August 17, 2017 The City Council of the City of Murfreesboro, Rutherford County, Tennessee, met in regular session at its regular meeting place in the Council Chambers at City Hall at 7:00 p.m. on Thursday, August 17, 2017, with Mayor Shane McFarland present and presiding and with the following Council Members present and in attendance, to wit: Madelyn Scales Harris Rick LaLance Bill Shacklett Eddie Smotherman Kirt Wade The following representatives of the City were also present: Robert J. Lyons, City Manager James Crumley, Assistant City Manager Jennifer Moody, Assistant City Manager Melissa Wright, City Recorder/Finance Director David Ives, Assistant City Attorney Donald Anthony, Principal Planner Karl Durr, Chief of Police Sam Huddleston, Assistant City Engineer Georgia A. Meshotto, Administrative Assistant City Council/City Recorder Council Member Eddie Smotherman commenced the meeting with a prayer followed by the Pledge of Allegiance. The Consent Agenda was presented to the Council for approval: 1) Letter of recommendations from the Transportation Director: Agreement No. 170095-Mercury Boulevard Transportation Alternative Program (TAP) Project with TDOT. 2) Letter of recommendations from the Community Development Grant Coordinator: Use of funds through the Affordable Housing Assistance Program for property located at 2011 Bartway Drive. 3) Letter of recommendations from the Fire & Rescue Chief: One-Year Extension of the Fire Suppression Contract with York Veterans Administration. 4) Letter of recommendations from the Chief of Police: A. Request to use Competitive Sealed Proposal Method of Procurement for PRI & Copper Line Telephony Services. B. Amendment to Tyler Technologies Contract for ERP Software Solution. August 17, 2017 Page 2 7) Request from International Folkloric Society Planning Council to hang a banner across East Main Street from June 8-18, 2018 to promote International Folkfest 2018. (Insert letters from the Transportation Director, Community Development Grant Coordinator, Fire & Rescue Chief, Chief of Police, City Manager and Information Technology Director here.) Mayor McFarland withdrew Items 2 and 4(L). He addressed Mr. Shacklett’s question regarding a 12% increase in the Agreement with Ramsey, Farrar & Bates in Item 5 which they indicated a significant amount of time was spent on legislative issues they monitored than in the previous year. The firm has also added the former Lieutenant Governor who is going to take on some things for the City. Mr. Shacklett made a motion to approve the Consent Agenda with the deletion of Items 2 and 4(L). Mr. Wade seconded the motion and all members of the Council voted “Aye”. Vice-Mayor Scales Harris made a motion to approve the minutes as written and presented for the regular meetings held on July 13, 2017 and July 20, 2017 and the special meetings held on July 27, 2017 (Franklin Synergy Bank Property); August 3, 2017 (2040 Major Transportation Plan) and August 3, 2017 (Public Comment). Mr. Wade seconded the motion and all members of the Council voted “Aye”. The following letter from the Assistant City Attorney was presented to the Council: (Insert letter dated August 14, 2017 here with regards to ORDINANCE 17-O-25, as amended.) An ordinance, entitled “ORDINANCE 17-O-25 amending Murfreesboro City Code Appendix A-Zoning, Section 9, Standards for Special Use Permits; Section 13, Planned Development Regulations; Section 14, Districts Established; Section 14A, Amenity Incentives for Multiple-Family Developments in the Multiple-Family Residential Districts; Section 19, Residential Districts; Section 24, Overlay District Regulations; Section 25, Temporary and Accessory Structures and Uses; Section 26, Off-Street Parking, Queuing, and Loading; Section 27, Landscaping and Screening; Chart 1, Uses Permitted by Zoning District; Chart 2, Minimum Lot Requirements, Minimum Yard Requirements, and Land Use Intensity Ratios; Chart 4, Required Off-Street Parking and Queuing Spaces by Use; Table 1, Adjacent and Proposed Zoning Districts; and Table 2, Buffer Zone Requirements; pertaining to single-family and multi-family housing; City of Murfreesboro Planning Department, applicant [2017-806],” which passed first reading on June 15, 2017, was read to the Council and offered for passage on second and final reading upon motion made by Mr. LaLance, seconded by Mr. Wade. Mayor McFarland announced that the next item on the agenda is to conduct a public hearing and consider for approval a Certificate of Compliance for Retail Liquor Store for Bina Patel, Manish Patel, Kinnari Patel, Jigna Patel and Dipakkumar Patel at Stones River Liquors, 208 North Thompson Lane. