Conference with Labor Negotiators The City Council will conduct a closed session, pursuant to Government Code Section 54957.6, with the City Manager, the City Attorney, and the City's negotiators, regarding labor negotiations with (1) the Murrieta General Employees’ Association; and (2) the Murrieta Supervisors’ Association. CS2. Conference with Legal Counsel - Existing Litigation The City Council will conduct a closed session, pursuant to Government Code Section 54956.9(d)(1), to confer with the City Manager, Administrative Services Director, Public Works Director, City Engineer, and legal counsel regarding 1 litigation case to which the City is a party. The title of such litigation is as follows: Procko v Murrieta; Case Number 5:22-cv-00005-JGB-SP; District Court of the Southern District of California. CS3. Conference with Legal Counsel - Anticipated Litigation The City Council will conduct a closed session with the City Manager and legal counsel, pursuant to Government Code Section 54956.9 (d)(2), because there is significant exposure to litigation in two cases. CS4. Conference with Legal Counsel - Existing Litigation The City Council will conduct a closed session with the City Manager, Administrative Services Director, and legal counsel, pursuant to Government Code Section 54956.95 (b), to consider the following worker’s compensation claims: (1) Joseph Pudelwitts v. City of Murrieta. Workers Compensation Appeals Board No. ADJ13146766, ADJ15792188, ADJ16868418, ADJ14418308; and (2) Sean Lawlor v. City of Murrieta. Reports shall not exceed three minutes. The City Clerk will use the computerized timer. PUBLIC COMMENTS (NON-AGENDA) At this time any person may address the governing bodies on any subject pertaining to City business, which does not relate to any item listed on the printed agenda. Normally no action may be considered or taken by the governing bodies on any matter not listed on the agenda . Each speaker will be limited to three minutes. Page 2 of 4 City Council Meeting Agenda April 16, 2024 CONSENT CALENDAR - APPROVAL OF ITEMS 1 – 6 All matters listed on the Consent Calendar are to be considered routine by the governing bodies, and will be enacted by one motion in the form listed. There will be no discussion of these items unless, before the governing body votes on the motion to adopt, specific items are removed from the Consent Calendar for separate motions. 1. Waive Reading of All Ordinance Adoptions on the Agenda and Read by Title Only Recommended Action: Waive reading, by title only, of all Ordinances and Resolutions. Said Ordinances and Resolutions which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. Minutes Recommended Action: Approve the minutes of the April 2, 2024 City Council Regular Meeting. 3. New Contract Services Agreements for Building and Safety Recommended Action: Award on-call consultant services agreements to BPR Consulting, Interwest, and True North Compliance Services for building inspection, plan check, and other miscellaneous services for the Building and Safety Division; Approve the agreements in not-to-exceed amounts of $650,000 combined in total per fiscal year or the available budget; and Authorize the City Manager to execute the agreements. 4. Professional Services Agreement - Market Research and Analysis Recommended Action: Authorize the City Manager to enter into a two-year agreement for market research and analysis services with up to three one-year optional extensions with The Retail Coach, LLC, in a form acceptable to the City Attorney. The total contract sum shall not exceed $137,500.00 over the entire contract term. 5. First Amendment to MGEA MOU 2022-24 Addressing Market Nights Event Pay and Schedule Issues Recommended Action: Adopt Resolution No. 24-4732 entitled: A Resolution of the City Council of the City of Murrieta, California, Accepting, Approving, and Adopting the First Amendment to the Memorandum of Understanding between the City of Murrieta and the Murrieta General Employee’s Association for the period July 1, 2022, through June 30, 2024. Delayed Approval to Purchase and Upfitting of Police Vehicles from FY 2022/23 Budget Recommended Action: Ratify the purchase of three police vehicles from Phil Long Dealerships, Inc.; and Approve an additional appropriation of $15,641.67 from the Supplemental Law Enforcement Fund (Fund 411) for this purchase in the Fiscal Year 2023/24 Operating Budget. PUBLIC HEARINGS 7. Adoption of Development Impact Fees and Nexus Study Recommended Action: Conduct a Public Hearing related to updating the City’s Development Impact Fees; Adopt Resolution No. 24-4733 entitled: A Resolution of the City Council of the City of Murrieta, California, Approving an Update of the Public Facilities Development Impact Fee Schedule and Amending the City’s Fee Schedule; and Adopt Resolution No. 24-4734 entitled: A Resolution of the City Council of the City of Murrieta, California, Adopting a Development Impact Fee Nexus Study, which Includes the Five-Year Fee Report (AB1600) for the Fiscal Year 2022/23 and Making Findings Required by the Mitigation Fee Act. GOVERNING BODY ANNOUNCEMENTS Governing Body Announcements is the opportunity for the City Council to provide miscellaneous reports and announcements. Announcements shall not exceed two minutes .
