Conference with Real Property Negotiator The City Council will conduct a closed session, pursuant to Government Code section 54956.8, to enable the City Council to consider negotiations and to give direction to its negotiators regarding that certain real property located at the Northwest Corner of Linnel Lane and Whitewood Road, Murrieta, Riverside County, CA, APN: 392-290-048. The City’s real property negotiators, the City Manager, the Assistant City Manager, and the City Attorney will seek direction from the City Council regarding the price and terms of this property. CS2. Conference with Real Property Negotiator The City Council will conduct a closed session, pursuant to Government Code section 54956.8, to enable the City Council to consider negotiations and to give direction to its negotiators regarding that certain real property, at the intersection of Kalmia and Jefferson, APN 906-080-041, 906-080-042, and 906-080-033 with Bold Communities, Fidelis Advisors, and Urban Pacific & Shopoff. The City’s real property negotiators, the City Manager, Assistant City Managers, Development Services Director, and City Attorney, will seek direction from the City Council regarding the price and terms for this property. CS3. Conference with Real Property Negotiator Recommended Action: The City Council will conduct a closed session, pursuant to Government Code section 54956.8, to enable the City Council to consider negotiations and to give direction to its negotiators regarding that certain real property, Town Square Park Amphitheater - 11 Town Square Park, Murrieta. The City’s real property negotiators, the City Manager, Assistant City Manager, Director of Economic Development, and City Attorney, will seek direction from the City Council regarding the price and terms for this property. CS4. Conference with Legal Counsel - Anticipated Litigation The City Council will conduct a closed session, pursuant to Government Code section 54956.9(d)(4), because the City is considering whether to initiate litigation in 5 cases. Waive Reading of All Ordinance Adoptions on the Agenda and Read by Title Only Recommended Action: Waive reading, by title only, of all Ordinances and Resolutions. Said Ordinances and Resolutions which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. Minutes Recommended Action: Approve the minutes of the August 6, 2024, City Council Special meeting. 3. Check Register July 2024 Recommended Action: Adopt Resolution 24-4780 entitled: A Resolution of the City Council of the City of Murrieta, California, Ratifying the Check Register for the month of July 2024 in the amount of $4,711,894.39 (Check Numbers 160469-160873). 4. Amending and Restating the Comprehensive Pay Schedule for Fiscal Year 2024/25 Recommended Action: Adopt Resolution No. 24-4781 entitled: A Resolution of the City Council of the City of Murrieta, California, Amending and Restating the Comprehensive Salary Schedule for Fiscal Year 2024/25. 5. VertiGIS Software Upgrade Recommended Action: Approve an agreement with VertiGIS for a one-time upgrade fee not to exceed $20,000, for a total project amount not to exceed $103,200; Authorize the exemption from bidding requirements; Approve an increase in the Fiscal Year 2024/25 Operating Budget as defined below; and Authorize the Mayor to execute the agreement. Adoption of an Ordinance of the City Council of the City of Murrieta, California, Amending Chapters 1.04, 1.32, and 8.20 of the Murrieta Municipal Council Revising the City’s Municipal Code to Provide Authority and Flexibility for the City to Recover the Costs Incurred in Abating Nuisances Recommended Action: Conduct the second reading and adopt Ordinance No. 608-24 entitled: An Ordinance of the City Council of the City of Murrieta, California, Amending Chapters 1.04, 1.32, and 8.20 of the Murrieta Municipal Council Revising the City’s Municipal Code to Provide Authority and Flexibility for the City to Recover the Costs Incurred in Abating Nuisances amending sections to define “responsible party,” clarify nuisance abatement options for the City, update provisions relating to the costs of abatement including attorney’s fees and costs, and establish lien and special assessment procedures for the recovery of nuisance abatement costs. 7. Approval of a Memorandum of Understanding with the County of Riverside for Services Pertaining to Vector Control and Onsite Wastewater Treatment Systems, and Enacting Regulations Pertaining thereto by Adopting Riverside County Code Chapter 8.36 (Control of Vectors) by Reference Recommended Action: Approve a memorandum of understanding with the County of Riverside and authorize the City Manager to execute the agreement; and Introduce and conduct the first reading of Ordinance No. 609-24 entitled: An Ordinance of the City Council of the City of Murrieta, California, Adopting by Reference Chapter 8.36 (Control of Vectors) of Title 8 (Health and Safety) of the County of Riverside County Code as a New Chapter in the Murrieta Municipal Code. 8. Second Reading - The Shops at the Triangle-Specific