THE MUNICIPALITY OF MURRYSVILLE Regular Voting Meeting – Wednesday, November 16, 2022 Council of the Municipality of Murrysville held a Regular Voting Meeting on Wednesday, November 16, 2022, at 7:00 p.m. in the Municipal Building. Present at the meeting were Council members Dayne Dice, Jason Lemak, Jamie Lingg, Mac McKenna, Tony Spadaro, Carl Stepanovich, and Mayor Synan. Also present were Chief Administrator, Michael Nestico, Director of Finance, Jacie Milchak, Director of Recreation, Carly Greene, Director of Public Works, Bill Paiano, and Solicitor, George Kotjarapoglus. Council member Jamie Lee Korns was absent. REGULAR VOTING MEETING AGENDA ROLL CALL/VOTING ORDER: Jason Lemak, Jamie Lee Korns-absent, Carl Stepanovich, Tony Spadaro, Mac McKenna, Jamie Lingg, Dayne Dice, and Mayor Synan. PLEDGE OF ALLEGIANCE: Mr. Dice led the audience in the Pledge of Allegiance. UNISTED AMENDMENTS: None CONSENT CALENDAR ITEMS: A. Approval of November 2, 2022, Council Meeting Minutes B. Accounts Payable C. Cash Investments and Transfers Mr. Spadaro made a motion to approve the Consent Calendar Items. Mr. Stepanovich seconded. Mr. Dice noted that he will abstain from any payable matters related to KU Resources. All those present voted aye. Motion approved. MAYOR’S COMMENTS: Mayor Synan proceeded with a slide presentation for the following: Congratulations to the Junior Legion State Champions who had a visit to Harrisburg with State Representative Bob Brooks yesterday. We are very proud of them. Curbside Leaf Collection Program will have its last pickup on Saturday, December 3rd. Fill out the Curbside Leaf Collection Program Form to schedule a pick-up. There is a 20-bag limit. Deadline to sign up is the Thursday before the pickup date. Santa at Sardis, A Holiday Celebration, will be Saturday, December 3rd from 1:00 – 4:00 pm at Sardis Park on Rocky Hill Lane. Join us at the park for s’mores, a bonfire, carriage rides and Santa to kick off the holiday season. Bring a chair and enjoy the bonfire. Murrysville and Hempfield Parks & Recreation are sponsoring a bus trip to People’s Gas Holiday Market on Wednesday, December 14th. Cost is $35 per person. Light snacks will be provided. CHIEF ADMINISTRATOR’S COMMENTS: None COMMUNITY INPUT: Mr. Dice stated that people from the community can now say whatever they’d like as long as it is around three minutes. Kate Manka, 3806 School Road: Ms. Manka stated that she is here to address the idea of the amphitheater. Times are hard. She doesn’t know a lot of people in the Municipality who want to hear that we are spending up to $2million on an amphitheater. That is a big expenditure. She would like to know who is going to be in charge of approving events at the amphitheater. If it’s going to be a free-for-all, we are going to get some riff-raff. There are safety concerns – things can happen anywhere. She is not convinced that it is a necessity, much less the cost. Jeannette Pavlick, 4200 Colonial Drive: Ms. Pavlick stated that she agrees that the cost and the location of this amphitheater is not a good idea. How is the community going to benefit from this, besides the shows? It is not a centralized location where businesses and shops are benefiting from this. How do you know that Murrysville will utilize this or even want this? Who will pay for bringing the entertainment here and who will pay for security. Will this bring in drugs and theft to the area? This grant money isn’t free; we are paying for it somehow. Will there be influences in receiving this grant money? Be fiscally conservative if the cost is too high. Paul Metzler, 6962 Berkshire Drive: Mr. Metzler stated that he was here for a follow-up to the highway noise and sign situation near Manordale Farms area. He did receive a phone call from Gina Jones from Senator Pittman’s office. They did get the approval to install both signs that were submitted and wanted to know the status of that. Mr. Metzler stated that the State is going to install the one sign that is being manufactured and the other one is to be supplied by the borough. Public Work Director, Bill Paiano stated that staff needs some time to research the task because it is a State highway coming through the Municipality and it is a safety feature. Mr. Metzler asked about the highway noise situation, whether it will be a soundwall or paving of the concrete to reduce the noise. Gina Jones had indicated that PennDOT is going to approve putting asphalt at the intersection of Harrison City Road and near the entrance to Manordale Farms. Has anyone talked to PennDOT about extending that to the quarter mile area? Mayor Synan stated that they will have to meet with the State Representative and either Senator Pittman or Senator Ward. Mr. Metzler will need to follow up with them to see if they asked PennDOT to do that. Mayor Synan said to let him know when a meeting is set up and he will try to attend. Mr. Dice said to let Council know also. Ed Mittereder, 105 Park Lane: Mr. Mittereder stated that the amphitheater has been a project talked about for a long time. The cost from the inception and the theory to where we are today has really risen vmp -2- THE MUNICIPALITY OF MURRYSVILLE Regular Voting Meeting – Wednesday, November 16, 2022 drastically. Grant money is great but that can run out and get dry really quick. How much has the cost actually gone up with add-ons and change orders? You are looking at something that is going to get limited use. When the weather is nice it can benefit the community. Who is in charge and approve what events will be coming in? Who is going to enforce the safety and security out there? Is that going to fall on our police force? Has another study been done? Will that infrastructure support the heavy traffic anticipated? Was any kind of traffic study done? How about a noise study? Was any of that taken into consideration? Money is getting tighter, and costs are going up. Somewhere along the line, someone has to pay for that and it’s usually the taxpayer. Mr. Mittereder stated that on behalf of his wife Valerie, who is in charge of the Murrysville Community Shelter Team, many residents may not know that in case of any disaster, there is a group of volunteers that have gone through extensive training for the safety of the people in case you get displaced from your home. Currently