MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES APRIL 6, 2021 Due to the COVID-19 Pandemic, the Board of Mayor and Burgesses is practicing social distancing. The meeting was held on a hybrid basis by Zoom Webinar, a remote video conferencing platform, by phone and in person. 1. Bernabe, Phoenix Advisors, virtual Due to technical difficulties in the Gem Room at the Naugatuck Event Center, Mayor Hess recessed the meeting at 7:13 p.m. and reconvened the meeting at 8:00 p.m. in the Hall of Burgesses at the Naugatuck Town Hall as well as by Zoom Webinar and phone. Posted signage at the event center and on the town website alerted the public to the aforementioned. 2. Burgess Neth led in the Pledge of Allegiance to the flag. 3. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the minutes of the regular meeting of March 2, 2021 and the public hearing of March 2, 2021. Each member received copies for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the monthly reports of March. Each member received copies for review. 5. Mayor’s Opening Comments  Mayor Hess said tonight was the first attempt at holding a hybrid meeting. Notification was put on the website that the meeting was moved. Signs were posted at the event center.  -2- Minutes – Board of Mayor and Burgesses – Regular Meeting – April 6, 2021  The COVID-19 Vaccine Clinic at the armory is doing well. They are vaccinating two hundred people a day. Vaccines are also being administered at CVS. Griffin Hospital will open a new vaccine clinic in Mountview Plaza next week. Seniors can call the Senior Center to make an appointment. If anyone needs help making an appointment, contact Unified Command at unifiedcommand@naugatuck-ct.gov.  Mayor Hess will be changing the format of the meeting next month to place items of interest in the beginning.  Mayor Hess said there will be no discussion on the Hunt investigations. The investigations are still ongoing but should be completed soon. The board will not be going into executive session tonight. 6. Public Comment – None 7. Mayor N. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses add a motion to the agenda to appoint a member to the Board of Finance. 10. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the appointment of Meghan Smith (R), 41 Mulberry Street, Naugatuck, CT 06770 as an alternate member of the Board of Finance, filling the unexpired alternate term of S. James, term to expire June 1, 2022. 11. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the appointment of Christopher Sheedy (D), 50 Debbie Lane, Naugatuck, CT 06770 as an alternate member of the Golf Commission, filling the expired term of D. Sweet, term to expire June 1, 2023. 12. Mayor Hess led a presentation and discussion on the service contract with Veolia for the Operation of the Wastewater Treatment Plant/Incineration Facilities Lease with Veolia. He said the current contract and lease expires in October 2022 after twenty years.  -3- Minutes – Board of Mayor and Burgesses – Regular Meeting – April 6, 2021 The new contract and lease will also be for twenty years. Improvements need to be designed and constructed by 2022. Naugatuck is one of the oldest towns in Connecticut to have a sewage treatment system. The borough wants to maintain the arrangement we have now where we have no sewer tax. Naugatuck is one of two towns in the state that does not have a sewer usage fee. We pay Veolia to operate our Wastewater Treatment Plant and in turn, Veolia pays rent to the borough to operate the Incineration Facility. We own the land plus the entire operation and Veolia manages it for the borough. We lease the incinerator to Veolia to operate the incineration business that brings in guaranteed rent to the budget, $2,875,000 a year. This public/private partnership has income tax implications. Attorney Teno West, West Group Law PLLC, is working with the borough because it is a complicated situation. Attorney West said we are paying Veolia to take all the responsibility but the borough is still the owner. Unless there are uncontrolled circumstances or a change in the law, the fee we pay Veolia in the service contract will be the same for twenty years. The incinerator lease shifts the risk onto Veolia and not the borough. The company is responsible to pay up to fifteen million dollars for any required future improvements to the facility. Veolia partnered with Cinnapro for the disposing and processing of sludge throughout New England and New York. The profit sharing aspect has four tiers and a threshold of $9,150,000. 13. VOTED: Unanimously on the amended motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the bid and authorize Mayor Hess to execute all contracts and related documents for the “Random Crack Sealing Modified A/c Crack Seal with Fiber Compound Installed per Specification > 2,500 Pounds/Day” to the following vendors as recommended by Public Works Director James Stewart; as if read: Sealcoating, Inc. d/b/a Indus $1.53 per pound 825 Granite Street Braintree, MA 02184 Northeast Crack Filling, Inc. $1.53 per pound P.O. VOTED: Unanimously on the amended motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the bid and authorize Mayor Hess to execute all contracts and related documents for “Quick Set Slurry & Micro-Surfacing HiMa Micro- Surfacing (Type II)” to Sealcoating, Inc. d/b/a Indus, 825 Granite Street, Braintree, MA 02184 in the amount of $281.98 per ton as recommended by Public Works Director James Stewart. Contracts shall commence upon vendor completing all borough requirements and the purchase order is received by vendor. 17. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses amend the following motion for “(PASS CR) Polymer Asphalt Surface Sealer (Chip Seal) Complete In-Place Chip Seal Using 3/8" Trap Rock”. 