March 23, 2017 The City Council of the City of Murfreesboro, Rutherford County, Tennessee, met in regular session at its regular meeting place in the Council Chambers at City Hall at 7:00 p.m. on Thursday, March 23, 2017, with Mayor Shane McFarland present and presiding and with the following Council Members present and in attendance, to wit: Madelyn Scales Harris Rick LaLance Bill Shacklett Eddie Smotherman Kirt Wade The following representatives of the City were also present: Robert J. Lyons, City Manager James Crumley, Assistant City Manager Jennifer Moody, Assistant City Manager Melissa Wright, City Recorder/Finance Director Craig Tindall, City Attorney Chris Lilly, Information Technology Director Georgia A. Meshotto, Administrative Assistant City Council/City Recorder Council Member Bill Shacklett recognized Mr. Derek Faulkner with Renewed Life Ministries Outreach who commenced the meeting with a prayer followed by Boy Scouts Tim Atkinson, Tyler Johnston, Ben Gomia and Mike Nelson with Blackman Troop 362 leading those present with the Pledge of Allegiance. Mayor McFarland recognized Mr. P.D. Mynatt, new General Manager of MED, and Ms. Lori Williams, Interim Chief Financial Officer, of MED. The Consent Agenda was presented to the Council for approval: 1) Letter of recommendations from the City Recorder/Finance Director: Acknowledgement of Receipt of City Manager’s approved Budget Amendments for Fiscal Year 2017. 2) Letter of recommendations from the Parks & Recreation Director: Outdoor Tennis Tournament Fee Increase at Adams Tennis Complex. 3) Letter of recommendations from the Senior Center Director: Alzheimer’s Association Agreement FY 2016-2017. 4) Letter of recommendations from the Community Development Grant Coordinator: Use of funds through the Affordable Housing Assistance Program for 2541 Jackalope Street. 5) Letter of recommendations from the Planning Commission: A. Mandatory Referral west of Pitts Lane. B. Mandatory Referral at Saint Andrews Place Subdivision. 6) Letter of recommendations from the City Manager: Demolition of substandard structure at 712 Carver Street. (Insert letters from the City Recorder/Finance Director, Parks & Recreation Director, Senior Center Director, Community Development Grant Coordinator, Planning Commission and City Manager here.) Mayor McFarland noted that Item 4 from the Community Development Grant Coordinator had been withdrawn.  March 23, 2017 Page 2 Mr. LaLance made a motion to approve the Consent Agenda with the deletion of Item 4. Mr. Wade seconded the motion and all members of the Council voted “Aye”. Mr. Wade made a motion to approve the minutes as written and presented for the regular meeting held on March 16, 2017. Mr. Shacklett seconded the motion and all members of the Council voted “Aye”. An ordinance, entitled “ORDINANCE 17-O-06 amending Appendix C, Employees’ Revised Pension Trust Agreement, of the Murfreesboro City Code, to comply with state law relative to qualified domestic relations orders,” was read to the council and offered for passage on first reading upon motion made by Mr. LaLance, seconded by Mr. Shacklett. Upon roll call said ordinance was passed on first reading by the following vote: Aye: Madelyn Scales Harris Rick LaLance Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None The City Recorder/Finance Director presented a request to consider approval of a Certificate of Compliance for Retail Liquor Store for Prajesh N. Patel, Dipakkumar Patel, Kinnari G. Patel and Bina Patel at Liquor Planet, 3508 Shelbyville Pike. All requirements have been met by the applicants for this existing location. Mr. Wade made a motion to approve a Certificate of Compliance for Prajesh N. Patel, Dipakkumar Patel, Kinnari G. Patel and Bina Patel at Liquor Planet, 3508 Shelbyville Pike. Vice-Mayor Scales Harris seconded the motion and all members of the Council voted “Aye”. The following letter of recommendations from the IT Director was presented to the Council: (Insert letter dated March 22, 2017 here with regards to Existing Kronos Annual Maintenance Contract and Conversion to Kronos SaaS Cloud-Based Platform.) Mr. Smotherman made a motion to accept the recommendation of the IT Director to approve a Maintenance Agreement for existing Kronos Services for an annual payment of $78,175.92, funded from IT FY 2018 Budget, and approve conversion to Kronos SaaS Cloud-Based Platform for a one-time implementation fee of $9,440.00, funded from 2014 TMBF. Mr. LaLance seconded the motion and all members of the Council voted “Aye”. The agenda item from the Assistant City Manager for Agreement of Conveyance for Real Estate to LifeCenters Development Group, LLC of Franklin was withdrawn. The City Recorder/Finance Director presented a Beer Application for Smoky Nights Hookah & Lounge (ownership/name change) at 2830 Middle Tennessee Boulevard. This application is pending completion of all required building and codes inspections.  March 23, 2017 Page 3 Vice-Mayor Scales Harris made a motion to approve a Beer Permit for Smoky Nights Hookah & Lounge at 2830 Middle Tennessee Boulevard upon successful completion of all building and codes inspections. Mr. Wade seconded the motion and all members of the Council voted “Aye” except Mr. LaLance and Mr. Smotherman voted to abstain. Mayor McFarland indicated there were no board or commission appointments to be considered at this time. The City Recorder/Finance Director indicated there were no statements to be considered at this time. Under other business, the following letter of recommendations from the Chief of Police was presented to the Council: (Insert letter dated March 22, 2017 here with regards to the purchase of five (5) Ford Explorer police vehicles.) Mr. Wade made a motion to accept the recommendation of the Chief of Police to purchase five (5) Ford Explorer police vehicles for a total cost of $140,580.00. Vice-Mayor Scales Harris seconded the motion and all members of the Council voted “Aye”. Vice-Mayor Scales Harris announced that the City of Murfreesboro and City Schools are hosting a program presented by Homeland Security at Patterson Park Community Center, Thursday, April 6, 2017, in the Washington Theater from 6-7:30 p.m. Topic of discussion will be internet safety and bullying. Mr. LaLance addressed West Main Street traffic issues and requested striping another lane into what is an exceptionally wide lane from the point of the railroad tracks to Broad Street. Mr. Smotherman addressed the existing Rover transit and pursuing a “free” bus system. It was suggested to remove the decals from the windows to allow people to see into the buses. The City Manager indicated he would get with the Transportation Director and present something in a future work session. Vice-Mayor Scales Harris also suggested considering a pilot program on Saturday for Rover. Mayor McFarland requested that Council be provided with a timeline update for road projects especially in the downtown area.
