3.a. Autumn Wood Apartments, Phase 2 [2015-3055] site plan for 144-unit multi-
family residential development on 6.86 acres zoned RM-16 located along Old
Fort Parkway, Mr. John Elliott developer.
This is the site plan review for the second phase of the Autumn Woods Apartments multi-family
development. Phase 1 was approved at the March 18th Planning Commission meeting. Much
like Phase 1, the plan for Phase 2 consists of 6 buildings with a total of 144 dwelling units. The
property is zoned RM-16 (except for a northernmost portion of the access drive off of Old Fort
Parkway) and the multi-family uses are permitted by right in the RM-16 zone. Access from Old
Fort Parkway is proposed to be via a private drive, as opposed to a new public street as had
been previously contemplated several years ago. The Planning Commission reviewed this site
plan at its May 20th regular meeting. Due to discussion regarding ownership and access rights
pertaining to the portion of the subject property directly adjacent to the H&K property to the west
and containing the drive to Old Fort Parkway, the Planning Commission deferred action on this
site plan.
Since that time, City Staff has researched these issues. The applicants propose leaving the
existing drive that serves Town and Country Apartments to the west in its current condition.
They propose to expand the width of the driveway, however, to serve the needs of the proposed
apartment complex as well. If this is to be the case, the topping for the new portion of the
driveway would also need to be applied to the existing driveway, so that the entire driveway is
one single surface. Approximately 5’ of the existing driveway, though, is on the H&K property to
the west. This 5’ would be part of the existing driveway to be topped. In order to work in this 5’,
the applicants need to provide evidence that they have permission to work on the H&K property.
In addition, they will need to provide evidence that they have access rights to use this 5’ of the
existing driveway in order to benefit their property. If they cannot provide the aforementioned
evidence, the driveway will need to be reconstructed entirely on the subject property, so that the
proposed apartment complex does not rely on the portion of the existing driveway that is off-site.
In addition, buffer plantings are required along the west side of the shared driveway adjacent to
the H&K property. A Type D buffer is required where the subject property is zoned CH, and a
Type C buffer is required where the subject property is zoned RM-16. This was stated in the
May 20th staff comments but it has not yet been addressed.
In Staff’s opinion, the above issues should be addressed prior to approval by the Planning
Commission. Staff recommends deferral once again until such time as the above issues can be
resolved.
Staff Comments (Staff Comments #1-24 were generated by the Engineering
Department. The Engineering Department has not had an opportunity to
comprehensively review the latest plans for compliance with comments #1-
24. Additional comments from the Engineering Department may be
forthcoming at the Planning Commission meeting.):
1) Provide proper turn around at proposed secondary gated entrance if visitors cannot get
through the gate.
2) A final plat will be required to create sewer easements prior to the first Certificate of
Occupancy. An access easement should be included to benefit the existing Town and
County apartments and should extend as far south as the southernmost existing entrance
into the Town and Country site.
3) Entrance on Old Fort Pkw/Hwy 96 will need to be completely reconstructed with a 3 lane
cross section with a 14’ lane in and 2 11’ lanes out for a total of 36’ in width.
4) Sidewalk will need to be extended from the commercial development to the drive including a
handicap ramp at the drive.
5) Add handicap ramps to the drive for the commercial lot.
6) Provide evidence that the septic lines for the existing apartments are not under the proposed
drive.
7) Compaction reports will be required in all fill areas prior to footing inspections.
8) Provide turn simulation for a fire truck around the site.
9) TDOT ROW permit will be required for work located within the ROW for Old Fort Pkwy/Hwy
96
10) Covering pervious parking spaces will not count as pervious area since the roof will be
impervious.
11) Provide details for pervious pavers. Show any underdrains if they are to be used.
12) If this development is to include a car wash, it will need to be covered and connected to the
sanitary sewer.
13) Provide a grading plan with proposed contours.
14) If the proposed grass channel is to be used for stormwater quality it should be labeled as
such.
15) Demonstrate compliance with stormwater quality requirements.
16) Label curb cuts and provide turf reinforcement mat if needed to prevent erosion.
17) Provide elevations details for all storm pipes.
18) A “2’ break in curb” label has an arrow pointing to building 8. Please revise.
