A regular meeting of the Board of Aldermen was held Tuesday, December 9, 2014; at 7:30 p.m. in the Aldermanic Chamber. President David W. Deane presided; City Clerk Paul R. Bergeron recorded. IN THE AMOUNT OF $5,104,172 Board of Aldermen – 12/09/14 Page 2 ON THE QUESTION President Deane I did speak with Deputy Chief Gallipeau who spoke with Mr. Mansfield and the one question that I had covered was the repeaters in the front line apparatus fire trucks that they use. My question had to do with whether the repeaters in the back line equipment were being replaced so if the front line equipment went done that they would have appropriate coverage if needed and I was told that was accounted for. Alderman McCarthy I wanted to thank Mr. Mansfield for the work he did on negotiating with Motorola. You will notice that this is down further than what we told it would be. Alderman Siegel I want to echo Alderman McCarthy’s praise of Mr. Mansfield, especially in light of some of the not so pleasant things we have seen. We have an ordinance that says a stop sign is supposed to up there. It went back up and taken back down. President Deane It’s a “No Parking” sign. Alderman Chasse Is it because of the Broad Street Parkway? Mayor Lozeau Yes, Alderman Chasse; as I explained to Mr. Cutter at the Board of Public Works meeting there was an ordinance that replaced the existing language that had a parking sign there and based on what was adopted by this Board, that plan changed and it now currently reflects the ordinances passed by this Board. It was put up after the phone call that took place in error by the traffic department and was taken down as soon as the error was brought to our attention by other residents in that area. I certainly have no problem with the personnel that we have, their skill sets or their job performance but unfortunately, we are running out of rabbits to pull out of the hat and like many of our contracts they are above any reasonable expectation for what we have for flexibility for next years’ budget. As somebody that’s obviously spent some time looking at the budget; as many of us have in trying to figure out in advance what we can do, I am sort of concerned. I think our CFO has clearly outlined a big hit we are going to take with the pension adjustment coming up and that’s going to really cut us in ways that we may not be expecting. If we pass this we are saying that we are going to have to eliminate something elsewhere and the choices that we make may be very unattractive. Unfortunately, the next budget season I suspect will not be fun. Our budget is pretty tight and there is not a lot of waste in there that one can find. In this particular instance I look at what is the elasticity of the contract, the relative Board of Aldermen – 12/09/14 Page 6 ability for people to seek employment elsewhere and what are our risks. Again, I appreciate the efforts but right now our employees are working for approximately, in the regular industry, close to top scale; at least for electricians which I did research using date from the state. That doesn’t include the fact that there are pensions and benefits which are not typically paid at least at that level of private industry. Under other circumstances we might not think too hard about this and say these are good guys doing a good job but this budget is one of the departments that is the biggest portion of the city budget and because they are already at the top of the scale in competitive wages – it’s not like when the police contract came before us where we had direct evidence that we were at risk for losing police officers; we have actually lost police officers and there was something that needed to be done to address that. I urge you to consider that. I understand that people may not agree with me but we have some hard decisions and we really have to start thinking about them. Now is the time, on the front end of the process. It’s much more difficult once the contract is signed and we have to look people in the eye and potentially say that you can’t work here anymore. Alderman Soucy I would like to pull one more rabbit out of the hat. Alderman Siegel mentioned that there are going to have to be some cuts. Yes, but that’s going to be up to the School Board as to where they are going to make those cuts. I remember clearly Mr. Conrad sitting in that chair and he was asked “is this how you want to spend your money?” We all know that there is only going to be so much money. It is going to be a rough year next year but I am going to support this. The School Board apparently supports it and Mr. Conrad supports it. They haven’t had a raise since July, 2013. I am going to support this and leave the hard work initially up to the Board of Education. Alderman Schoneman I appreciate the comments from Alderman Soucy and Alderman Siegel. I think though that we have already heard, at least in the press, what the School Board is thinking about for a budget for next year and it exceeds any Cap and my guess is that although