The City Council reserves the right to meet in Executive Session closed to the public at any time in the course of this meeting to discuss matters listed on the agenda, as authorized by the Texas Open Meetings Act, Texas Government Code, Chapter 551, including §551.071 (private consultation with the attorney for the City); §551.072 (discussing purchase, exchange, lease or value of real property); §551.074 (discussing personnel or to hear complaints against personnel); and Scott Bradley §551.087 (discussing economic development negotiations). B. Economic & Community Development December 2, 2025 ISSUE: Consider and/or Act on the establishment of the Public Art in Murphy Program, to be funded by the established Community Enhancement Grant Program, including the purchase of two pieces of public art. Reagan Rothenberger, AICP, Director of Community & Economic Development SUMMARY: In 2025, the City Council adopted the City of Murphy Strategic Plan. This plan provides a significant amount of input to the development of community enhancements within the city. Objective 4.3 states, "Celebrate parks, creeks, and urban ecosystems". The goals under this objective include "ensure parks have modern amenities" and "create engaging places to gather." Furthermore, during the formulation of the Master Plan, there have been several community comments requesting that the city consider public art. Therefore, the staff proposes the development and funding of a public art program in the City of Murphy under the existing Community Enhancement Grant Program. At this time, the only form of public art in Murphy is the Mural on the Murphy Activity Center. No three-dimensional forms of art exist. The City of Murphy has taken proactive steps to engage with the Murphy Veterans Tribute. A design for the tribute has been finalized and is to be located at the east end of the plaza on the east front of City Hall. The city is managing the construction of the project, which is now expected to be complete by May of 2026. The site will be anchored by a significant bronze statue, and the tribute will be a contemplative place for all to appreciate. Funding for this project is expected to come from existing funds raised by the Tribute Committee, including past City- granted funds, and a parks grant from Collin County. Prior to the engagement with the Tribute and the assumption of the management of the project, staff had also begun weighing options for a public art installation elsewhere. Since 2025 marks the twentieth anniversary of the dedication of the Murphy Municipal Complex, the site will be receiving some attention with new plantings on the east front of the building, as well as some improvements to the pond on the west front. Staff have been considering how public art may also play into this occasion. There are several identified locations for public art within the "planting circles" located on the pond walking trail of the west front of City Hall. Staff has engaged an artist named Dale Rogers of Massachusetts, who creates striking Cor-Ten sculptures for cities across the United States. His work has been examined, and his track record of working with municipalities is strong. Therefore, the staff proposes the purchase and installation of two Dale Rogers sculptures, "Wise Owl" and "Sitting Dog", and placing them in two particular locations on the west front of City Hall, adjacent to the pond. These would be highly visible to those walking the trail and would be great photo ops for families to enjoy. Page 10 of 22 Agenda Item 8. B. It is the staff's intention to use these installations as a springboard for the program. All would be installed in the spring of 2026. It is expected that an "art council" will be established so that future art installations will have greater community engagement. This engagement would include the identification of key sites and potential artworks. FINANCIAL CONSIDERATIONS: The City of Murphy has contributed funding toward the Veterans Tribute over its lifetime and has dedicated a site and staff time to ensure its completion. For the Dale Rogers Sculptures, the total estimated cost is $20,000, including installation. Staff proposes using a portion or all of the current $15,000 allocation of the budgeted Community Enhancement Grant Funds for this. The difference will come through either a budget amendment in the future or other cost savings found within the MCDC or MDD budget. The rationale for using the Community Enhancement Grant is that staff does not expect any applicants in FY26. The Historical Society has disbanded, and the Veterans Tribute is underway - these have been the only applicants over the past few years. ACTION REQUIRED: Consider and/or Act on the request for funding from the Community Enhancement