City of Mount Vernon City Council Meeting Minutes August 26, 2020 (Virtual Meeting) The meeting was called to order by Mayor Boudreau at 6:01 PM. Present: Councilmembers Brocksmith, Beaton, Carías, Hudson, Hulst, and Moberg Excused: Councilmember Molenaar Staff Present: Police Chief Cammock, Fire Chief Brice, Finance Director Volesky, Development Services Director Phillips, Public Works Director Bell, City Attorney Rogerson, Senior Planner Lowell, Project Development Manager Donovan, Public Works Engineer Bullock, Library Director Huffman, Human Resource Director Keator, IS Director Kleppe, Asst. Fire Chief Harris, and Parks Director Berner Citizens Present: 2 CONSENT AGENDA A. Approval of August 12, 2020 Regular Council Meeting Minutes B. Approval of August 20, 2020 payroll checks numbered 110209 – 110231 direct deposit checks numbered 78272 – 78487, and wire transfers numbered 884 – 888 in the amount of $1,162,362.98 C. Approval of August 26, 2020 Claims numbered 10105 – 10252 in the amount of $839,611.42 Councilmember Hudson moved to approve the Consent Agenda items A-C. Motion seconded by Councilmember Beaton. Motion carried 6-0. REPORTS A. Review of Emails from the Public: • Public comments sent via email to council@mountvernonwa.gov were read aloud by Mr. Donovan. o Bryan Hill, Mount Vernon – Concern of speeding vehicles on College Way. B. Councilmember Comments • None C. Mayors Report. • Discussion on resuming committee meetings. Suggested holding a Public Safety Committee meeting on September 2nd. Council agreed. D. Committee Agenda Requests • None NEW BUSINESS A. Solid Waste Service Rate Change for Transfer Station Tipping Fee Increase: Mr. Bell requested Council to adopt an ordinance increasing the charge for garbage service over the next 3 years due to the increase in disposal fees by Skagit County. Mount Vernon City Council August 26, 2020 Page 2 of 4 Councilmember Hulst moved to adopt Ordinance 3807 increasing the charge for garbage service over the next 3 years due to the increase in disposal fees by Skagit County. Motion seconded by Councilmember Moberg. Motion carried 6-0. B. Closed Record Public Hearing – Zoning Change of Deol Property: Ms. Lowell requested Council to adopt an ordinance to change the zoning designation of the Deol property from Public to R1-4.0 to make it consistent with the Comprehensive Plan designation. • Mayor Boudreau opened the closed record public hearing. • There being no comments, Mayor Boudreau closed the closed record public hearing. Councilmember Hudson moved to adopt Ordinance 3808 to change the zoning designation of the Deol property from Public to R1-4.0 to make it consistent with the Comprehensive Plan designation. Motion seconded by Councilmember Carías. Motion carried 6-0. C. Final Plat Approval of Deol Estates Plat: Ms. Lowell requested that Council approve a resolution that will approve the final plat of Deol Estates. This subdivision will create 11 new single-family residential lots. Councilmember Beaton moved to approve Resolution 979 that will approve the final plat of Deol Estates. Motion seconded by Councilmember Hulst. Motion carried 6-0. D. Closed Record Public Hearing – Skagit Valley RV Park Expansion of a Non- Conforming Use and Shoreline Substantial Development Permit: Ms. Lowell requested Council to approve a resolution to allow improvements to an existing RV park requiring special permission approval to allow for the continuation of the Non- Conforming Use and Shoreline Substantial Development approval. • Mayor Boudreau opened the closed record public hearing. • There being no comments, Mayor Boudreau closed the closed record public hearing. Councilmember Hulst moved to approve Resolution 980 that will allow improvements to an existing RV park requiring special permission approval to allow the continuation of the Non-Conforming Use and Shoreline Substantial Development approval. Motion seconded by Councilmember Hudson. Motion carried 6-0. E. Closed Record Public Hearing – Viewmont Estates Mobile Home Site Plan Modification and Continuation of a Non-Conforming Use: Ms. Lowell requested Council to approve a resolution that will modify the existing site plan for the Viewmont Estates Mobile Home Park and special permission approval to allow for the Mount Vernon City Council August 26, 2020 Page 3 of 4 continuation of the non-conforming structures within the remainder of the park. • Mayor Boudreau opened the closed record public hearing. • Darton Riely-Gibbons, Mount Vernon resident, thanked Council and City staff for all the work done on this proposal and voiced his support for the proposal. • Ross Rongner, Mount Vernon resident and property manager of this property, voiced his support for the proposal. • There being no further comments, Mayor Boudreau closed the closed record public hearing. Councilmember Beaton moved to approve Resolution 981 that will modify the existing site plan for the Viewmont Estates Mobile Home Park and special permission approval to allow the continuation of the non-conforming structures within the remainder of the park. Motion seconded by Councilmember Hulst. Motion carried 6-0. F. Contract Amendment with PBS Engineering and Environmental, Inc.: Mr. Bullock requested Council to authorize the Mayor to enter into a change order with PBS Engineering and Environmental, Inc. for the North 19th Stream Rehabilitation Project. Councilmember Moberg moved to approve the authorization for the Mayor to enter into a change order with PBS Engineering and Environment, Inc. Motion seconded by Councilmember Carías. Motion carried 6-0. G. 2020 COVID-19 Budget: Mr. Volesky gave an update on the 2020 budget impact of COVID-19. The projected revenue shortfall decreased from $5.35M to $2.86M due to unexpected increases in sales tax collections. With new estimated expenditure reductions of $1.96M and estimated reimbursements from CARES and FEMA funding of $685K brought the estimated overall budget shortfall to $211K. No action taken. H. CARES Act Funds Plan: Mayor Boudreau requested Council to approve the Coronavirus Relief Funds (CARES Act funds) expenditure plan. Mayor Boudreau gave an update on the CARES Federal government funding and the contract with the State Department of Commerce for reimbursement of $1,072,200 allocation from the State of Washington. Councilmember Hulst moved to approve the Coronavirus Relief Funds expenditure plan. Motion seconded by Councilmember Hudson. Motion carried 6-0 I. For the Good of the Order: Mr. Volesky and Ms. Keator lead a discussion on the following items. • 2020 revenue update • 2021 budget planning discussion • COLA discussion • HB 1406 discussion • 2019 audit follow-up Mount Vernon City Council August 26, 2020 Page 4 of 4 J. Executive Session: A discussion with legal counsel on matters relating to enforcement actions, litigation or potential litigation to which the City, the governing body, or a member acting in an official capacity is, or is likely to become, a party, when public knowledge regarding the discussion is likely to result in an adverse legal or financial consequence to the agency. The meeting was convened into executive session at 8:22 p.m. and was estimated to last 20 minutes. Mr. Rogerson announced that they would need to extend it for an estimated additional 20 minutes.
