October 12, 2017 The City Council of the City of Murfreesboro, Rutherford County, Tennessee, met in regular session at its regular meeting place in the Council Chambers at City Hall at 7:00 p.m. on Thursday, October 12, 2017, with Mayor Shane McFarland present and presiding and with the following Council Members present and in attendance, to wit: Madelyn Scales Harris Rick LaLance Bill Shacklett Eddie Smotherman Kirt Wade The following representatives of the City were also present: Robert J. Lyons, City Manager James Crumley, Assistant City Manager Jennifer Moody, Assistant City Manager Craig Tindall, City Attorney David Ives, Assistant City Attorney Erin Tucker, Assistant Finance Director Gary Whitaker, Planning Director Matthew Blomeley, Assistant Planning Director Ram Balachandran, Assistant Transportation Director/ Traffic Engineer Sam Huddleston, Assistant City Engineer Paul Boyer, Purchasing Director Georgia A. Meshotto, Administrative Assistant City Council/City Recorder Vice-Mayor Madelyn Scales Harris commenced the meeting with a prayer followed by the Pledge of Allegiance. Mayor McFarland read the following statement on behalf of the City Council to address a serious matter confronting the community: “As Mayor of Murfreesboro and on behalf of the City Council, we want to condemn in no uncertain terms the ideology of white nationalists and white supremacists who are planning to bring their ideas to Murfreesboro. As Mayor of the fastest growing City in the State of Tennessee and one of the fastest growing in the nation and home to the largest undergraduate university in the State of Tennessee, we are proud of the community we are building and the diversity of our residents who live here. We stand and work together every day to represent all residents in this community. We stand together to make sure every person in this City has an equal opportunity to do the things that Murfreesboro has to offer. We realize there is much discussion about the potential rally in our City and I want you to know this...the City of Murfreesboro and this Council are committed to protecting the Constitutional Rights we have taken an oath to uphold and to the peace and to the public safety of our City. Be assured that we will take every step necessary to protect both.” Mayor McFarland stepped down to the podium to present a Proclamation to Kristen Perry, 2017 Miss MTSU, for her community service in special school events to promote reading, music, art and preventing substance abuse; serving as an emcee, speaker, etc. in October 12, 2017 Page 2 charitable events and civic group meetings; and appearances at community events such as Oaklands, MTSU or to represent MTSU and Murfreesboro at events in Metropolitan Nashville area. Miss Kristen introduced her parents and friends attending this presentation. Mayor McFarland recognized members of Leadership Rutherford present. The Consent Agenda was presented to the Council for approval: 1) Letter of recommendations from the Chief of Police: Request to trade confiscated weapons for store credit. 2) Letter of recommendations from the Transportation Director: Purchase of traffic signal equipment for signalization of Medical Center Parkway and Gateway Boulevard. 3) Letter of recommendations from the Community Development Director: A. Emergency Rehab: 5077 Cornelius Drive. B. Emergency Solutions Grant: Supplemental Allocation for 2017-18. 4) Letter of recommendations from the Building & Codes Director: Change position of Building Inspector to Electrical Inspector. 5) Letter of recommendations from the City Recorder/Finance Director: Acknowledgement of Receipt of City Manager’s approved Budget Amendments for Fiscal Year 2018. 6) Request from Murfreesboro Parks & Recreation Department to hang a banner across East Main Street from August 31-September 10, 2018 to promote the Greenway Art Festival in September. (Insert letters from the Chief of Police, Transportation Director, Community Development Director, Building & Codes Director and City Recorder/Finance Director here.) Mr. Shacklett made a motion to approve the Consent Agenda in its entirety. Vice- Mayor Scales Harris seconded the motion and all members of the Council voted “Aye”. The minutes for the regular meeting of September 28, 2017 was presented to Council for approval. Mayor McFarland noted a correction in the term ending of Mr. Scott Uselton to expire on June 1, 2020 instead of June 1, 2019. Vice-Mayor Scales Harris made a motion to approve the minutes as amended for the regular meeting held on September 28, 2017. Mr. Shacklett seconded the motion and all members of the Council voted “Aye”. The following letter from the Assistant Planning Director was presented to the Council: (Insert letter dated October 3, 2017 here with regards to ORDINANCE 17-OZ-33.) An ordinance, entitled “ORDINANCE 17-OZ-33 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now in force and effect, to rezone approximately 43.2 acres along Veterans Parkway and Vaughn Road from Single-Family Residential Fifteen (RS-15) District to Highway Commercial (CH) District; Joy Pratt Hord, et.al., applicants [2017-410],” which passed