THE MUNICIPALITY OF MURRYSVILLE Regular Voting Meeting – Tuesday, June 18, 2024 Council of the Municipality of Murrysville held a Regular Voting Meeting on Tuesday, June 18, 2024, at 7:00 p.m. in the Municipal Building. Present at the meeting were Council members Eli Diacopoulos, Jason Lemak, Jamie Lingg, Mac McKenna, Matthew Olszewski, Carl Stepanovich, and Mayor Synan. Also, present were Chief Administrator, Michael Nestico, and Solicitor, Wes Long. Council President, Dayne Dice was absent. REGULAR VOTING MEETING AGENDA PLEDGE OF ALLEGIANCE: Council Vice President, Mac McKenna led the audience in the Pledge of Allegiance. ROLL CALL/VOTING ORDER: Carl Stepanovich, Matthew Olszewski, Eli Diacopoulos, Dayne Dice-absent, Mac McKenna, Jamie Lingg, Jason Lemak, and Mayor Synan. UNISTED AMENDMENTS: None CONSENT CALENDAR ITEMS: A. Approval of June 5, 2024 Council Meeting Minutes B. Accounts Payable C. Cash Investments and Transfers Mrs. Lingg made a motion to approve Items A through C, Consent Calendar Items. Mr. Olszewski seconded. All those present voted aye. Motion approved. MAYOR’S COMMENTS: Mayor Synan presented the following announcements. Murrysville Farmers' Market continues on Thursdays, June 6th - September 26th, from 3:00 pm to 7:00 pm at 3235 Sardis Road next to Murrysville Volunteer Fire Department. Tuesdays at Townsend Park with free live performances from 6:30 p.m. to 8:00 p.m. will be June 25th, July 9th and 23rd, and August 6th and 20th. Any cancellations will be posted on the Facebook event page and our website. The Mayor wanted to thank Public Works for the great job they did with responding to trees down during the storms last night and today. Just a note to residents that we, including Public Works, Fire Departments, Police, and EMS, cannot do anything with trees that have live wires on them until West Penn Power comes and removes the wires or cuts off the power. CHIEF ADMINISTRATOR’S COMMENTS: Mr. Nestico wanted the community to be aware that there will be overnight road repairs being done by Peoples Gas on Old William Penn Highway between Sardis Road and North Hills Road occurring from Wednesday evening to Friday evening. This is down by Ferri’s Pharmacy. vmp -1- THE MUNICIPALITY OF MURRYSVILLE Regular Voting Meeting – Tuesday, June 18, 2024 Chief Seefeld is retiring at the end of the month. The swearing in for Tom Kusinsky and Dave Coleman will be on Monday, July 1st at 10:00 a.m. The new Code Enforcement Officer starts on Monday, June 24th. She was previously a Code Officer in another municipality, so does come in with some experience. There are quite a few calls we have been receiving from the community regarding high grass, weeds, etc. Hopefully she can hit the ground running with some of the complaints which have been building up. Just to make Council and the community aware, the traffic signal at Route 380 and Saltsburg Road is now in operation at a temporary capacity and will become permanent. The signal is considered a continuous green “T”. The only other location in the area that has a continuous green “T” is at the Donegal Turnpike interchange. The outside lane continues and has a green light at all times. The folks coming onto the roadway from Saltsburg Road would have to stop at the traffic signal and once they receive a green light would proceed and merge in with the existing traffic going north bound on Route 380. It is a bit of a change, and residents will have to become acclimated and adapt to this this new signal. PennDOT approved this signal type because of the nature of that intersection with speed on the roadway, sight distance, and stopping distance. Mr. McKenna wanted to thank Chief Seefeld for his service. Murrysville has been blessed with one of the best chiefs that anyone could ask for. Enjoy your retirement! COMMUNITY INPUT: None LIAISON COMMENTS AND COMMITTEE REPORTS: Mr. Diacopoulos: The Pension Committee doesn’t meet again until August. Mr. Olszewski: EAC meets next week. Mrs. Lingg: The last Planning Commission meeting was to be held on June 11 th, but there was no quorum so no official business was conducted. Mr. Stepanovich: Murrysville Parks and Recreation Foundation met this past Monday. Concert in the Park sponsorships