September 6, 2018 The City Council of the City of Murfreesboro, Rutherford County, Tennessee, met in regular session at its regular meeting place in the Council Chambers at City Hall at 7:00 p.m. on Thursday, September 6, 2018, with Mayor Shane McFarland present and presiding and with the following Council Members present and in attendance, to wit: Madelyn Scales Harris Rick LaLance Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade The following representatives of the City were also present: Craig Tindall, City Manager James Crumley, Assistant City Manager Adam Tucker, Interim City Attorney David Ives, Deputy City Attorney Melissa Wright, City Recorder/Finance Director Donald Anthony, Planning Director Matthew Blomeley, Assistant Planning Director Gary Whitaker, Assistant City Manager/ Economic Development Russ Brashear, Assistant Transportation Director Mark Foulks, Fire & Rescue Chief Sam Huddleston, Executive Director/ Development Services Georgia A. Meshotto, Administrative Assistant City Council/City Recorder Council Member Eddie Smotherman commenced the meeting with a prayer followed by the Pledge of Allegiance. The City Recorder/Finance Director reported that the Certification and Election Summary Report was received on August 13, 2018 from the Rutherford County Election Commission. The Certification, Election Summary Report and Oath of Office administered this date, September 6, 2018, by Judge Toby Gilley to the elected City Council and Mayor is to be spread on the minutes of this meeting, September 6, 2018. (Insert Oath of Office and Certification of Election here.) Mayor McFarland addressed Item 3 under the Consent Agenda for the Affordable Housing Program. A Habitat for Humanity home was built at 410 Douglas Avenue by the Murfreesboro and Rutherford County Emergency Service Providers for Ms. Baker and her son. This was Ms. Baker’s first home which she always wanted to own by the time she was 30 years old, and she will be 30 in January 2019. The Consent Agenda was presented to the Council for approval: 1. Subrecipient Agreement - H3ARC (Community Development). 2. Housing Rehabilitation: 1811 Foxdale Drive (Community Development). 3. (Insert letters from Community Development and Water Resources here.) Mr. LaLance made a motion to approve the Consent Agenda in its entirety. Mr. Wade seconded the motion and all members of the Council voted “Aye”. Mr. Wade made a motion to approve the minutes as written and presented for the regular meeting held on August 8, 2018; special meeting held on August 15, 2018; and regular meetings held on August 16, 2018 and August 23, 2018. Mr. Shacklett seconded the motion and all members of the Council voted “Aye”. An ordinance, entitled “ORDINANCE 18-OZ-44 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now in force and effect, to rezone approximately 0.17 acres along North Church Street and Olive Street from Residential Multi-Family Twelve (RM-12) District to Planned Residential Development (PRD) District (The Flats at Olive Street); Shane McFarland Construction, LLC, applicant [2018-418],” which passed first reading on August 23, 2018, was read to the Council and offered for passage on second and final reading upon motion made by Mr. LaLance, seconded by Mr. Wade. Upon roll call said ordinance was passed on second and final reading by the following vote: Aye: Madelyn Scales Harris Rick LaLance Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Abstain: Shane McFarland Nay: None Said ordinance so passed on second and final reading is as follows: (Insert ORDINANCE 18-OZ-44 here.)  