19) This development must comply with the City’s stormwater quality design standards. Provide
a Stormwater Management Plan including associated design and calculations to the City
Engineer’s office for review and approval prior to a building permit.
20) Provide an Engineer’s Certification of Stormwater Quality Controls to the City Engineer’s
office for review and approval prior to Certificate of Occupancy.
21) Provide a Stormwater Facilities Operation and Maintenance plan and agreement to the City
Engineer’s office for review and approval prior to Certificate of Occupancy.
22) This development will require a State of Tennessee Construction General Permit. Provide
evidence of the Construction General Permit to the City Engineer’s office prior to
construction commencement.
23) Provide an Erosion Prevention and Sediment Control plan and a Stormwater Pollution
Prevention Plan to the City Engineer’s office for review and approval prior to a building
permit.
24) A Land Disturbance Permit will be required. A separate Land Disturbance Permit application
shall be made with the City Engineer’s office for review and approval prior to a building
permit
25) Show adjacent property zonings on landscape plan and label proposed buffers. Please
provide adjacent zoning on ALL landscape plan sheets.
26) Please choose another tree in place of the proposed white pine as they do not grow well in
the middle TN area. (To be reviewed at a later date by Urban Environmental.)
27) Please identify and locate all utilities and easements on the landscape plan. (To be
reviewed at a later date by Urban Environmental.)
28) Complete buffer plantings and/or perimeter planting yards on sheet L.3 along both sides of
private drive to Highway 96 and include the proper planting yard widths. A 15’-wide Type D
buffer is required adjacent to the H&K property where the subject property is zoned CH and
a 12’-wide Type C buffer is required where the subject property is zoned RM-16. The buffer
requirements are not being met adjacent to the H&K property. This still needs to be
addressed.
29) Label the zoning of the adjacent properties on the landscape plan sheets. Please provide
adjacent zoning on ALL landscape plan sheets.
30) A 12’-wide Type C buffer is required along all property lines adjacent to properties zoned
RS-15. Show and label Type C buffer where needed. The minimum 12’ Type C buffer
width is not being met adjacent to the southeast corner of the H&K property. Revise
plans to demonstrate compliance.
31) A 10’-wide Type A buffer is required along all property lines adjacent to properties zoned CH.
Show and label Type A buffer where needed. The minimum width for a Type A buffer
has been provided. Urban Environmental will review the buffer design at a later date.
32) Please submit an irrigation plan for staff review. All properties 1.5 acres or greater are
required to install an automated irrigation system. An irrigation plan still needs to be
submitted.
33) Please include a sheet that shows overall landscape plan. A landscape master plan has
been provided.
34) Please add the required ANSI note on landscape plan. (To be reviewed at a later date by
Urban Environmental.)
35) Evergreen trees are to be specified by height and not caliper inches. Please reconcile the
material schedule. (To be reviewed at a later date by Urban Environmental.)
36) In the plant material schedule please add “single/straight central leader” to the notes section
of the canopy trees. (To be reviewed at a later date by Urban Environmental.)
37) Please add— 4’ Clear Trunk, Full Canopy—to any proposed ornamental trees in the plant
material schedule. (To be reviewed at a later date by Urban Environmental.)
38) Any multi-stem trees should list minimum and maximum number of canes and a minimum
size in caliper inches for each cane. (To be reviewed at a later date by Urban
Environmental.)
39) All parking rows are required to be originated and terminated with a shade tree. (To be
reviewed at a later date by Urban Environmental.)
40) In the site data table on the master plan, there appears to be some text overlaid on other
text. Please correct. This has been addressed.
41) The information provided is not sufficient to determine whether or not this site qualifies for
the density bonuses proposed. If the following information cannot be provided prior to the
Planning Commission meeting, it is recommended that the applicant withdraw this item from
the agenda until such time as sufficient information can be provided. Revisions to the
density bonus information should be made as noted below.
42) Provide more detailed density bonus calculations, showing how the formulas in the Zoning
Ordinance are being applied to this plan. In the density bonus calculations, the
percentage increases should be based on 269 units rather than 288 units. Please
revise the calculations.
43) In order for Staff to review the requested density bonus for the playground, please submit
additional details on the design of the playground, including the proposed equipment. In
addition, a fence is required around the playground in order to qualify for the density bonus.
