CALL TO ORDER: 1:30 p.m. 1.A. Roll Call: Present: 5- Councilmember Gentry, Councilmember Krider, Councilmember Sedgley, Vice Mayor Mott, and Mayor Techel 2. AGENDA REVIEW AND SUPPLEMENTAL REPORTS: City Clerk Roberts announced the following supplemental information: 4.A. General Plan Advisory Committee. · Email dated October 26, 2018 from applicant Emma Swain. · Email with attachment received October 30, 2018 from Councilmember Doris Gentry. 3. PUBLIC COMMENT: Mayor Techel began the meeting by explaining the process of the interviews. She explained she would allow Councilmember comments first, followed by public comments, which would be limited to matters appearing on the agenda and taken as each item was heard. No more than 13 members should be chosen, leaving two seats open until after the General Muncipal Election in November. At that time, two additional members could be added in order to create a more ethnically diverse Committee. Under City Council comments, Councilmember Gentry voiced concern that the individuals that Mayor Techel and Councilmember Sedgley had chosen as the Nomination Committee did not include more representation from the business community. She suggested delaying all the appointments until after a new City Council was seated in December. Councilmember Sedgley and Vice Mayor Mott voiced that they did not support delaying the interviews. Mayor Techel called for public comment. She suggested the committee think in the long-term and consider subjects such as global warming and issues related to sustainability and the environment. Wayne O’Connell, resident, stated the city was struggling with the policies from the previous General Plan and voiced concern about the lack of diversity of the applicants. There was no further public comment regarding the interviews. 4. COMMISSION INTERVIEWS AND APPOINTMENTS: 4.A. 1611-2018 General Plan Advisory Committee Indexes: General Plan Mayor Techel began the interviews. The following people were interviewed (listed in order of interviews): Steven Cuddy, Tracy Krumpen, Michelle Dahme, Danielle Barreca, Anthony Zand, Chuck Shinnamon, Elizabeth McKinne, Kara Brunzell, John Glasser, Micky Mantle, Patrick Band. A short break was called at 2:54 p.m. and reconvened at 3:08 p.m. The remaining applicants were interviewed in the following order: Howard Siegel, Lauren Ackerman, Deborah McDonald, Sandina Bailo, Eric Haygard, Roman Block, Ted Ward, Jason Priestly, Jennifer Stewart. City Clerk Roberts stated due to scheduling conflicts, applicants Emma Swain and Heather McCollister were not able to attend the interview; however, both reiterated their interest in being considered for appointment. The Mayor and City Councilmembers were distributed paper tally sheets to rank the interviews on a scale of 1 through 5, with 5 being the highest score and most qualified. A short break was taken to allow the City Clerk and Deputy City Clerk to tally the scores. After tallying the scores, Deputy Clerk Carranza displayed the scores on the projector, showing those applicants with the highest scores listed on top, and announced the scores. Due to an error of a zero scoring for some applicants, the zeros were changed to ones. It was noted that the instructions were to score one to five. After all zeros were changed to ones, the Clerk retallied the results and the 13 top rated applicants were chosen as follows: Shinnamon:25 Glasser:25 CITY OF NAPA Page 2 Printed on 11/15/2018 CITY COUNCIL MEETING MINUTES - Final October 30, 2018 Cuddy:24 Barreca:24 MacDonald:23 Ward:22 Priestly:21 Ackerman:20 Siegel:20 Band:19 Stewart:19 Zand:18 Dahme:18 A motion was made by Councimlember Krider, seconded by Vice Mayor Mott, to appoint thirteen initial members, with two appointments to be made after the November 2018 Municipal Election as follows: Charles Shinnamon, John Glasser, Stephen Cuddy, Danielle Barreca, Deborah Macdonald, Ted Ward, Jason Priestly, Lauren Ackerman, Howard Siegel, Patrick Band, Jennifer Stewart, Anthony Zand, and Michelle Dahme. The motion carried by the following vote: Aye: 5- Gentry, Krider, Sedgley, Mott, and Techel 5. CONSENT CALENDAR: 5.A. 1620-2018 U.S. Senate Bill S. 3157 - STREAMLINE Small Cell Deployment Act Mayor Techel called for public comment; no one came forward to speak. A motion was made by Councilmember Sedgley, seconded by Councilmember Krider, to authorize the Mayor to sign a Letter of Opposition to Senators Feinstein and Harris regarding S. 3157 - the STREAMLINE Small Cell Deployment Act. The motion was carried by the following vote: Aye: 5- Gentry, Krider, Sedgley, Mott, and Techel 6. COMMENTS BY COUNCIL OR CITY MANAGER: Interim City Manager Potter announced that City Clerk Roberts would retire in December and that the Closed Session item concerned next steps in filling the vacancy that would be created by her departure. 