we would like to hold the School Board to such a limit, I don’t think they are heading in that direction. If that’s the case then we are adding fuel to an engine that we just can’t afford to run. My concern is as what was expressed earlier this evening that we are setting ourselves up for a very difficult situation. I don’t want to support something now that later I have to blame for going higher than the Cap. Alderman Moriarty I have been consistent all along. I have played no favorites on the contracts and I’ve made the difficult decisions and I am going to vote against this for the same reason. The real salary average across the country has gone down every year since 2007. People are not getting 2% raises; they are not even getting 2.5% or 2.56%. I do not believe that the Board of Education and Superintendent Conrad are going to hold the line on salaries and I do not believe that they are going to make the difficult decision to keep the budget to what is sustainable to our tax payers but I will. Alderman Chasse It’s ironic, I mentioned it once before. Many of the custodians do not want this contract for the simple reason that there is a clause in there that they could be forced to work the 16 hours. If they come off of their shift and someone doesn’t show up for the next one they have to stay there. Many of them have said do not want it but the union still passed the contract. It’s a difficult decision. I would like a roll call. Alderman Sheehan I don’t know how many of you this morning heard from people that wondered why the custodians were not their earlier with the ice storm. I think it’s important that we are able to contractually require people to do a job that sometimes has a big impact. When it takes two teachers to get one child off a bus because it’s a wipe out. There are times that we need to be able to mandate people to work and that’s important and I Board of Aldermen – 12/09/14 Page 7 don’t think that we can just look at school with well this is how much we have and this is how much…school is the number one priority that we have. We don’t get a year back with a student and when you are looking for houses there isn’t a sheet there on your real estate page that talks about how often your trash is picked up or how often your roads are swept. It does however give our schools a grade and some of our grades are ones and two’s. Those are not things that we should be proud of, we are not funding this to the level that it needs to be funded to and to cut it even more now because we are not doing it in light of what might come later; there’s going to be work to be done for next year but we can’t just say that schools are going to have to be cut in line with everything else. There are things that have to be done and schools are one of them and they are what I hear about most and it’s one of the most important things that drives the whole value of our community and what our tax base is and that is what we need to keep in mind. I am voting in favor of this because I think it is important that we have that ability to have custodians there when we need to have them there. Alderman Schoneman I want to address the issue of prioritization. I’ve talked about this before and I think it’s vital and that’s what we are facing in this situation. I would disagree with my colleague Alderman Sheehan about what constitutes the highest priority. I believe that a taxpayer has a reasonable expectation for public safety and I think that makes the police department number one. They need to be able to go to sleep at night and believe that they are going to wake up safe in the morning. Secondly, I think that the public has a reasonable expectation of good roads, bridges, and infrastructure; that’s what they pay taxes for and I know it’s a difficult thing and it may not be exactly politically correct but I think that the school system falls below those two. I say that because everybody benefits from public safety and from good infrastructure and families with children benefit from schools. I understand the argument for property values but I don’t think it’s as strong as the argument that can be made to prioritize public safety and infrastructure. UNFINISHED BUSINESS – ORDINANCES – None NEW BUSINESS – RESOLUTIONS – None NEW BUSINESS – ORDINANCES – None PERIOD FOR GENERAL PUBLIC COMMENT Mr. Jim Cutter, 86 Palm Street Dear President Deane, In all due respect Mayor Lozeau is attempting to take advantage of a mistake made in Ordinance O-12-025 per new street design with a $10 violation fine to override Ordinance O-00-24 per a no parking sign with a $50 violation fine that gives it superior authority. This misconduct in office of hers was prompted by her friend who does not like the shortage of parking spaces on our street from Kinsley Street to West Hollis Street and a no parking sign in front of her business would take away two parking spaces. As head of the DPW, Mayor Lozeau can do anything she wants in that department except break the law. Ordinance O-00-24 