The meeting was called to order by Mayor Boudreau at 7:00 PM.
Present: Councilmembers Beaton, Brocksmith, Carías, Hulst, Hudson, Molenaar, and
Mayor Boudreau. Councilmember Moberg was excused from attendance.

• Mayor Boudreau opened the community comments with a review of the rules of
decorum.
• Richard Bowyer – Mount Vernon – Revisited his comments to the council 2 weeks
earlier requesting a moratorium on development. Expressed concerns about the impact
of higher population density on traffic and infrastructure.
• A number of youths from the community –Spoke in favor of plastic bag ban.

D. Mayor’s Report:
• Mayor Boudreau invited the public to attend the upcoming walking coffee hour on
October 4th, from 10-11 AM starting at the City Hall.
• Mayor Boudreau invited the public to attend the upcoming Downtown Waterfront Flood
Project Completion Celebration on September 28th starting at 10AM at the Skagit River
walk.
• Mayor Boudreau announced the hiring of new Park Ranger Kevin Mathis.
• Mayor Boudreau announced the Affordable Housing Work Plan webpage is now up and
running.

• Councilmember Hudson requested the council review the proposed plastic bag ban.

A. Closed Record Public Hearing – Highpoint Preliminary Plat Application: Rebecca Lowell
presented a recap of the situation regarding the Highpoint Preliminary Plat Application.

• There being no comments the Closed Record Public Hearing was closed.
Councilmember Hulst moved the Council approve Resolution
970 to accept the Highpoint Preliminary Plat Application. Motion
seconded by Councilmember Hudson. Motion carried 6-0.

SUBJECT: CLOSED RECORD PUBLIC HEARING - PRELIMINARY PLAT APPROVAL OF HIGHPOINT – LAND USE
NO. PLAN19-0042
RECOMMENDED ACTION:
Staff recommends that Council hold a closed record public hearing and then make a motion to authorize the
Mayor to sign the accompanying resolution approving the preliminary plat for the Highpoint development.
INTRODUCTION/BACKGROUND:
Proposed is a 15.3-acre preliminary plat that will create 49 single-family lots, two tracts containing stormwater
facilities, one tract containing a wetland and its associated buffer, and one open space tract. The residential
lots range in size from approximately 7,500 square feet (sf) to 11,800 sf with an average lot size of 8,061 sf.
The project site is described by the Skagit County Assessor as parcels P126391 and P27513. The site is located
on the north side of East Division Street immediately east of North 53 rd Street. See the vicinity map below that
identifies the site location in yellow.

On August 9, 2019 an open record hearing was held before the Hearing Examiner for this preliminary plat. The
Hearing Examiner (HE) recommended conditional approval of the application in a decision dated August 29,
2019. No request for reconsideration of the HE recommendation of approval was received by the
Development Services Department during the allotted 10 day period counted from the date of the HE
recommendation.
FINDINGS/CONCLUSIONS:
The proposal is found to be consistent with the Mount Vernon Municipal Code and the Comprehensive Plan.
The proposed preliminary plat was considered at a duly advertised public hearing before the Hearing Examiner
who recommended approval of the application with conditions.
RECOMMENDATION:
Staff recommends that Council move to adopt a resolution approving the preliminary plat for the Highpoint
development.

