June 22, 2017 The City Council of the City of Murfreesboro, Rutherford County, Tennessee, met in regular session at its regular meeting place in the Council Chambers at City Hall at 7:00 p.m. on Thursday, June 22, 2017, with Mayor Shane McFarland present and presiding and with the following Council Members present and in attendance, to wit: Madelyn Scales Harris Bill Shacklett Eddie Smotherman Kirt Wade Council Member Rick LaLance was absent and excused from this meeting. The following representatives of the City were also present: Robert J. Lyons, City Manager James Crumley, Assistant City Manager Jennifer Moody, Assistant City Manager Melissa Wright, City Recorder/Finance Director David Ives, Assistant City Attorney Matthew Blomeley, Assistant Planning Director Donald Anthony, Principal Planner Gary Whitaker, Planning Director Sam Huddleston, Assistant City Engineer Angela Jackson, Parks & Recreation Director Sam Huddleston, Assistant City Engineer Roger Toombs, Deputy Fire & Rescue Chief Georgia A. Meshotto, Administrative Assistant City Council/City Recorder Council Member Kirt Wade commenced the meeting with a prayer followed by the Pledge of Allegiance. Mayor McFarland extended condolences to the family of Mr. David Lose upon his passing this past week. Mayor McFarland presented a Proclamation to Mr. Tom Clark expressing appreciation and gratitude for 15 years of service on the Planning Commission. Mr. Clark’s wife, Clydell, was also present. Mayor McFarland extended well wishes to Council Member Rick LaLance who recently underwent surgery. Mr. Greg Tucker, Rutherford County Historian, gave a presentation on the local history of the City Cemetery. The Consent Agenda was presented to the Council for approval: 1) Letter of recommendations from the City Recorder/Finance Director: Acknowledgement of Receipt of City Manager’s approved Budget Amendment for Fiscal Year 2017. 2) Letter of recommendations from the IT Director: Purchase & Implementation of Security Cameras. (Insert letters from the City Recorder/Finance Director and IT Director here.) Mr. Smotherman made a motion to approve the Consent Agenda in its entirety. Mr. Wade seconded the motion and all members of the Council present voted “Aye”. June 22, 2017 Page 2 Mr. Shacklett made a motion to approve the minutes as written and presented for the special meetings held on May 25, 2017, May 30, 2017, June 1, 2017, June 6, 2017, June 8, 2017 and June 8, 2017, and the regular meeting held on June 8, 2017. Vice-Mayor Scales Harris seconded the motion and all members of the Council present voted “Aye”. The following letter of recommendations from the City Recorder/Finance Director was presented to the Council: (Insert letter dated June 19, 2017 here with regards to Fiscal Year 2017 Budget Amendment.) Mr. Smotherman made a motion to approve amendments to Exhibit “A” of ORDINANCE 17-O-16. Mr. Wade seconded the motion and all members of the Council present voted “Aye”. An ordinance, entitled “ORDINANCE 17-O-16 amending the 2016-2017 Budget (5th amendment,” which passed first reading on May 18, 2017, was read to the Council and offered for passage on second and final reading, as amended, upon motion made by Mr. Smotherman, seconded by Mr. Wade. An ordinance, entitled “ORDINANCE 17-O-26 amending Murfreesboro City Code, Chapter 25.2-Signs, Section 25.2-8, Conflicting Codes and Ordinances, and Section 25.2- 23, Exemptions, regarding City property and athletic fields [2017-804],” which passed first reading on June 15, 2017, was read to the Council and offered for passage on second and final reading upon motion made by Vice-Mayor Scales Harris, seconded by Mr. Shacklett. An ordinance, entitled “ORDINANCE 17-O-27 amending Murfreesboro City Code Appendix A-Zoning, Section 4, pertaining to general plan and procedure,” which passed first reading on June 15, 2017, was read to the Council and offered for passage on second and final reading upon motion made by Mr. Wade, seconded by Mr. Shacklett. Mayor McFarland announced that the next item on the agenda is to conduct a public hearing, pursuant to RESOLUTION 17-R-PH-17 adopted by the City Council on May 18, 2017, to consider amending approximately 50.2 acres in the Planned Unit Development (PUD) District (Victory Station PUD) located along Fortress Boulevard; Swanson Development, applicant [2016-460]. Notice of said public hearing was published in the June 5, 2017 issue of a local newspaper as follows: (Insert notice here.) The Assistant Planning Director presented the applicant’s request to amend approximately 50.2 acres of the Victory