Plan Amendment 2023-00003 Recommended Action: Conduct the Second reading to Adopt Ordinance No. 607-24 entitled: An Ordinance of the City Council of the City of Murrieta, California, Approving and Adopting the Triangle Specific Plan Amendment No. 2 (Specific Plan 276 Amendment No. 2 - Formerly named Murrieta Springs Mall) for property located on 64.3 acres southerly of Murrieta Hot Springs Road, east of Interstate 15 and west of Interstate 215 (APN’s 910-390-001 through 910-390-003, 910-390-008 through -018, 910-390-020 through 910-390-022, 910-400-001 through -018) (Planning Case No. SP-2023-00003); subject to the Conditions of Approval in Exhibit A. 9. Fire Station 6 Land Swap Resolution and Exemption from the Surplus Land Act Recommended Action: Approve Resolution No. 24-4782 entitled: A Resolution of the City Council of the City of Murrieta, California, Making Findings Relating to the Proposed Transfer of a Portion of City-Owned Real Property Located at Assessor’s Parcel Number 963-060-086 to J&T Investments, Inc., in Exchange for Real Property Owned by J&T Investments, Inc., Located at Assessors Parcel Number 963-060-065 and Adoption of Exemption from the Surplus Land Act. Agreement with Willdan Engineering for As-Needed Fire Inspection and Plan Review Services Recommended Action: Award a consultant services agreement to Willdan Engineering for as-needed fire inspection and plan review services; Approve the three-year agreement in the amount of $240,000 per fiscal year for a total not to exceed $720,000; and Authorize the City Manager to execute the agreement. 11. Second Reading - Catalytic Converter Possession Municipal Codes Recommended Action: Conduct the second reading and adopt Ordinance No. 606-24 entitled: An Ordinance of the City Council of the City of Murrieta, California, Amending Title 9 of the Murrieta Municipal Code to Establish a New Chapter 9.35 to Set Forth Regulations Defining and Prohibiting the Unlawful Possession of Detached Catalytic Converters in the City of Murrieta and Adoption of Exemption From CEQA. 12. Acceptance of Public Improvements in Parcel Map 37612 Recommended Action: Accept the Public Improvements in Parcel Map 37612 located south of Murrieta Hot Springs Road and west of Delhaven Street; and Direct the Public Works Department to perform continued maintenance on the aforementioned public improvements in conformity with the City of Murrieta’s maintenance standard. 13. Construction Contract for the Murrieta Hot Springs Road Pavement Rehabilitation Project, CIP 13047 Recommended Action: Award the construction contract for the Murrieta Hot Springs Road Pavement Rehabilitation Project CIP No. 13047 to Onyx Paving Company, Inc. in the amount of $1,991,000; Authorize a fifteen percent (15%) construction contingency of $298,650; and Authorize the City Engineer to approve contract change orders not to exceed fifteen percent (15%) of the contract amount. 14. Notice of Completion of the Clinton Keith Road and Date Street Pavement Rehabilitation Project Recommended Action: Accept the improvements for the Clinton Keith Road and Date Street Pavement Rehabilitation project, CIP No. 8043, as complete; and Direct the City Clerk to record a Notice of Completion; and release bonds in accordance with State law and City ordinances. DISCUSSION 16. Los Alamos Sports Park Soccer Project - Amendment No. 1 to Agreement with Glenn Lukos Associates, Inc. and Amendment No. 1 to Agreement with Rick Recommended Action: Approve Amendment No. 1 to the Agreement with Glenn Lukos Associates, Inc.; Approve Amendment No. 1 to the Agreement with RICK; and Authorize the Mayor to execute both Amendments. 17. Approving a Tentative Agreement for a Successor Memorandum of Understanding between the City of Murrieta and the Murrieta General Employees’ Association for the Period July 1, 2024 through June 30, 2027 Recommended Action: Adopt Resolution No. 24-4783, entitled: A Resolution of the City Council of the City of Murrieta, California, Approving a Tentative Agreement for a Successor Memorandum of Understanding between the City of Murrieta and the Murrieta General Employees’ Association for the Period July 1, 2024 Through June 30, 2027. 18. Approving a Tentative Agreement for a Successor Memorandum of Understanding between the City of Murrieta and the Murrieta Supervisors’ Association for the Period July 1, 2024 through June 30, 2027 Recommended Action: Adopt Resolution No. 24-4784, entitled: A Resolution of the City Council of the City of Murrieta, California, Approving a Tentative Agreement for a Successor Memorandum of Understanding between the City of Murrieta and the Murrieta Supervisors’ Association for the Period July 1, 2024 through June 30, 2027. 19. Updated Murrieta Management, Professional, and Confidential Employees’ Compensation Plan Recommended Action: Adopt Resolution No. 24-4785 entitled: A Resolution of the City Council of the City of Murrieta, California, Approving an Updated Murrieta Management, Professional, and Confidential Employees’ Compensation Plan.
