to the southern end of his property. 2. Obtain written consent/support from all public utilities that are impacted by the fence construction. 3. Provide the City with Exhibit “A” Easement Description and Exhibit “B” Survey Map. FINDINGS/CONCLUSIONS: Mr. Cook has completed all requirements to construct a fence within defined easement areas. City Staff recommends entering into a Revocable Right of Way/License Agreement.
