Mandatory Referral [2014-719] for the acquisition of approximately 2.2 acres along Veterans Parkway and Windrow Road for a MED substation, MED & City of Murfreesboro applicant. Attached is a memo from the Assistant City Attorney regarding a Mandatory Referal request to acquire approximately 2.2 acres located near the intersection of Veterans Parkway and Windrow Road for a MED substation. This matter will be forwarded to the City Council after action has been taken by the Planning Commission. MURFREESBORO PLANNING COMMISSION STAFF COMMENTS OCTOBER 1, 2014 4.a. Annexation Petition [2014-505] for approximately 114.17 acres along Blackman Road, Mr. Donald McDonald applicant. The subject property is located along Blackman Road south of SR840 and includes land on both sides of Blackman Road. The area east of Blackman Road includes a tract of approximately 103.29 acres located north of the Berkshire Subdivision. The area west of Blackman Road includes 7 undeveloped lots (approx. 6.52 acres) of the old Homestead Subdivision located north of Lyle McDonald Road (formerly Vaughn Rd.). All of these lots are owned by the applicant. Included with this annexation petition is the R.O.W. of Blackman Road (approx. 3.92 acres) and Lyle McDonald Road (approx. 0.44 acres) that fronts the request area. It is noteworthy that approximately 14.8 acres of this tract located between the Blackman Meadows and the Berkshire Subdivisions is already inside the City. The property is within the City’s urban growth boundary. The owner has petitioned the City to annex the property. It is contiguous with the existing City Limits and no other property owner must be annexed in order for the City to effect the annexation. It appears the City will be able to provide all services to the property upon the effective date of annexation. The property is within the area studied as part of the Blackman Community Land Use Plan and it has been contemplated that the City would eventually annex the area. Included with the agenda materials is an annexation feasibility study and plan of services. On September 16 the applicant hosted a neighborhood meeting at the Blackman Community Center to allow those who may be interested an opportunity to find out about the plans for annexation and zoning. Prior the neighborhood meeting the applicant was in communication with the officers of the Berkshire HOA to share with them the plans and to enlist their efforts in contacting the neighborhood about the proposed application and public hearings. Several people attended the meeting and members of the Planning Staff were in attendance. The Planning Commission will need to conduct a public hearing after which the Planning Commission will be responsible for preparing a recommendation on the matter for the City Council. Zoning application [2014-422] for approx. 21.59 acres to be zoned CF and approximately 88.22 acres to be zoned CH simultaneous with annexation, Mr. Donald McDonald applicant. The subject property is the same property considered earlier on the agenda for annexation. The applicant has made this zoning application for consideration simultaneously with annexation of the property. The application is for all the land included with the annexation west of Blackman Road (approx. 6.52 acres) to be zoned to CH. The zoning application also includes a 250 foot strip along the south side of the tract and north of the Berkshire Subdivision and a strip along the east side of the tract west of the Blackman Meadows Subdivision tract to be zoned CF (Commercial Fringe) (approx. 21.59 acres) with the remainder of the tract (approx. 81.7 acres) to be zoned CH. It is noteworthy that approximately 14.8 acres of this tract located between the Blackman Meadows and the Berkshire Subdivisions is already inside the City and is zoned RS-12. The property is located in the area that was included in the Blackman Community Land Use Plan which depicts the property to be used for mixed use and office distribution including retail, office, civic/institutional, and high density residential uses that accommodates regional employment opportunities. It was expected that these areas would be developed with rather intense land uses that would have a “regional” draw. The current implementation zones available to implement the scope of uses contemplated in the Blackman Community Land Use Plan include CH, CF, L-I, RM-16 and the Planned Development zones as authorized by Section 13 of the zoning ordinance. It is noteworthy that at the time the Blackman Land Use Plan was adopted the Berkshire Subdivision was in its very early stages and there were no homes or streets in that subdivision at the time the plan was adopted. Zoning application [2014-402] for approximately 3.6 acres to be rezoned from RS-10 to CH along Bradyville Pike at S. Rutherford Blvd., Mr. David Waldron applicant. The subject property is located along the northeast side of Bradyville Pike at the east corner of the intersection with S. Rutherford Blvd. It is bounded on the east by Floyd Avenue and Willow Drive. The application is to rezone the property from RS-10 to CH to allow the property to be developed for commercial purposes. The property was annexed in two separate actions with the first in 1967 and the second in 1973. The property was a part of a larger tract that was developed as the Wilson Estates Subdivision. Because this property was bounded on its west side by Bradyville Pike and on its north side by the then planned for Rutherford Blvd., the former owner retained this property and did not subdivide it with the remainder of the tract. Prior to 1984 the property was zoned R2 and in 1984 the property was reclassified as RS-10 under the newly adopted zoning ordinance. At that time Rutherford Blvd. was being planned but the street had not been designed for an absolute certainty of the street’s alignment. The current owner now desires to move forward with development of the property and feels that zoning for single family residences on lot of a minimum size of 10,000 sq.ft. is no longer appropriate for the property. The property has severe limitations for residential development. It has an unusual shape and frontage along streets on four of its five sides. It has frontage along a state highway (SR99 aka Bradyville Pike) and S. Rutherford Blvd. It has large drainage conveyances along the frontage of S. Rutherford and Bradyville Pike and through the middle of the property. It appears to staff that the maximum number of buildable lots would be somewhat less than 10 lots and some of these would have unusual shapes. The owner contends that circumstances in the community have changed since the property was zoned to its current RS-10 classification. Rutherford Blvd. has been constructed and the alignment is different from what was expected in 1984. The previous alignment included a sharp curve to the north to align with other sections of Rutherford Blvd. that have since been renamed to Rutherford Street and Hunt Street. The community has grown considerably and the population of Murfreesboro has tripled since the time the property was zoned to RS-10. The applicant feels that the area would be better served were the property zoned to allow commercial uses rather than single family homes. The Planning Commission will need to conduct a public hearing after which the Planning Commission will be responsible for preparing a recommendation on the matter for the City Council. PCD and PRD Amendment [2014-425-B] for approximately 2.08 acres along Middle Tennessee Blvd. and E. Main Street, Mr. Jon Nebel applicant. The subject property is located along the east side of Middle Tennessee Blvd. south of E. Main Street. It includes the small commercial center and restaurant as well as the parking area north of E. Vine Street. The application is to amend the PCD and PRD zoning in order to allow an increase in the square footage allowed for restaurant use and to allow some of the areas that are approve for use and development as townhome residential structures to be used for parking until such time as other parking can be provided to support the commercial center. Included with the agenda material is a letter of explanation and a site plan showing the proposed parking areas provided by the applicant. The Planning Staff and the owner’s representative expect to have additional comments at the meeting. The design engineer continues to work with the Transportation Dept. staff to design the proposed parking area and there may be adjustments after preparation of these comments prior to the meeting. The Planning Commission will need to conduct a public hearing after which the Planning Commission will be responsible for preparing a recommendation on the matter for the City Council.