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the Certificate of Compliance come forward to the podium. There was no one present who wished to speak for or against the Certificate of Compliance and, after ample time had been given, Mayor McFarland declared the public hearing closed. Mr. LaLance made a motion to approve a Certificate of Compliance for Bina Patel, Manish Patel, Kinnari Patel, Jigna Patel and Dipakkumar Patel at Stones River Liquors, 208 North Thompson Lane. Mr. Wade seconded the motion and all members of the Council voted “Aye”. Mayor McFarland announced that the next item on the agenda is to conduct a public hearing, pursuant to RESOLUTION 17-R-PH-36 adopted by the City Council on July 13, 2017, to consider amending the Murfreesboro City Code, Appendix A-Zoning by repealing ORDINANCE 17-O-14 and replacing it with ORDINANCE 17-O-36; Planning Staff, applicant. Notice of said public hearing was published in the July 31, 2017 issue of a local newspaper as follows: (Insert notice here.) The following letter from the Assistant City Attorney was presented to the Council: (Insert letter dated August 17, 2017 here with regards to ORDINANCE 17-O-36 making certain clerical modifications to ORDINANCE 17-O-14 which amend Appendix A- Zoning, Sections 9 & 31, regarding cell towers, small cell and antennas and underground fiber optic cable.) Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed amendments to Appendix A-Zoning, Sections 9 & 31, regarding cell towers, small cell and antennas and underground fiber optic cable come forward to the podium. An ordinance, entitled “ORDINANCE 17-O-36 amending the Murfreesboro City Code, Appendix A-Zoning, Sections 9 and 31, regarding cell towers, small cell antennas, and underground fiber optic cable; Section 27 and Table 2, regarding landscaping, and Chart 1 and Chart 4, and repealing and replacing Ordinance 17-O-14,” was read to the Council and offered for passage on first reading upon motion made by Mr. Shacklett, seconded by Mr. Wade. Upon roll call said ordinance was passed on first reading by the following vote: Aye: Madelyn Scales Harris Rick LaLance Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None Mayor McFarland announced that the next item on the agenda is to conduct a public hearing, pursuant to RESOLUTION 17-R-PH-37 adopted by the City Council on July 20, 2017, to consider a proposed amendment to approximately 27.34 acres in the Planned Unit Development (PUD) District located along Lascassas Pike (Emerald Place PUD); Investment Partners, LLC, applicant [2017-418]. Notice of said public hearing was published in the July 31, 2017 issue of a local newspaper as follows: (Insert notice here.) Mr. Donald Anthony, Principal Planner, presented the favorable recommendation of the Planning Commission to approve the amendments to Emerald Place PUD (formerly known as Garrison Place) for both the entitlements and the Pattern Book. Subject property is located along the west side of Lascassas Pike and north of East Northfield Boulevard. The original PUD was approved in 2007 which included entitlements for mixed uses including commercial and residential. The PUD allowed 61 townhouses on 15.88 acres and the various commercial services on 11.5 acres. The applicant has requested amending the PUD by replacing commercial area “C” with 17 additional townhouses which will be located near the center of the PUD between the existing townhouses and existing and planned commercial structures to the east. The new townhouses would be accessed from the same private street that services the existing townhouses. The applicant was asked to install an emergency driveway and gate connecting to the commercial area to the west. Mr. Anthony recognized the presence of Mr. Jewell Hale and Mr. Bobby Kirby with Investment Partners, LLC. There were no questions from the Council. August 17, 2017 Page 5 Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed amendments to Emerald Place PUD come forward to the podium. Mr. Wayne Dugger, 2035 Herring Crossing in Rock Bridge Subdivision, said he was not present for or against the amendments but rather to provide information. The developer committed to installing a fence along the northern property boundary; HOA allowed to extend perimeter fencing as HOA funds are available; complete current phase of Rock Bridge Cove before any additional construction is started; secondary entrance provided for construction vehicles to enter and exit the site from Lascassas Pike; and improve the entire mailbox units with some type of weather protection over the current and proposed expanded mailboxes. Mr. Bobby Kirby, Investment Partners, LLC, clarified that the developer would install the additional mailboxes and HOA would add the cover over the mailboxes. There were no others present who wished to speak for or against the proposed amendments and, after ample time had been given, Mayor McFarland declared the public hearing closed. An ordinance, entitled “ORDINANCE 17-OZ-37 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now in force and effect, to amend the conditions applicable to approximately 27.34 acres in the Planned Unit Development (PUD) District located along Lascassas Pike (Emerald Place PUD), as indicated on the attached map; Investment Partners, LLC, applicant [2017-418],” was read to the Council and offered for passage on first reading upon motion made by Mr. Shacklett, seconded by