September 6, 2018 Page 3 An ordinance, entitled “ORDINANCE 18-OZ-46 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now in force and effect, to amend the conditions applicable to approximately 5.02 acres in the Planned Residential Development (PRD) District (Sunset Ridge PRD) located along Wamingfield Drive; O’Brien Loyd, LLC, applicant [2018-419],” which passed first reading on August 23, 2018, was read to the Council and offered for passage on second and final reading upon motion made by Mr. Shacklett, seconded by Mr. LaLance. Upon roll call said ordinance was passed on second and final reading by the following vote: Aye: Madelyn Scales Harris Rick LaLance Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None Said ordinance so passed on second and final reading is as follows: (Insert ORDINANCE 18-OZ-46 here.) The Fire & Rescue Chief, Mark Foulkes, reported that the Fire & Rescue Department received notice that they had been awarded a grant that was made application for a couple of months ago in the amount of $2.8 Million. This grant will fund 27 new firefighter positions for the department over the next three years. The first two years will be funded at 75% and 35% later. This will meet staffing requirements to comply with NFBA-1710 for structure fires as well as adequately respond to the needs of the community. The City Manager withdrew the IT agenda item for City Hall Access Control System Purchase and Installation. The following letter from the Planning Director was presented to the Council: (Insert letter dated September 6, 2018 here with regards to Mandatory Referral for Overhead Electric Easement south of Manson Pike [2018-717].) Mr. Shacklett made a motion to approve a Mandatory Referral for Overhead Electric Easement south of Manson Pike. Mr. Martin seconded the motion and all members of the Council voted “Aye”. The following letter from the Assistant Transportation Director was presented to the Council: (Insert letter dated September 6, 2018 here with regards to a Contract with TDOT for FY 2018 Preventive Maintenance Expenses.) Mr. Shacklett made a motion to approve Contract 75-5307-S3-025 with TDOT for FY 2018 Preventive Maintenance Expenses with a local match of $18,750.00. Vice-Mayor Scales Harris seconded the motion and all members of the Council voted “Aye”.  September 6, 2018 Page 4 The following letter from the Assistant City Manager, Economic Development, was presented to the Council: (Insert letter dated September 6, 2018 here with regards to Construction Contract for ADA Improvements to City Hall, Phase One.) Mr. Martin made a motion to approve a Construction Contract with Rice Construction for ADA Improvements to City Hall, Phase 1, in the amount of $195,206.00, funded from 2012 and 2016 General Obligation Bond Issues. Mr. LaLance seconded the motion and all members of the Council voted “Aye”. The City Recorder presented Beer Permit Applications for Minuteman Convenience Center (ownership change), 1509 Joe B. Jackson Parkway, Suite B, and Speedway 7101, 2624 S. Rutherford Boulevard (new location). Both applications are pending successful completion of all building and code requirements. A Special Event Beer Application was presented for Second Harvest Food Bank of Middle Tennessee, 331 Great Circle Road, with event to be held at The Avenue Murfreesboro, 2615 Medical Center Parkway, Courtyard next to Talbots, on October 18, 2018. All requirements have been met and approval is requested for this application. Mr. Wade made a motion to approve a Beer Permit for Minuteman Convenience Center and Speedway 7101 upon successful completion of all building and code inspections and approve a Special Event Permit for Second Harvest Food Bank of Middle Tennessee. Mr. LaLance seconded the motion and all members of the Council voted “Aye”. Upon recommendation of Mayor McFarland, Mr. Smotherman made a motion to appoint Mr. Mark A. Pirtle to fulfill the term of Mr. Edward E. Miller, Jr. with term ending 05/03/2022 on the Murfreesboro Housing Authority and appoint Mr. Greg McKnight to fulfill the term of Mr. Ronnie Grimes (term ending 01/01/2022) and appoint Mr. John Jones to replace vacancy left by Mr. Warren Jackson (term ending 01/01/2024) on the Public Building Authority. Mr. LaLance seconded the motion and all members of the Council voted “Aye”. The City Recorder/Finance Director indicated there were no statements to be considered for payment. The City Manager reminded Council of the workshop on Wednesday, September 12, 2018, at 11:30 a.m.; Public Comment meeting on Thursday, September 20, 2018, at 6:30 p.m.; and regular Council meeting on Thursday, September 20, 2018, at 7:00 p.m. There being no further, Mayor McFarland adjourned this meeting at 7:16 p.m. SHANE MCFARLAND - MAYOR  September 6, 2018 Page 5 ATTEST: MELISSA B.