states there should be a no parking sign. It was confirmed by Lisa Fauteux, Director of DPW, and Steve Dookran, City Engineer, who agreed with me after they did a June to September study. On September 4, they had a new sign installed only to have Mayor Lozeau order it removed five days later. City Charter, Section 57, Removals from Office, shows the Board of Aldermen has the authority to order the no parking sign back where it had been. Because time is of the essence due to ice and snow conditions that make installing a sign difficult we are looking for the Board of Aldermen’s approval this evening. Board of Aldermen – 12/09/14 Page 9 REMARKS BY THE MEMBERS OF THE BOARD OF ALDERMEN Alderman McCarthy This afternoon we had the first of what I hope will be a number of input sessions on the discussion of a Performing Arts Center for Nashua. I want to thank Alderman Siegel, Alderman Donchess, and Alderman Deane for attending that session. There were about 35 members of the arts community and some members of the public that were there in a facilitated 3-hour session to discuss some of the needs of the facility and priorities. A number of people have asked what was the outcome of the meeting. It’s hard to recap it because it took place in four groups and the results will be rolled up by the Community Development Department and made available. I believe there is some discussion of having a follow-up meeting in January to continue but I think it was a very positive first step towards looking at that proposal and I look forward to having more meetings. This one was held during the day I believe because that is when some of the people from the art’s community whose input was desired were available. I’m sure there will be some of them that will be held at night and other times so other groups of people can attend and I encourage members of the community and members of this Board to get involved in that process. Alderman Dowd I have a lot of meetings going on at work this week and I may not be able to be at the Infrastructure Committee meeting tomorrow night. I wanted to mention that Sharon Avenue; that left turn situation has been looked at for quite some time. I know that my predecessor Alderman Rose had concerns and I had voiced concerns but I am willing to wait because there are private groups that are willing to contribute significantly to solving the problem and other problems with regard to the jug handles and that’s going ahead rather quickly. I would wait to do anything until we see the results of that action. Alderman Schoneman I attended the Santa in the Park event on Sunday at Greeley Park and I want to thank the organizers for that, particularly Imelda Murphy who does a tremendous amount of work, the Friends of Greeley Park, and the Parks & Recreation Department who provided a lot of support. It was a great turnout and I am very grateful for those who contributed so much. Alderman Soucy I am very pleased about our R-14-095 recognizing the Nashua Police Athletic League. I was very fortunate that Chief Donald Gross appointed me as the Program Director for 10 years of my police department years. They were the best years ever. To watch this program grow to where it was in its infancy; 25 years later to see what it is all about is amazing. It is a non-profit that is worth supporting and I hope it is around for another 25 years. Alderman Donchess I would like to second Alderman Soucy’s thoughts about the Police Athletic League and I know that Alderwoman Melizzi-Golja has been active with them as well and they do a fine job. I also wanted to elaborate on the Santa in the Park event. It is a really nice event. The neighbors of the park decorate in a very elaborate fashion the gazebo and they dress up in the traditional old fashioned garb. Compliments of Alderman Schoneman there were roasted chestnuts and Irish sausages. Children and families are welcome absolutely free to visit Santa Clause. There is a long list of children’s names there of kids that have been judged to have behaved very well and there are so many names that almost any child can find their name on the list. It was a wonderful event and a lot of effort went into it by Imelda Murphy and Tom Dwayne from the Parks & Rec Department has been dedicated to this event for a number of years and volunteers a lot of time towards it. Board of Aldermen – 12/09/14 Page 10 Alderman Moriarty To give credit where credit is due, you have heard me in the past say that I wonder whether the appointments, whether we have interest from people outside of Nashua. We have people from Pelham and Hollis and I think that’s cool. Whether or not you are for or against selling alcohol at Keefe Auditorium, show up on Saturday. The Symphony New Hampshire is playing the Holiday Pops Concert and New Hampshire local and 2014 American Idol finalist Alex Preston will be the guest there and I hope I see you there. Alderman Siegel I want to say a special thanks to Chris & Billy Fogus from Martha’s Exchange. Unfortunately Villa