CONSENT CALENDAR: 5.A. 1004-2017 City Council Meeting Minutes Recommendation: Approve the June 20, 2017 Regular City Council Meeting Minutes. 5.B. 1017-2017 City Council Special Meeting Minutes Recommendation: Approve the July 3, 2017 Special City Council Meeting Minutes. 5.C. 1003-2017 Napa Municipal Code Chapter 3.44 “Mello-Roos Community Facilities Act Taxes” Recommendation: Approve the second reading and final adoption of an Ordinance Amending Napa Municipal Code Title 3 To Add a New Chapter 3.44 "Mello-Roos Community Facilities Act Taxes". 5.D. 1002-2017 Rezoning of Property Located on the west side of Soscol Avenue, south of Sousa Lane Recommendation: Approve the second reading and final passage, and adopt an ordinance amending the Zoning Map established under Section 17.04.050 of the Napa Municipal Code pertaining to the rezoning of property located at 459 and 473 Soscol Avenue from MP-G3, Tulocay Village, to CC, Community Commercial District and determine that the actions authorized by this ordinance were adequately analyzed by a previous CEQA action. 5.E. 980-2017 League of California Cities Voting Delegate Recommendation: Appoint a City Council Voting Delegate and an Alternate to the League of California Cities Annual Business Meeting. 5.F. 1022-2017 Stoddard West Apartments Project CDBG Loan CITY OF NAPA Page 2 of 7 Printed on 8/4/2017 CITY COUNCIL REGULAR MEETING AGENDA July 18, 2017 Recommendation: Adopt a resolution approving a loan from the City of Napa Community Development Block Grant Fund in the amount of $2,000,000 to Burbank Housing Development Corporation for the Stoddard West Apartments Project; and determining that the actions authorized by this resolution were adequately analyzed by previous CEQA and NEPA actions. 5.G. 921-2017 Monthly Budget and Investment Statement Recommendation: Receive and file the Monthly Budget and Investment Statement as of May 31, 2017. 5.H. 992-2017 Public Safety Software and Systems Support Recommendation: Authorize the Finance Director to execute an agreement with Cloud 5 Solutions, LLC for Public Safety Software and Systems Support for an amount not-to-exceed $300,000. 5.I. 1000-2017 Chemical Supply Purchase Contracts for Potable Water Treatment Plant Facilities Recommendation: (1) Determine that the proposed contracts with Chemtrade Chemicals US, and Univar USA, for the purchase of chemical supplies for potable water treatment plant facilities meet the requirements for procurement of supplies via existing contracts with another public agency (North Bay Chemical Agency Pool), as set forth in Napa Municipal Code Section 2.91.060; and (2) Authorize the Public Works Director to approve contracts and issue purchase orders for Fiscal Year 2017-18 and Fiscal Year 2018-19 in an amount not to exceed $800,000 per Fiscal Year for aluminum sulfate, and in an amount not to exceed $250,000 per Fiscal Year for sodium hydroxide (caustic soda) for use at the three City of Napa potable water treatment facilities, and determine this action is exempt from CEQA. 5.J. 1010-2017 Water Meter Equipment Purchase Contract Recommendation: (1) Determine that the proposed contract with National Meter and Automation, Inc., for purchase of water meters and associated items meets the requirements for acquisition of a specialty item, as set forth in Napa Municipal Code Section 2.91.050; and (2) Authorize the Public Works Director to approve a contract and issue a purchase order issued to National Meter and Automation, Inc., for Fiscal Years 2017-2018 and 2018-2019 in an amount not to exceed $1,565,900 to purchase water meters and associated items for use in the municipal water distribution system, and determine this action is exempt from CEQA. 5.K. 1026-2017 State Water Project Water Supply Payment Recommendation: Adopt a resolution approving amendment to the adopted Water Enterprise Fund Budget for 2016/17, and determining that the actions authorized by this resolution are exempt from CEQA. ADMINISTRATIVE REPORTS: 1011-2017 Citywide Travel Demand Model Recommendation: Receive a presentation on the Citywide Travel Demand Model for the City of Napa. 998-2017 OpenGov web-based financial and budget data Recommendation: Receive a brief demonstration, provide input and ask questions regarding the City's upcoming rollout of the OpenGov web-based public data portal. 