3.a. Zoning application [2017-423] PRD amendment for Kimbro Woods PRD
on approximately 28.18 acres located along Veterans Parkway and
Saint Andrews Drive, Kimbro Development Group, LLC applicant.
In late 2017, the Kimbro Woods PRD (Planned Residential District) was amended
to modify the development standards for the remainder of the subdivision. It did
not affect the existing, developed portion of the PRD. The staff comments from
the August 2017 Planning Commission meeting are below for reference. The
developer and his design team subsequently discovered a “typographical error” in
the approved pattern book. The minimum lot width was listed in the pattern book
as 60’. According to the applicant, he never intended to have 60’-wide lots and
that the concept plan in the pattern book and the resulting density was based on
55’-wide lots. Even though the lot width listed was a “typographical error”, it was
a clearly-written minimum standard in the pattern book and to change it for all lots
would be above and beyond what Staff feels could be approved administratively
as a minor deviation to the plan. As such, the applicant has filed a request to
amend the PRD zoning to reduce the minimum lot width to 55’. According to a
letter submitted by the design engineer, all other aspects of the approved plan,
including the density, will remain the same.
The Planning Commission will need to conduct a public hearing, after which it will
need to discuss this matter and then formulate a recommendation for City Council.
A copy of the approved pattern book has been included in the agenda materials
for reference. The 60’ minimum lot width is referenced on page 9.
Staff Comments from the August 2, 2017 Planning Commission Meeting
The subject property is located along the west side of Saint Andrews Drive south of New
Salem Highway and north of Veterans Parkway. It is the site of the Kimbro Woods
Subdivision. The PRD zoning for the Kimbro Woods Subdivision was adopted in early
2005. Two sections were developed in relatively short order but development stalled
during the recession. By the time the recession ended, a new developer had taken over
the development. He developed two additional sections, which he called The Meadows
at Kimbro Woods. His vision for the balance of the property differs in some respects from
the original PRD pattern book, so he has requested to amend the PRD zoning. In
addition, he has acquired the 8.9-acre tract to the south and would like to rezone it from
RS-15 to PRD in order to incorporate it into the Kimbro Woods PRD.
The existing Kimbro Woods PRD consists of 283 homes on approximately 74 acres for a
density of 3.8 dwelling units per acre. The proposed plan calls for 314 homes on
approximately 83 acres for a density of 3.8 dwelling units per acre. The original zoning
plan did not specify a minimum lot size but most of the lots that have been developed in
the existing sections are at least 7,000 square-feet. The amendment seeks to codify a
minimum lot size of 6,000 square-feet. The current plan calls for the exterior materials of
the homes to be a minimum of 60% masonry, while the proposed plan increases that
percentage to 100%, to include brick, stone, and cementitious siding. (Vinyl will be
allowed only in the trim and soffit.) The current plan requires that certain lots have side-
entry garages, but the proposal will remove that requirement and allow for all homes to
have front-entry garages. The minimum required home size is currently 1,400 square-
feet and this is not proposed to change. The applicant proposes to modify the setbacks.
The front setback is proposed to be increased from 25’ to 35’. This will allow for the
parking of four (4) vehicles in the driveway. In addition, the side setback is remaining at
5’ but the amendment proposes to do away with the requirement for a minimum
separation of 15’ between buildings.
The road network has been modified slightly from the existing zoning plan. In addition,
the acquisition of the 8.9 acres to the south will afford the development access to Veterans
Parkway. Sidewalks are proposed on both sides of all streets. The original zoning plan
had a very minimal amenity package. The proposed amendment adds an amenity lot
that will include a picnic area and a playground. The plan also proposes a Type A buffer
to screen the detention area from Saint Andrews Drive, as well as another Type A buffer
to provide screening for the adjacent resident to the south. The Planning Commission
should note that the amendments proposed in the pattern book do not apply to the
sections that have already been developed. In addition, the amended area will be
required to comply with any existing standard from the original pattern book not
specifically referenced in the new pattern book.
Directly to the north of the subject property is the Belle Haven single-family residential
subdivision, which is zoned RS-12 (Single-Family Residential District 12). Directly to the
west of the subject property is the Weston Park single-family residential development,
which is zoned PRD and contains a variety of lot sizes, some less than 6,000 square-feet.