Station PUD, specifically Parcels “B” and “T”, located June 22, 2017 Page 4 along Fortress Boulevard. The proposed amendments to Parcel “B” are to allow the addition of several uses to make it more commercial fringe. This parcel was zoned in 2000 for health services, day cares and clinics; however, only 4 of the 11 parcels have been developed and the other 7 lots have remained vacant for quite some time. Speakers from Paschal Estates expressed their objection to some of the proposed uses, and the Planning Commission approved the amendment to Parcel “B” subject to the Plan Book being revised to eliminate those uses. The revised Plan Book was before Council. Parcel “T” is the larger area to the north that was added to the planned development in 2007 for 176 units on 38.4 acres which included single-family detached, single-family attached, and town homes; however, the plan never came to fruition. The applicant is requesting to amend the planned development for a different type of development that would increase the density by 9 units for a total of 185 units. The Planning Commission unanimously approved this amendment to Parcel “T”. Mr. Rob Molchan, SEC, Inc., gave a power point presentation from the applicant’s Pattern Book on the proposed development of Parcel “B” and “T” and answered questions from the Council. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed amendments to Parcel “B” and “T” in the Victory Station PUD along Fortress Boulevard. Mr. Rob Rodgers, 407 Carmel Drive-Victory Point Subdivision, addressed the existing traffic at Lazarus Way and Fortress Boulevard and the proposed emergency entrance that will be gated for Section “T” right next to the entrance of another large apartment complex across from Lazarus Way coming out of Victory Point. He suggested bringing everyone to the same intersection of Lazarus Way and Fortress Boulevard and signalize it. There were no others present who wished to speak for or against the proposed amendments to Victory Station PUD and, after ample time had been given, Mayor McFarland declared the public hearing closed. Mr. Blomeley addressed the previous speaker’s comments regarding the gated emergency access and signalization of Lazarus Way and Fortress Boulevard. It was uncertain if that intersection would meet the warrants for signalization. The purpose of the gated emergency access was to make provisions for emergency services in the event the main entrance was blocked. An ordinance, entitled “ORDINANCE 17-OZ-17 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now in force and effect, to amend the conditions applicable to approximately 50.2 acres in the Planned Unit Development (PUD) District (Victory Station (PUD) located along Fortress June 22, 2017 Page 5 Boulevard, as indicated on the attached map; Swanson Development, applicant [2016- 460],” was read to the Council and offered for passage on first reading upon motion made by Mr. Smotherman, seconded by Mr. Wade. Upon roll call said ordinance was passed on first reading by the following vote: Aye: Madelyn Scales Harris Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None Mayor McFarland announced that the next item on the agenda is to conduct a public hearing, pursuant to RESOLUTION 17-R-PH-18 adopted by the City Council on May 18, 2017, to consider rezoning approximately 4.53 acres along New Salem Highway and Salem Creek Drive from Commercial Fringe (CF) District to Planned Commercial Development (PCD) District (Salem Creek Commons PCD); Development Management Group, applicant [2017-413]. Notice of said public hearing was published in the June 5, 2017 issue of a local newspaper as follows: (Insert notice here.) The Assistant Planning Director presented the unanimous recommendation of the Planning Commission to approve the applicant’s request to rezone three (3) vacant commercial lots to Planned Commercial Development (PCD) District with the eastern most lot being a vehicle wash; center lot being a multi-tenant retail building; and the corner lot being a convenience market with gas pumps. Mr. Mike Gilbert gave a presentation from the applicant’s Program Book on the Salem Creek Commons PCD and answered questions from the Council. