January 31, 2019 The City Council of the City of Murfreesboro, Rutherford County, Tennessee, met in regular session at its regular meeting place in the Council Chambers at City Hall at 7:00 p.m. on Thursday, January 31, 2019, with Mayor Shane McFarland present and presiding and with the following Council Members present and in attendance, to wit: Madelyn Scales Harris Rick LaLance Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade The following representatives of the City were also present: Craig Tindall, City Manager Adam Tucker, City Attorney David Ives, Deputy City Attorney Melissa Wright, City Recorder/ Finance Director Gary Whitaker, Assistant City Manager Development and Coordination Darren Gore, Assistant City Manager Utility Enterprises Sam Huddleston, Executive Director Development Services Chris Griffith, Executive Director Public Works/City Engineer Greg McKnight, Development Projects Director Erin Tucker, Budget Director Donald Anthony, Planning Director Matthew Blomeley, Assistant Planning Director Mr. LaLance commenced the meeting with a prayer followed by the Pledge of Allegiance. Mr. LaLance made a motion to approve the Consent Agenda. Mr. Wade seconded the motion and all members of the Council voted “Aye”. An ordinance, entitled “ORDINANCE 19-O-01 amending the Murfreesboro City Code, Chapter 18 – Licenses and Ad Valorem Taxes, Section 18-81,” which passed first reading on January 17, 2019, was read to the Council and offered for passage on second and final reading, upon motion made by Mr. LaLance, seconded by Mr. Shacklett. The following letter from the Planning Department was presented to the Council by the Planning Director: (Insert letter dated January 30, 2019 here with regards to Plan of Services, Annexation, and Zoning for 39.9 acres along Manson Court and Manson Pike [2017-514 & 420].) An ordinance, entitled “ORDINANCE 18-OZ-56 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now in force and effect to zone approximately 39.9 acres along Manson Pike and Manson Court as Planned Unit Development (PUD) District (Shelton Grove PUD), simultaneous with annexation; Crescent Homes, applicant [2018-420],” was read to the Council. Mr. Anthony explained changes made to the application since the November 1, 2018 public hearing which include: a swimming pool has been added to the amenity package; City trash collection services will be used for the single-family detached homes and a private collection service will be used for the townhouse units; a garage or no-garage option is being shifted to a garage or two-car garage option; and on-street parking is proposed for the swimming pool addition which would necessitate a change to the pattern book. Mr. Smotherman motioned for approval on first reading which was seconded by Mr. Wade. The City Recorder/Finance Director stated that this Certificate of Compliance for Gauttam Patel was a renewal of an existing location and that the State requires this renewal every two years. January 31, 2019 Page 5 Mr. Wade made a motion to approve renewal of a Retail Liquor Certificate of Compliance for Gauttam Patel at 96 Liquor & Wine, 2019A Lascassas Pike. Mr. Martin seconded the motion and all members of the Council voted “Aye”. The following letter from the Planning Director was presented to the Council: (Insert letter dated January 31, 2019 here with regards to Zoning Ordinance Amendment Pertaining to Multiple-Family Residential Uses in the MU Zoning District [2018-808].) Mayor McFarland announced that the next item on the agenda is to conduct a public hearing, pursuant to RESOLUTION 18-R-PH-76 adopted by the City Council on December 20, 2018, to consider amending Murfreesboro City Code Appendix A-Zoning, Chart 1 Endnotes, Uses Permitted by Zoning District, pertaining to multiple-family residential uses in the MU zoning district, City of Murfreesboro Planning Department, applicant [2018-808]. Notice of said public hearing was published in the January 15, 2019 issue of the local newspaper as follows: (Insert notice here.) Mr. Donald Anthony, Planning Director, explained how the ordinance changes would be applied and that the proposed changes were approved by the Planning Commission with a vote of 7-0. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed amendment to the Zoning Ordinance, come forward to the lectern. There was no one present who wished to speak for or against the proposed amendment and, after ample time had been given, Mayor McFarland declared the public hearing closed. An ordinance, entitled “ORDINANCE 18-O-76 amending Murfreesboro City Code Appendix A-Zoning, Chart 1 Endnotes, Uses Permitted by Zoning District, pertaining to multiple-family residential uses in the MU zoning district, City of Murfreesboro Planning Department, applicant [2018-808],” was read to the Council and offered for passage on first reading upon motion made by Mr. LaLance, seconded by Mr. Smotherman. The following RESOLUTION 19-R-04 was read to the Council and offered for adoption upon motion made by Mr. LaLance, seconded by Mr. Shacklett. The following letter from the Assistant Planning Director was presented to the Council: (Insert letter dated January 31, 2019 here with regards to amending zoning in the Sunset Ridge PRD along Sunray Drive [2018-436].) Mayor McFarland announced that the next item on the agenda is to conduct a public hearing, pursuant to RESOLUTION 18-R-PH-73 adopted by the City Council on December 20, 2018, to consider amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, to