Grant Program to establish the Public Art in Murphy Program, including the purchase of two pieces of public art. Economic & Community Development December 2, 2025 ISSUE: Consider and/or Act on the amendment of the REVAMP Grant Program Guidelines. Reagan Rothenberger, AICP, Director of Community & Economic Development SUMMARY: In September 2021, the City of Murphy and Murphy Municipal Development District adopted the REVAMP (REVive & Advance Murphy's Prosperity) program. This is a simple 50/50 grant matching program intended for significant site improvements in the city. Since the time of its adoption, there has been only one applicant. City Staff desires to amend the Program Guidelines to potentially attract more applicants for the City's review and consideration. FINANCIAL CONSIDERATIONS: Each request will be reviewed individually, with appropriate budget amendments occurring after respective approvals of grants. ACTION REQUIRED: Consider and/or act on the proposed amendments. ANALYSIS: Generally, the changes are based in first; adding further clarification as to what site improvements may be considered, and secondly; increasing the grant consideration amounts. Remember that the amounts proposed are not a funding amount guaranteed to any applicant, but rather a guide for applicants. Each application will be reviewed by the MMDD board and potentially City Council if the threshold is met. ATTACHMENTS: Program Guidelines - 2025 Revision Proposal Page 16 of 22 Agenda Item 8. C. revamp GRANTS For Existing Murphy Businesses Approved September 2021 Program Guidelines I. Introduction The REVAMP (REVive and Advance Murphy’s Prosperity) Grant program was established by the City of Murphy and the Murphy Municipal Development District (MMDD) to provide local businesses with assistance to improve their properties. The purpose of the program is to visibly enhance the physical appearance of Murphy’s commercial district. The program will provide fifty/fifty matching grants of up to $10,000 for the funding of well-designed improvements that will enhance the physical appearance of local businesses. Grants will be processed and considered on a first come, first considered basis to commercial property owners or business tenants. The program will remain open until funds are depleted for the fiscal year. Nothing herein shall imply or suggest that the City of Murphy or the MMDD are under any obligation to provide any grant to any applicant. II. Eligibility Criteria Grant funds are available only for exterior work on commercial properties that are visible from public streets. All of the following criteria must be meet for participation in this program: A. The commercial property must be located within the City of Murphy. B. Property may be owner-occupied or tenant-occupied. In the case of a tenant-occupied property, the applicant must have the owner’s consent and have at least two (2) years remaining on the lease. C. Business must be open a minimum of 12 months from issuance of a Certificate of Occupancy. D. All taxes and other government fees and assessments must be current on the property. E. The property must be subject to the city’s ad valorem property tax. F. Non-profits, government offices, residences and home-based businesses are not eligible. G. Applicants who have an ongoing lawsuit or in any way parties to litigation against the City of Murphy are not eligible. III. Grant Assistance A. Program assistance is available for the following project categories: www.MurphyEDC.org | Page 1 of 4 Page 17 of 22 Agenda Item 8. C. 1) Building Improvements – upgrade a building exterior to meet the city’s Exterior Masonry Construction standards, Murphy Code of Ordinances Section 26.06, or otherwise significantly improve a building’s appearance from a main thoroughfare by the replacement of dated or worn materials, or inclusion of new visual features. Includes the replacement of or installation of new awnings and canopies, or major design changes with the addition of green spaces and creation of unique gathering spaces or environments. Maximum matching grant of $100,000. 2) Sign Improvements – new signs, renovation of existing signs, and removal of non- conforming (grandfathered) signs. Maximum matching grant of $10,000. 