first reading on September 28, 2017, was read to the Council and offered for passage on second and final October 12, 2017 Page 3 reading upon motion made by Mr. LaLance, seconded by Mr. Wade. Mr. Shacklett suggested that staff monitor the intersection at Highfield Drive and Shelbyville Pike as development proceeds and continue to look for other avenues to address the current congestion. An ordinance, entitled “ORDINANCE 17-OZ-41 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now October 12, 2017 Page 4 in force and effect, to rezone approximately 24.15 acres along Shelbyville Pike and Joe B. The following letter from the City Recorder/Finance Director was presented to the Council: (Insert letter dated October 9, 2017 here with regards to ORDINANCE 17-O-52.) An ordinance, entitled “ORDINANCE 17-O-52 amending the 2017-2018 Budget (1st Amendment)”, was read to the Council and offered for passage on first reading upon motion made by Mr. LaLance, seconded by Mr. Shacklett. Upon roll call said ordinance was passed on first reading by the following vote: Aye: Madelyn Scales Harris October 12, 2017 Page 6 Rick LaLance Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None Mayor McFarland announced that the next item on the agenda is to conduct a public hearing, pursuant to RESOLUTION 17-R-PH-46 adopted by the City Council on August 31, 2017, to consider (1) adoption of a Plan of Services for and annexation of approximately 107.6 acres and (2) zoning of approximately 107.6 acres along Yeargan Road to Planned Residential Development (PRD) District (Magnolia Grove PRD) which have been proposed to be annexed to the City of Murfreesboro, Tennessee; Mary Lou Dodson and TVLP Management, LLC, applicants [2017-509 & 2017-419]. Notice of said public hearing was published in the September 25, 2017 issue of a local newspaper as follows: (Insert notice here.) The Assistant Planning Director presented the recommendation of the Planning Commission to annex subject property located along the north side of Yeargan Road and directly to the south of the Westwind Subdivision and Veterans Parkway. Plan of Services indicates services can be provided to subject property upon annexation; however, there is an existing house on the north side of Yeargan Road, and the water line is not large enough to provide the City’s ISO Class 2 fire protection to this structure. The Plan of Services states that the existing house would have to be demolished before the annexation can be effected. Staff has been notified by the applicant this date that the house is now vacant and will be demolished prior to second reading if the zoning passes first reading. The property will be served as it develops beginning at the north end by Westwind Subdivision. Utilities will be extended from Westwind into this property. Planning Commission conducted a public hearing on July 12, 2017 and voted unanimously, with one abstention, to recommend approving this annexation. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed annexation and Plan of Services for approximately 107.6 acres located along Yeargan Road come forward to the podium. Mr. Mark Bradley, 4035 Yeargan Road, addressed the negative traffic impacts that would be created by the proposed 300-home development. To-date there have been no revisions made to the proposal to address the looming significant traffic increases on Yeargan Road and surrounding thoroughfares. He provided a handout that included a multitude of issues that other community members wanted to address. October 12, 2017 Page 7 Ms. Pat Sanders, 2568 Armstrong Valley Road, addressed water retention issues on subject property she had witnessed for 54 years. She spoke for Ms. Connie Yeargan McGhee who is 94 and could not be present but would be directly impacted by this development and had concerns regarding traffic and drainage. Ms. Sanders requested that the hydrology be looked at before Council approves this request. Ms. Kym Bradley, 4035 Yeargan Road, addressed housing density; traffic congestion; surface runoff; road wear and tear; and the aesthetics of the community. She presented a handout which included pictures of the neighborhood as well as a petition of signatures. There were no others present who wished to speak for or against the proposed annexation and Plan of Services and, after ample time had been given, Mayor McFarland declared the public hearing closed. The following RESOLUTION 17-R-PS-46 was read to the Council and offered for adoption upon motion made by Mr. LaLance, seconded by Mr. Wade. The following RESOLUTION 17-R-A-46 was read to the Council and offered for adoption upon motion made by Mr. LaLance, seconded by Mr. Wade. Mayor McFarland announced that the next item on the agenda is to conduct a public hearing to consider zoning approximately 107.6 acres along Yeargan Road to Planned Residential Development (PRD) District, simultaneous with annexation, (Magnolia Grove PRD); TVLP Management, LLC, applicant [2017-410]. The Assistant Planning Director presented the applicant’s zoning request for Planned Residential Development (PRD) District which was presented to Planning Commission