with the help of Pastor Dan and the Alliance Church, if we need to use their facility, we can for around 100 people or so. Pastor Dan had a generator brought into their church, because that is important if you have no power. The other facility looked at was the Murrysville Community Center. He had heard that a generator was approved but never heard anything more about it. One would be between $25,000-30,000. Can Council find a way to put that into the budget for the year-round use for that facility. Mr. Dice noted that the amphitheater project was sent to the Parks & Recreation Board for them to discuss and give Council a recommendation on how to proceed or if to proceed. There were a lot of good questions asked tonight. As far as the grants go, there are no strings attached to any grants other than sometimes we have to match the funds given. Tonight is not the time to get into another discussion about the amphitheater. Parks & Recreation will give Council their recommendations. Council will then have anther discussion and will let the public know when that discussion will be. LIAISON COMMENTS AND COMMITTEE REPORTS: Mr. McKenna: Just a reminder that Santa at Sardis is on Saturday, December 3rd from 1:00 – 4:00 pm. They have an unbelievable bonfire thanks to Bill and the Public Works Department. Bring out the family. It is a great event. Parks and Recreation did meet last Tuesday. A huge discussion was had in regard to the amphitheater. A lot of questions were asked by people on the Parks and Recreation Board. The staff did go back and put a briefing together that starts from the inception of the project back in 2016 to what it was then in scope to right now. It has every number associated with that, every amenity that was associated with that and all questions they had asked were incorporated into that. The Parks and Recreation Board is reviewing that now and anticipate having a recommendation possibly at the next meeting or the second meeting in December. The Parks and Recreation Board is going to give him their written response to Council which will be read at the meeting for Council to discuss and then do what they need to do. Mrs. Lingg: Franklin Regional School Board met on Monday, November 14th. It was both a Board and Committee-of-the Whole meeting. There were no mutual concerns. It was a quick meeting. Mr. Spadaro: Medic One meets tomorrow night Mr. Stepanovich: Planning Commission met last week. He was working the polls so has no input from the meeting. The Parks and Recreation Foundation will meet this coming Monday. vmp -3- THE MUNICIPALITY OF MURRYSVILLE Regular Voting Meeting – Wednesday, November 16, 2022 Mr. Lemak: The Murrysville Community Library meets tomorrow evening. WORKSHOP ITEMS ADMINISTRATION: 9.A. Discussion of 2023 Budget Mr. Dice noted that that Budget was presented to Council. If anyone has any questions or concerns, now would be the time to bring it up. Mrs. Lingg had a question regarding Page #68 Authorized Number of Employees: Director of Community Development, 0. Are we not going to be filling that position? Mr. Nestico answered that the position would be a contracted position, not a salary position. Therefore, it would be under Contracted Services of the Community Development Department. Ms. Milchak stated that she did talk with Mr. Morrison, who would like to be put on payroll for taxing purposes. The Budget will need to be adjusted to have Mr. Morrison as a part-time employee. ENGINEERING: None COMMUNITY DEVELOPMENT: None PUBLIC WORKS AND PARKS: None COUNCIL ACTION ITEMS ADMINISTRATION: 13.A. Consider approval of the Westmoreland County Transit Authority local share assessment Mr. Lemak made a motion to approve the Westmoreland County Transit Authority local share assessment. Mr. McKenna seconded. Mr. Nestico stated that this is a routine item completed each year. The amount is $1,375.50 for the fiscal year 2022 to 2023. This is for the Westmoreland County Transit Authority to run one bus route through the Municipality that runs from Arnold Palmer Airport, through Delmont and on William Penn Highway into Pittsburgh. Ms. Milchak added that this is typical. Any time there is a bus route that goes through they assess a share assessment. The requested local share has been at the same lever since 2018-2019. All those present voted aye. Motion approved. 13.B. Consider approval of Resolution No. 766-22, a Resolution to dispose of certain municipal records in accordance with the State Records Retention Policy Mr. Stepanovich made a motion to approve Resolution No. 766-22, a Resolution to dispose of certain municipal records in accordance with the State Records Retention Policy. Mr. Spadaro seconded. vmp -4- THE MUNICIPALITY OF MURRYSVILLE Regular Voting Meeting – Wednesday, November 16, 2022 Mr. Nestico stated that this item requires Council approval by resolution of any destruction of municipal records. This includes different development plans, building permits, invoices, and other items that have met the 7-year expiration period. The records are preserved in digital format. Al those present voted aye. Motion approved. COMMUNITY DEVELOPMENT: None ENGINEERING: None PUBLIC WORKS AND PARKS: 16.A. Consider authorization in advertise for bids for sale of used municipal vehicles and equipment Mr. McKenna made a motion to authorize advertising for bids for sale of used municipal vehicles and equipment. Mr. Spadaro seconded. Mr. Paiano stated that this is our way of periodically selling off surplus equipment or used equipment that is either out of date or not used any more. This year we intend to sell 3 garage doors of various sizes, 1 light tower from the Korean War, a 2007 Peterbilt dump truck, and a 1991 Mack tank truck. Municibid is going to be used for the sale of the vehicles and equipment. They do all the deliberations. All those present voted aye. Motion approved. OLD BUSINESS: Mrs. Lingg stated that two of the speakers this evening brought up the traffic infrastructure for the amphitheater. Could Council get a copy of the traffic study? Mr. Nestico stated that he is not aware of a traffic study being conducted for that. Mrs. Lingg stated that she thinks it is required by ordinance to have a traffic study done (Ordinance No. 955-16, section 201-141). Mr. Nestico stated that he would look into that.
