THE MUNICIPALITY OF MURRYSVILLE Regular Voting Meeting – Wednesday, July 20, 2022 Council of the Municipality of Murrysville held a Regular Voting Meeting on Wednesday, July 20, 2022, at 7:00 p.m. in the Municipal Building. Present at the meeting were Council members Dayne Dice, Jamie Lee Korns, Jason Lemak, Jamie Lingg, Mac McKenna, Tony Spadaro, Carl Stepanovich, and Mayor Synan. Also, present were Director of Community Development, James Morrison, and Solicitor, George Kotjarapoglus. Chief Administrator, Michael Nestico was absent. REGULAR VOTING MEETING AGENDA ROLL CALL/VOTING ORDER: Jamie Lingg, Mac McKenna, Jason Lemak, Tony Spadaro, Dayne Dice, Jamie Lee Korns, Carl Stepanovich, and Mayor Synan. PLEDGE OF ALLEGIANCE: Mr. Dice led the audience in the Pledge of Allegiance. UNISTED AMENDMENTS: Mr. Morrison stated that there will be no action on item number 13.C. because the stipulation has not been received yet. CONSENT CALENDAR ITEMS: A. Approval of July 6, 2022, Council Meeting Minutes B. Accounts Payable C. Cash Investments and Transfers Dr. Lee Korns made a motion to approve the Consent Calendar Items. Mr. Spadaro seconded. Mr. Dice noted that he will abstain from any payable matters, or any cash investments related to KU Resources. All those present voted aye. Motion approved. MAYOR’S COMMENTS: Mayor Synan presented the following announcements: Franklin Regional School District: Three-time All-American forward Anthony DiFalco, who had a stellar, four-year career at Franklin Regional, was nominated for USA Today’s national soccer player of the year for 2021-22. Three finalists and the winner will be announced virtually on July 31. He joins 23 others from 17 states on the national all-star team. Good luck to Anthony on that award. National Night Out will be held Tuesday, August 2nd from 4:00 pm to 7:00 pm at the Public Works garage. NNO enhances the relationship between neighbors and law enforcement while bringing back a true sense of community. Our Public Works Department, local Fire Departments and EMS will be there to meet the community. There will be four food trucks there: Hot Ash Pizza Food Truck, Concession Stand Food Truck, Roll Up Food Truck, and Sweets for the Streets. Concert in the Park, which includes live music, food, games, and fireworks will be held Saturday, August 13th from 3 pm – dusk at Murrysville Community Park on Wiestertown Road. Sometimes the time of the fireworks change depending on the weather. CHIEF ADMINISTRATOR’S COMMENTS: None COMMUNITY INPUT: None LIAISON COMMENTS AND COMMITTEE REPORTS: Mr. Lemak: The Library meets tomorrow at 7:00 pm. Mr. Stepanovich: The Planning Commission met on July 12th. There was a Public Hearing conducted on Olympus Energy, Hermes Gas Well Development which is located at the intersection of 380/286 and Logan Ferry Road. There was a team from Olympus Energy: presenters included the project manager, the traffic consultant, and the sound consultant. The area is 147 acres in Murrysville. They are requesting a variance in regard to trees and shrubs. There will be an access maintenance agreement. In regard to sound, they ran an ambient test which was 48 dba – the Titan Well was 58 dba. There have been no complaints, as of yet, with sound at the Titan Well. The second issue was Tommy’s Car Wash. The NPDES pollution item is in process and the PennDOT item is in process. FTMSA has indicated that the lateral in existence for Tommy’s Car Wash is sufficient. There will be 13 vacuum stations and there will be a five-foot retaining wall with a roof over the vacuum stations to minimize the sound. There is no equipment on the roof. It will be taken back to Planning to conclude some of the other items before forwarding to Council. There was a request to rezone approximately 21 acres on Logan Ferry Road from R-1 Residential to R-3 Residential to build twelve townhouses and one single family unit. It was rejected by the Planning Commission because of the infrastructure difficulties and citizen complaints. There is a possibility of duplexes on the land. The Parks and Recreation Foundation met on Monday. They have become members of the National Association of Park Foundations. They are looking at starting a pickup