Beer Permits Payment of Statements Other Business from Staff or City Council Adjourn . . . creating a better quality of life CONSENT AGENDA September 16, 2013 Honorable Mayor and Members of City Council: As an item for the consent agenda, it is recommended that you approve the following item: 1. 2013-2014 CAPER Background Because the City of Murfreesboro receives Community Development Block Grant funding from the U.S. Department of Housing and Urban Development (HUD), it must report annually on how federal resources have been used. The report, called the CAPER, must be submitted to HUD no later than 90 days following the end of the program year. The City’s Citizen Participation Plan requires that the report be available for public review and comment for 15 days before being submitted to HUD. The CAPER for the program year 2013- 14 was made available for review on the City web site beginning September 15, 2014. The City invites written comments from residents of Murfreesboro, public agencies and other interested parties. As required by its Citizen Participation Plan, the City will respond in writing to all written comments regarding the CAPER within 15 days of receipt. Fiscal Impact No fiscal impact. Recommendation We recommend approving the CAPER subject to adding written comments received before September 29, 2014, and authorizing the Community Development Department to submit the document to HUD. Box 1139 Murfreesboro, TN 37133-1139 Phone 615-848-2553 FAX 615-904-6506 E-mail: ggodwin@murfreesborotn.gov Information Only MEMORANDUM TO: Mayor Shane McFarland and Members of the Murfreesboro City Council FROM: Glen Godwin DATE: September 18, 2014 SUBJECT: Payroll Changes As you may know, City Council approved a proposal made by IT Director Chris Lilly in May of this year to purchase Enterprise Resource Planning (ERP) Software for the purpose of updating Finance, Judicial, and Human Resources Department software and related department processing applications. As a result of the approval, new Human Resources and Payroll software is tentatively scheduled to be implemented in October of 2015. One of the more important aspects of preparing for this transition includes a strategic review of our existing Payroll processes. Payroll check processing currently includes paying employees in one of five (5) different processing cycles; weekly (1 City General, 1Water& Sewer), bi-weekly, semi-monthly, and monthly. Approximately 25% of City employees receive a live payroll check (non-direct deposit). It is and has always been our goal to pay employees accurately and timely while maintaining flexibility in scheduling to accommodate our employees’ needs. However, it has become necessary to consolidate the number of Payroll cycles that we process and to move all payroll check processing to direct deposit in order to maintain the standard of excellence City employees have come to expect. Therefore, the following changes are presented to City Council as information: Page 1 Payroll cycle changes include the following key points: 1. Employees paid on the semi-monthly cycle will change to a bi-weekly cycle effective Friday, January 9th 2015. Instead of receiving payment on January 15th and 30th of 2015, January pay dates for the 26 (bi-weekly) payroll cycle are January 9th and January 23rd 2015. 2. Employees paid on the Monthly cycle will also change to a Bi-weekly cycle effective the same date, January 9th, 2015. 3. Employees paid on existing bi-weekly cycles will remain unchanged (paid 26 times per year). 4. Employees currently paid on weekly payroll cycles (including City General and Water & Sewer) will continue to be paid on weekly payroll cycles. A decision whether these payroll cycles will be changed will be made after the implementation of the new time keeping and payroll software takes place in the fall of 2015 and early 2016. Please note that these changes will not affect an employee’s annual budgeted salary. The amount an employee is paid per check will change, since there are 26 payments during the year instead of 24 payments (or 12 payments for monthly employees). Many employees will recognize that being paid every two weeks is an improvement for their household planning and budgeting purposes. And, employees will also notice that overtime earnings will be paid closer to when overtime hours are actually worked. We are communicating our plans ahead of time since we know that many employees have automatic draft payments in place with their financial institutions that need to be rescheduled or changed with respect to the timing of when the payroll cycle change takes place in January of 2015. Direct Deposit and Pay Card Option New employees hired on or after January 1, 2015 will be required to have their payroll checks direct deposited, regardless of the payroll cycle they are assigned to. Existing employees will also be required to change their paper or “live” payroll checks to direct deposit or use a pay card option beginning with the February 6, 2015 payroll date. This change will ensure that our Payroll operations are not adversely affected by a natural disaster and that our ability to process payroll and make timely employee payments is not interrupted by such events. Further, many employees prefer a pay card option instead of direct