MINUTES BOARD OF MAYOR AND BURGESSES REGULAR MEETING DECEMBER 7, 2010 1. Mayor Robert Mezzo called the meeting to order at 6:30 p.m. with the following in attendance: BURGESSES: RESIDENTS: T. K. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the minutes of the regular meeting of November 3, 2010. Each member received a copy for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the monthly reports of November. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns to recess to Executive Session at 6:32 p.m. for discussion on the following: Collective Bargaining (UPSEU/Clerical Collective Bargaining Agreement) Collective Bargaining/Personnel (Fire Marshal and Second Assistant Fire Chief) inviting in Human Resources Director J. Deschesnes. Mayor Mezzo reconvened the meeting at 7:00 p.m. 6. There were no motions emanating from Executive Session. -2- Minutes – Board of Mayor and Burgesses Regular Meeting – December 7, 2010 7. Burgess Comments/Sub-Committee Reports Burgess Kuczenski is upset with residents not shoveling their sidewalks on City Hill Street. He is concerned about the safety of students having to walk in the street in order to pass in front of the residence. He would like to see the issue addressed. Burgess Ciacciarella congratulated the high school football team on their win against Ansonia. He encouraged everyone to participate in the toy drives being held during this time of year. He received several calls from parents upset with the communication tower being installed at Maple Hill School. He was shocked at the Zoning Board of Appeals decision to overturn a liquor permit denial. He would like to see an education process for commissioners on Borough commissions so they know the rules and regulations. FOR THE RECORD: Burgess Ciacciarella has no opinion on the decision made. Burgess Neth attended the Long Term School Building/Facility Planning Committee meeting and felt it was very productive. Attorney N.W. Hess is the Chair and Charles Marenghi is the Vice Chair. He is very disturbed by the use of the welcome sign on Maple Street as a bulletin board. He feels it’s as offensive as if a person were to post a sign on the side of someone’s house. Deputy Mayor Rossi welcomed Burgess Mindy Fragoso back. She stated the welcome signs are not Borough property but were purchased by businesses and private citizens. She is disappointed the greyhound at the Veterans’ Pathway was defaced and stolen by someone in our own community. The Deputy Mayor thanked Chief Edson, Captain Scully and Police Department personnel for doing a wonderful job with the swearing-in ceremony. She congratulated new Deputy Chief Bernegger, Lieutenant Hunt, Sergeant Deely and Patrolman Baskins on their promotions. She congratulated the high school football team for a terrific year. Congratulations to Fran Dambowsky for receiving the Franklin Johnson Award. She is concerned with the lack of communication by the Board of Education to the students at the parochial schools. Burgess Burns welcomed back Burgess Fragoso. He reminded everyone to say a prayer tonight for those who perished at Pearl Harbor. Burgess Fragoso thanked well wishers for the phone calls, cards, gifts and prayers while she was recuperating. She wished everyone a very Merry Christmas and healthy New Year. She congratulated Fran Dambowsky for receiving the Frank Johnson Award. Burgess Scully said he is glad to see Burgess Fragoso back. He congratulated the football team and the coaches. He said it was an honor to attend Fran Dambowsky’s breakfast. He also congratulated him on his new position. Burgess Campbell is glad to see Burgess Fragoso back. He congratulated Fran Dambowsky on his new position in the Fire Department. Mayor Mezzo asked everyone to observe a moment of silence for the lives lost at Pearl Harbor. -3- Minutes – Board of Mayor and Burgesses Regular Meeting – December 7, 2010 8. Public Comment Residents spoke on the following issues: • Automatic budget referendums • Borough Engineer Wayne Zirolli said as a point of information, the tower at Maple Hill School is a communication tower not a cell tower. He said the Zoning Commission asked about the emissions and was told it is below guideline levels. 9. Mayor Mezzo reappointed Chester Cornacchia, 53 Graham Ridge Road, Naugatuck, CT 06770 as a regular member of the Economic Development Commission, term to expire December 7, 2015. 10. Mayor Mezzo reappointed Alipio DaSilva, 972 New Haven Road, Naugatuck, CT 06770 as a regular member of the Economic Development Commission, term to expire December 7, 2015. 11. Mayor Mezzo reappointed Mary Rimkus (D), 507 Cherry Street, Naugatuck, CT 06770 as a member of the Carriage House Account Committee, term to expire December 1, 2012. 12. Mayor Mezzo reappointed Caesar Ruggeri (U), 70 Florence Street, Naugatuck, CT 06770 as a member of the Carriage House Account Committee, term to expire December 1, 2012. 13. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the appointment of Brian Newman, 211 Spring Street, Naugatuck, CT 06770 as a member of the Human Resource Development Board, filling the expired term of R. Savoy, term to expire October 1, 2011. 14. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the road acceptance of Graham Ridge Road and Westover Drive as described in the warranty deed and release the subdivision road bond as recommended by Borough Engineer Wayne Zirolli and the Planning Commission. Motion withdrawn. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the road acceptance of Graham Ridge Road and Westover Drive as described in the warranty deed and release the subdivision road -4- Minutes – Board of Mayor and Burgesses Regular Meeting – December 7, 2010 bond as recommended by Borough Engineer Wayne Zirolli and the Planning Commission contingent upon payment of any outstanding taxes together with interest as determined by the Naugatuck Tax Collector. 15. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents for an easement on Hillside and Terrace Avenue in favor of AT&T as recommended by Borough Engineer Wayne Zirolli and the Planning Commission. 16. The Mayor said the following motion is an assistance proposal between the Borough and the DECD to provide $500,000 dollars of planning and design money for the parking structure. It is not a commitment for the funding. Essentially it defines the parameters of how an assistance agreement with money behind it goes forth. 17. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following resolution: WHEREAS, pursuant to Special Act 81-71, Sec. 2(d)(1) and Special Act 79-95, Sec. 2(d)(1) the Connecticut Department of Economic and Community Development is authorized to extend financial assistance for economic development projects; and WHEREAS, it is desirable and in the public interest that the Borough of Naugatuck make an application to the State for $500,000 in order to undertake the Renaissance Place Downtown Naugatuck – Phase I/Parking Garage Design and to execute an Assistance Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE Board of Mayor and Burgesses 1. That it is cognizant of the conditions and prerequisites for the state financial assistance imposed by Special Act 81-71, Sec. 2(d)(1) and Special Act 79-95, Sec. 2(d)(1) 2. That the filing of an application for State financial assistance by Borough of Naugatuck in an amount not to exceed $500,000 is hereby approved and that Mayor Robert A. Mezzo is directed to execute and file such application with the Connecticut Department of Economic and -5- Minutes – Board of Mayor and Burgesses Regular Meeting – December 7, 2010 Community Development, to provide such additional information, to execute such other documents as may be required, to execute an Assistance Agreement with the State of Connecticut for State financial assistance if such an agreement is offered, to execute any amendments, decisions, and revisions thereto, and to act as the authorized representative of the Borough of Naugatuck 3. That it adopts or has adopted as its policy to support the following nondiscrimination agreements and warranties provided in subsection (a)(1) of Connecticut General Statutes sections 4a-60 and 4a-60a, respectively, as amended by Public Acts 07-142 and 07-245, and for which purposes the “contractor” is Borough of Naugatuck and “contract” is said Assistance Agreement: The contractor agrees and warrants that in the performance of the contract such contractor will not discriminate or permit discrimination against any person or group of persons on the grounds of race, color, religious creed, age, marital status, national origin, ancestry, sex, mental retardation or physical disability, including, but not limited to, blindness, unless it is shown by such contractor that such disability prevents performance of the work involved, in any manner prohibited by the laws of the United States or of the state of Connecticut. The contractor further agrees to take affirmative action to insure that applicants with job-related qualifications are employed and that employees are treated when employed without regard to their race, color, religious creed, age, marital status, national origin, ancestry, sex, mental retardation, or physical disability, including, but not limited to, blindness, unless it is shown by such contractor that such disability prevents performance of the work involved. The contractor agrees and warrants that in the performance of the contract such contractor will not discriminate or permit discrimination against any person or group of persons on the grounds of sexual orientation, in any manner prohibited by the laws of the United States or of the state of Connecticut, and that employees are treated when employed without regard to their sexual orientation. Woodfield Motion carried 10-0-0 -6- Minutes – Board of Mayor and Burgesses Regular Meeting – December 7, 2010 18. Motion by Burgess that the Board of Mayor and Burgesses approve a Sanitary Sewer Easement with Chemtura Corporation on Elm Street subject to the Water Pollution Control Authority conditions and Land Use approval and conditions. Motion tabled. 19. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents for Jesse Camille’s Restaurant renovations with Munger Construction, per the CRCOG construction bid, as recommended by James Stewart, Public Works Director. 20. Motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents to amend the Jesse Camille’s Restaurant Lease Agreement which provides rent abatement for the period of time during the renovations and in addition the Borough will assume obligation to pay utilities incurred by the tenant during that period. Motion withdrawn and tabled. 24. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize the Mayor to enter into the following Memorandum of Understanding between the Borough of Naugatuck and the Greater Waterbury Transit District Board of Directors for a municipal grant program for seniors and disabled demand responsive transportation: The Greater Waterbury Transit District member municipality, Borough of Naugatuck, enters into an agreement with the Greater Waterbury Transit District Board of Directors to jointly apply for the Municipal Grant Program for Senior and Disabled Demand Responsive Transportation (CGS 13b-38bb) FY 2012 (starting July 1, 2011 and ending June 30, 2012) from the Connecticut Department of Transportation. This Matching Grant Program is not intended to replace funds previously spent by municipalities on transporting the elderly or persons with disabilities. This program is intended to expand a coordinated transportation system for the elderly and persons with disabilities. The maximum amount each municipality can receive is based on two parts: 1.) The 2000 U.S. Census count of people 60 years and older in the municipality relative to the state’s population of people 60 years or older is 50%, and -8- Minutes – Board of Mayor and Burgesses Regular Meeting – December 7, 2010 2.) The municipality’s square acreage relative to the state’s total square acreage is 50%. The municipality agrees to provide the Connecticut Department of Transportation with financial records of expenditures on transportation for the elderly and disabled and documentation of the level of ridership and hours of service, when requested to do so. The eight Greater Waterbury Transit District member municipalities will apply to the Municipal Grant Program for Senior and Disabled Demand Responsive Transportation (CGS 13b-38bb) as a group to provide coordinated transportation. These eight municipalities are Cheshire, Middlebury, Naugatuck, Prospect, Thomaston, Waterbury, Watertown and Wolcott. The Greater Waterbury Transit District will administer the grant, providing additional and coordinated transportation services to the elderly (60 years and older) and to persons with disabilities within the Greater Waterbury Transit District area. The grant will be used to cover administrative cost and operational cost relative to this program. The Greater Waterbury Transit District will coordinate with the municipal senior transportation service to perform this program. The Greater Waterbury Transit District will be responsible for required reporting information. The Greater Waterbury Transit District will be the recipient of the grant and will disburse the grant. The Greater Waterbury Transit District will be responsible for negotiating operational service or services. The Greater Waterbury Transit District administrative cost includes but is not limited to, office supplies and equipment, utilities, outreach, bookkeeper, auditor, travel, liability insurance, and meetings. The Charter Review Potential Issues Subcommittee met last month and held a public forum. All input by email, telephone and at the public forum was taken into consideration. The committee recommends forming a Charter Revision Commission to move forward to the next level. They would like to expedite the process so it can be on the ballot for the May election. The following items have been pinpointed to be addressed: 1. Term limits for the Mayor from two years to four years. 2. Term limits for Burgess from two years to four years. 3. Change the language under the Fire and Police Commissions to state that the hiring of employees should be directly through the Human Resources Department. 4. Change the language in the Finance Department section of the Charter which is Article 6, Act 159, Section 11, 3rd paragraph and have the language changed to Borough based businesses instead of the lowest bidder. 5. Change the elections from May to November. 26. Police Commissioner Chris Ford spoke to the Borough Board regarding the proposed Revised Alarm Ordinance. The specific changes made to the old ordinance deals with the appeal process. The Board requested a redline version to compare before voting to adopt the revised version. 27. Motion by Burgess that the Board of Mayor and Burgesses adopt the following resolution: WHEREAS, pursuant to Special Act 81-71, Sec. 2(d)(1) and Special Act 79-95, Sec. 2(d)(1) the Connecticut Department of Economic and Community Development is authorized to extend financial assistance for economic development projects; and WHEREAS, it is desirable and in the public interest that the Borough of Naugatuck make an application to the State for $500,000 in order to undertake the Renaissance Place Downtown Naugatuck – Phase I and to execute an Assistance Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE Board of Mayor and Burgesses 1. That it is cognizant of the conditions and prerequisites for the state financial assistance imposed by Special Act 81-71, Sec. 2(d)(1) and Special Act 79-95, Sec. 2(d)(1) 2. Motion by Burgess that the Board of Mayor and Burgesses authorize the Mayor to enter into the following Memorandum of Understanding between the Borough of Naugatuck and the Greater Waterbury Transit District -5- Agenda – Board of Mayor and Burgesses Regular Meeting – December 7, 2010 Board of Directors for a municipal grant program for seniors and disabled demand responsive transportation: The Greater Waterbury Transit District member municipality, Borough of Naugatuck, enters into an agreement with the Greater Waterbury Transit District Board of Directors to jointly apply for the Municipal Grant Program for Senior and Disabled Demand Responsive Transportation (CGS 13b-38bb) FY 2012 (starting July 1, 2011 and ending June 30, 2012) from the Connecticut Department of Transportation. This Matching Grant Program is not intended to replace funds previously spent by municipalities on transporting the elderly or persons with disabilities. This program is intended to expand a coordinated transportation system for the elderly and persons with disabilities. The maximum amount each municipality can receive is based on two parts: 1.) The 2000 U.S. Census count of people 60 years and older in the municipality relative to the state’s population of people 60 years or older is 50%, and 2.) The municipality’s square acreage relative to the state’s total square acreage is 50%. The municipality agrees to provide the Connecticut Department of Transportation with financial records of expenditures on transportation for the elderly and disabled and documentation of the level of ridership and hours of service, when requested to do so. The eight Greater Waterbury Transit District member municipalities will apply to the Municipal Grant Program for Senior and Disabled Demand Responsive Transportation (CGS 13b-38bb) as a group to provide coordinated transportation. These eight municipalities are Cheshire, Middlebury, Naugatuck, Prospect, Thomaston, Waterbury, Watertown and Wolcott. The Greater Waterbury Transit District will administer the grant, providing additional and coordinated transportation services to the elderly (60 years and older) and to persons with disabilities within the Greater Waterbury Transit District area.