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed rezoning of approximately 4.53 acres along New Salem Highway and Salem Creek Drive to Planned Commercial Development (PCD) District (Salem Creek Commons PCD). There was no one present who wished to speak for or against the proposed rezoning and, after ample time had been given, Mayor McFarland declared the public hearing closed. The Assistant Planning Director addressed questions from Council regarding right turn-lanes and sidewalks along the thoroughfare of New Salem Highway. An ordinance, entitled “ORDINANCE 17-OZ-18 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now in force and effect to rezone approximately 4.53 acres along New Salem Highway and Salem Creek Drive from Commercial Fringe (CF) District to Planned Commercial Development June 22, 2017 Page 6 (PCD) District (Salem Creek Commons PCD); Development Management Group, applicant [2017-413],” was read to the Council and offered for passage on first reading upon motion made by Mr. Shacklett, seconded by Vice-Mayor Scales Harris. Upon roll call said ordinance was passed on first reading by the following vote: Aye: Madelyn Scales Harris Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None Mayor McFarland announced that the next item on the agenda is to conduct a public hearing, pursuant to RESOLUTION 17-R-PH-19 adopted by the City Council on May 18, 2017, to consider rezoning approximately 22.5 acres along Manson Pike and Brinkley Road from Single-Family Residential Fifteen (RS-15) District to Planned Residential Development (PRD) District (Blackman Station PRD); Laws Bouldin, applicant [2016-459]. Notice of said public hearing was published in the June 5, 2017 issue of a local newspaper as follows: (Insert notice here.) The Assistant Planning Director presented the Planning Commission’s unanimous recommendation to approve the applicant’s request to rezone an area along Manson Pike to Planned Residential Development (PRD) District for development of the Blackman Station PRD. The property is mostly undeveloped except for a single-family residence and several outbuildings. This zoning plan contains both single-family attached homes or townhomes as well as single-family detached lots. The purpose of this zoning is to transition with a lesser density to the west towards Brinkley Road with a single-family detached product such as that in the Oakton, Blackman Meadows and Princeton Oaks Subdivisions. The proposed Wilkerson Downs PRD is across Brinkley Road. Mr. Clyde Rountree, Huddleston-Steele Engineering, Inc. gave a presentation from the applicant’s Program Book and answered questions from the Council. Mr. Laws Bouldin, applicant, Mr. Taze Lundy with Source Land Company and Mr. Dan BoBo, developer for Ole South Properties, were present. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed rezoning of approximately 22.5 acres along Manson Pike and Brinkley Road to Planned Residential Development (PRD) District for the proposed Blackman Station PRD. Ms. Anna Moore, 4304 Farren Davis Court in Princeton Oaks, said her lot backs up to the proposed single-family development and addressed the drainage ditch in the existing tree line and water that sits during heavy rains; price point of homes; and would this development be open for rental property or have limitations set. June 22, 2017 Page 7 There were no others present who wished to speak for or against the proposed rezoning along Manson Pike and Brinkley Road and, after ample time had been given, Mayor McFarland declared the public hearing closed. The Assistant City Attorney indicated Council cannot impose conditions on an individual’s ability to rent property. Mr. Rountree addressed the price point of homes to be $250-$300,000 and would be comparable to the adjacent neighborhood. It was noted that drainage issues from their site would not be allowed to migrate on Ms. Moore’s site, and they would do their best to help alleviate her existing conditions. There is no motivation to alleviate the tree line which is contingent on grading the property. An ordinance, entitled “ORDINANCE 17-OZ-19 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now in force and effect, to rezone approximately 22.5 acres along Manson Pike and Brinkley Road from Single-Family Residential Fifteen (RS-15) District to Planned Residential Development (PRD) District (Blackman Station PRD); Laws Bouldin, applicant [2016-459],” was read to the Council and offered for passage on first reading upon motion made by Mr. Shacklett, seconded by Mr. Wade. Notice of said public hearing was published in the June 5, 2017 issue of a local newspaper as follows: (Insert notice here.) Mr. Donald Anthony, Principal Planner, presented the unanimous recommendation of the Planning Commission to approve the applicant’s request for annexation of approximately 8.85 acres located along the north side of Halls Hill Pike, east of North Rutherford Boulevard and just west of the Providence Point Subdivision. It is currently undeveloped, contiguous with the City Limits and within the City’s Urban Growth Boundary. The annexation study June 22, 2017 Page 8 area includes approximately 2,100 linear feet of Halls Hill Pike right-of-way (3.39 acres) from Woods Edge Drive on the east to approximately 100 feet west of subject property. Ten foot strips would have to be implemented to keep the City from surrounding the unincorporated property. The total study area would consist of approximately 12.24 acres. The Plan of Services indicates that this property can be adequately served. There were no questions from the Council. