MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES OCTOBER 4, 2016 1. Mayor “Pete” Hess called the regular meeting to order at 6:00 p.m. with the following in attendance: BURGESSES: PRESS: R. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the minutes of the regular meeting of September 6, 2016 with a revision and the special meetings of November 23, 2015 and February 24, 2016. Each member received copies for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the monthly reports of September. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully to recess to Executive Session at 6:02 p.m. for discussion on the following: Personnel (Staff Accountant), Real Estate Negotiations (Industrial Park/Land Acquisition, Naugatuck Armory, Property on Rubber Avenue, Property on North Main Street, Property on Springdale Avenue) and Pending Litigation inviting in Controller R. Butler, Tax Collector J. Goggin and Assessor C. Tyler. Mayor Hess reconvened the meeting at 7:06 p.m. 6. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to execute all contracts and related documents for the proposed  -2- Minutes – Board of Mayor and Burgesses Regular Meeting – October 4, 2016 sale of .38 acres parcel on Rubber Avenue and Brookside Avenue in the amount of $25,000 as is or $50,000 if the town fills the property, provided the purchaser obtains approval by the Planning Commission, Zoning Commission and Inland Wetlands Commission, based on a favorable report from the Planning Commission pursuant to Section 8-24 of the General Statutes in a form approved by borough counsel. 7. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses refer the proposed acquisition of property owned by Republic Realty LLC located on School Street Extension, Naugatuck, CT 06770 for payment in lieu of back taxes and add the parcel to the borough owned property abutting the parcel to the Planning Commission for a report pursuant to Section 8-24 of the General Statutes as recommended by Borough Engineer Wayne Zirolli and Tax Collector James Goggin. 8. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses refer the proposed acquisition of property owned by Republic Realty LLC located on Springdale Avenue, Naugatuck, CT 06770 for payment in lieu of back taxes to the Planning Commission for a report pursuant to Section 8-24 of the General Statutes as recommended by Tax Collector James Goggin. 9. The following motions emanated from Executive Session. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses accept the deed in lieu of back taxes for property at 176 North Main Street, Naugatuck, Parcel 07- 0910. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses accept the conveyance of real property in lieu of back taxes Parcel 001-8800 School Street Extension and Parcel 054-5001 Springdale Avenue from Republic Realty LLC. 10. Public Comment A resident asked if the board is adopting a Feral and Domestic Cat Ordinance to alleviate the problem in her neighborhood. 11. Mayor Hess reappointed Robert E. Lauer (D), 51 Tanglewood Lane, Naugatuck, CT 06770 as a regular member of the Code of Ethics Commission, term to expire October 1, 2018.  -3- Minutes – Board of Mayor and Burgesses Regular Meeting – October 4, 2016 12. Mayor Hess reappointed Theresa Swanson, 36 Fuller Street, Naugatuck, CT 06770 as a member of the Housing Authority, term to expire October 1, 2021. 13. VOTED: Unanimously on a motion by Burgess Vitale and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the reappointment of Steven Rosenblatt, 1 Elaine Court, Prospect, CT 06712 as a member of the Human Resource Development Board, term to expire October 1, 2019. 14. VOTED: Unanimously on a motion by Burgess Vitale and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Jeffrey S. Litke (R), 73 Bird Road, Naugatuck, CT 06770 as an alternate member of the Inland Wetlands Commission, filling the unexpired term of A. Olbrys, term to expire January 1, 2017. Mayor Hess swore in Jeffrey Litke as an alternate member of the Inland Wetlands Commission. 15. VOTED: Unanimously on a motion by Burgess Vitale and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the bids and authorize the mayor to execute all contracts and related documents for “Snow and Ice Control – Sand” to H.I. Stone & Son, Inc., 313 Main Street North, Southbury, CT 06488 in the amount of $11.20 per ton as recommended by Public Works Director James Stewart. 16. VOTED: Unanimously on a motion by Burgess Vitale and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the bid for the “Sale of a 2000 Volvo Recycle Truck” to Glenn Spector, 59 Rubber Avenue, Naugatuck, CT 06770 in the amount of $3,300.00 as recommended by Sandy Ribeiro, Assistant to the Public Works Director/Recycling Coordinator. 17. VOTED: Unanimously on a motion by Burgess Donovan and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize the Assistant to the Public Works Director Sandra Ribeiro to sell vehicles to the next highest bidder, agenda items #13 to #46. 