MINUTES BOARD OF MAYOR AND BURGESSES REGULAR MEETING August 3, 2010 1. Mayor Robert Mezzo called the meeting to order at 6:01 p.m. with the following in attendance: BURGESSES: RESIDENTS: T. K. Mallane, WPCA 2. Mayor Mezzo led in the Pledge of Allegiance to the flag. 3. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the minutes of the regular meeting of July 6, 2010. Each member received copies for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the monthly reports of July. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns to recess to Executive Session at 6:03 p.m. for discussion on the following: Collective Bargaining (VNA and Chapter 90 – Assistant Tax Collector) Personnel (Fire Chief and Assistant Animal Control Officer). No one outside of the Board was invited in. Mayor Mezzo reconvened the meeting at 7:00 p.m. 6. The following motions emanated from Executive Session.  -2- Minutes – Board of Mayor and Burgesses Regular Meeting – August 3, 2010 VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses authorize Mayor Robert Mezzo to enter into a memorandum of agreement dated July 7, 2010 between the Borough of Naugatuck and the Borough of Naugatuck Supervisors Chapter 90, C.S.E.A., Local 2001, SEIU. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses authorize Mayor Robert Mezzo to enter into a separation agreement and general release between the Borough of Naugatuck and Sean Godejohn. 7. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses recess to the Firemen’s Pension Plan “C” Board at 7:03 p.m. Mayor Mezzo reconvened the meeting at 7:11 p.m. 8. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses accept the stipulated agreement dated June 17, 2010 between Louis Grella and the Borough of Naugatuck subject to the approval of the stipulated agreement by the Connecticut Workers’ Compensation Commission. 9. Public Comment Residents spoke on the following issues: • Blight Committee • Charter Revision status • Illegal dumping at a blighted property on Damson Lane Mayoral Aide Ed Carter thanked all the volunteers and the following sponsors for their participation in making the Classic Car Show on July 31st a success: Naugatuck Valley Savings and Loan, Naugatuck Savings Bank, Sibby’s Automotive, Buckmiller Funeral Home, Fitzpatrick, Mariano and Santos, G and R Manufacturing, B Bouncing Party Rentals, Ground Up Car Restoration, Valvoline Instant Oil Change, Beacon Falls Park and Recreation, Local 1219 Naugatuck Firefighters and Team Image. 10. Burgess Comments/Sub-Committee Reports Burgess Kuczenski asked if there was anything that the Zoning Department could do with the blighted property on Damson Lane.  -3- Minutes – Board of Mayor and Burgesses Regular Meeting – August 3, 2010 Burgess Ciacciarella said he was saddened by the news that Fire Chief Charles Doback is retiring. He thanked the Chief for his many years of service and wished him luck in the future. He feels the Chief did an excellent job. Burgess Ciacciarella said he has received phone calls regarding the odor at the Treatment Plant. He informed everyone about a public hearing being held at the Water Pollution Control Authority’s next meeting on August 19th. Burgess Neth echoed the comments made regarding Chief Doback. He said the Chief is a terrific professional. You couldn’t ask for a better person in that position and he will be sorely missed. Deputy Mayor Rossi apologized to Chief Doback. She said it was extremely unfortunate to have him go through contract negotiations in the paper. The Deputy Mayor said it was a privilege and an honor to work with Chief Doback. He is a true community oriented person. She thanked Ed Carter the volunteers and sponsors for making the car show a success. She encouraged everyone to support the small stage theatre production company opening in Naugatuck. Mayor Mezzo thanked Chief Doback for his service and professionalism. He has always been a gentleman especially through the past few weeks of media attention. He wished the Chief and his family well. He thanked Ed Carter for all of his hard work on the car show. He also thanked Jim Stewart for arranging the public hearing regarding the Treatment Plant at the WPCA meeting. The Mayor said the Board of Education budget deficit of $950,000. is now $205,000. Credit should go to the Board of Education, teachers and Wayne McAllister. He said there will be a special Board of Mayor and Burgesses meeting to discuss the proposed blight ordinance on August 17, 2010 at 7 p.m. Burgess Burns thanked Chief Doback for his years of service. He said he is one of the most prestigious people in Naugatuck. Burgess Burns said it is a loss to Naugatuck. He said something needs to be done regarding skateboarders around Town Hall. Burgess Fragoso encouraged everyone to support new businesses, fairs and events being held this time of year. Burgess Fragoso thanked Chief Doback for his continued service over the past twenty-five years. He has been an extremely professional and honorable man. He will be sorely missed. She wishes all the best to the Chief and his family. Burgess Scully thanked Chief Doback and Officer Grella and wished them well on their retirement. The Zoning Commission is in the process of changing the Zoning Regulations to allow bars to be located near churches and schools. He said if others feel the same way as he does, then they should speak against the change. Burgess Campbell said it is difficult to retire from a job you love. He was not a firefighter under many chiefs but not Chief Doback. When they worked side by side, he always felt safe knowing he was on the scene. He will be known as the best Chief in Naugatuck.  -4- Minutes – Board of Mayor and Burgesses Regular Meeting – August 3, 2010 11. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses add to the agenda discussion/possible action regarding the Connecticut Department of Transportation Letter Agreement. 