RESOLUTION NO.
A RESOLUTION PERTAINING TO SUBDIVISION CONTROL AND ACCEPTING THE
PRELIMINARY PLAT OF HIGH POINT PURSUANT TO CHAPTER 16.08 OF THE MOUNT
VERNON MUNICIPAL CODE.
WHEREAS, an application for approval of a Preliminary Plat of a proposed 49-lots and four
tract subdivision has been made pursuant to Chapter 16.08 of the Mount Vernon Municipal Code
by the owner of the real property described in Exhibit "1" which comprises approximately 15.3
acres in Mount Vernon, Washington; and
WHEREAS, the City of Mount Vernon issued a Mitigated Determination of Non-Significance
(MDNS) on July 16, 2019; and
WHEREAS, notices of the time, location and purpose of a public hearing for the purpose of
giving approval, conditional approval or disapproval of the Preliminary Plat were sent pursuant to
Chapter 14.05; and
WHEREAS, pursuant to Chapter 16.08 of the Mount Vernon Municipal Code, a public hearing
was conducted before the Mount Vernon Hearing Examiner on August 9, 2019; and
WHEREAS, a Preliminary Plat map, Exhibit "2", has been reviewed and approved with
conditions by the Hearing Examiner; and
WHEREAS, the Hearing Examiner recommended, based on Findings of Fact, Conclusions of
Law listed within his recommendation, Preliminary Plat approval with conditions and restrictions
listed in the accompanying Exhibit “3”.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOUNT VERNON,
WASHINGTON AS FOLLOWS:
That said Preliminary Plat known and described as HIGH POINT has been presented for acceptance,
approval and filing and is hereby accepted, approved and ordered filed subject to the restrictions and
conditions listed in Exhibit "3", attached hereto and made a part hereof by reference as though fully set
forth herein.
The real property comprising such plat is hereby described in Exhibit "1" and shown in Exhibit “2”, both
of which are attached hereto and made a part hereof by reference as though fully set forth.

CONDITIONS OF APPROVAL
HIGH POINT PRELIMNARY PLAT
1. The MDNS issued (see Exhibit 4c in Staff Report) pursuant to SEPA and the mitigation
measures, as stated therein must be satisfied.
2. The Traffic Concurrency Recommendations, as set forth in the Transportation Concurrency
Review completed by Transportation Solutions, Inc (see Exhibit 12 in Staff Report) shall be
completed prior to final plat approval and payment of the requisite traffic impact fees shall occur
consistent with MVMC Chapter 3.36.
3. There shall be no curb cuts or access off of East Division Street. The only curb cut on North 53rd
Street shall be for proposed Road A.
4. Proposed Lots 3, 4, 5 and 6 shall install residential automatic fire sprinkler systems.
5. The north and east sides of the stormwater pond in Tract A and all four of the sides of the
stormwater pond in Tract D shall have a six-foot tall black powder coated chain link fence
installed with no less than a seven-foot wide landscape strip installed on the development side of
the fence consisting of a mix of two-inch caliper deciduous trees and five-foot evergreen trees 15
feet on center with minimum five-gallon shrubs and two-gallon ground cover installed. The
shrubs and ground cover shall be installed at a density that will fill 85 percent of the seven-foot
wide landscaping strip within two years. The west and south sides of the stormwater pond in
Tract A is subject to fencing and landscaping per the MDNS issued for this project (see Exhibit
4c in Staff Report).
6. Private driveways meeting the following requirements shall be constructed to serve lots 3 and 4, 5
and 6, and 30 and 31:
A. The driveways shall be a minimum of 20 feet in width.
B. The driveways shall be located in easements no less than 20 feet in width.
C. They shall be located no closer than eight feet from property lines.
7. A note shall be placed on the final plat map stating the City’s intent that Crested Butte Boulevard
be extended to East Division Street when property to the east of the subject preliminary plat is
developed in the future.
8. A homeowner’s association be created for the development that shall be responsible for the
maintenance all landscape areas, fencing around the perimeter of the plat and around the
stormwater ponds, the wetland and associated buffer, sidewalks and street trees installed adjacent
to sidewalks. The City will not be maintaining any of the areas the homeowner’s association is
required to maintain.

9. Codes, Covenants & Restrictions (CC&Rs) for the development shall be submitted to the
Development Services Department for review and approval prior to final plat approval. The
CC&Rs shall include a map that clearly shows the areas within the plat that the homeowner’s
association is responsible for maintaining. Evidence that sufficient funds will be collected from
each of the future residents shall be supplied to the City to ensure proper maintenance of these
areas. The City approved CC&Rs shall be recorded with, and cross-referenced on, the face of the
final plat.