on October 12, 2017 Page 8 July 12, 2017 and for which a public hearing was conducted and deferred so that a neighborhood meeting could be held. Following that meeting, the applicant made some changes to the Pattern Book which were brought back to the Planning Commission on August 16, 2017 and, at that time, the Planning Commission voted unanimously to approve with two abstentions. The Murfreesboro 2035 Comprehensive Future Land Use Map recommends that the northern area of this property be developed as “Auto Urban Residential” which is a density of 3.5 to 8 units per acre, and the southern half, closer to Yeargan Road, is recommended for “Suburban Residential” which is a density of up to 3.5 dwelling units per acre. The proposed density is 2.86 dwelling units per acre which takes into account the entire property, open spaces, detention areas, and amenity centers. The total acreage is then divided by the number of proposed units which equals 2.86 dwelling units per acre. The request, density-wise, is lower but generally consistent with the recommendations of the Murfreesboro 2035 Comprehensive Plan. Mr. Matt Taylor, SEC, Inc., accompanied by Mr. Darrell Hon, TVLP Management, LLC, Mr. Rob Molchan, Landscape Architect with SEC, Inc. and Mr. Roger Haley, Consultant on project, oriented those present to subject property and the proposed Magnolia Grove PRD. He gave a summary of the revisions to the Concept Plan and Rezoning Booklet for the proposed development. Mr. Taylor addressed questions from the Council regarding density, transition, aesthetics, setback variances, property values, standing water and inadequate sized pipes. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed zoning of approximately 107.6 acres along Yeargan Road to Planned Residential Development (PRD) District, simultaneous with annexation, (Magnolia Grove PRD), come forward to the podium. Mr. Mark Bradley, 4035 Yeargan Road, addressed his previous comments and asked that they be carried over to the zoning discussion. He additionally addressed the widening of the road along the frontage of subject property to address turn lanes for efficient in and out of the neighborhood; however, he did not feel it improved the overall situation with the high level of traffic. The community did not view the proposed round-about as an improvement; the 50’ buffer needs to be higher; early phases of development are going to start right in front of their neighborhoods instead of what was originally proposed to start far away from the residents; they did not see how property values would be improved; and they wanted to see an official hydrology report that documents what water does. Ms. Kym Bradley, 4035 Yeargan Road, addressed the changes requested by the community but not considered by the developer regarding less density; no entrances on October 12, 2017 Page 9 Yeargan Road; no construction traffic; requests for hydrology reports; Armstrong Valley/Yeargan Roads not prepared for current traffic much less new development; property values affected by zero lot-line development; flooding that occurs causing backup of traffic when there are heaving rains. Mr. Zack Brown, 3934 Ashley Drive, addressed the watershed impact to their area and the request for a comprehensive hydrology analysis as to the designs of the detention ponds and surface runoff. Before this proposal is considered, residents must be able to review these reports because of the direct proximity to their residents and have an appropriate assurance that there is not going to be a negative impact. Ms. Mary DeVault, 4020 Yeargan Road, addressed the flooding and runoff issues on Armstrong Valley Road, Yeargan Road and Thompson Road that currently exist and what plan has been put in place to handle safety issues and road closures due to high water. Ms. Linda White, 4121 Yeargan Road, asked Council to consider the future and beauty of Rutherford County and not soak it up with 300 homes. Ms. Pat Campbell, 3927 Yeargan Road, requested that the phasing begin at the other end of the property instead of the residential end. She also requested that construction trucks not be allowed to use Yeargan Road as an entrance into the development. Ms. Brenda Harold, 2432 Armstrong Valley Road, addressed her family, some of which are special needs children, who enjoy the peaceful area in which they live. The increased traffic from this development will change this peaceful atmosphere. Mr. Bill Gracey, 4156 Yeargan Road, addressed his concerns with this development and increased runoff water issues on his property. Ms. Pat Sanders, 2568 Armstrong Valley Road, addressed her concerns with the proposed detention ponds filling up and where the excess water will go. Mr. Donald White, 4121 Yeargan Road, addressed road construction keeping up with growth. Ms. Glenda Cox, 4100 Michelle Street, stated this area is crawfish land and had concerns with flooding the nearby cemetery and graves that have been there for years. Ms. Doris Martin, 4028 Ashley Drive, addressed construction and blasting and how it will affect the graves in this cemetery as well as their homes. She asked Council to