Mr. LaLance. Upon roll call said ordinance was passed on first reading by the following vote: Aye: Madelyn Scales Harris Rick LaLance Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None Mayor McFarland announced that the next item on the agenda is to conduct a public hearing, pursuant to RESOLUTION 17-R-PH-38 adopted by the City Council on July 20, 2017, to consider a proposed amendment to approximately 46.2 acres in the Planned Residential Development (PRD) District located along Sulphur Springs Road (Estates at Primm Springs PRD, formerly Oakleigh Springs PRD); City of Murfreesboro Engineering August 17, 2017 Page 6 Department, applicant [2017-420]. Notice of said public hearing was published in the July31, 2017 issue of a local newspaper as follows: (Insert notice here.) Mr. Donald Anthony, Principal Planner, presented the unanimous recommendation of the Planning Commission to amend the Estates at Primm Springs PRD to allow for removal of a barricade along Satinwood Drive. Mr. Sam Huddleston, Assistant City Engineer, reported on permitting and development buildout and the request to amend the Pattern Book by removing the requirement that Satinwood Drive not be connected to the adjacent subdivision, Primm Springs, until the last phase reaches 75% buildout. The Fire & Rescue Chief reported on numerous issues with response time into this subdivision and numerous calls from residents regarding the access being blocked for emergency vehicles as well as other city resources and school buses. He recommended that the barricade be removed as it is impeding their access to the remainder of this subdivision, extends their response times into the subdivision and, more importantly, impacts public safety. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed amendment to the Estates at Primm Springs PRD come forward to the podium. Ms. Glenda Smart, 3012 Fallswood Drive, supported the removal of the barricade as soon as possible as they live behind the barricade, and there is heavy construction equipment remaining for the last phase of the neighborhood which could cause them to be trapped if emergency vehicles could not get down Satinwood and could not access them from Sulphur Springs Road even if the GPS directed them to the correct side. Mr. Brandon Smith, 1906 Satinwood Drive, said the barricade is in the middle of the 1800 block. They are not the only ones that the barricade inconveniences on the Primm Springs side as they only have one exit out of their subdivisions. Between the two subdivisions, there are over 100 people on both sides that, if something happened at the entrance to their subdivision, they would affectively be trapped. He felt a second exit should be allowed for both sides prior to final paving of that road. Ms. Crystal Wesley, 1914 Satinwood Drive, addressed the safety issues, especially when there is an accident, and there is no way out of the subdivision. There were no others present who wished to speak for or against the proposed amendment to the Estates at Primm Springs PRD and, after ample time had been given, Mayor McFarland declared the public hearing closed. An ordinance, entitled “ORDINANCE 17-OZ-38 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now August 17, 2017 Page 7 in force and effect, to amend the conditions applicable to approximately 46.2 acres in the Planned Residential Development (PRD) District located along Sulphur Springs Road (Estates at Primm Springs PRD/formerly Oakleigh Springs PRD), as indicated on the attached map; City of Murfreesboro Engineering Department, applicant [2017-420],” was read to the Council and offered for passage on first reading upon motion made by Mr. Smotherman, seconded by Mr. LaLance. Upon roll call said ordinance was passed on first reading by the following vote: Aye: Madelyn Scales Harris Rick LaLance Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None Mayor McFarland announced that the next item on the agenda is to conduct a public hearing, pursuant to RESOLUTION 17-R-PH-39 adopted by the City Council on July 20, 2017, to consider amending Murfreesboro City Code, Appendix A-Zoning, Section 2, Interpretations and Definitions; Section 7, Site Plan Review; and Section 26, Off-Street Parking, Queuing, and Loading, pertaining to pavement materials and site plan review; Murfreesboro Planning Department, applicant [2017-808]. Notice of said public hearing was published in the July 31, 2017 issue of a local newspaper as follows: (Insert notice here.) Mr. Donald Anthony, Principal Planner, presented Planning Commission’s unanimous approval to amend Appendix A-Zoning Section 2, 7, & 26. The proposed revision includes three components: 1) Clarify types of pavement materials that are allowed in the City of Murfreesboro: 2) Allow Planning Director to require Planning Commission review and approval for certain site plans that would otherwise qualify for administrative review; and 3) Clarify the authority of decision-making bodies in the site plan review and approval process. There were no questions from the Council. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed amendments to Appendix A-Zoning, Sections 2, 7, and 26 come forward to the podium. An ordinance, entitled “ORDINANCE 17-O-39 amending Murfreesboro City Code, Appendix A-Zoning, Section 2, Interpretations and Definitions, Section 7, Site Plan Review, and Section 26, Off-Street Parking, Queuing, and Loading, pertaining to pavement materials August 17, 2017 Page 8 and site plan review; Murfreesboro Planning Department, applicant [2017-808],” was read to the Council and offered for passage on first reading upon motion made by Mr. LaLance, seconded by Mr. Wade. The following RESOLUTION 17-R-22 was read to the Council and offered for adoption upon motion made by Mr. Shacklett, seconded by Mr. Wade. The following letter of recommendations from the Chief of Police was presented to the Council: (Insert letter dated August 17, 2017 here with regards to application for FY 2017 Justice Assistance Grant (JAG) and enter in an Interlocal Agreement with the Rutherford County Sheriff’s Office to share the funds.) The following RESOLUTION 17-R-23 was read to the Council and offered for adoption upon motion made by Vice-Mayor Scales Harris, seconded by Mr. Wade. Upon roll call said resolution was adopted by the following vote: Aye: Madelyn Scales Harris Rick LaLance Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland August 17, 2017 Page 11 Nay: None (Insert RESOLUTION 17-R-23 here authorizing application for the FY 2017 Edward Byrne Memorial Justice Assistance Grant (JAG) Program Award for 2016-2020, designating a representative for such grant and approving entry into an Interlocal Agreement between Rutherford County and the City of Murfreesboro, Tennessee for the FY 2017 Edward Byrne Memorial Justice Assistance Grant (JAG) Program Award in the amount of $59,821.00.) The following letter of recommendations from the Assistant City Attorney was presented to the Council: (Insert letter dated August 11, 2017 here with regards to proposed waterline easement to CUD.) Mr. LaLance made a motion to accept the recommendation of the Assistant City Attorney and approve a waterline easement to Consolidated Utility District (CUD) of Rutherford County. Mr. Shacklett seconded the motion and all members of the Council voted “Aye”. The City Recorder/Finance Director presented a Special Event Beer Application for Freedom Farm Animal Sanctuary for events to be held at 1660 Middle Tennessee Boulevard on August 19, 2017 and at Oakland Park on August 26, 2017. A Special Event Beer Application was also presented for Earth Experience Museum for an event to be held on November 5, 2017 at 816 Old Salem Road. These applications are in order. Beer Permit Applications were presented for Quick Stop (ownership/name change), 1411 S. Church Street and Champy’s Chicken (ownership/name change), 1310 NW Broad Street. These applications are pending approval of building and codes inspections. Mr. Wade made a motion to approve a Special Event Beer Permit for Freedom Farm Animal Sanctuary and Earth Experience Museum and Beer Permits for Quick Stop and Champy’s Chicken upon successful completion of all building and codes inspections. Vice- Mayor Scales Harris seconded the motion and all members of the Council voted “Aye”. Mayor McFarland did not have any appointments to consider. The City Manager and City Recorder/Finance Director presented the following statement with the recommendation that it be approved: From TMBF/Bond Fund: Mid-South Bus Center $ 24,500.00 Mr. Smotherman made a motion to approve payment of the statement as recommended by the City Manager and City Recorder/Finance Director. Mr. Shacklett seconded the motion and all members of the Council voted “Aye”. Mayor McFarland reminded everyone of the eclipse event on Monday, August 21, 2017 from 1:20 p.m. to 1:40 p.m. August 17, 2017 Page 12 Under other business, the following letter of recommendations from the Parks & Recreation Director was presented to the Council: (Insert letter dated August 17, 2017 here with regards to Reimbursement Resolution 17-R-24 for design and construction of West Park.) The following RESOLUTION 17-R-24 was read to the Council and offered for adoption upon motion made by Vice-Mayor Scales Harris, seconded by Mr. LaLance. Upon roll call said resolution was adopted by the following vote: Aye: Madelyn Scales Harris Rick LaLance Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None (Insert RESOLUTION 17-R-24 here expressing official intent that certain expenditures to be incurred in connection with certain public works projects, and related expenditures for professional services for concept development, design development, final design, permitting, construction drawings, bid documentation and construction phases services for West Park, located at Burnt Knob Road and Veterans Pkwy, be reimbursed from proceeds of notes, Bonds, or other indebtedness to be issued or incurred by the City of Murfreesboro, Tennessee.) Vice-Mayor Scales Harris extended birthday wishes to the City Manager.