12. Mayor Mezzo said the Borough has been in negotiations with the Department of Transportation in conjunction with Renaissance Place. There is a letter of agreement to partner together on a parking structure and to transfer title to the Borough two parcels at the end of Elm Street. He said the letter agreement is agreeing to accept the property. No action was taken at this time. 13. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the reappointment of Brian Wright, (U) 461 Spring Street, Naugatuck, CT 06770 as an alternate member of the Golf Course Commission, term to expire July 1, 2013. 14. Mayor Mezzo reappointed Lieutenant Todd Brouillette, 211 Spring Street, Naugatuck, CT 06770 as a regular member of the Northwest Connecticut Public Safety Communication Center Inc., term to expire April 1, 2012. 15. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the bid and authorize the Mayor to execute all contracts and documents for the “Fire Department Drug and Alcohol Testing Program” Connecticut Council of Municipalities, 900 Chapel Street 9th Floor, New Haven, CT 06510 in the amount of $80 per individual subject to random testing as recommended by Jeannette Deschesnes, Human Resources Director. 16. The Board discussed the updated Non-Union Personnel Policy Manual. The Board had questions regarding the changes made to the policy. Human Resources Director Jeannette Deschesnes was unable to be in attendance because she had to attend a Special Police Commission meeting. The vote to adopt the policy was tabled until Ms. Deschesnes has an opportunity to explain the changes. 17. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the bid and authorize the Mayor to execute all contracts and documents for the “Kitchen Upgrades for the Naugatuck Housing Authority at the Lewis Circle Housing Development” to Stanley Construction, 6 White Deer Lane, Seymour, CT 06483  -5- Minutes – Board of Mayor and Burgesses Regular Meeting – August 3, 2010 in the amount of $154,900.00 as recommended by Kevin Knowles, Naugatuck Housing Authority Director. 18. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the bid and authorize the Mayor to execute all contracts and documents for “Roofing and Siding Upgrades for the Naugatuck Housing Authority at the Robert E. Hutt Congregate Housing” to Rocky’s Home Improvement, 706 West Redding Road, West Redding, CT 06896 in the amount of $87,650.00 as recommended by Kevin Knowles, Naugatuck Housing Authority Director. 19. Motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the bid and authorize the Mayor to execute all contracts and documents for “Nursery Plants” to Millane Nurseries, 604 Main Street, Cromwell, CT 06410 in the amount of $5,907.50 as recommended by James Stewart, Public Works Director. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses waive the bid and authorize the Mayor to execute all contracts and documents for “Hauling Services for Recyclables brought to the CRRA Facility in Watertown” to USA Hauling and Recycling Inc., P. O. Box 718, 9 Shoham Road, East Windsor, CT 06088 in the amount of $120.75 per haul as recommended by James Stewart, Public Works Director. 21. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses waive the bid and authorize the Mayor to execute all contracts and documents for “Tub Grinding Services” to Greencycle of the Northeast Inc., 232 Colt Highway, Farmington, CT 06032 in the amount of $3,260.00 per day as recommended by James Stewart, Public Works Director.  -6- Minutes – Board of Mayor and Burgesses Regular Meeting – August 3, 2010 22. Public Comment Fire Chief Charles Doback told the Board he appreciates the effort that went into implementing the drug and alcohol program. He agrees with Burgess Neth that the lowest bidder is not always the best. He congratulated Louis Grella on his retirement and said his service saved the Borough thousands and thousands of dollars on vehicle repairs. He wished him a healthy retirement. Chief Doback addressed the negotiations of his contract. He said it was unfortunate that it was played out in the media; it wasn’t his intention to handle it that way. He was on a planned vacation and was going to first address his position with his bosses, the Fire Commission and the Board of Mayor and Burgesses, not the media. The Fire Chief/ Fire Marshal position is very time demanding and underpaid. He was not comfortable taking a contract as a department head that does not have a set salary in place. The Chief said he overstep one requirement in his contract and is not making any excuses for that but he said he did whatever the position required of him all hours of the day. He thanked the present and past burgesses, the Finance Board, the Fire Commission and Controller Wayne McAllister for everything they have done to help him make the department one he is proud of. He is very happy with the decision that he has made. 24. Burgess Comments/Sub-Committee Reports Burgess Fragoso said the vouchers for the Farmers Market are available at the Senior Center. She said Deputy Chief Hanks will be the interim acting chief when Chief Doback retires on September 9th. Chief Doback will stay on as Fire Marshal until a replacement is found. Deputy Mayor Rossi said there will be an Art Reception at the Senior Center on September 2nd from 6-8 p.m. The Blight and Beautification Council has been established as a 501C3 and their funds are being run through the NEDC. (Deputy Mayor Rossi’s comments are attached as submitted.)  -7- Minutes – Board of Mayor and Burgesses Regular Meeting – August 3, 2010 Burgess Neth said there are weeds growing in between the brick road. The principal of the school would like it to look nice for the first day of school. Burgess Ciacciarella said there will be a Union City fall clean up day in September. Burgess Kuczenski said Chief Doback is the best. 25. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully to adjourn the meeting at 8:45 p.m. A recording of this meeting is available in the office of the Borough Clerk for further review.
