MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES SEPTEMBER 6, 2022 Due to the COVID-19 Pandemic, the Borough of Naugatuck held the Board of Mayor and Burgesses meeting on a hybrid basis. Everyone was welcomed to attend in person, by Zoom Webinar or by phone. 1. Mayor “Pete” Hess called the regular meeting to order at 7:00 p.m. with the following in attendance: BURGESSES: PRESS: R. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the minutes of the regular meeting of August 2, 2022. Each member received a copy for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the monthly reports of August. Each member received copies for review. 5. Mayor’s Opening Comments Mayor Hess said there will be two executive sessions tonight. The first will be relatively short to choose a preferred developer for Parcel A. The second will be lengthier at the end of the regular meeting. He accepted with regret Dan Sheridan’s resignation from the Board of Finance. He said Dan did more homework than anyone did and was a great asset to the borough. He will be missed. For the record: “I want the record to reflect my thanks and the borough’s thanks to him for what he did.” -2- Minutes – Board of Mayor and Burgesses – Regular Meeting – September 6, 2022 Mayor Hess intends on recommending Kenneth Hanks as chairman and James Higgins as vice chairman of the Board of Finance. He said Naugatuck has the best public water in the region. At the height of the drought, we were at ninety-six percent. 6. Public Comment – None 7. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko to recess to Executive Session at 7:07 p.m. for discussion on the following: Real Estate (Parcel A) inviting in NVRDC Director Thomas Hyde and Public Works Director James Stewart. Mayor Hess reconvened the meeting at 7:20 p.m. 8. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses select Corvus Capital Partners as the preferred developer for Parcel A pursuant to the Borough of Naugatuck Request for Proposals for Parcel A dated May 12, 2022. 9. Chief Kyle Kelley gave the monthly update on the Naugatuck Ambulance Corps (NAC). NAC was in trouble a year ago and it has been reversed. Trinity EMS Service provides service for the City of Waterbury and asked NAC for assistance. NAC is currently staffing one of their ambulances to help Waterbury cover their calls. 10. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the appointment of Adam M. Bronko (R), 34 Fairfield Court, Naugatuck, CT 06770 as a regular member of the Board of Assessment Appeals, filling the expired term of J. Anderson, term to expire February 1, 2025. 11. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses adopt the revised policies and fee schedule for trash removal and recycling in accordance with the schedule called Proposed Fees and Policies #2 as presented by Public Works Director James Stewart. 12. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Mayor Hess to execute a lease for one year to the Bank of America for the use of the drive through window at 275 Church Street as recommended by Borough Attorney Edward Fitzpatrick. 13. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the bid for contract FY23-B028 for “High Visibility Double Yellow Roadway Traffic Markings” to Atlantic Pavement Marking, Inc., 15 Industrial Road, Prospect, CT 06712 as per bid as recommended by Police Chief C. Colin McAllister. -3- Minutes – Board of Mayor and Burgesses Regular Meeting – September 6, 2022 Contracts shall commence upon vendor completing all borough requirements and the purchase order is received by vendor. 14. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses table agenda item #14. Motion by Burgess that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to sign a contract to provide “Gutter Replacement to Prevent Future Storm Damage and Washout – Naugatuck Police Department” with Brown Roofing Company, Inc., 12 Progress Avenue, Seymour, CT 06483 for Fiscal Year 2022/2023 as recommended by Police Chief C. Colin McAllister. Motion tabled. 15. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Mayor Hess to sign all contracts and related documents for a “Master Data Services Subscription Agreement and Equipment” for 60 Months effective upon contract execution with Rekor Recognition Services, Inc., 6721 Columbia Gateway Drive, Suite 400, Columbia, MD 21046 in the amount of $12,000 as recommended by Chief of Police C. Colin McAllister. Contracts shall commence upon vendor completing all borough requirements and the purchase order is received by vendor. 16. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Mayor Hess to sign a renewal contract and related documents for “Investigative Software Annual Subscription – CLEAR for Law Enforcement Plus” for 36 months effective December 1, 2022 with Thomson Reuters, P.O. Box 6292, Carol Stream, IL 60197 as recommended by Chief of Police C. Colin McAllister. Contracts shall commence upon vendor completing all borough requirements and the purchase order is received by vendor. 17. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to sign a contract to provide “Vehicle Rental for a Sedan, SUV, Pick-up, and/or Mini-van” as needed for a term of 12 months effective September 1, 2022 through August 31, 2023 at the rate of $635 per month to the Naugatuck Police Department with ACME Auto Leasing LLC, 440 Washington Avenue, North Haven, CT 06473 as recommended by Police Chief C. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the bid for contract FY23-B024 for “Medical Examinations, Evaluations and Testing” to Prospect CT Medical Foundation, Inc. d/b/a Alliance Medical Group, 1625 Straits Turnpike, Suite 211, Middlebury, CT, 06762 as per bid as recommended by Deputy Fire Chief Kenneth Hanks. Contracts shall commence upon vendor completing all borough requirements and the purchase order is received by vendor. 19. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the bid for contract FY23-B029 for the “Purchase of Lift Bags and Related Equipment” to Municipal Emergency Services, Inc., a/k/a Shipman’s MES, 12 Turnberry Lane, 2nd Floor, Sandy Hook, CT 06482 as per bid as recommended by Assistant Fire Chief Walter Seaman. Contracts shall commence upon vendor completing all borough requirements and the purchase order is received by vendor. 20. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the bid for contract FY23-B025 for the “Removal of an Underground Storage Tank – 607 Rubber Avenue” to Red Technologies LLC, 173 Pickering Street, Portland CT 06480 as recommended by Public Works Director James Stewart; as if read: Underground Storage Tank Removal and Disposal $13,100 Removal of Contaminated Soil $175 per ton Pumping and Transfer of Remaining Fuel Oil $3.25 per gallon (to borough facility to be determined) Contracts shall commence upon vendor completing all borough requirements and the purchase order is received by vendor. 21. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the bid for contract FY23-B027 for “Pest Control Services” to Total Pest Control LLC, P.O. Box 788, Southington, CT 06489 as per bid as recommended by Public Works Director James Stewart. Contracts shall commence upon vendor completing all borough requirements and the purchase order is received by vendor. -5- Minutes – Board of Mayor and Burgesses Regular Meeting – September 6, 2022 22. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Mayor Hess to sign a contract extension for FY 2023 for professional engineering consulting services to provide “On-Call Engineering Support Services for the Wastewater Treatment Facility and Wastewater Collection System” with Kleinfelder Northeast, Inc., 200 Corporate Place, Suite 310, Rocky Hill, CT 06067 at the rates as provided in the contract as recommended by Public Works Director James Stewart. 23. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the following vendors to continue to provide goods and/or services for Fiscal Year 2022/2023 and to authorize Mayor Hess to execute all contracts and related documents as recommended by Controller Allyson W. Bruce; as if read: APPROVED VENDORS:  Acushnet Company, P.O. Box 88112, Chicago, IL 60695  Adkins Printing, Inc., 40 South Street, New Britain, CT 06051  MHQ, 750 Newfield Street, Middletown, CT 06457 Contracts shall commence upon vendor completing all borough requirements and the purchase order is received by vendor. 24. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the use of funds from the Five Year Capital Account to fund the Removal and Replacement of Vinyl Asbestos Flooring Project at City Hill Middle School in the amount of $352,487 as recommended by the Five Year Capital Committee and Superintendent of Schools Christopher Montini. 25. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the use of funds from the Five Year Capital Account to fund the Removal and Replacement of Vinyl Asbestos Flooring Project at Andrew Avenue Elementary School in the amount of $394,227 as recommended by the Five Year Capital Committee and Superintendent of Schools Christopher Montini. 26. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the use of funds from the Five Year Capital Account to fund the Removal and Replacement of Vinyl Asbestos Flooring Project at Salem Elementary School in the amount of $54,506 as recommended by the Five Year Capital Committee and Superintendent of Schools Christopher Montini. -6- Minutes – Board of Mayor and Burgesses Regular Meeting – September 6, 2022 27. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to expand the scope of the “Revaluation of all Real Estate within the Borough of Naugatuck, Connecticut” (Revaluation Project) previously authorized to include the updating and standardization for the naming/numbering convention of tax parcel maps to conform with generally accepted assessing practices for ease of use for the public and web and paper-based maps, not to exceed $10,400, for the Naugatuck Assessor’s Office with New England GeoSystems, 420 East Main Street, Building 3, Suite 18, Branford, CT, 06405 for Fiscal Year 2022/2023 as recommended by Assessor Shelby Jackson. Contracts shall commence upon vendor completing all borough requirements and the purchase order is received by vendor. 28. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses waive the bid procedure for the following solar projects: Andrew Avenue School, Naugatuck Police Department, DPW Maintenance Garage, Naugatuck Day Care Facility and authorize Advanced Energy Efficiencies to design and construct the above projects in order to achieve the optimal electric rate. 29. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Mayor Hess to retain Woodward & Curran, Inc./Nicholas A. Hastings, LEP#149 to implement the Stewardship Permit as required under Permit No. DEEP/REM/SP/2022, Section 111.A. 30. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Mayor Hess to enter into a contract with Woodward & Curran, Inc. to perform Environmental Consulting Services on a time and materials basis in accordance with the rate schedule for the period of September 2022 to June 30, 2023. 31. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Mayor Hess to enter into an agreement with Woodward & Curran, Inc. on a time and materials basis not to exceed $90,000 for the period of September 2022 to June 30, 2023 to perform the following consulting services: 1. Site development planning 2. Soil management and implementation of development plan included in the site remediation agreement 3.