18. VOTED: Unanimously on the amended motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the bid and authorize Mayor Hess to execute all contracts and related documents for “(PASS CR) Polymer Asphalt Surface Sealer (Chip Seal) Complete In-Place Chip Seal Using 3/8" Trap Rock” to Seymour Sealing Services, Inc., 147 North Plains Industrial Road, Wallingford, CT 06492 in the amount of $2.43/SY, Pricing Based on Southbury Bid Number 2020-010 March 25, 2020, minimum 1 full day or minimum of 25,000 SY as recommended by Public Works Director James Stewart. VOTED: Unanimously on the amended motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Hess to enter into a Waste Paint Management Agreement with PaintCare Connecticut LLC, 901 New York Avenue NW, Suite 300W, Washington, D.C. 20001 to participate in the Connecticut Architectural Paint Recovery Program for the collection of waste paint at the Naugatuck Transfer Station, Recycling Facility, and Landfill Drop-Off Site as recommended by Public Works Director James Stewart. Contracts shall commence upon vendor completing all borough requirements and the purchase order is received by vendor. 23. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses amend the following motion for the “Fireworks Display”. 24. VOTED: Unanimously on the amended motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses extend the contract for the “Fireworks Display” to Central Maine Pyrotechnics, 165 Maple Street, Farmingdale, ME 04344 in the amount of $15,000 for Friday July 2, 2021 with a rain date of Saturday July 3, 2021 as recommended by the Assistant to the Public Works Director Sandra Ribeiro. 25. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to execute a license agreement between the Borough of Naugatuck and Catholic Cemeteries Association of the Archdiocese of Hartford, Inc. for the borough’s continued use of Cotton Hollow Field for baseball games and related sporting events as recommended by Borough Attorney Edward Fitzpatrick. 26. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses expend the remaining balance of $27,300 on the Silver/Petrucelli and Associates contract approved by the Board of Mayor and Burgesses at the June 26, 2019 meeting to complete the architectural work associated with the Photovoltaic Solar Project at City Hill Middle School, construction contract awarded to WC McBride Electrical Contractors LLC at the March 2, 2021 meeting as recommended by the Naugatuck Standing Building Committee and the Naugatuck Board of Education.  -6- Minutes – Board of Mayor and Burgesses Regular Meeting – April 6, 2021 27. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the Post Issuance Continuing Disclosure Compliance Procedures in accordance with SEC Amendments to Rule 15c2-12 as recommended by Controller Allyson W. Bruce. 28. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Marenghi that the Board of Mayor and Burgesses refer to the Joint Boards of Mayor and Burgesses and Board of Finance the purchase of vehicles through the Fleet Fund for FY 2022 as recommended by Controller Allyson W. Bruce. 29. Burgess Rocky Vitale is proposing the adoption of a Tax Abatement Ordinance for Fire Police, CERT and Safety Patrol Volunteers. The ordinance states members of the emergency volunteer organization have to be a member for at least a year. They have to respond to fifty percent of calls in a year. They would receive a ten percent tax abatement up to $1,000. Burgess Marenghi asked if the abatement would be by individual or by household. Burgess Vitale said there would be only one tax abatement per household. Burgess Neth asked if Burgess Vitale looked into other municipalities and if they only do tax abatements for emergency volunteers or for commission/board volunteers as well. Burgess Vitale looked at three towns and the ordinance is only for emergency volunteers. Burgess Dambowsky stated the ordinance would be like paying the volunteers six dollars an hour. He said other towns pay their volunteers thirty to thirty-five dollars per call. Burgess Vitale said they could look into giving members who do not live in Naugatuck some type of reciprocal agreement in the town they reside in. Mayor Hess said the proposed ordinance would be discussed at the May meeting. 30. Public Comment – None 33. Burgess Comments/Sub-Committee Reports Burgess DeOliveira said he will be resigning as a burgess effective April 16th. He received an offer to attend the PHD Program at the University of South Carolina. He thanked everyone for the trust they put in him. Burgess Bronko asked the mayor if they could revisit revising the tax collector position at the next meeting. Burgess Herb thanked Burgess DeOliveira for his service. The Planning Commission sent a positive referral to the Zoning Commission for the proposed Dunkin Donuts. Burgess Vitale drove with Detective McGarvey around town to look at camera locations to fight against blight and litter. The police department will also be able to use the cameras for their purpose. He will make a recommendation to the Litter Committee. He told Burgess DeOliveira it was a pleasure sitting next to him at meetings. He wished him good luck. Burgess Marenghi congratulated Burgess DeOliveira for being accepted into the doctorate program. He thanked him for everything he’s done. There will be a Union City Little League opening ceremony on April 17th at 10 a.m. Burgess Dambowsky told Burgess DeOliveira it was a pleasure working with him. Burgess Neth wished Burgess DeOliveira good luck and it was a pleasure working with him over the years. Deputy Mayor Taf Jackson wished Burgess DeOliveira good luck. She said he will be missed on the board. Mayor Hess congratulated Burgess DeOliveira and wished him well. He said the board would need to meet after April 16th to vote on his replacement. The Republican Town Committee made a recommendation because the vacancy has to be filled by someone from the same party. 34.