3)2) Other Property Improvements – items such as replacement of non-conforming signs, landscaping (no addition of greenspace added), parking lot improvements, lighting, and other site amenities such as outdoor seating areas.. Maximum matching grant of $510,000. B. Ineligible Improvements & Expenses include: 1) Interior improvements 2) New commercial construction 3) Exterior improvements away from located on the sides or rear of buildings out of street view 4) Parking lot re-striping only 5) Permitting fees 6) Architectural, survey or other professional fees 7) Sweat equity or “in-kind” services for labor 7)8) Repair of paving in a Fire Lane that is otherwise required by Fire Code. C. Grants are provided on a 50/50 matching basis with a cap of $10,000100,000 per property or business. D. Accumulative Maximum Grant: No property or business may receive more than $10,000100,000 in matching grants for one 12-month period. The following examples are provided to clarify different application scenarios: 1) Example 1: Applicant desires to do $9,000 in eligible Sign Improvements. By this policy, the maximum grant allowed by the max percentage (50%) would be $4,500. Further within a 12-month period the Applicant cannot receive more grants for Sign Improvements, but may apply and receive a second matching grant, not to exceed $5,500 ($10,000 max - $4,500 grant) for any project category other than signage. 2) Example 2: Applicant desires to do $22,000250,000 in eligible Building Improvements. By this policy, the maximum grant allowed by the max percentage (50%) would be $11,000125,000, but the maximum cap per property is $10,000100,000. The lesser of the two is $10,000100,000, which would be the maximum matching grant. Minimum grant provided by the CityThe city will not consider a grant less than shall be $2,5005,000 – a project total of $5,00010,000. F. Grants will not be provided for work that is already completed. G. All applications must contain a cost estimate/ bid from at least one qualified contractors or suppliers. H. Depending on the request, the applicant may be required to provide a site plan showing the address of the property and location of the proposed improvements. I. All improvements must be in compliance with standards set forth in the Murphy Code of Ordinances. J. Applicant is obligated to obtain all applicable permits and inspections related to the improvement project. Failure to do so will render the Applicant ineligible for grant funding. K. All work shall be completed within six (6) months from the date of the written agreement. If the applicant is unable to complete the work within this timeframe, applicant must make a written request for an extension. Extensions will be limited to two, 30-day periods. IV. Application Process A. Applicant is encouraged to meet with the Economic Development staff prior to application submittal. B. Applicant shall submit the completed “Application Form”, and all required detailed information to the Community & Economic Development Department, at: City Hall, 206 N. Murphy Rd, Murphy, TX, 75094. Or via email by sending the scanned documents to EcoDev@murphytx.org. C. Incomplete applications will not be considered. D. Applications will be considered on a monthly basis and must be submitted by the 10th date of the monthat least 30 days in advance in order to be considered the following month.of a MMDD meeting. E. Applications will be reviewed by the Economic Development staff and City Manager to determine viability, and whether the application is appropriate for review by the MMDD Board. City Staff, MMDD board, and/or City Council reserve the right to reject any application if the application does not clearly meet the goals and objectives of the City of Murphy. F. Grants of $5,000$10,000 or less can be approved solely by the MMDD board. Grants over $5,000$10,000 require the additional review and approval of City Council. G. The City may award applicant a grant with certain provisions, conditions, or other requirements as it may from time to time deem appropriate. H. A written performance agreement will be prepared and executed by all parties outlining the terms and conditions of any grants. V. Grant Payments A. An on-site inspection of the improvements will be performed by city staff. C. Payment of approved grants will be made to the applicant based on the terms of the written agreement. Kandi Jackson, TRMC, City Secretary SUMMARY: On June 3, 2025, the Council approved the creation of the Historic Resources Advisory Committee (HRAC) to help preserve the history of the City of Murphy, comprised of seven (7) members. Applications for all boards and commissions were accepted during September and October, with a deadline of October 17, 2025. A committee of three Council Members, comprised of Council Member Scott Smith (Place 2), Council Member Andrew Chase (Place 3), and Council Member Laura Deel (Place 5), made up the Boards & Commissions Interview Committee this year. On October 28, 2025, they interviewed 13 applicants for consideration for all expiring terms on Boards and Commissions. Seven of those applicants will be appointed to the HRAC. In addition, the committee shall have a vice-chairperson and a secretary who are elected by its members for one-year terms.