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed Plan of Services for 11.6 acres and annexation of approximately 8.9 acres for a total of approximately 12.24 acres. There was no one present who wished to speak for or against the proposed Plan of Services and annexation and, after ample time had been given, Mayor McFarland declared the public hearing closed. The following RESOLUTION 17-R-PS-21 was read to the Council and offered for adoption upon motion made by Mr. Wade, seconded by Mr. Shacklett. Mr. Donald Anthony, Principal Planner, presented the unanimous recommendation of the Planning Commission to approve the applicant’s request for zoning approximately 8.9 acres along Halls Pike as Planned Residential Development (PRD) District, simultaneous with annexation. The proposed Heritage Place PRD would consist of 129 townhomes divided among 24 buildings with a gross density of 14.39 dwelling units per acre. Surrounding June 22, 2017 Page 9 zoning includes Single-Family Residential Fifteen (RS-15) District on the north; Single- Family Residential Ten (RS-10) District on the northeast; and Residential Multi-Family Sixteen (RM-16) District on the southeast with adjacent properties to the west and south located in the unincorporated Rutherford County and zoned Residential Multi-Family. The Murfreesboro 2035 Plan, not yet approved, shows this area being appropriate for multi- family residential, and this request seems to be consistent with that plan. Mr. Matt Taylor, SEC, Inc., gave a presentation from the applicant’s Pattern Book and answered questions from the Council. Mr. Dan Bobo, developer for Ole South Properties, was present. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed zoning of approximately 8.9 acres along Halls Hill Pike to Planned Residential Development (PRD) District, simultaneous with annexation. There was no one present who wished to speak for or against the proposed zoning request and, after ample time had been given, Mayor McFarland declared the public hearing closed. An ordinance, entitled “ORDINANCE 17-OZ-21 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now in force and effect to zone approximately 8.9 acres along Halls Hill Pike as Planned Residential Development (PRD) District (Heritage Place PRD), simultaneous with annexation; Ole South Properties, applicant [2017-412],” was read to the Council and offered for passage on first reading upon motion made by Mr. Shacklett, seconded by Mr. Wade. Upon roll call said ordinance was passed on first reading by the following vote: Aye: Madelyn Scales Harris Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None Mayor McFarland announced that the next item on the agenda is to conduct a public hearing, pursuant to RESOLUTION 17-R-PH-23 adopted by the City Council on May 18, 2017, to consider (1) adoption of a Plan of Services for and annexation of approximately 1.94 acres and (2) zoning of approximately 1.36 acres along Florence Road and Alexandria Drive to Commercial Fringe (CF) District which have been proposed to be annexed to the City of Murfreesboro, Tennessee; Chris Bratcher, applicant [2017-504 and 2017-408]. Notice of said public hearing was published in the June 5, 2017 issue of a local newspaper as follows: (Insert notice here.) June 22, 2017 Page 10 Mr. Donald Anthony, Principal Planner, presented the unanimous recommendation of the Planning Commission to approve the applicant’s request for annexation of approximately 1.36 acres at the corner of Florence Road and Alexandria Drive. Subject property lies west of NW Broad Street and CSX railroad track and lies adjacent to the Florence Field Subdivision on the north and west sides of subject property. The property adjoins the City on the south and east and is located within the City’s Urban Growth Boundary. Included in the study area is a 430-linear foot section of Alexandria Drive. The Plan of Services indicates that this property can be adequately served with City services. There were no questions from the Council. