INTRODUCTION/BACKGROUND: The Applicant seeks to expand a deck attached to a non-conforming structure. The existing home does not meet the requirement for combined side setbacks of 15 feet thus resulting in the structure being non-conforming. The proposed deck would add roughly 128 square feet tying two existing decks together. All of the decks conform to required setbacks. MVMC Chapter 17.102 has a process by which the City Council (upon recommendation by the Hearing Examiner) can grant special permission to enlarge or expand an existing non-conforming structure and/or use so long as certain criteria are met. The proposal property has an address of 1130 S 6th Street, and its parcel number is P52455. FINDINGS/CONCLUSIONS: On October 27, 2021 an open record hearing was held before the Hearing Examiner. The Examiner recommended approval of the application in a report dated December 6, 2021. There were no parties of record besides the applicant so there was not request for reconsideration of the Examiner’s Decision. The Hearing Examiner’s recommendation is submitted together with the attached proposed Resolution, the Staff Report, and all of the Exhibits that the Examiner relied upon in making his recommendation. RECOMMENDATION: Staff recommends that Council move to adopt a resolution approving the expansion of a non- conforming structure to allow the addition of a 128 square foot deck. INTRODUCTION/BACKGROUND: This Kulshan Trail Safety Lighting Project installed 35 LED street style trail lights to improve safety and encourage usage during times of darkness, particularly in the winter months. The work was completed in two phases, Oceanside Construction performed the earthwork and installed conduits and utility boxes; Puget Sound Energy installed the streetlights and wiring. The project was awarded on December 9, 2020, for $134,487.99; work was completed on April 9, 2021. Project Budget: TAP Grant Funding: $295,000 Design: $ 27,625 Oceanside: $134,488 PSE: $127,290 Total: $289,403 FINDINGS/CONCLUSIONS: Physical completion was achieved on April 9, 2021, in accordance with the plans and specifications. Final adjusted project costs were as follows: Design: $ 27,323 Oceanside: $142,290 PSE: $122,339 Total: $291,952 RECOMMENDATION: Staff recommends accepting the work performed by Oceanside Construction, for the Kulshan Trail Safety Lighting Project. INTRODUCTION/BACKGROUND: Lakeside Industries, Inc., has completed the 2021 Street Improvements Project. The project included the repaving or resurfacing Laventure Rad from Section to College Way, Fir Street from Laventure Road to Apache Drive, and Little Mountain Road. The project was awarded on May 12, 2021, for $1,218,795.67. FINDINGS/CONCLUSIONS: Project completion was achieved on February 2, 2022, in accordance with the plans and specifications. The final adjusted contract amount was $1,561,183.44. RECOMMENDATION: Staff recommends accepting the work performed by Lakeside Industries, Inc., for the 2021 Street Improvements Project. INTRODUCTION/BACKGROUND: Axthelm Construction, Inc., has completed the Wastewater Treatment Plant Admin Building Remodel/Addition Project. The project included a 1,369 sf addition and site improvements to the existing 2,063 sf admin building. The project was awarded on August 12, 2020, for $1,223,556.55. FINDINGS/CONCLUSIONS: The project has been completed in accordance with the plans and specifications. The final adjusted contract amount was $1,259,542.69. RECOMMENDATION: Staff recommends accepting the work performed by Axthelm Construction, Inc., for the Wastewater Treatment Plant Admin Building Remodel/Addition Project. ATTACHED: None  AGENDA ITEM: F DATE: February 23, 2022 TO: Mayor Boudreau and City Council FROM: Chris Phillips, Acting Public Works Director SUBJECT: RESOLUTION ADOPTING THE REVISED SKAGIT COUNTY SOLID WASTE MANAGEMENT PLAN (SCSWMP). RECOMMENDED ACTION: Staff recommends that Council pass the proposed resolution that adopts the Contamination Reduction and Outreach Plan (CROP) as an appendix to the Skagit County Solid Waste Management Plan (SCSWMP) approved by Solid Waste System Governance Board. INTRODUCTION/BACKGROUND: The SCSWMP is intended to provide guidance for the solid waste system in Skagit County. The system includes garbage collection and disposal, and programs for waste reduction, recycling, organics, special wastes and the administration of those programs. The plan was originally created by Skagit County in cooperation with the cities and towns of the county in 2008. FINDINGS/CONCLUSIONS: It is required by the Department of Ecology to update the Solid Waste Management Plan with a Contamination Reduction and Outreach Plan. The County has amended its plan with an Ecology approved CROP. All municipalities within Skagit County need to approve this plan to remain in compliance with the Skagit County Solid Waste Management Plan. RECOMMENDATION: Staff recommends approval of the attached resolution adopting the revised Skagit County Solid Waste Management Plan ATTACHED: Resolution