Show the required fence on the site plan. The square footage of the playground in the
calculations does not match the square footage of the playground in the playground
detail. Please reconcile. In addition, based on the square footage in the playground
detail, it appears that the correct percentage increase is 5% instead of 3.258%.
Regardless, the 6 unit maximum increase will still govern.
44) In order for Staff to review the requested density bonus for the clubhouse, please submit a
floorplan for the clubhouse denoting the areas that will be available to the residents and the
areas that will be devoted to offices and storage. The areas devoted to offices and storage
cannot be applied to the density bonus calculations. The density bonus calculations
show the clubhouse area to be 5,245 square-feet. Based on the club house floor plan
provided, Staff calculates that 2,845 square-feet can be counted toward the density
bonus. Although this decrease in floor area does not affect the ultimate density
increase, the floor area should be revised in the calculations.
45) In order for Staff to review the requested density bonus for the bike racks, please submit a
detail of the bike rack. The bike rack detail should denote how many bike spaces will be
included in each rack. Also, provide a total number of bike racks and bike rack spaces. The
bike rack locations do not appear to be very convenient. In order to receive the
density bonus for bike racks, the plans should be revised to have a greater number of
smaller bike racks spread throughout the development, so that they are convenient
and accessible to the majority of the tenants.
46) The side setback along the west side property line should be labeled as 20’. This has been
addressed.
47) The garage along the west side property line appears to encroach into the required 20’ side
setback. If this is the case, please revise the plans to demonstrate compliance. Call out the
distance between the garage and the property line to demonstrate compliance.
48) Provide additional details on the parking lot “covers.” Will they have side or just a roof?
What will they look like? What will they be constructed out of? Also, the site plan should be
revised to depict the locations of the posts for these covers. These details have not yet
been provided.
49) Label all minimum building setback lines. This has been addressed.
50) Many buildings are very close to the side setback lines. Label the dimension of the closest
point of each of the buildings to the side lot lines in order to demonstrate compliance with the
setbacks. This has been addressed.
51) Label any existing and proposed access easements for Lot 1 of Autumn Wood Commercial
and for the H&K Investment property to the west. The boundaries of the proposed access
easement are not clearly defined. Also, is there an existing access easement over the
subject property for the benefit of the H&K property? If so, show and label the
existing easement on the plans.
52) Submit a photometric lighting demonstrating compliance with the minimum requirements of
Section 18 of the Zoning Ordinance. A photometric lighting plan still needs to be
submitted.
53) Show the CH zoning boundary line near the north end of the site. Please show and label
this zoning boundary line on all applicable sheets as requested.
54) Are garage parking spaces being counted toward the minimum parking requirements? If so,
please include a note that the garages are only to be used for the parking of automobiles.
Garage spaces used or available to be used for the parking or storage of boats, recreational
vehicles, trailers, equipment, or any other item may not be counted toward the minimum
parking requirements. Please also include this note with the parking calculations on
the site plan sheets as well.
55) The proposed sign shown along Old Fort Pkwy is within a 30’ Waterline Easement and on a
CUD waterline. CUD requires a minimum 10’ setback from waterlines. Clearly label the
boundaries of the CUD easement on the plans in order to demonstrate the sign is no
longer in the easement.
Standard Staff Comments:
1) This site plan is not affected by the City’s Major Thoroughfare Plan.
2) Per the engineer’s certification on this plan, the property lies in Zone X, outside of areas
designated as floodway and 100-year floodplain per the latest FIRM maps (1/05/07) for
the City of Murfreesboro.
3) In accordance with TCA Section 7-59-310(b)(1), Competitive Cable and Video Services
Act, in case of new construction or property development where utilities are to be placed
underground, the developer or property owner shall give all providers of cable or video
serving the City of Murfreesboro dates on which open trenching will be available for the
providers’ installation of conduit, pedestals or vaults, and laterals referred to as
“equipment” to be provided at each such providers’ expense.
4) Upon completion and final acceptance of the landscape installation, a three (3) year
landscape maintenance bond will be required. This bond should be submitted in the
name of the property owner of record or a lease holder who has ten (10) years or more
remaining on a current lease. The property owner/lease holder should allow adequate
time to obtain the bond as this process may be lengthy and may delay the issuance of
the Certificate of Occupancy.