consider the voices they have heard tonight and how this proposed development will change the dynamics of their neighborhoods that are very dear to their hearts. There were no others present who wished to speak for or against the proposed zoning along Yeargan Road and, after ample time had been given, Mayor McFarland declared the public hearing closed. October 12, 2017 Page 10 An ordinance, entitled “ORDINANCE 17-OZ-46 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now in force and effect to zone approximately 107.6 acres along Yeargan Road as Planned Residential Development (PRD) District simultaneous with annexation; TVLP Management, LLC, applicant [2017-419],” was read to the Council and offered for passage on first reading. The Assistant City Engineer addressed the issues heard in the public hearing regarding wetland features of subject property and Stormwater Management Guidelines. The hydrology report would be provided at the time of site plan review. Mr. Taylor and staff responded to those comments made regarding grave site, traffic, Phase I, construction traffic and density. He also noted that demolition of the house on subject property will require an asbestos report. Mr. Shacklett made a motion to defer first reading until the asbestos removal report and the hydrology report have been received. Vice-Mayor Scales Harris seconded the motion. Upon roll call, deferral of said ordinance failed by Vice-Mayor Scales Harris and Mr. Shacklett voting “Aye” and Mr. LaLance, Mr. Smotherman, Mr. Wade and Mayor McFarland voting “Nay”. Mr. LaLance made a motion to pass ORDINANCE 17-OZ-46 on first reading, contingent on hydrology and demolition reports. Mr. Wade seconded the motion. Vice-Mayor Scales Harris made a motion to accept the recommendation of the Purchasing Director to approve a Professional Services Agreement with Davita Taylor in an amount “not to exceed” $17,000.00 for the creation of a Small Business Attraction and Retention Program. Mr. Wade seconded the motion and all members of the Council voted “Aye”. Upon recommendation of Mayor McFarland, Mr. Smotherman made a motion to appoint Mr. Charles Apigian to fulfill the term of Mr. Stephen Shirley on the Parks & Recreation Commission with term ending June 30, 2018. Mr. Wade seconded the motion and all members of the Council voted “Aye”. The Assistant Finance Director presented the following Beer Permit Applications pending completion of all required building and codes inspections: A Plus #41077 H (ownership/name change), 1118 Mercury Boulevard; A Plus #41075 H (ownership/name change), 1209 Fortress Boulevard; A Plus #41058 H (ownership/name change), 4106 Franklin Road; A Plus #41064 H (ownership/name change), 3208 Shelbyville Highway; Tiger Market #41076 H (ownership/name change), 2020 Church Street; Tiger Market #41078 H (ownership/name change), 1849 E. Northfield Boulevard; and Tiger Market #41046 H (ownership/name change), 2464 New Salem Highway. Mr. Wade made a motion to approve Beer Permits for the A Plus and Tiger Market locations pending successful completion of all building and codes inspections. Mr. Shacklett seconded the motion and all members of the Council voted “Aye” The following statement was presented to the Council with the recommendation of the City Manager and Assistant Finance Director their payment be approved: From TMBF/Bond Fund: Mid-South Bus Center $ 74,455.57 Mr. Wade made a motion to approve payment of the statement as recommended by the City Manager and Assistant Finance Director. Mr. Smotherman seconded the motion and all members of the Council voted “Aye”. Mayor McFarland announced that the unveiling of the 1892 Steam Fire Engine recently restored would be held on Wednesday, October 25, 2017, at 2:00 p.m. at Oaklands Mansion. Mayor McFarland stepped out at this time. Vice-Mayor Scales Harris took the chair. October 12, 2017 Page 13 Under other business, the following letter from Mr. Jim Crumley, Assistant City Manager, was presented to the Council: (Insert letter dated October 11, 2017 here with regards to purchase of 3.48 acres of City-owned real estate on Lyle McDonald Court.) Mr. Crumley mentioned that this recommendation was presented and approved unanimously by the Gateway Commission. Mr. Shacklett made a motion to accept the recommendation of Mr. Crumley to approve the sale of 3.48 acres of City-owned property separated from the main West Park site by I-840 to Mr. Donald McDonald for a purchase price of $40,000.00 per acre, subject to final legal documentation. Mr. LaLance seconded the motion and all members of the Council voted “Aye” except Mayor McFarland who was not present. Mayor McFarland resumed the chair at this time. Mr. Crumley mentioned that this recommendation was presented and approved unanimously by the Gateway Commission. Mr. Shacklett made a motion to accept the recommendation of Mr. Crumley to approve the sale of 1.6 acres of City-owned property at 1334 Medical Center Parkway to One Nine Investments MCP, LP for an estimated sale price of $331,000.00, subject to final legal documentation. Mr. LaLance seconded the motion and all members of the Council voted “Aye”.