amend the conditions applicable to approximately 0.58 acres in the Sunset Ridge Planned Residential Development (PRD) District located along Sunray Drive; Chip Loyd, applicant [2018-436]. Notice of said public hearing was published in the January 15, 2019 issue of the local newspaper as follows: January 31, 2019 Page 7 (Insert notice here) Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed amendment to the Sunset Ridge PRD, come forward to the lectern. There was no one present who wished to speak for or against the proposed amendment and, after ample time had been given, Mayor McFarland declared the public hearing closed. Mr. Smotherman asked if the garage doors would be the pretty carriage style doors, and the developer, Mr. Chip Loyd, answered yes. An ordinance, entitled “ORDINANCE 18-OZ-73 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now in force and effect, to amend the conditions applicable to approximately 0.58 acres in the Sunset Ridge Planned Residential Development (PRD) District located along Sunray Drive as indicated on the attached map; Chip Loyd, applicant [2018-436],” was read to the Council and offered for passage on first reading upon motion made by Mr. LaLance, seconded by Mr. Shacklett. Mayor McFarland announced that the next item on the agenda is to conduct a public hearing, pursuant to RESOLUTION 18-R-PH-74 adopted by the City Council on December 20, 2018, to consider amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, to rezone approximately 18.7 acres along Veterans Parkway and Kingdom Drive from Single-Family Residential Fifteen (RS-15) and Local Commercial (CL) District to Commercial Fringe (CF) District; Swanson Developments, LP, applicant [2018- 437]. Notice of said public hearing was published in the January 15, 2019 issue of the local newspaper as follows: (Insert notice here) Mr. Matthew Blomeley, Assistant Planning Director, presented the application for rezoning approximately 18.7 acres along Veterans Parkway and Kingdom Drive from CL January 31, 2019 Page 8 (Local Commercial District) and RS-15 (Single-Family Residential District 15) to CF (Commercial Fringe) which was approved by the Planning Commission with a vote of 7-0. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed rezoning, come forward to the lectern. Mr. Joe Swanson Jr., 1188 Park Avenue, supported the rezoning and voiced his belief that the current zoning, CL and RS-15, is not conducive to the topography of the property and that it would be better suited for commercial development. There were no others who wanted to speak for or against the proposed rezoning and, after ample time had been given, Mayor McFarland declared the public hearing closed. An ordinance, entitled “ORDINANCE 18-OZ-74 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now in force and effect, to rezone approximately 18.7 acres along Veterans Parkway and Kingdom Drive from Single-Family Residential Fifteen (RS-15) and Local Commercial (CL) District to Commercial Fringe (CF) District; Swanson Developments, LP applicant [2018- 437],” was read to the Council and offered for passage on first reading upon motion made by Vice-Mayor Scales Harris, seconded by Mr. Smotherman. Mayor McFarland announced that the next item on the agenda is to conduct a public hearing, pursuant to RESOLUTION 18-R-PH-75 adopted by the City Council on December 20, 2018, to consider amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, to rezone approximately 1.96 acres along Veterans Parkway from Single-Family Residential Fifteen (RS-15) to Planned Residential Development (PRD) District (Kingdom Crest Clubhouse PRD); Swanson Developments, LP, applicant [2018-438]. Notice of said public hearing was published in the January 15, 2019 issue of the local newspaper as follows: (Insert notice here) January 31, 2019 Page 9 Mr. Kevin Gunther of Ragan-Smith presented proposed plans for a Clubhouse to be built on the property and answered questions from Mr. Smotherman regarding traffic flow issues. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed rezoning of the 1.96 acres located along Veterans Parkway, come forward to the lectern. Mr. Rickie & Mrs. Monique Pigg, 4150 Veterans Parkway, opposed the rezoning stating that the Clubhouse’s parking lot would be very close to their yard; the Clubhouse would be right next to their barn; the sinkhole on the property acts as necessary drainage for the surrounding properties; and that the additional lighting from the Clubhouse would be disruptive. A letter was submitted from Mr. Scott and Mrs. Linda Carpenter, 4130 Veterans Parkway, that voiced their opposition to the proposed rezoning. Mr. Joe Swanson Jr., 1188 Park Avenue, supported the rezoning stating that it would reduce traffic at the existing school and local road as well as create an entrance from Veterans Parkway for the multi-family development. There were no others who wanted to speak for or against the proposed rezoning and, after ample time had been given, Mayor McFarland declared the public hearing closed. Mr. LaLance had some questions for Mr. Swanson regarding how long he had owned the property, and if the two houses on either side of the property had been there when the property was purchased. Mayor McFarland questioned Mr. David Ives, Deputy City Attorney, if the City had at one time owned 4150 Veterans Parkway. Mayor McFarland then asked Mr. Blomeley to explain what types of buffers were going to be used surrounding the property. Mr. Sam Huddleston, Executive