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the Plan of Services and annexation of approximately 1.94 acres along Florence Road and Alexandria Drive. Mr. Jeff Wruck, 7102 Polk Drive, lives directly across from subject property and addressed the traffic issues, frequency of train passing through and blocking intersection, and odors generated from the mulching facility. Several neighbors have indicated, if this annexation is approved, they will be moving out of the area. He felt the proposed development will only increase traffic and was opposed to the annexation. There were no others present who wished to speak for or against the proposed Plan of Services and annexation and, after ample time had been given, Mayor McFarland declared the public hearing closed. The following RESOLUTION 17-R-PS-23 was read to the Council and offered for adoption upon motion made by Vice-Mayor Scales Harris, seconded by Mr. Shacklett. The following RESOLUTION 17-R-A-23 was read to the Council and offered for adoption upon motion made by Mr. Smotherman, seconded by Vice-Mayor Scales Harris. Mr. Donald Anthony presented the recommendations of the Planning Commission to approve the applicant’s request for Commercial Fringe (CF) District, simultaneous with annexation, for approximately 1.36 acres along Florence Road and Alexandria Drive. The Commercial Fringe (CF) District allows uses such as gas stations, retail shops, offices and restaurants by right but does not allow the more intensive uses as allowed in Highway Commercial (CH) District such as automotive repair and vehicle sales. Zoning districts adjacent to subject property include Highway Commercial (CH) District, Heavy Industrial (H-I) District and Light Industrial (L-I) District on the south and Highway Commercial (CH) District on the east. Adjacent properties to the north and west lie within the unincorporated County and are zoned Medium Density Residential. It was noted that, while this property is located adjacent to the Florence Fields Subdivision and looks like it should be a part of the Florence Fields Subdivision, staff’s research indicates that this lot is independent of that subdivision and has not been part of that subdivision in the past. The Murfreesboro 2035 Plan, not yet approved, is somewhat ambiguous as it shows that the property is vacant or undeveloped which appears to be more of a reflection of its current state than any plan for future use. The applicant was present. There were no comments or questions from the Council. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed zoning of approximately 1.36 acres along Florence Road and Alexandria Drive to Commercial Fringe (CF) District. Mr. Jeff Wruck, 7102 Polk Drive, noted that the property is not accessible to Florence Road and that any and all traffic would use Alexandria Drive which would be at the end of his driveway. Mr. Tony Malana (address not stated) said he and his family own the property adjacent to subject property and are in favor of the proposed development because, as the land currently sits now, it is a target for dumping, trash blows on their property, and the lower lying areas hold water creating issues with rodents, mosquitos and bugs. He has a background in real estate appraisal and the highest and best use of this property is not residential by any means. Being developed commercial would be more beneficial in the long-run. Mr. Chris Bratcher, owner and applicant, stated that he has owned the property for 13 years and tried to market it as residential with no success. It is located on a busy corner June 22, 2017 Page 12 and surrounded by industrial and commercial highway uses and felt commercial zoning would be the best and highest use for this property. There were no others present who wished to speak for or against the proposed zoning of an area along Florence Road and Alexandria Drive and, after ample time had been given, Mayor McFarland declared the public hearing closed. The Assistant City Engineer addressed the intersection of CSX railroad and its proximity to NW Broad Street and the City’s efforts to systematically address CSX with the City’s new road projects and the 2 or 3 new crossings in town that are grade separation crossings which are not impacted by the railroad track. The proposed Major Thoroughfare Plan takes a serious look at CSX and where the roads interact with CSX. While there are not short term solutions to this particular issue, there are some global solutions that would help this area if they can be implemented in the