are being received. The election of officers was held. Nick Subich will be President and Gabby Viragova will be Vice President. Carly will meet with Stroll Magazine on June 25th to discuss advertising the Foundation. Tuesdays at Townsend was very well attended on the 11th. The Foundation had a tent there with a donation jar. There is going to be participation by the Foundation on July 14th in a 5K on the Westmoreland County Heritage Trail. Mr. Lemak: Parks and Recreation did meet last Tuesday. He was unable to attend. Advertise Fee Ordinance No. 1089-24, the Fee Ordinance, Chapter 112-6, an Ordinance amending existing Fee Ordinance No. 1074-23. Mr. Stepanovich made a motion to advertise Fee Ordinance No. 1089-24, the Fee Ordinance, Chapter 112- 6, an Ordinance amending existing Fee Ordinance No. 1074-23. Mrs. Lingg seconded. Mr. Nestico stated that this is for an update to the Solicitation Ordinance. We wanted to adjust the fees for soliciting to ensure that they are in compliance with all State and Federal laws. This would just be for door- to-door solicitation. Solicitor Long noted that we were contacted by counsel for companies and entities that considered challenging our Solicitation Ordinance because of the way it is written. The ordinance is being reviewed to see if it is fine as is or if it needs modification. Mr. Nestico and himself are working with outside counsel regarding those matters to see if we can come to an agreement as to what needs modified and in what manner and fashion. The ordinance itself and the fee schedule are being looked at. The opposing counsel is out of Dallas, Texas and we have not yet heard back from them on the modifications. All those present voted aye. Advertise Ordinance No. 1090-24, the Solicitation Ordinance, amending Chapter 169, Peddling and Soliciting, prescribing regulations for peddling and soliciting, providing for exceptions thereto; providing for license/permitting of persons engaged in such activities; setting certain limitations on such activities; establishing a no soliciting or peddling list and establishing penalties for violations of this Ordinance. The Solicitation Ordinance itself provides all the regulations as it relates to soliciting. The fees are set by the Fee Ordinance. This is going to address the hours that solicitation may occur in the community. All those present voted aye. Motion approved. 13.C. Advertise for a vacancy on the Zoning Hearing Board. Mr. Diacopoulos made a motion to advertise for a vacancy on the Zoning Hearing Board. Mr. Stepanovich seconded. Mr. Nestico stated that last month Council accepted the resignation of Greg Hammil from the Zoning Hearing Board so there is a vacancy. The Municipal Code requires us to advertise for vacancy on boards and commissions. If anyone in the community does have interest in a position on the Zoning Hearing Board, please submit a letter of interest to the municipal building. The Zoning Hearing Board meets occasionally, just several times a year when there is a zoning matter. Members of the Zoning Hearing Board are not bonded because they don’t handle any revenue. Mr. Nestico noted that, historically, there have been a lot of professional residents that have filled that position: attorneys, engineers, architects, but anyone can qualify. The advertisement will be in the Penn Franklin News, on the website, social media, and word of mouth. All those present voted aye. Motion approved. COMMUNITY DEVELOPMENT: None ENGINEERING: None 15.A. Award the contract for DPW-3-24, 2024 Chip Seal Project, to Russell Standard Corporation in an amount not to exceed $179,800. Mrs. Lingg made a motion to award the contract for DPW-3-24, 2024 Chip Seal Project, to Russell Standard Corporation in an amount not to exceed $179,800. Mr. Olszewski seconded. Mr. Nestico stated that this is for the Chip Seal Project this summer. There were two bidders. Russell Standard Corporation was the low bidder at $179,800. The second bidder was Midland Asphalt Materials at $182,125. This item was budgeted out of the Capital Reserve in the amount of $235,000. The remaining budget funds will be used by Public Works to prepare the roads for treatment. All those present voted aye. Motion approved.
