REVISED MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES MARCH 5, 2013 1. Mayor Robert A. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the minutes of the regular meeting of February 5, 2013 and the special meeting of February 25, 2013. Each member received copies for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the monthly reports of February. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns to recess to Executive Session at 6:31 p.m. for discussion on the following: Collective Bargaining (Police Bargaining Unit and Public Works Bargaining Unit), Strategy and Negotiations (EMS Services Contract). No one outside of the board was invited in. Mayor Mezzo reconvened the meeting at 7:00 p.m. 6. There were no motions emanating from Executive Session. 7. Public Comment A resident was upset about the dumping of snow in the river after the blizzard. He thinks there should be a Conservation Commission who could overlook such occurrences.  -2- Minutes – Board of Mayor and Burgesses Regular Meeting – March 5, 2013 8. Burgess Comments – Open Topic Burgess Jackson thanked the Public Works Department for their work during the blizzard and the Mayor for his updates. Deputy Mayor Rossi congratulated the Exchange Club’s 2013 Community Champions: Citizen of the Year Dolly Lengyel, Educator of the Year MaryEllen Marques (posthumously), Firefighter of the Year John DeBisschop and Officer of the Year Andre Moutela. She encouraged the public to give their input to the strategic planning consultant BlumShapiro. The Deputy Mayor thanked the Public Works Department, Fire Department and Police Department for their dedication and hard work during and after the blizzard. Burgess Bronko followed up with the Mayor regarding the furnace which is not working at the Naugatuck Youth Services’ building. Burgess Ernsky said the Historical Society did a great job with their Savor Connecticut Event. Burgess San Angelo complimented Senior Center Director Harvey Frydman for the tremendous work he does there. The building needs some minor work and he wondered if perhaps we can improve its condition before it gets really bad. 9. Mayor Mezzo reappointed Robert Schmidt, 68 Radnor Avenue, Naugatuck, CT 06770 as a member of the Building Code Board of Appeals, term to expire March 1, 2018. 10. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the reappointment of Ruth Yachtis, 385 May Street, Naugatuck, CT 06770 as a member of the Naugatuck Valley Health District, term to expire March 1, 2016. 11. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the appointment of Linda Ramos (R), 17 Carriage Drive, Naugatuck, CT 06770 as a member of the Parks Commission, filling the unexpired term of P. Wagner, term to expire June 1, 2015. Mayor Mezzo swore in Linda Ramos as a commissioner on the Parks Commission. 12. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Jackson that the Board of Mayor and Burgesses adopt the Emergency Contingency Model Plan for Elections as recommended by Republican Registrar Janice Dambowsky and Democratic Registrar Louise Sheedy. 13. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the bid and authorize Mayor Mezzo to execute all contracts and related documents for the “Refuse and Recycling Containers for Manual Collection” to Recycle Away, LLC, 45 Flat Street, Brattleboro, VT 05301 as per bid as recommended by Sheila Baummer, Recycling and Solid Waste Coordinator. 15. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the bid for the “Sale of a 1992 Ford F-350 Dually Truck” to Mark Ziello, 58 Hewlett Street, Waterbury, CT 06710 in the amount of $659.00 as recommended by Public Works Director James Stewart. 16. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the bid for the “Sale of a Flink S.S. Sander” to Mark Ziello, 58 Hewlett Street, Waterbury, CT 06710 in the amount of $59.00 as recommended by Public Works Director James Stewart. 17. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the bid and authorize Building Committee Chairman Robert Neth to execute all contracts and related documents for the “Bid Package #1.02 – Sitework for the Naugatuck High School Renovate to New Project” to Mather Corporation in the amount of $9,226,049 as recommended by the Naugatuck High School Building Committee. 29. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Jackson that the Board of Mayor and Burgesses approve the bid and authorize Building Committee Chairman Robert Neth to execute all contracts and related documents for the “Bid Package #1.03 – Concrete for the Naugatuck High School Renovate to New Project” to Waterbury Masonry & Foundation in the amount of $965,592 as recommended by the Naugatuck High School Building Committee. 30. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the bid and authorize Building Committee Chairman Robert Neth to execute all contracts and related documents for the “Bid Package #1.04 – Masonry for the Naugatuck High School Renovate to New Project” to Joe Capasso Mason Enterprises in the amount of $4,003,800 as recommended by the Naugatuck High School Building Committee. 31. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the bid and authorize Building Committee Chairman Robert Neth to execute all contracts and related documents for the “Bid Package #1.09 – Drywall and Plaster for the Naugatuck High School Renovate to New Project” to Connecticut Acoustics, Inc. in the amount of $2,806,954 as recommended by the Naugatuck High School Building Committee. 35. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the bid and authorize Building Committee Chairman Robert Neth to execute all contracts and related documents for the “Bid Package #1.15 – Plumbing for the Naugatuck High School Renovate to New Project” to Eastern Energy Services in the amount of $3,169,483 as recommended by the Naugatuck High School Building Committee. 36. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the bid and authorize Building Committee Chairman Robert Neth to execute all contracts and related documents for the “Bid Package #1.16 – Fire Protection for the Naugatuck High School Renovate to New Project” to HHS Mechanical Contractors, Inc. in the amount of $1,260,000 as recommended by the Naugatuck High School Building Committee. 37. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the bid and authorize Building Committee Chairman Robert Neth to execute all contracts and related documents for the “Bid Package #1.18 – Electrical for the Naugatuck High School Renovate to New Project” to All-Brite Electric in the amount of $7,296,864 as recommended by the Naugatuck High School Building Committee. 39. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the bid and authorize Building Committee Chairman Robert Neth to execute all contracts and related documents for the “Bid Package #1.19 – Elevator for the Naugatuck High School Renovate to New Project” to Otis Elevator Company (Northern) in the amount of $285,000 as recommended by the Naugatuck High School Building Committee. 40. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses add to the agenda a motion regarding the Recreational Trails Program Application for the Design of the Phase II Greenway Project. 41. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Jackson that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents for the Recreational Trails Program Application for the Design of the Phase II Greenway Project as recommended by Public Works Director James Stewart. 42. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following Fair Housing Resolution, as if read: WHEREAS, all persons are afforded a right to full and equal housing opportunities in the neighborhood of their choice; and WHEREAS, federal fair housing laws require that all individuals, regardless of race, color, religion, sex, handicap, familial status or national origin, be given equal access to all housing-related opportunities, including rental and homeownership opportunities, and be allowed to make free choices regarding housing location; and  -8- Minutes – Board of Mayor and Burgesses – Regular Meeting – March 5, 2013 WHEREAS, Connecticut fair housing laws require that all individuals, regardless of race, creed, color, national origin, ancestry, sex, marital status, age, lawful source of income, familial status, learning disability, physical or mental disability, sexual orientation, or gender identity or expression be given equal access to all housing-related opportunities, including rental and home ownership opportunities, and be allowed to make free choices regarding housing location; and WHEREAS, the Borough of Naugatuck is committed to upholding these laws, and realizes that these laws must be supplemented by an Affirmative Statement publicly endorsing the right of all people to full and equal housing opportunities in the neighborhood of their choice; and NOW THEREFORE, BE IT RESOLVED, that the Borough of Naugatuck hereby endorses a Fair Housing Policy to ensure equal opportunity for all persons to rent, purchase, obtain financing and enjoy all other housing-related services of their choice on a non-discriminatory basis as provided by state and federal law; and BE IT FURTHER RESOLVED, that the chief executive officer of the Borough of Naugatuck or his designated representative is responsible for responding to and assisting any person who alleges to be the victim of an illegal discriminatory housing practice in the Borough of Naugatuck and for advising such person of the right to file a complaint with the State of Connecticut Commission on Human Rights and Opportunities (CHRO) or the U.S. Department of Housing and Urban Development (HUD) or to seek assistance from the CT Fair Housing Center, legal services, or other fair housing organizations to protect his or her right to equal housing opportunities. Motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses adopt the following Fair Housing Policy Statement, as if read: It is the policy of the Borough of Naugatuck to promote fair housing opportunities and to encourage racial and economic integration in all its programs and housing development activities. Programs funded and administered by the Borough of Naugatuck must comply with the provisions of Section 46a-64c of the C.G.S., and with related state and federal laws and regulations that prohibit discriminatory housing practices.  -9- Minutes – Board of Mayor and Burgesses – Regular Meeting – March 5, 2013 The Borough of Naugatuck or any sub-recipient of the Borough of Naugatuck will carry out an affirmative marketing program to attract prospective buyers or tenants of all majority or minority groups, without consideration of race, color, religion, sex, national origin, ancestry, creed, sexual orientation, gender identity or expression, marital status, lawful source of income, disability, age or because the individual has children in all programs and housing development activities funded or administered by the Borough of Naugatuck. The municipality’s Office of the Mayoral Aide is responsible for the enforcement and implementation of this policy. Complaints pertaining to discrimination in any program funded or administered by the Borough of Naugatuck may be filed with the Mayoral Aide. The municipality’s Grievance Procedure will be utilized in these cases. Complaints also may be filed with the Commission on Human Rights and Opportunity, Special Enforcement Unit, 21 Grand Street, Hartford, CT 06106, Telephone (860) 541- 3403. A copy of this policy statement will be given annually to all Borough of Naugatuck employees and they are expected to fully comply with it. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following Title VI Equal Opportunity Statement, as if read: The Borough of Naugatuck does not discriminate in the provision of services, the administration of its programs, or contractual agreements. The Borough of Naugatuck seeks to fully carry out its responsibilities under the Title VI Regulations. Title VI of the Civil Rights Act of 1964 prohibits discrimination on the grounds of race, color or national origin in programs and activities receiving federal financial assistance. Motion by Deputy Mayor Rossi and seconded by Burgess Jackson that the Board of Mayor and Burgesses adopt the following Affirmative Action Policy Statement, as if read: As Mayor of the Borough of Naugatuck, CT I recognize the need for Affirmative Action and I pledge my commitment to undertake positive actions to overcome the present effects of past practices or barriers to equal employment opportunity and to achieve the full and fair participation of minorities, women, people with disabilities, older persons, and all other protected groups found to be underutilized in the Borough of Naugatuck's work force or affected by policies having an adverse impact. In the spirit of Executive Order 11, signed by Governor Ella Grasso November 21, 1975, and Executive Order 9, signed by Governor William A. O’Neill on January 3, 1984, I further state that this Borough of Naugatuck will comply with the anti-discrimination provisions of the state and federal laws and regulations listed at the end of this section. I recognize the hiring difficulties experienced by minorities, people with disabilities and by many older persons and, where appropriate, I have set goals to overcome the present effects of past discrimination, if any, to achieve the full and fair utilization of such persons in the work force. Burgess Comments/Sub-Committee Reports Burgess Neth announced there will be a ground breaking ceremony for the Naugatuck High School Renovate to New Project on April 2nd. Deputy Mayor Rossi reported the Senior Center remains busy. She relayed that the director reported there are many issues of conflict that seniors have to deal with such as mental health issues, alcoholism, drug abuse, domestic violence, dementia, schizophrenia and suicidal tendencies. Director Frydman has acquired a $30,000 grant with a team for the Western Connecticut Area Agency on Aging to assist seniors with those issues. The Fire Department responded to 106 incidents in January. The EMS Advisory Committee is trying to coordinate a tour of the Naugatuck Ambulance building. Mayor Mezzo stated strategic planning consultant Blum Shapiro will hold public forums on March 21st and March 26th at 6:30 p.m. There will be a presentation on the phasing process of the high school building project this Thursday. Burgess Burns thanked Mayor Mezzo for the CodeRED phone calls during the blizzard. Burgess Scully thanked everyone involved for their hard work during the storm. Burgess Jackson said the Parks Commission will meet to discuss field space. The Naugatuck Education Foundation will be holding a 5K Race. 51.