5) Any Ground sign or Freestanding wall sign (monument style) within a public utility or
drainage easement must receive permission from the easement holder for the sign
location and BZA approval for a Variance for a sign within a Public Utility or Drainage
Easement.
Water and Sewer; Fire & Rescue, Building & Codes, & MED Staff Comments
(MWSD, MFRD, Building and Codes, and MED have not reviewed the latest
plans for compliance with the comments below.) :
1) Water and/or sewer main construction drawings and hydraulics must be submitted to
MWSD for detailed review and approval separate from planning commission review.
2) Owner, for budget purposes, should check with MWSD for connection fees, which may
be substantial.
3) Resubmit two sets of plans to MWSD for the review of the sanitary sewer.
4) Building permits are not to be issued until water and sewer construction plans are
approved by MWSD.
5) Building permits are not to be issued until fees are paid.
6) The owner/developer must sign a Landscaping within a City Easement Agreement with
MWSD.
7) The maximum allowed sewer service line length to serve each individual building must be
less than or equal to a total of 150 feet.
8) All dumpsters/dumpster pads connecting to the sanitary sewer must be covered and
completely enclosed on all sides except for one that opens for hauling.
9) All canopy trees must be located 10’ minimum from all public water/sewer main(s).
10) Submit a copy of the final Site Lighting Plan to MWSD.
11) Submit a copy of the final Landscaping/Planting Plan to MWSD.
12) Submit a copy of the final Grading & Drainage Plan to MWSD.
13) All new sanitary sewer taps, connections, and manhole adjustments are to be per MWSD
specifications and be made under MWSD supervision by a MU licensed utility contractor.
14) Water service, domestic, fire and/or irrigation, is provided by CUDRC.
15) Preliminary construction plans must be submitted to CUDRC in digital AutoCAD and PDF
format for the waterline design, review, and construction approval prior to the start of any
construction. Submit plans to subdivisions@cudrc.com for design and review. Contact
Bryant Bradley (615-225-3340) for further information.
16) All main waterline taps are to be made by CUDRC.
17) A “Meter Application and Fixture Count Submittal Form” will need to be completed and
submitted to CUDRC. The form is available at the following link and can be completed

19) The reduced pressure backflow preventer for the domestic water service must be outside

4.a. Rezoning application [2015-412] for approximately 0.46 acres located along
the east side of South Highland Avenue to be rezoned from RD to RS-4,
Rutherford County Habitat for Humanity applicant.
The subject property is located at the northeast corner of South Highland Avenue and
Reid Avenue. It consists of two parcels, both of which are currently vacant and zoned
RD (Residential Duplex). Both parcels are also located within the CCO (City Core
Overlay District). The parcel on the corner was previously developed with a single-family
residence, while the northern parcel was developed with a duplex. Both structures were
demolished around 2007.
Rutherford County Habitat for Humanity has purchased both parcels and wishes to
subdivide them into three (3) lots of record. Habitat intends to build a total of three (3)
single-family detached homes. The current RD zoning has a minimum lot size of 8,000
square-feet for single-family lots. The area of both parcels combined is 20,124 square-
feet, which is not enough land area to yield three (3) lots under the existing RD zoning.
In order to create three (3) lots, Habitat has requested that these two parcels be rezoned
to RS-4 (Single-Family Residential District). The RS-4 zone requires a minimum 4,000
square-foot lot size.
The subject parcels are bordered to the north and east, as well as to the south across
Reid Avenue, by RD zoning. There is also RD zoning to the west, at the southwest
corner of South Highland Avenue and East State Street. The properties in the nearby
RD zone are developed with both single-family residences and duplexes. The subject
property is also bordered by RS-4 zoning to the west across South Highland Avenue.
The properties in the nearby RS-4 zone are predominantly developed with single-family
residences.
The Planning Commission will need to conduct a public hearing, after which it will need
to discuss the matter and then formulate a recommendation for City Council.

4.b. Rezoning application [2015-413] for approximately 6.17 acres located at the
southwest corner of Medical Center Parkway and Robert Rose Drive to be
rezoned from MU to CH, Mr. Tommy Smith applicant.