deposit due to the convenience that a debit-style card provides them. In order to provide new and current employees who do not currently have direct deposit with an option, the City has made arrangements with Bank of America to provide a “CashPay™-prepaid card” which works much like a debit card. Bank of America currently provides the City Payroll department with Automated Clearing House (ACH) service and the prepaid card service implementation will result in no additional fees to the City or to the employee. Page 2 These pay cards will be optional and there is no cost for the first pay card or first replacement card. Current employees must request a pay card by January 2, 2015 if they currently receive a paper or “live” paycheck. Pay cards will become effective on the payroll scheduled for February 6th, 2015 for those employees choosing this option, in order to allow for proper implementation and system testing in the City Payroll department. Employees should request a pay card from the Payroll department in Human Resources. Many employers, including Murfreesboro City Schools and Rutherford County Government, provide a pay card option in lieu of direct deposit to their employees and have reported a successful transition with those employees who received live payroll checks. Payroll Calendar of Events A Payroll calendar of events is attached to this memorandum as a resource for your reference. This calendar illustrates the sequence and timing of the changes. I will also post this memo and calendar of events on the HR intranet site for additional reference. A: Effective January 1, 2015, employees paid on the 24-payroll cycle (paid twice per month) and monthly cycle will begin being paid on the 26-payroll cycle (paid every two weeks). An explanation of the entire change is available on Murfree’s web (City’s intranet), you may also contact or stop by Human Resources for more information. The first new pay date is January 9th, 2015 and will continue for all future payrolls. Employees who currently receive a “live” payroll check (not direct-deposited) will be required to apply for a direct deposit or paycard option by January 2nd, 2015. A paycard is a new option being provided by Bank of America; employees do not have to be a customer of Bank of America. Further information on the paycard option will be provided on Murfree’s web and will be available in Human Resources. A paycard will work much like a debit card and there are no fees associated with its usage to either the employee or the City. Page 1 Q: Why is the City changing payroll cycles? A: The City is planning to update its software for processing all payroll cycles for City employees and is reviewing plans to ensure that accurate and timely payroll operations continue. It has become increasingly difficult to generate five (5) separate payroll cycles for City employees and ensure the accuracy and timeliness City employees have come to expect. Q: Who is affected by these changes? A: Payroll cycle changes include city employees who are being paid on the 24 payroll- cycle (paid twice per month) or monthly cycle. Employees who are being paid on a weekly cycle are not being affected by these changes. Employees who currently receive a “live” payroll check are also affected by these changes, regardless of the payroll cycle they are currently on. Q: Will employees who currently receive a “live” payroll check receive a voucher or statement of earnings when they change to a paycard? A: Yes, employees will continue to receive a statement of earnings or payroll “voucher”. Q: What do I have to do? A: If you are an employee being paid weekly or bi-weekly and have a direct deposit, you do not have to do anything. If you are currently paid on the 24 payroll cycle (paid twice per month) we strongly encourage you to use the time between now and January 2015 to review your personal financial information and bank account information (such as Ascend financial) and determine whether drafts that are being made from your account to your payees should be changed. This is not required, but encouraged. If you are an employee who receives a “live” payroll check, you will be required to select either a direct deposit or paycard option for being paid by January 2, 2015. Enrollment forms for the paycard option will be made available in the very near future. Enrollment forms for direct deposit are available in Human Resources now. Page 2 Q: How is my pay affected? A: You will continue to receive your annual, budgeted salary. However, employees now on the 24-payroll (paid twice per month) cycle will notice that their new payroll amount is different since their annual budgeted salary amount will be divided by 26 instead of 24. Payroll will automatically update employee deductions with the exception of Christmas club accounts, Ascend accounts (both deductions are for whole dollar amounts) and employee W-4 withholding amounts. Employees may change their Christmas club or Ascend accounts to reflect the increase in deductions (26 versus 24) over the course of a year. Employees with multiple direct deposits should review them to ensure that withheld amounts correctly reflect your intentions for total deductions. Federal tax withholding rates will continue to be based from the Federal tax withholding