near future. To address the issue of the property being accessible from Florence Road, the applicant has not turned in a site plan to-date, but the access plan will be scrutinized very carefully during that process. There are some issues that would affect access regarding how sewer would be served and how the property would be graded. An ordinance, entitled “ORDINANCE 17-OZ-23 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now in force and effect to zone approximately 1.36 acres along Florence Road and Alexandria Drive as Commercial Fringe (CF) District, simultaneous with annexation; Chris Bratcher, applicant [2017-408],” was read to the Council and offered for passage on first reading upon motion made by Mr. Smotherman, seconded by Mr. Wade. Vice-Mayor Scales Harris requested that a future ballfield have the Caldwell name reinstated. Years ago, the family was in route to Murfreesboro from Paducah, Kentucky when a fatal accident occurred killing 3 of the 5 children instantly. A softball field was named at the Murfreesboro Airport in memory of them but some years later was removed. June 22, 2017 Page 13 A surviving daughter brought to her attention that her parents died with the memory that a park was named after their children, and she asked that this request be considered for a future park facility. Mr. Shacklett made a motion to accept the recommendation of the Parks & Recreation Director to approve the Public Parks, Parklands and Park Facilities Naming Policy. Vice-Mayor Scales Harris seconded the motion and all members of the Council present voted “Aye”. The Deputy Fire & Rescue Chief presented the following letter of recommendations from the Fire & Rescue Chief to the Council: (Insert letter dated June 22, 2017 here with regards to Roof Replacement Package at Guaranteed Maximum Price for Doug Young Public Training Facility.) Mr. Shacklett made a motion to accept the recommendation of the Fire & Rescue Chief to approve the roof replacement package at Guaranteed Maximum Price in the amount of $129,366.00, funded from previous allocated CIP Funds, for the Doug Young Public Training Facility. Mr. Wade seconded the motion and all members of the Council present voted “Aye”. The City Recorder/Finance Director presented the following letter of recommendations from the City Schools Assistant Superintendent to the Council: (Insert letter dated June 15, 2017 here with regards to purchase from Wrightcore, Inc. for network switches, wireless access points and Voice Over IP at the Black Fox School addition.) Vice-Mayor Scales Harris made a motion to accept the recommendation of the City Schools Assistant Superintendent to waive the bid process and approve Wrightcore, Inc. for the purchase of network switches, wireless access points and Voice-Over IP from GSA Contracts, in the amount of $98,425.41 (34,641.46-hardware & $63,783.95-Voice Over IP), funded from bond funds shared from Rutherford County. Mr. Shacklett seconded the motion and all members of the Council present voted “Aye”. The following letter of recommendations from the City Recorder/Finance Director was presented to the Council: (Insert letter dated June 19, 2017 here with regards to Federal Grant Internal Controls Policy.) Mr. Wade made a motion to accept the recommendation of the City Recorder/Finance Director and approve the Federal Grant Internal Controls Policy. Mr. Shacklett seconded the motion and all members of the Council present voted “Aye”. The following RESOLUTION 17-R-18 was read to the Council and offered for adoption upon motion made by Vice-Mayor Scales Harris, seconded by Mr. Wade. Upon recommendation of the Mayor McFarland, Mr. Smotherman made a motion to appoint Mr. Gary Whitlow for a three-year term to replace Ms. Addie Sue Webb on the Urban Environmental Commission with term ending 6/30/2020. Mr. Wade seconded the motion and all members of the Council present voted “Aye”. The City Recorder/Finance Director presented a Special Event Beer Application for Rutherford County Chamber of Commerce, 3050 Medical Center Parkway, for events to be held at Swanholme property, 4296 Franklin Road (07/11/17), and The Grove at Williamson Place, 3250 Wilkinson Pike (09/12/17). The application has met all of the requirements. Vice-Mayor Scales Harris made a motion to approve a Special Event Beer Permit for the Chamber of Commerce events at Swanholme property and The Grove at Williamson Place. Mr. Shacklett seconded the motion and all members of the Council present voted “Aye”. The City Recorder/Finance Director indicated there were no statements to be considered.