cornhole league in the fall at the Community Center. The current memorial benches are $1,500 for a composite bench and $750 for wood. There will be an increase in fee for a composite bench. A donation of at least $1,000 towards the Concert in the Park was made by the Foundation. The balance in the Foundation is $87, 454.74. Mr. Spadaro: Medic One did not meet. Dr. Lee Korns: Pension Committee did not meet. Mrs. Lingg: Franklin Regional School Board will meet next month. vmp -2- THE MUNICIPALITY OF MURRYSVILLE Regular Voting Meeting – Wednesday, July 20, 2022 Mr. McKenna: Parks and Recreation did meet last Tuesday. The “Welcome to the Park” signs were discussed. Most of the parks have them already. They are working with the Penn Franklin News and social media to have announcements of what’s going on in the parks and what’s happening in the community and to have it consistent so residents will know when and where to see the announcements. The last Tuesdays at Townsend was a huge success. There were over 300 people who attended, the band gave out prizes to those who were dancing, the food truck sold out and so did the beer truck. The next concert is July 26th. The next meeting of Parks and Recreation is August 16th, which will be dedicated to the parks surveys. Mr. Dice: FTMSA meets tomorrow at 6:00 pm. Consider approval of Municipal Alcohol Permit Policy #51-22, a formal policy establishing a permitting process to allow alcohol consumption within the Murrysville Community Center, Townsend Park (Upper and Lower Pavilions), Sardis Park (Pavilion #1 and #2), and the Clubhouse at Murrysville Community Park. Dr. Lee Korns made a motion to approve Municipal Alcohol Permit Policy #51-22, a formal policy establishing a permitting process to allow alcohol consumption within the Murrysville Community Center, Townsend Park (Upper and Lower Pavilions), Sardis Park (Pavilion #1 and #2), and the Clubhouse at Murrysville Community Park. Mr. McKenna seconded. Mr. Morrison stated that this policy was reviewed at the last meeting. Mr. Morrison noted that the Clubhouse has been a big success with high reviews coming back from people who have rented it. Mrs. Lingg wanted to clarify the security deposit fee of $350 for the alcohol permit. Is that in addition to the rental security deposit fee of $200 which would be $550 total security deposit for both rental and alcohol. Mr. Morrison answered yes. Usually that is paid by check and held until after the event. The security deposit is then returned when they return the key. All those present voted aye. Mr. McKenna made a motion to consider authorizing Fee Ordinance No. 1062-22, the Fee Ordinance, Chapter 112-6, an ordinance amending existing Fee Ordinance No. 1049-21. Dr. Lee Korns seconded. Mr. Morrison stated that this updates the Fee Ordinance to implement the policy previously passed. All those present voted aye. Motion approved. 13.C. Consider approval of the Joint Petition and Stipulation of Settlement under Tax Assessment Appeal No. 5729 of 2019 for the property located at Tax Map No. 49-21-00-0-057 bearing a physical address of 1 Wesco Lane. 13.D. Consider approval of Resolution #759-22, appointing delegates for the Westmoreland County Tax Collection Committee (T.C.C.). Mr. Lemak made a motion to consider approval of Resolution #759-22, appointing delegates for the Westmoreland County Tax Collection Committee (T.C.C.). Mrs. Lingg seconded. Mr. Morrison noted that the main delegate will be Jacie Milchak and the alternate being Michael Nestico. All those present voted aye. Motion approved. COMMUNITY DEVELOPMENT: None ENGINEERING: 15.A. Consider reducing the bond being held to insure completion of the required improvements at The Acres development in the amount of $1,282,228.20. Mr. Stepanovich made a motion to consider reducing the bond being held to insure completion of the required improvements at The Acres development in the amount of $1,282,228.20. Mr. Spadaro seconded. Mr. Morrison stated that the original bond on this was $1,339,758.20. The work is now complete with exception of the final wearing course of asphalt. A total of $57,530.00 will remain until that is completed. All those present voted aye. Motion approved.
