MURFREESBORO PLANNING COMMISSION STAFF COMMENTS, PAGE 1 AUGUST 6, 2014 3.a. Mandatory Referral [2014-714] for the replacement of the DeJarnette Lane Pump Station #13, MWSD applicant. The Planning Commission is being asked to consider the acquisition of property for the replacement of an existing Pump Station located along Broad Street. In July 2014, the Murfreesboro water and sewer board approved the request to acquire additional properties necessary to construct the pump station. The acquisitions are being made because the City does not own enough property to construct the pump station. . Attached are a letter from the Water and Sewer Department and maps describing the project. . . . creating a better quality of life MEMORANDUM DATE: July 24, 2014 TO: Water and Sewer Board FROM: Valerie H. Smith SUBJECT: Pump Station #13 Replacement DeJarnette Lane Property Acquisition Background At the May 2013 Board meeting, the Board approved the design contract with Huddleston Steele. The design of the station is progressing and staff requests making offers to the property owners that are affected by the Pump Station replacement. These acquisitions are required because there is not currently enough property owned by the City/Department around the pump station for the construction. Attached is a spreadsheet that details the necessary property acquisitions and the associated values as determined by the Rutherford County Tax Assessor, equaling approximately $2,495.63 total. The Department has made offers based on tax assessed values in the past, when considering the overall value of the offers as compared to the cost of conducting property appraisals. In this particular project, the Department would probably spend as much for the appraisals as the Department would expect to pay for the estimated acquisition costs. The total amount includes a 10% premium if the property owner voluntarily conveys. See attached table for affected properties and respective offers. Recommendation Staff recommends the Board recommend to City Council allowing staff to make offers to affected property owners based on the Rutherford County Tax Assessor’s valuations. Staff would also request approval to add 10% to the offer if the affected property owners voluntarily convey the needed property. As a contingency, and in the event that a property owner doesn’t voluntarily convey, staff requests approval to obtain property appraisal services as recommended by the City’s Legal Department and proceed with offers based on the appraised value. Zoning application [2014-423] for approximately 1.1 acres to be rezoned from RS-10 to RM-16 at 626 Dill Lane, Mr. Tim Holder applicant. The subject property is located along the west side of Dill Lane north of Horncastle Drive. It is developed with one single family dwelling. The property was created as a subdivision lot and the residence was constructed prior to its annexation in 1989. The property was zoned to RS-10 soon after its annexation. The owner has made application to rezone the property from RS-10 to RM-16. Included with the staff comments is a letter of explanation offered by Mr. Matt Taylor on behalf of the applicant. The property to the west of the subject property is zoned RS-10 and is developed with a subdivision of single family structures. The property to the south across Horncastle Drive is also zoned RS-10 and is developed with a subdivision of single family dwellings. The property to the east is zoned PRD and is partially developed with a multiple family complex that has access to S. Rutherford Blvd. at the intersection with Billy Blvd. at the Walmart SuperCenter. The final phase of this development has not been constructed and remains in an undeveloped condition although earth berms, a privacy fence, and a gated access has been developed on the property. The property to the north is zoned RS-10 and is developed with a single family residence and a home occupation that involved restoration of old and antique cars. Approximately 600 feet to the north is the Richland Falls Apartment complex which is also zoned PRD. Included with the agenda materials are two photographs with one taken viewed from the north and one from the south. Under the RS-10 classification the property could be developed with perhaps 4 single family dwellings each on a separate lot. Under the proposed zoning it would be possible to develop the property with perhaps 16 dwelling units. The number of dwelling units that could be developed, however, would be affected by design requirements for solid waste management, stormwater management, landscaping and mandatory screening, parking, setbacks, and other design requirements. Practically speaking and due to the small size of the property, staff would not expect the property to be developed with more than 12 units. The Planning Commission will need to conduct a public hearing after which it will need to prepare a recommendation for the City Council.