Directly to the south of the subject property is Veterans Parkway and three estate lots in
the unincorporated County. Further to the south, across Veterans Parkway is the
Sheffield Park single-family residential subdivision, which is zoned PRD and has a
minimum lot size of 8,000 square-feet. To the east of the subject property across Saint
Andrews Drive is an undeveloped tract in the unincorporated County as well as the
Southern Meadows single-family residential subdivision, which is zoned PRD and has a
10,000 square-foot minimum lot size.
The future land use map contained in the Murfreesboro 2035 Comprehensive Plan, which
has not yet been adopted, recommends that the subject property develop as “Auto Urban
Residential.” The density and lot sizes proposed in this zoning request are generally
consistent with the recommendations of the Comprehensive Plan.

If this rezoning is approved, the Kimbro Woods subdivision will have 314 single
family homes versus the 283 lots currently approved PRD. The additional lots are
the result of the reduction in lot size and the acquisition of the additional acreage.
However, the unit density of 3.8 units per acre will remain the same with the ex-
pansion of the subdivision as it was in the original PRD. The home sizes, character
and quality will remain the same as what was originally approved.
The exterior materials will increase from minimium 60% masonry to 100% mason-
ry construction to include brick, stone, and fiber cement siding (vinyl only on trim
and soffit). The homes will have front entry garages with the capability of parking
two cars in the garage and four on the driveway.
As was the original commitment every effort will be made to preserve healthy tree
lines during construction. The type ‘A’ buffer that has already been established will
be continued into the new phase of construction. There will also be over 6 addi-
tional acres of land used for detention areas and green space.
Development Team:
The homeowners in the neighborhood will be required to participate in the home- Kimbro Development Group, LLC
owner’s association. The homeowner’s association has the power to enforce the 1804 Williamson Court Suite 101
restrictions and the covenants. The assocation’s responsibility will continue to Brentwood, TN 37133-1139
encompass the open spaces, detentions ponds, and neighborhood entry ways.
The HOA will be required to maintain all common areas in perpetuity.

3.b. Zoning application [2018-401] for approximately 5.9 acres located
along City View Drive to be rezoned from RS-10 to CU and 1.4 acres to
be rezoned from CL to CU, MTSU Campus Planning applicant.
The subject property, which totals approximately 7.3 acres, is located along the
west side of City View Drive north of East Main Street. It consists of ten (10)
parcels and a portion of the main university campus. The property is developed
with six (6) residential structures and two university parking lots, one of which is
associated with the athletic fields on East Main Street. The majority of the parcels
are zoned RS-10 (Single-Family Residential District 10), but one parcel along East
Main Street and City View Drive is zoned CL (Local Commercial District). All
parcels involved in this request are owned by Middle Tennessee State University.
MTSU would like to develop a service facility for its buses on the parcels directly
south of the parking lot that is adjacent to Alumni Drive. The current RS-10 zoning
does not permit the development of university facilities, such as the proposed bus
service facility, so MTSU has filed a request to have all of the properties it owns
on the west side of City View Drive zoned CU (College and University District).
The CU zone will allow the development of university facilities on these parcels,
including the proposed university bus service facility.
The adjacent property to the north is the main MTSU campus. To the east of the
subject property on the east side of City View Drive is an apartment complex
(zoned PRD -- Planned Residential District), two duplexes, a triplex, and a
quadplex (zoned RM-12 and RM-16 -- Multi-Family Residential Districts). To the
south along East Main Street are several commercial uses zoned CH (Highway
Commercial District) and CL, including a tavern and an RV storage lot, as well as
several institutional and office uses, including a church and an office for the non-
profit Special Kids. East of the subject parcels are MTSU athletic fields, zoned
CU. Also east of the property is the proposed Walker Station residential
development, which is zoned PRD and consists of 23 proposed single-family
residential detached dwelling units in a horizontal property regime. If the rezoning
request to CU is approved, the installation of a Type C buffer will be required when
the portion of the requested area adjacent to the Walker Station PRD develops.
The future land use map contained in the Murfreesboro 2035 Comprehensive Plan,
which was adopted by the Planning Commission in July 2017, depicts a future land
use classification of “Public/Institutional” for the subject property. According to the
plan, “institutional land uses include improved parcels and facilities that are held in
the public interest and are usually exempt from real property taxation plus any
service drives or roads inside the actual parcel. This category encompasses major
City-owned facilities, plus other public and private buildings and sites with an
institutional nature.” According to the plan, one of the appropriate “development
types” for this category is “schools, colleges and universities” and one of the
existing zoning districts that it sees as being compatible with this category is the
CU zone. It appears that, in recommending “public/institutional” uses for this area,
the comprehensive plan was recognizing the need to accommodate the future
expansion of the university. The rezoning request appears to be consistent with
the recommendations of the future land use map contained in the comprehensive
plan.