The subject property is located at the southwest corner of Medical Center Parkway and
Robert Rose Drive. It is currently undeveloped. The properties immediately to the west
are zoned MU (Mixed Use) and CH (Highway Commercial), respectively. The CH parcel
is developed with the Peter D’s restaurant. Further to the west, The Avenue shopping
center is zoned CH. The property to the south is zoned MU and a site plan for this
property has been approved for an apartment development called Everwood at the
Avenue. The properties to the east, across Robert Rose Drive, and to the north, across
Medical Center Parkway, are zoned MU also.
The subject property was rezoned from CH to MU in 2013 at the request of the applicant.
Since that time, the applicant and his engineer have been designing a plan to subdivide
the subject property into four (4) separate lots of record. One of the lots proposed is a
flag lot. The Zoning Ordinance is silent on flag lots in the MU zone. In addition, the
Zoning Ordinance requires a minimum 200’ lot width in the MU zone when the property
is adjacent to an arterial or collector street. One of the lots proposed along Medical
Center Parkway does not meet the minimum 200’ lot width requirement. Therefore, the
proposed plan to subdivide, as currently designed, is not possible under the current MU
zoning. The applicant has requested to have the property rezoned back to CH in order
to subdivide the property as desired. The manner in which the property is proposed to
be developed is more consistent with the CH zoning than the MU zoning. If rezoned, the
property will remain in the GDO-1 (Gateway Design Overlay District) and will still be
subject to the GDO development requirements.
The Planning Commission will need to conduct a public hearing, after which it will need
to discuss the matter and then formulate a recommendation for City Council.

4.c. Asbury Road and Florence Road [2015-712] right of way abandonment
request for 2.4 acres of Asbury Road right-of-way and 0.21 acres of Florence
Road right-of-way, Mr. Kevin Waldron applicant.
The subject property is located along the west side of Florence Road. It consists of
excess right-of-way that remains after the relocation of Asbury Road in conjunction with
the construction of Thistle Downs, Section 4. It also consists of excess right-of-way that
was left over after the reconstruction of Florence Road several years ago. The excess
rights-of-way along both streets are adjacent to the Thistle Downs Subdivision, and the
developer of Thistle Downs has requested that this right-of-way be abandoned and
transferred to him.
The Planning Staff has completed a study of the impact of the proposed right-of-way
abandonment. It has been included in the agenda packet. If the Planning Commission
approves this right-of-way abandonment request, Staff recommends the following
conditions of approval:
1) Utility, drainage, and slope easements must be dedicated as stated in the
attached ROW abandonment study.
2) All conditions stated in the attached e-mail from Sam Huddleston of the
Engineering Department dated May 28th, 2015 and all conditions stated in the
attached e-mail from Dana Richardson of the Transportation Department dated
May 14th, 2015 must be met.
3) The applicant must provide a legal description, an exhibit, and any other
documentation necessary for the preparation of the required legal documents.
4) All legal documents are subject to the approval of the City Attorney.
The Planning Commission will need to conduct a public hearing, after which it will need
to discuss the matter and decide whether or not to abandon this excess right-of-way. If
the request is approved, then it will be forwarded on to the City Council for ratification of
the Planning Commission’s action.

regarding the captioned right of way abandonment. In summary:
AT&T
Officials from AT&T indicated that they will need a 20’x 20’ easement at the
south corner of Asbury Road and Florence Road next to the existing sign easement
for future cabinet placement.
Murfreesboro Electric Department (MED)
An e-mail received from Mr. Chris Barns states that MED would like to maintain
an electric easement on the west side of Florence Road where MED’s/MTEMC’s
joint pole line is located.
Murfreesboro Water and Sewer Department
MWSD does not have water or sewer in this area. MWSD is not opposed to the
abandonment of this right of way.

Consolidated Utility District
CUD has a water line along Florence Road and has requested that they reserve
easement rights across the Asbury Road right of way abandonment and in front of
lot 211. The easement area will need to be 15’ feet on each side of the existing
water line for a total of 30’ feet.
Engineering Department
Sam Huddleston has the following comments regarding the right of way
abandonment.
For the ROW to be abandoned along existing Florence Road including a portion of
what is now Asbury Road.