53. VOTED: Unanimously on a motion by Burgess Vitale and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the bid and authorize Mayor Hess to execute all contracts and related documents for a “2016 Ford F-350 Pick-up with Plow” to Shaker Family Ford Lincoln, 831 Straits Turnpike, Watertown, CT 06795 in the amount of $33,845.00 as recommended by Public Works Director James Stewart. 54. Mayor Hess said the fall downtown festival was a success and several people told him how much they enjoyed it. He would like to hold more Downtown Festivals in the future. Approximately $11,500 was donated by various people to pay for the festival’s expenses. The portable stage and sound equipment was rented for $8,000. He said the borough can purchase our own portable stage, sound equipment and generator for $20,000. The stage could be used at locations other than downtown. He would like to appoint a subcommittee to look into purchasing these items. Motion made by Burgess Herb and seconded by Burgess Jackson to form a subcommittee and not to exceed $25,000 then refer to the Joint Boards for approval. Motion withdrawn. Mayor Hess appointed the following people to a subcommittee to look into the purchase of a portable stage and sound equipment for Future Downtown Festivals: Charley Marenghi Deputy Mayor Robert Neth Robert Hughes Burgess Dorothy Hoff 56. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses ratify the approval for a “Large General Firm Service – System Expansion Rate 30-SE on Main with Rider DG – Fuel Cell Facilities” with Yankee Gas Services Company DBA Eversource Energy signed by Mayor Hess on September 23, 2016. 57. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses disburse the sum of $47,557.17 to Naugatuck Youth Services, Inc. which sum represents a distribution from the Everett Rogers Trust for the exclusive benefit of Naugatuck Youth Services as recommended by Attorney Alicia Perillo.  -10- Minutes – Board of Mayor and Burgesses – Regular Meeting – October 4, 2016 58. Controller Robert W. Butler told the borough board that town departments, schools and the library have been through the General Data Comm building to pick through the abandoned property left by the previous owners. Saracco Mechanical Services and Lanco Manufacturing contacted the town to purchase items in the building. Controller Butler is looking for permission from the board to sell the abandoned property at the General DataComm Building. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Controller Robert W. Butler to sell abandoned property in the GDC building. 59. Controller Robert W. Butler reported checks have been returned to the borough for insufficient funds. The borough receives bank fees associated with the insufficient checks being returned. He would like to start imposing a processing fee for insufficient checks. VOTED: Unanimously on a motion by Burgess Hoff and seconded by Burgess Scully that the Board of Mayor and Burgesses adopt a policy authorizing the controller to set an insufficient check fee at $35 and take appropriate action to collect those funds. 60. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Controller Robert W. Public Comment – None 64. Burgess Comments/Sub-Committee Reports Burgess Herb reported the Planning Commission approved A Better Way Wholesale’s application. The commission would like to discuss making the sight line at all intersections two hundred feet. The Conservation Commission is hosting a biofuels speaker. Burgess Hoff said Gary Peterson came to the Arts Commission meeting. He wants to lease the Salem Theatre and bring live entertainment. Deputy Mayor Neth attended the Mayor’s Festival and it was awesome. Mayor Hess said he has had more people speak to him about the festival than any other subject. They want more festivals. Merchants made more money in one day than they have in years. The mayor said a major university, Touro University, is purchasing property on May Avenue and Maple Hill Road to build a private high school specializing in the medical field with student and faculty housing. The plan also includes residential housing. Mayor Hess said it is a revenue positive project. Burgess Burns said railings are needed at the golf course where they put new steps and sidewalks. Burgess Scully said the mayor’s festival was excellent. Burgess Jackson thought the festival was great. She hopes we can do one at Christmastime. The Senior Center event was excellent. There will be an Oktoberfest fundraiser for the library. Naugatuck Youth Services is holding a town-wide tag sale. Burgess Vitale reported Police Commissioner Andy Barnes has resigned after fourteen years of service on the Police Commission. He thanked him for his years of service. The cones on Water Street have been replaced with barrels. The Public Works Department is planning for Halloween. The Fire Marshal’s Office is spending more time at the Tuttle Building. The project is larger than anticipated. The Eversource light bulb exchange at  -13- Minutes – Board of Mayor and Burgesses Regular Meeting – October 4, 2016 the Senior Center will be held on October 15th. Burgess Vitale is hoping to complete the proposed Noise Ordinance at their next committee meeting. Deputy Mayor Neth said the Elderly Tax Committee is waiting for the proposal to review. It is in the hands of the borough attorney. 65.