The primary purpose of this revision of the Murfreesboro Zoning Ordinance is to eliminate
the use “dwelling, multiple-family” as a by-right use in the RM-12, RM-16, CBD, and MU
zoning districts. Presently, Chart 1 of the Zoning Ordinance permits multi-family
residential dwelling units on property zoned RM-12, RM-16, CBD, MU, and CU by right if
the property and the proposed development conform to the bulk regulations set forth in
Chart 2 of the Zoning Ordinance. If approved, this amendment would limit future
development of multi-family residential dwelling units to properties zoned PUD, PRD, or
CU. (With minor exceptions, the CU district covers only state-owned parcels located on
or near the Middle Tennessee State University campus.) PUD and PRD zoning require
City Council approval, and specific development standards may be imposed during the
rezoning process.
Properties having already been zoned RM-12, RM-16, CBD, or MU prior to December 31,
2017, would retain existing land use entitlements, including multi-family residential as a
by-right use.
This amendment would also add introductory language to the Endnotes that follow Chart
1 in the Zoning Ordinance. A previous Zoning Ordinance amendment shifted certain bulk
and development standards from Section 15 to Chart 1 Endnotes. When that shift
occurred, an introductory paragraph that had previously appeared in Section 15 was
inadvertently eliminated. The introductory paragraph describes the function of Chart 1.
Additionally, as follow-up to a previously approved Zoning Ordinance amendment, this
amendment would remove all references to the RM-22 district.
The Planning Commission will need to conduct a public hearing, after which it will need
to discuss this matter and formulate a recommendation for the City Council.
ORDINANCE 17-O-___ amending Murfreesboro City Code Appendix A—Zoning,
Section 13, Planned Development Regulations; Section 19, Residential Districts;
Section 21, Commercial Districts; Chart 1 and Chart 1 Endnotes, Uses Permitted
by Zoning District; pertaining to multi-family housing, City of Murfreesboro Planning
Department, applicant [2017-809].
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MURFREESBORO, TENNESSEE, AS FOLLOWS:
SECTION 1. Appendix A, Section 13, Planned Development Regulations, of the
Murfreesboro City Code is hereby amended at subsections (C)(1) and (C)(4) by deleting
the subsections in their entirety and substituting in lieu thereof the following:
(C)(1) PRD, Planned Residential District. Any planned development for a land
use, uses, or combination of uses permitted by right or by special use permit
in the RS-15, RS-12, RS-10, RS-8, RS-6, RS-4, RS-A, RD, RM-12, RM-16,
R-MO, or MU districts as indicated in the DWELLINGS, OTHER HOUSING,
and INSTITUTIONS section of Chart 1 of this article shall be classified as
and shown on the official zoning map as a PRD, Planned Residential
District. The use “dwelling, multiple-family” may be permitted within the
Planned Residential District if approved by the City Council.
(C)(4) PUD, Planned Unit District. Any planned development consisting of a
combination of uses permitted by right or by special use permit in a
combination of the zoning districts indicated on Chart 1 of this article and
which does not qualify otherwise as a PRD, PCD, or PID shall be classified
as and shown on the official zoning map as a PUD, Planned Unit District.
The use “dwelling, multiple-family” may be permitted within the Planned Unit
District if approved by the City Council.
SECTION 2. Appendix A, Section 19, Residential Districts, of the Murfreesboro
City Code is hereby amended at the RM-12, RESIDENTIAL MULTIFAMILY DISTRICT
and RM-16, RESIDENTIAL MULTIFAMILY DISTRICT subsections by deleting the
subsections in their entirety and substituting in lieu thereof the following:
RM-12, RESIDENTIAL MULTIFAMILY DISTRICT
This district is characterized by a broad range of residential housing types including
single-family detached, single-family attached, two-family, three-family, and four-
family dwellings up to three stories in height. Other uses such as churches,
schools, and specified services associated with or compatible with the residential
uses allowed in this district are also permitted subject to site plan review and
approval or the issuance of a special permit therefor. The uses permitted in this
district, the special uses that may be allowed in this district and the uses for which
site plan review and approval are required are listed in Chart 1 unless otherwise
regulated in this article. The minimum lot and yard requirements, maximum height,
maximum gross dwelling unit density and the land use intensity ratios which govern
any use in this district are listed on Chart 2 unless otherwise regulated in this
article. The use “dwelling, multiple-family” is not permitted by right or special use
permit in the RM-12 zoning district unless the property shall have been zoned RM-
12 on or before December 31, 2017, provided that all regulations and procedures
set forth in this article (Appendix A – Zoning) and all other applicable codes are
satisfied.