Director-Developmental Services, answered questions regarding the sinkhole on the property and how drainage issues would be dealt with when the sinkhole no longer existed. Mr. Smotherman expressed his belief that the developers and engineers would be able to handle the drainage issues that would arise from removing the sinkhole. Mr. LaLance agreed with Mr. Smotherman regarding drainage but questioned Mr. Blomeley about how headlight brightness would be addressed in the proposed parking area and questioned Mr. Gunther regarding how late the clubhouse would be open. Mr. Smotherman expressed his belief that rezoning was the best use for the property and stated that he had faith that Mr. Swanson would deliver a good product and had a good track record of working with neighbors on his building projects. January 31, 2019 Page 10 Mr. Martin espoused his belief that change was inevitably coming to this area and that he supported the project. Mr. LaLance expressed his desire to have definite hours of operation from the Clubhouse presented by the second reading of the ordinance. Mr. Blomeley assured the Council that by second reading that information would be available. Mr. LaLance also had some questions regarding trees on the property that Mr. Blomeley was not able to answer. An ordinance, entitled “ORDINANCE 18-OZ-75 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now in force and effect, to rezone approximately 1.96 acres along Veterans Parkway from Single Family Residential Fifteen (RS-15) to Planned Residential Development (PRD) District (Kingdom Crest Clubhouse PRD); Swanson Developments, LP, applicant [2018-438],” was read to the Council and offered for passage on first reading upon motion made by Mr. Martin, seconded by Mr. Smotherman. Upon roll call said ordinance was passed on first reading by the following vote: Aye: Madelyn Scales Harris Rick LaLance Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None Mr. LaLance requested hours of operation for the clubhouse be available before second reading. The following letter from the Assistant Planning Director was presented to the Council: (Insert letter dated January 31, 2019 here with regards to rezoning approximately 24.2 acres located along Medical Center Parkway [2018-439]) Mayor McFarland announced that the next item on the agenda is to conduct a public hearing, pursuant to RESOLUTION 18-R-PH-72 adopted by the City Council on December 20, 2018, to consider amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, to rezone approximately 24.2 acres along Medical Center Parkway from Gateway Design Overlay One (GDO-1) District to Gateway Design Overlay Three (GDO-3) District; City of Murfreesboro and Swanson Development, applicant [2018-439]. Notice of said public hearing was published in the January 15, 2019 issue of the local newspaper as follows: (Insert notice here) January 31, 2019 Page 11 Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed rezoning of the 24.2 acres along Medical Center Parkway, come forward to the lectern. There was no one present who wished to speak for or against the proposed amendment and, after ample time had been given, Mayor McFarland declared the public hearing closed. Mr. Smotherman had some questions regarding any potential Civil War earthworks that may exist on the property and how they would be documented or examined for any artifacts. An ordinance, entitled “ORDINANCE 18-OZ-72 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now in force and effect, to rezone approximately 24.2 acres along Medical Center Parkway from Gateway Design Overlay One (GDO-1) District to Gateway Design Overlay Three (GDO-3) District; City of Murfreesboro and Swanson Development, applicant [2018-439],” was read to the Council and offered for passage on first reading upon motion made by Mr. Shacklett, seconded by Mr. Martin. All applications are pending completion of all required building and codes inspections. Vice-Mayor Scales Harris made a motion to approve all presented Beer Permits upon successful completion of all building and codes requirements. Mr. Martin seconded the motion and all members of the Council voted “Aye”. Upon recommendation of Mayor McFarland, Vice-Mayor Scales Harris made a motion to appoint Erin Tucker to the Pension Committee, to replace the vacancy left by Jim Crumley. Mr. Wade seconded the motion and all members of the Council voted “Aye”. Mayor McFarland introduced David Arthurton of Boy Scout Troop 441, Mars Hill Church of Christ, Christiana, along with his father Larry, who was there working on one of his scout badges. The following letter from the City Engineer was presented to the Council: January 31, 2019 Page 13 (Insert letter dated January 31, 2019 here with regards to Property Exchange Agreement for the extension of West Northfield Boulevard) Mr. Chris Griffith, City Engineer, presented the Property Exchange Agreement with New Vision Baptist Church for the extension of West Northfield Boulevard to the Council. Mr. Shacklett made a motion to approve the Property Exchange Agreement for the extension of West Northfield Boulevard. Mr. LaLance seconded the motion and all members of the Council voted “Aye”. The Finance Director announced that there were not any statements to be considered. The City Manager went over the meeting calendar stating there wouldn’t need to be a Council meeting the first week of February. The Mayor indicated he has had meetings with the County Mayor regarding a new DMV location and County Clerk’s Office.