7. CONSENT HEARINGS: 7.A. 719-2017 Conveying to Adjacent Property Owners a Portion of the former alignment of California Boulevard, from the Trancas Street/Highway 29 Interchange Project Recommendation: (1) Adopt a resolution authorizing a Grant of Easement and Agreement for Shared Driveway Access and Maintenance affecting a portion of former California Boulevard, and determining that the actions authorized by this resolution were adequately analyzed by a previous CEQA action; and (2) Adopt a resolution authorizing the conditional abandonment and sale of a portion of former California Boulevard as excess property from the Trancas Street/Highway 29 Interchange Project, and determining that the actions authorized by this resolution were adequately analyzed by a previous CEQA action. 7.B. 993-2017 Community Development Block Grant (CDBG) Program Annual Action Plan Recommendation: Adopt a resolution adopting the Community Development Block Grant (CDBG) Fiscal Year 2017-2018 Annual Action Plan and program budget; approving program certifications, authorizing the City Manager to execute all documents; and determining that that actions authorized by this resolution are exempt from CEQA. 9. CONDUCT OF CITY COUNCIL MEETINGS: Meetings are conducted in accordance with the requirements of state law (the “Ralph M. Brown Act,” California Government Code Sections 54950, et seq.) and the City’s Rules of Order (Council Policy Resolution 19). Members of the public may address the Council at designated times and are expected to conduct themselves with courtesy and respect. Speakers should direct comments to the Mayor and City Councilmembers, not the audience. Speakers are expected to yield the floor when the time limit is identified and comply with the City ’s Rules of Order. Speaking times are limited to no more than three minutes per person, with the exception of certain hearings and appeals, or at the discretion of the Mayor or City Council. CONSENT HEARINGS: These items are considered routine and may be approved by a single vote; however, any member of the public or City Council may remove an item for consideration during the public hearing portion of the agenda. PUBLIC HEARINGS/APPEALS During any public hearing or appeal, any person may directly address the City Council. Applicants (or appellants) are allowed 10 minutes to present testimony at the beginning of the public hearing, and if needed, 5 minutes to present rebuttal at the end of the public hearing. All other speakers will be limited to 3 minutes. CLOSED SESSION The City Council is authorized to meet in closed session, without attendance by the public, on limited confidential topics such as pending litigation, real property negotiations, or personnel or labor matters. CALIFORNIA ENVIRONMENTAL QUALITY ACT: The California Environmental Quality Act (“CEQA”) is the state law that requires the City to evaluate and document the potential environmental consequences of discretionary decision. (See, California Public Resources Code Sections 21000 - 21189.3; and the “CEQA Guidelines” at California Code of Regulations Title 14, Division 6, Chapter 3, Sections 15000 - 15387). For each item that requires a CEQA determination by City Council, there is a reference to that determination on this agenda, and more information regarding the CEQA analysis is included in the documents that accompany this Agenda. To the extent that City staff determines that particular items are not subject to CEQA, there will be no indication of a CEQA action on this Agenda. CHALLENGES TO DECISIONS MADE BY THE CITY COUNCIL: If a person wishes to file a legal challenge to any decision made by the City Council, you may be limited to raising only those issues which you or someone else raised during the meeting, or in a written communication received by the City Clerk prior to or during the meeting. In addition, a legal challenge may be limited or barred where the interested party has not sought and exhausted all available administrative remedies. The time limit to commence any legal challenge may be subject to strict timing requirements, and failure to comply with applicable timing requirements may result in a legal challenge being barred. Any lawsuit or legal challenge to any quasi-adjudicative decision made by the City Council is governed by Section 1094.6 of the Code of Civil Procedure, unless a shorter limitation period is specified by any other provision. Under Section 1094.6, any lawsuit or legal challenge to any quasi-adjudicative decision made by City Council must be filed no later than the 90th day following the date on which such decision becomes final.