Blanca is closed but I think it says a lot about Nashua that they stepped up to the plate to honor those gift cards. Alderwoman Melizzi-Golja I would like to thank Mr. Patenaude & Mr. Leonard from Pennichuck Water for making themselves and their staff available to give us a tour of the facility on Concord Street as well as the Will Street facility on Saturday morning. I think it gave us a better insight to the Will Street facility and what their space is like as compared to their needs. I am also glad to hear that the meeting earlier today was successful and that there was a large turnout regarding an Art’s Center. I unfortunately couldn’t attend because my work schedule is not quite as flexible as some others so I am looking forward to evening meetings that I will be able to attend. Finally, Happy Hanukkah to those in our community who begin their celebration tonight. Alderwoman Brown I too would also like to congratulate P.A.L. on their 25th anniversary and to those who are celebrating Hanukkah; I wish them a happy one. On a sadder note, I would like to extend heartfelt sympathy to the Mulcahey family, their son Tommy passed away. He was 27 and he went to Nashua High School South and it’s very sad. Alderman Wilshire I also want to congratulate the Police Athletic League for 25 years of providing some really awesome services to the kids in the community. Also a thank you to Pennichuck for the tour on Saturday, it was very interesting and enlightening. President Deane It was very sad reading about that 3 year old girl that was murdered. It’s something we don’t have a lot of control over but I hope something can be done to stop that sort of thing from happening. I would like to thank our Public Work’s Department for all of the work they did over that Thanksgiving Day storm along with our police and fire departments. There was a lot of work done between the snow storm, the downed trees, the wires, the trash pick-up, the sidewalk plowing, and the downtown being cleaned up for the stroll on Saturday night. Sunday morning it looked like no one had been there. We all appreciate everyone’s efforts. Madame Mayor, I would like to ask you to do is put a link on the home page regarding the Sergeant’s Avenue Playground so people can see the design. Mayor Lozeau Sure. Board of Aldermen – 12/09/14 Page 11 Committee announcements: Alderman Dowd Wednesday of this coming week will be a Construction Committee Meeting at 7:00pm and then the JSSB Committee at 8:00pm at NHS North. We have two major projects going on and we need to take some action on them so I hope the members will appear. Alderman Chasse There’s a Personnel Meeting on the 22nd in the Aldermanic Chamber. Alderman Donchess The Infrastructure Committee will meet tomorrow at 7:00pm in the Aldermanic Chamber. Alderman Moriarty The Cable Television Advisory Board will meet tomorrow and have the public hearing on the new franchise contract with Comcast. Currently it is going to move forward as is unless there is public comment otherwise. Next Tuesday at 7:00pm is Planning and Economic Development Committee in the Aldermanic Chamber and then next Wednesday at 7:00pm is the Finance Committee in the Aldermanic Chamber. Alderman Donchess With regard to the cable franchise renewal, I’ve asked the legal department about this and we are going to talk about it but maybe it would be worth having some type of public briefing as to what authority the city really has with respect to this renewal. I think many people misbelieve that the city’s legal authority to do things is greater than it really is. My understanding of it is not all that clear so I think it would be helpful if at some point there were a clear explanation of what the city’s authority is. President Deane I think the federal government took all of that away. Alderman Donchess I think that’s true but I think it would be helpful to have some kind of statement as to what this is all about. President Deane The Special Board of Aldermen meeting with regard to the pawn broker has been rescheduled to the 29th and I’ve been working with Mr. Farrington of the Board of Education and we have scheduled a joint meeting on January 8th at 7:00pm at the Nashua High School North. Mr. Conrad and Mr. Farrington are working on some topics. Alderwoman Melizzi-Golja was kind enough to assist me in that area and we provided them with a short list. Alderman Moriarty An answer to Alderman Donchess’ question is that tomorrow at 7:00pm the Cable Television Advisory Board is going to have a presentation on the franchise contract renewal and I suspect that they will probably talk about issues about the franchise and what we can and cannot do. I don’t understand and I don’t think most people understand what the parameters are. Alderwoman Melizzi-Golja I agree with Alderman Donchess. I think something should be put together and be made available on the city’s website. Alderman Dowd If they are doing a presentation then maybe that presentation can be made available to the Board.