7. CLOSED SESSION: 4:15 p.m. City Attorney announced the following Closed Session item: 7.A. 1615-2018 • PUBLIC EMPLOYEE APPOINTMENT, Title: Interim City Clerk (California Government Code section 54957). CONFERENCE WITH LABOR NEGOTIATORS for the unrepresented employee position of the Interim City Clerk, with the City's designated representatives: the Mayor, the City Attorney, and the City Manager (California Government Code section 54957.6). CONDUCT OF CITY COUNCIL MEETINGS: Meetings are conducted in accordance with the requirements of state law (the “Ralph M. Brown Act,” California Government Code Sections 54950, et seq.) and the City’s Rules of Order (Council Policy Resolution 19). Members of the public may address the Council at designated times and are expected to conduct themselves with courtesy and respect. Speakers should direct comments to the Mayor and City Councilmembers, not the audience . Speakers are expected to yield the floor when the time limit is identified and comply with the City ’s Rules of Order. Speaking times are limited to no more than three minutes per person, with the exception of certain hearings and appeals, or at the discretion of the Mayor or City Council. ADMINISTRATIVE REPORTS Only the Mayor or a majority of the City Council may authorize public input after an administrative report item is introduced. CONSENT HEARINGS: These items are considered routine and may be approved by a single vote; however, any member of the public or City Council may remove an item for consideration during the public hearing portion of the agenda. PUBLIC HEARINGS/APPEALS During any public hearing or appeal, any person may directly address the City Council. Applicants (or appellants) are allowed 10 minutes to present testimony at the beginning of the public hearing, and if needed, 5 minutes to present rebuttal at the end of the public hearing. All other speakers will be limited to 3 minutes. CLOSED SESSION The City Council is authorized to meet in closed session, without attendance by the public, on limited confidential topics such as pending litigation, real property negotiations, or personnel or labor matters. CALIFORNIA ENVIRONMENTAL QUALITY ACT: The California Environmental Quality Act (“CEQA”) is the state law that requires the City to evaluate and document the potential environmental consequences of discretionary decision. (See, California Public Resources Code Sections 21000 - 21189.3; and the “CEQA Guidelines” at California Code of Regulations Title 14, Division 6, Chapter 3, Sections 15000 - 15387). For each item that requires a CEQA determination by City Council, there is a reference to that determination on this agenda, and more information regarding the CEQA analysis is included in the documents that accompany this Agenda. To the extent that City staff determines that particular items are not subject to CEQA, there will be no indication of a CEQA action on this Agenda. CHALLENGES TO DECISIONS MADE BY THE CITY COUNCIL: If a person wishes to file a legal challenge to any decision made by the City Council, you may be limited to raising only those issues which you or someone else raised during the meeting, or in a written communication received by the City Clerk prior to or during the meeting. In addition, a legal challenge may be limited or barred where the interested party has not sought and exhausted all available administrative remedies. The time limit to commence any legal challenge may be subject to strict timing requirements, and failure to comply with applicable timing requirements may result in a legal challenge being barred. Any lawsuit or legal challenge to any quasi -adjudicative decision made by the City Council is governed by Section 1094.6 of the Code of Civil Procedure, unless a shorter limitation period is specified by any other provision. Under Section 1094.6, any lawsuit or legal challenge to any quasi-adjudicative decision made by City Council must be filed no later than the 90th day following the date on which such decision becomes final.
