Real Property Negotiations The City Council will conduct a closed session, pursuant to Government Code section 54956.8, to enable the City Council to consider negotiations and to give direction to its negotiators regarding that certain real property, at the intersection of Kalmia and Jefferson, APN 906-080-041, 906-080-042, and 906-080-033 with Bold Communities and Fidelis Advisors. The City’s real property negotiators, the City Manager, Assistant City Managers, Development Services Director, Economic Development Director, and City Attorney, will seek direction from the City Council regarding the price and terms for this property. CS2. Real Property Negotiations The City Council will conduct a closed session, pursuant to Government Code section 54956.8, to enable the City Council to consider negotiations and to give direction to its negotiators regarding that certain real property located at the Northwest Corner of Linnel Lane and Whitewood Road, Murrieta, Riverside County, CA, APN: 392-290-048 with KNE Real Estate. The City’s real property negotiators, the City Manager, the Assistant City Manager, Economic Development Director and the City Attorney will seek direction from the City Council regarding the price and terms of this property. CS3. Real Property Negotiations The City Council will conduct a closed session, pursuant to Government Code section 54956.8, to enable the City Council to consider negotiations and to give direction to its negotiators regarding that certain real property located in Murrieta, Riverside County, CA, APN: 916-380-011. The City’s real property negotiators, the City Manager, the Assistant City Manager, Economic Development Director and the City Attorney will seek direction from the City Council regarding the price and terms of this property. CS4. Conference with Legal Counsel - Anticipated Litigation The City Council will conduct a closed session, pursuant to Government Code section 54956.9(d)(2), because there is a significant exposure to litigation in two cases. CS5. Public Employee Appointment The City Council will conduct a closed session, pursuant to Government Code section 54957(b), to continue the process for the future appointment of an employee to the position of City Manager. Reports shall not exceed three minutes. The City Clerk will use the computerized timer. PUBLIC COMMENTS (NON-AGENDA) At this time any person may address the governing bodies on any subject pertaining to City business, which does not relate to any item listed on the printed agenda. There will be no discussion of these items unless, before the governing body votes on the motion to adopt, specific items are removed from the Consent Calendar for separate motions. 1. Waive Reading of All Ordinance Adoptions on the Agenda and Read by Title Only Recommended Action: Waive reading, by title only, of all Ordinances and Resolutions. Said Ordinances and Resolutions which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. Minutes Recommended Action: Approve the minutes of the July 31, 2024 Special Workshop, September 10, 2024 Special City Council meeting, and September 17, 2024 Regular City Council meeting. 3. Check Register August 2024 Recommended Action: Adopt Resolution No. 24-4787 entitled: A Resolution of the City Council of The City of Murrieta, California, Ratifying the Check Register for the Month of August 2024 in the amount of $10,078,917.49 (Check Numbers 160874-161383). 4. First Reading of Ordinance No. 611-24 Amending City Council Compensation Recommended Action: Conduct the first reading of Ordinance No. 611-24 entitled: An Ordinance of the City Council of the City of Murrieta, California, Amending the Compensation of the City Council. 5. Recap of July 31, 2024, City Council Priority Setting Workshop Recommended Action: Receive and file. 6. Repealing Surplus Language in Chapter 2 (City Manager) of the Murrieta Municipal Code Recommended Action: Adopt Ordinance No. 612-24 entitled: An Ordinance of the City Council of the City of Murrieta, California, to Repeal Murrieta Municipal Code Sections 2.08.090-2.08.130 and 2.08.150-2.08.170 which Set Forth Regulations for the City’s Relationship with the City Manager. Change Order for Construction Management Services for Sykes Ranch Park Improvements Recommended Action: Approve a change order to Purchase Order P03083 with Anser Advisory Management LLC in the amount of $14,753, for Construction Management Services for CIP 22010, Sykes Ranch Park improvements; and Approve a reallocation of funds from CIP 22011 to CIP 22010 necessary to fund the remaining expenses for this project. 8. Change Order for Construction Management Services for Tot Lot Improvements Phase 2 Recommended Action: Approve a change order to Purchase Order P03688 with Anser Advisory Management LLC, in the amount of $20,000, for Construction Management Services related to the Tot Lot Improvements Project Phase 2; and Approve an additional budgetary appropriation for Capital Improvement Projects 22029, 22030, and 22040. 9. Pickleball Courts Design Services Change Order Recommended Action: Approve a change order for Purchase Order P04153 to NV5, Inc., for pickleball court design services at Alderwood Park for $65,615, plus a 10% contingency of the total purchase order amount. 10. Agreement with the California Conservation Corps for As-Needed Defensible Space Clearing on City Properties Recommended Action: Approve an agreement with the California Conservation Corps for as-needed defensible space clearing on City properties; and Authorize the City Manager to execute the agreement. 11. City of Murrieta Local Hazard Mitigation Plan Annex Recommended Action: Adopt Resolution No. 24-4788 entitled: A Resolution of the City Council of the City of Murrieta, California, Adopting the 2023 City of Murrieta Local Hazard Mitigation Plan Annex to the Riverside County Operational Area Multi-Jurisdictional Hazard Mitigation Plan...recommendation Page 4 of 5 City Council Meeting Agenda - Amended October 1, 2024 12. Fiscal Year 2023 Fire Prevention & Safety Grant Award Recommended Action: Authorize the City Manager to accept the Fiscal Year 2023 Fire Prevention & Safety Grant award; and Authorize the City Manager to amend the Fiscal Year 2024/25 Operating Budget to allocate and appropriate the grant funds for $462,990.47. 13. Acceptance of Public Improvements in Tract Map 28532-4 Recommended Action: Accept the Public Improvements in Tract Map 28532-4 located north of Baxter Road and west of Menifee Road; and Direct the Department of Public Works to perform continued maintenance of the aforementioned public improvements in conformance with the City of Murrieta’s maintenance standard. PULLED CONSENT CALENDAR ITEMS DISCUSSION 14. All-Way Stop at Jackson Avenue and Magellan Street Intersection Recommended Action: Approve the installation of an all-way stop traffic control at the intersection of Jackson Avenue and Magellan Street.