1. Reserve the necessary electric easements for the existing electric facility.
2. Reserve sewer easement for the existing sewer line
3. Reserve a slope easement where needed for the existing Florence Road.
4. Confirm that no other utility easements are needed to be reserved by checking
the Florence Road reconstruction plans.
5. Submit construction plans for approval of the City Engineer to modify
pavement markings in Florence Road at Asbury Road which should be completed
prior to abandonment of the ROW.
6. Submit construction plans for approval of the City Engineer to remove
pavement along the intersection of existing Florence Road and existing Asbury
Road which should be completed prior to abandonment of the ROW. Some
pavement removal will be necessary to provide adequate separation from the
Florence Road roadway to remain. A pedestrian corridor on the shoulder of
Florence Road should be maintained from the end of sidewalk to the Florence
Road bridge over Interstate 24.
7. Submit construction plans for approval of the City Engineer to modify guardrail
along Florence Road at Asbury Road which should be completed prior to
abandonment of the ROW. The guardrail should be extended parallel to Florence
Road in the area where Asbury Road pavement will be removed. Excess
guardrail should be salvaged and returned to the City of Murfreesboro Street
Division.

pavement markings in Florence Road at Asbury Road which should be completed
prior to abandonment of the ROW.
For the Asbury Road ROW between Florence Road and relocated Asbury Road
1. Reserve electric easements necessary for the existing facility. Confirm with
electric facility owner how to provide access to the existing poles in Asbury Road
ROW.
2. Reserve drainage easements as may be necessary to support public roadway and
private site drainage routing to the I-24 drainage system (outfall)
3. Submit construction plans for approval of the City Engineer to modify
pavement and add pavement markings and signage at Asbury and relocated
Asbury. This should include removal of pavement along relocated Asbury,
restoration of vegetation, adding edge lines, adding signage for the curve (curve
signs) adding signage to the approach to the curve (chevron or arrow), and
reduction in the perception of the continuation of the existing Asbury Road
roadway for southbound drivers. This work should be completed prior to
abandonment of the ROW.
Traffic Department
Mr. Dana Richardson does not have any concerns with closing this portion right of
way. A remediation plan should be created that outlines timeframes and
responsibilities of abandonment between parties before official abandonment
documents are executed. Ram Balachandran suggests maintaining a good clear
zone (minimum 20’ feet from the edge of pavement) similar to the east side of
Florence Road due to the overhead bridge structure.
Police Department
The right of way abandonment will not affect the Murfreesboro Police
Department.
Solid Waste Department
The Solid Waste Department will not be affected by the closure of this right of
way.

CUD does not have any issue with abandoning the R.O.W. areas however we need to reserve easement rights across
the Asbury Road R.O.W. abandonment and in the small sliver in front of lot 211 as this is where we have a 30"
main water line. The easement area we need to retain is 15 feet each side of the existing water line. I am not for sure
how we need to do this or how the city has handled this in the past.

4.d. Rezoning application [2015-414] for approximately 21.6 acres located along
Joe B Jackson Parkway to be rezoned from L-I to H-I, Mr. John Harney on
behalf of Elam Road Partnership applicant.
The subject property is located along the south side of Joe B Jackson Parkway east of
the I-24 interchange. It consists of 21.6 acres and is currently zoned L-I (Light
Industrial). The applicant has indicated that he has a potential buyer for the property
whose use will require H-I (Heavy Industrial) zoning. Specifically, he has indicated that
the user is an auto parts manufacturer. Auto parts manufacturing is only permitted in the
H-I zone.
The adjacent property to the east is developed with NHK seating, which is also an auto
parts manufacturer and is zoned H-I. The Amazon distribution facility, also zoned H-I, is
further to the east. The property is also directly adjacent to CH (Highway Commercial)
zoning to the west, where a Subway restaurant was constructed several years ago. A
multi-tenant commercial building has also been approved in the same CH subdivision.
Directly to the north of the subject property, across Joe B Jackson Parkway, is the Elam
Farms warehouse development and Schwan Cosmetics, both of which are also zoned L-
I. The Magnolia Trace and Sunset Ridge single-family residential developments are
further to the east along Joe B Jackson Parkway and are approximately 2,000-2,500
linear feet from the subject property, as the crow flies.
The Planning Commission will need to conduct a public hearing, after which it will need
to discuss the matter and then formulate a recommendation for City Council.