RM-16, RESIDENTIAL MULTIFAMILY DISTRICT

SECTION 3. Appendix A, Section 21, Commercial Districts, of the Murfreesboro
City Code is hereby amended at the CBD, CENTRAL BUSINESS DISTRICT and MU,
MIXED USE DISTRICT subsections by deleting the subsections in their entirety and
substituting in lieu thereof the following:
CBD, CENTRAL BUSINESS DISTRICT
The purpose of this district is to provide a zoning category which allows the
maintenance and development of uses which will reinforce the vitality of the central
business district as a residential and employment center and as the commercial,
governmental, and cultural center of Murfreesboro. The uses permitted in this
district, the special uses that may be allowed in this district and the uses for which
site plan review and approval are required are listed in Chart 1 unless otherwise
regulated in this article. The minimum lot and yard requirements, maximum height,
maximum gross dwelling unit density and the land use intensity ratios which govern
any use in this district are listed in Chart 2 unless otherwise regulated in this article.
The use “dwelling, multiple-family” is not permitted by right or special use permit in
the CBD zoning district unless the property shall have been zoned CBD on or
before December 31, 2017, provided that all regulations and procedures set forth
in this article (Appendix A – Zoning) and all other applicable codes are satisfied.
MU, MIXED USE DISTRICT
The purpose of the MU, Mixed Use District, is to provide a zoning category that
allows a mixture of land uses both vertical and horizontal including commercial and
institutional uses. It is intended that the MU district be allowed only for lands
located within a GDO overlay district or within other overlay districts with a similar
purpose and intent. The uses permitted in this district, the special uses that may
be allowed in this district and the uses for which site plan review and approval are
required are listed in Chart 1 unless otherwise regulated in this article. The
minimum lot and yard requirements, maximum height, maximum gross dwelling
unit density and the land use intensity ratios which govern any use in this district
are listed in Chart 2 unless otherwise regulated in this article. The use “dwelling,
multiple-family” is not permitted by right or special use permit in the MU zoning
district unless the property shall have been zoned MU on or before December 31,
2017, provided that all regulations and procedures set forth in this article (Appendix
A – Zoning) and all other applicable codes are satisfied.
SECTION 4. Appendix A, Chart 1, Uses Permitted by Zoning District, of the
Murfreesboro City Code is hereby amended under “Dwellings” in the “Multiple-Family”
row by adding a reference to Endnote 37 in every column but “CU”. A new Chart 1 is
attached hereto.
SECTION 5. Appendix A, Chart 1 Endnotes, Uses Permitted by Zoning District, of
the Murfreesboro City Code is hereby amended as follows:
Insert the following introductory paragraph prior to endnote 1:
The uses permitted in the various districts established in this article shall be
as identified in this section on Chart 1 USES PERMITTED BY ZONING
DISTRICT. Those uses identified in Chart 1 with a “X” at the intersection of
the uses row and a zoning district column shall be uses that are permitted
by right subject to site plan review and approval and the issuance of building
permits in those zoning districts. Those uses identified in Chart 1 with a “S”
at the intersection of the uses row and a zoning district column shall be uses
requiring site plan review and approval subject to the issuance of a special
use permit in accordance with the provisions of Sections 8 and 9 of this
article in those zoning districts. Those uses that are shown with no “X” or
“S” at the intersection of a uses row and a zoning district column shall be
uses that are prohibited and are not permitted or allowed in those districts.
Insert new 37. to read as follows:
37. The use “dwelling, multiple-family” shall be permitted by right in the RM-12,
RM-16, MU, and CBD zoning districts only if the property was zoned RM-
12, RM-16, MU, or CBD on or before December 31, 2017. Otherwise,
“dwelling, multiple family” shall not be a permitted use in the above zones.
SECTION 6. Appendix A of the Murfreesboro City Code is hereby amended by
removing all references to “RM-22”.
SECTION 7. That this Ordinance shall take effect fifteen (15) days after its
passage upon second and final reading, the public welfare and the welfare of the City
requiring it.