tables; employees may change Federal tax withholding by requesting, completing and returning a new W-4 form to the Payroll department. Q: Where can I find more information about the CashPay® paycard? A: CashPay® may be used as a debit or credit card at most banking and financial institutions and owners may withdraw cash using their card at ATM’s or make purchases anywhere that Visa or Mastercard debit cards are accepted. Agenda September 16, 2014 Honorable Mayor and Members of City Council Re: Moskovitz Court [2014-715] right of way abandonment request for 0.23 acres of right of way located south of Middle Tennessee Boulevard, Jim Jones & John Manning applicants Background During its regular meeting on September 3, 2014, the Planning Commission held a public hearing and then considered the matter of abandoning Moskovitz Court right of way as recorded with the Samsonite Boulevard Office Park Lot 11 in 1999. Moskovitz Court is located south of Middle Tennessee Boulevard. Moskovitz Court is 50-feet wide and approximately 181 linear feet. The total study area is approximately 0.23 acres (10,133 square feet). The original development plan was to develop a commercial/industrial subdivision along this right of way. Lot 11 has a multi-tenant industrial building. The City of Murfreesboro acquired a 5.14 acre parcel along Moskovitz Court which changed the development potential in this area. Orgain Ready mix submitted a site plan in August to develop the remaining property. Staff suggested Orgain make an application to abandon the right of way or, if that wasn’t an option, then extend the right of way so that it terminates into a proper cul-de-sac. Attached is a report prepared by Planning Staff with correspondence from various department. The approval of this request is subject to the applicant providing a legal description, a re-subdivision plat, and field locate the utilities to property locate the easement. Recommendation It is the recommendation of the Murfreesboro Planning Commission to approve the request to abandon Moskovitz Court right of way. The recommendation is to authorize the Mayor to sign a quitclaim deed as prepared by the City’s Legal Department. Memorandum To: Joseph Aydelott, Planning Director From: Joe Ornelas Date: August 25, 2014 Re: Right of way abandonment- Moskovitz Court Please find attached with this memorandum a copy of the responses received regarding the captioned right of way abandonment. In summary: BellSouth Officials from BellSouth indicated that the company has guy wires located in the 20’ foot public utility easement at the entrance to Moskovitz Court from Middle Tennessee Boulevard. As this is already located in the existing public utility easement, Jamal Abed has indicated that no new easements will be needed. Murfreesboro Electric Department (MED) An e-mail received from Mr. Chris Barns has indicated that MED only has facilities located at the intersection of Moskovitz Court and Middle Tennessee Boulevard. There will need to be an electrical easement for the future underground electric lines. Murfreesboro Water and Sewer Department MWSD has an existing 8-inch water line along Moskovitz Court. The department does not mind abandoning the ROW but requests that a twenty (20) foot minimum water line easement be reserved around the existing water main as well as the water service that extends to the edge of the current ROW serving the business located at 464 Middle Tennessee Boulevard (John Deere). This is outside of CUD’s service territory. Engineering Department The Engineering Department and Street Division does not have an objection to the request to abandon the ROW. The following comments were provided: 1. The abandonment should reserve utility easements for existing public utilities included in the ROW. 2. The abandonment should also reserve access easements to both the City parcel to the west and the Samsonite Business Park parcel to the east. 3. The applicant should provide legal descriptions and exhibits for the easements to be reserved and ROW to be abandoned for preparation of the documents necessary to accomplishment the abandonment. 4. The applicant should prepare a resubdivision plat necessary to combine the abandoned ROW with the base parcel to be used for Orgain Ready Mix plant. Atmos Energy Mr. Jerry Burke states that there are no gas lines along Moskovitz Court. Traffic Department Mr. Dana Richardson does not have any concerns with closing this portion right of way Police Department The right of way abandonment will not affect the Murfreesboro Police Department. Fire Department The right of way abandonment will not affect the Murfreesboro Fire Department. Solid Waste Department The Solid Waste Department will not be affected by the closure of this right of way. The abandonment should also reserve access easements to both the City parcel to the west and the Samsonite Business Park parcel to the east. 4. The applicant should provide legal descriptions and exhibits for the easements to be reserved and ROW to be abandoned for preparation of the documents necessary to accomplishment the abandonment. 5. The applicant should prepare a resubdivision plat necessary to combine the abandoned ROW with the base parcel to be used for Orgain Ready Mix plant. Let me know if you have questions. Sam A.
